JULY 1 6 , 1 9 8 4 A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. PRESENT Philip E. Zegarelli, Mayor James J. Tinmings William MsBride Robert King Susan Galgano Steven Salman Vincent Buonanno, Trustees Robert Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:10 P.M. with a prayer and a salute to the flag. Trustee Buonanno moved seconded by Trustee Galgano that the minutes of the meetings held on June 18th and June 27th, 1984 be accepted as read. Carried. tfeyor Zegarelli stated that he would like the meeting to proceed quickly in order that the Democratic Trustees could go home to watch the Democratic Convention. Mayor Zegarelli asked if there was anyone present who would like to address the Board. Mr. James Donovan, Chairman of the tfenager-Administrator Conmittee stated that all members of the Board had received a copy of the conmittee regarding the hiring of. an Administrator and he and members of his committee would be glad to answer questions in regard to same. Mayor Zegarelli accepted the report and directed that it be made part of the official record. (See official minutes.) After a discussion the Mayor agreed to meet with the "Committee" before the next Board meeting. Mr. Robert Carpenter, Pocantico Street, asked about the situation of the Aruj Gas Station at Broadway and Pocantico Street. Mr. Margotta, Building Inspector reported that he had sent Mr. Aruj a Notice of Violation allowing thirty days to clean up his property and that the thirty days were not up. Mr. Carpenter stated that he had been told this for the last year and asked how many times Notice of Violations were going to be sent. Mr. Carpenter asked what the Village was going to do about the fumes. teyor Zegarelli stated that the County and D.O. T. had to be notified. He stated that within the past year the Village had three Building Inspectors and now that Mr. Margotta has been appointed he would follow through. �r - 2 « REPORTS OF OCMflTTEES AEMINISTRATION Trustee Buonanno stated that at the last work session the Board had discussed increasing the payment to part-time workers. Trustee Buonanno reported that the Ambulance Garage painting had been completed by the contractor, Mr. Raguzin. Trustee Buonanno reported that his committee had been studying the matter o^ a more suitable office for the Recreation Department as their office was not air-conditioned. It was agreed by the ^ y o r and Board that the Recreation Office would use thefcfeyor'soffice for the summer months and that the Assessor and the Auditors would work in the Board Room. Trustee Buonanno moved, seconded by Trustee Timnings that the summer hours for the Village Offices be 9:00 A.M. to 4:00 P.M. for the months of July and August. Carried. Trustee Buonanno stated that approximately fifteen chairs in the various firehouses needed repair and moved that Mario Seminara be authorized to repair same, Seconded by Trustee Tinmings, motion carried. Trustee Buonanno reported that Shirley Canfield, now on Maternity Leave, has been assisting in the end of the year closeout and moved, seconded by Trustee Tinwings| that time spent would be credited back to her sick time. Carried. GOVERNMENTAL RELATIONS Trustee McBride stated that in the N.Y.S. Mmicipal Bulletin FERMA had a 375% increase in membership and a 700% increase in total annual premium. Mayor Zegarelli reported that a 25% dividend will be returned to the members of PERMA due to the low accident rate. Trustee Buonanno stated that a Safety Program will have to be instituted in the near future. MANAGEMENT & BUDGET Trustee Tinmings reported a Cash Balance in the General R m d as of July 16, 1984 of $250,165.47. Trustee Timmings reported that the Village Treasurer will be purchasing Certificatf of Deposit with an interest rate of 8%% to 9% within the next few days and moved, seconded by Trustee Buonanno that she be authorized to do so. Carried. Trustee Timmings stated that conmunication was received from the Arbitrator and that an Executive Session will be held on July 26th at 10 A.M. Mayor Zegarelli stated that the Village has not received any reports from the Negotiator-Fact Finder regarding the Teamster Contract. It was stated they would send a report to the Village by June 1st. He stated that when the reports do come in the Board would have to meet as a whole. �*?sS~g r• -3Trustee Timmings, Chairman of the Management and Budget Committee report on the estimated Revenues for the current fiscal year for the General Fund, Water Department, Revenue Sharing. He reported that he would be looking into the expenses of the Police Department for the past month and stated that the Recreation Department has submitted reports of income and estimated expenditures for the month. Trustee Timmings moved, seconded by Trustee Buonanno that $16,488. be transferred from Contingency to Police-Personal Services to the salary for Patrolman John DiCairano. Carried. Trustee Timmings reported that he had received a copy of the Police Department's secondary response to the Binding Arbitration Panel findings. Trustee Timmings moved, seconded by Trustee Buonanno that $400,00." • be transferred from Contingency to Parks-Temporary. Carried. PUBLIC SAFETY Trustee King reported that the Police Department had submitted Sick Time, Overtime, DWI Arrest Reports and Police Report for the month of June. (Copy in Official Minutes) Trustee King reported that the new Parking Enforcement Officer had issued a total of 416 summonses from June 19th to July 14th. He also reported that Doreen Pulsoni had resigned as Parking Enforcement Officer. Chief Spota had informed him that pursuant to Section 52-53 of the Village Code he had granted a Taxi Stand to Stefan's Taxi on the North side of Beekman Avenue adjacent to the visitor's parking lot of General Motors. Trustee King reported that while on a call to 282 North Washington Street, Patrolman DiCairano's pants were ripped when he was bitten by a dog and moved, seconded by Trustee Buonanno that the Village pay for the replacement of his pants. Carried. Mayor Zegarelli stated that the Treasurer notify the Court and that the owners of the dog reimburse the Village for the expense of replacing the pants. Trustee King reported that the Group #3 M.R.D. will meet in North Tarry town to review the M.R.D. Specifications with Mr. McAndrews of the D.C.J.S. on August 15th 1984 at 10:00 A.M. Trustee King reported that he had recieved a letter from Mr. & Mrs. Barney Cafarelli commending Patrolman Biro and his partner in assisting them when their car broke down on Route 9 near the Old Dutch Church and moved, seconded by Trustee Buonanno that the letter be placed in his jacket. Carried. Trustee King reported that he had met with Sgt. Booth regarding the towing and storage of cars by a private contractor. The matter was referred to Counsel Ponzini. Trustee King moved, seconded by Trustee Buonanno that Local Law #3 of 1984 be adopted. Mayor Zegarelli stated that the $1.00 discount would still apply if the fine was paid the same day as the ticket was received. >\l\\* ; i VI * V r* Trustee King reported that the cost of replacing part of the meter head would be approximately $12.00 and that the total cost of replacing all the meter heads would be approximately $1,000.00. He stated that he would be meeting with Duncan Meter Company to investigate the feasibi] of buying new meters. PUBLIC WORKS ;t ' 'J Trustee Salman gave the following report; The Highway Department planted new trees on Beekman Avenue, Hudson, Washington, Bellwood and Kelbourne Avenues. They have been resurfacing on Depeyster Street between Cedar and Cortlandt and the gutter on Fremont and Hemlock Drive. Replacing sidewalks on Elm, Kendall, Depeyster and Clinton Street. Repaired catch basin on Sleepy Hollow Road and sewer manhole in easement in General Motors parking lot. Hauled broken concret from sidewalk repairs to washout behind Barnhart Park to stabilize the steep slope leading into G.M. parking lot. He also reported that the I conversion of the greenhouse for the storage of salt and sand must be I undertaken immediately in order to be ready for the winter season. | Trustee Timmings moved, seconded by Mayor Zegarelli that the Board recess for five minutes and meet in Executive Session. Carried. Upon reconvening Trustee Timmings moved, seconded by Trustee Buonanno that the Treasurer be authorized to contact the Bonding Attome] for the necessary resolutions for the purpose of financing the reconstruction of the greenhouse for storage in the amount of $40,000.00 . Carried. mi I< 'I Mayor Zegarelli stated that the Village would be receiving approxims ly $80,000. from OASHA and if possible these funds would be used for the reconstruction of the greenhouse. Trustee Salman stated that the Water and Sewer Department personnel had replaced defective hydrant on Valley Street near Frank Chevrolet, have painted hydrants throughout the Village, using sewer jet on storm drains on Riverside Drive at Hunter Avenue and Harwood Avenue. Placed permanent blacktop on prior excavation on Kelbourne Avenue near Monroe Avenue. Received new 4-wheel drive % ton pickup truck for the pump station. Trustee Salman reported a cash balance in the Water Department as of July 13th, 1984 of $30,245.00. Trustee Salman reported that they were investigating the purchase of a new Sanitation Truck and would report at the next meeting. : !U 4J �^Sys r RECREATION Trustee Galgano stated that copies of the Annual Report of the Recreation Department were placed on all Trustees desks. Trustee Galgano gave the following report: ( copy attached) MAYOR'S REPORT Mayor Zegarelli reported that the Village had been granted under Title III-B a grant in the amount of $3,299.00 for personal services for the Senior Citizens Mini-Bus. Mayor Zegarelli stated that the Village telephone policy in regard to telephones in employees residence will be reimbursed only for that portion used for Village purposes and that the phone must be listed in the directory as a Village telephone, and that all toll calls will be reimbursed by the person making said calls. Mayor Zegarelli proposed that a local law establishing an Economic Advisory Council be adopted, and stated that before the next meeting the Board members provide name to be submitted for the twelve member council. Mayor Zegarelli moved, seconded by Trustee Buonanno that the Economic Advisory Council be established as part of the Advisory system of the Village of North Tarrytown. Carried Mayor Zegarelli reported that a bill had been introduced by the State Legislature which would provide low cost energy to various companies including General Motors in North Tarrytown. He stated that the Village has been asked to send a letter in support of this legislation. Trustee Timmings moved, seconded by Trustee Buonanno that the Mayor be authorized to send a letter to Albany stating that the Village of North Tarrytown supports that adoption of legislation providing low cost energy to different companies. Carried. Mayor Zegarelli reported he had received a letter from the state concerning recent legislation regarding organizations such as PERMA and authorizing a "pooling concept" which would reduce costs by 2%. Trustee Timmings moved, seconded by Trustee Buonanno that the Mayor be authorized to send a letter to the State Legislature in support of Bill S.8356-A. Carried. Mayor Zegarelli stated that he had contacted Duracell regarding the "oil spill" on Elm Street and he was in receipt of a check for $602.30 covering the expenses for the clean-up and a check in the amount of $1,000.00 as a contribution to the Village. Trustee Timmings moved, seconded by Trustee Buonanno that a letter be sent to Duracell thanking them for the donation. Carried. Mayor Zegarelli reported that he had sent a letter to the Environmental Conservation Department requesting that they inspect the Tucci tree on Pine Street. Mr. Tucci had complained that the tree was �r -. ' -6dying and would like it taken down, Mayor Zegarelli stated that he had received a telephone call from Mr. Tucci on Dell Street regarding the erosion and damage to his proper by the Pocantico River. Trustee Salman reported that he would like Gus Paese to look at the situation and advise the Board. Mayor Zegarelli reported that he had received a letter signed by many residents of Philipse Manor regarding the Bike Race and the manner in which it was handled. He stated in the future when a request of that nature was received by the Village that notice be sent to the P.M.I.A. notifying that permission was granted for such events. COMMUNICATIONS Communication from Rev. Anthony Fagnani, Administrator of the Immaculate Conception Church requesting permission to hold a bazaar on August 16, 17,18, 19,23,24, 25 and 26th, 1984, and to close Depeyster Street between Broadway and North Washington Street during the period requested. Trustee Timmings moved, seconded by Trustee Buonanno that permissioi be granted and that the Fire and Police Departments be notified. Carried. Mayor Zegarelli stated that the Police Department notify all residents of the street that permission was granted to the Church to have the bazaar. Communication was received from the Fire Council dated July 6, 1981 rejecting the North Tarrytown Realty Associates letter dated June 19thI 1984 relating to the compactor installation problems at 100 College ArmJ and recommended that no burning of garbage be allowed. Mayor Zegarelli stated that the company who had designed the disposal would like to meet with the various members of the Fire Council in order to comply with their wishes. Communication from Jose Alonso, 142 Depeyster Street requesting sidewalk repairs in front of his property was read upon motion duly made and seconded referred to the Public works Department. Carried. Communication from Joseph Kelly, 101 Rice Avenue requesting that the Village inspect a tree in front of his property was read and upon motion duly made and seconded referred to the Public Works Department. Carried. Communication from Fire Council regarding suspension of Robert Rose of Fire Patrol was read and upon motion duly made and seconded action of Fire Council was confirmed. Carried. Mayor Zegarelli stated that he was in receipt of a letter from Mr. John Keels, Jr. Director of the Community Opportunity Center of the Tarrytowns requesting release of $10,000. which the Village had budgeted in 1984-1985. Mayor Zegarelli stated that the budgeted $10,000 was in conjunction with the Village of Tarrytown and was to be used solely for insurance, heating, etc. After a discussion Trustee Timmings moved, seconded by Trustee Buonanno that the Mayor be authorized to repl �^*z -7~ to Mr.Keel's request informing him of the Board's decision. Carried. The Italian-American Ind. Club had requested permission to hold a dance on Saturday, June 30th in the Van Tassel Auditorium from 9 P.M. to 12 Midnight and the Clerk granted such permission. Trustee Timmings moved seconded by Trustee Galgano that action of the Clerk be confirmed. Carried. The Clerk was in receipt of Notice of Claim of George Boumis and Amalia Boumis against the Village of North Tarrytown as a result of a fall sustained to Mr. Boumis on April 18th, 1984 and the Clerk referred to the Insurance Carrier. Trustee Buonanno moved, seconded by Trustee Timmings that action of the Clerk be confirmed. Carried. UNFINISHED BUSINESS Trustee Timmings reported that the Fourth of July fireworks had been very successful and suggested that the Villages increase their donation to the fireworks and suggested that a reserve be set up early in the year whereas residents could donate and the celebration could be expanded. Mayor Zegarelli stated that a band should be planned for and included in the celebration next year. Trustee Timmings moved, seconded by Trustee Buonanno that the Budget Committee set up a Reserve Fund so that residents of the community could donate and funds could be applied to celebrations. Carried. •i Mayor Zegarelli reported that he had received copy of application for State funding for the fiscal year 1985-86 for the North Tarrytown Conservation Advisory Council. Trustee Timmings moved, seconded by Trustee Buonanno that the Mayor be authorized to sign same on behalf of the Village. Carried. Trustee Timmings reported that recent correspondence from NYCOM regarding several pieces of legislation pertaining to paid Firemen's Benefits and regarding the increasing of the amount of reimbursement up to $10.00 per case to villages for the handling of cases in local courts and moved, seconded by Trustee Buonanno that the Village increase the amount of $10.00 per case in our local court. U' Trustee Timmings reported that he had recieved correspondence from the attorney for the Teamsters regarding two grievances filed by employees and hearings will be held on October 10th at 10 A.M. and October 16th at 10 A.M. in White Plains. Trustee Salman reported that he had conferred with the Westchester County Department of Transportation regarding Bus Shelters and they were in the process of re-negotiating with the contractors installing them. ' *': Trustee Timmings reported that in neogotiating the contracts that Counsel contact the Teamsters Attorney regarding the scheduling of holidays for the fiscal year 1984-85. U .—•3l?ti �*7 r -8NEW BUSINESS After a discussion Trustee Salman moved, seconded by Trustee Buonanno that the Village advertise for sealed bids for the demolition work at the River Street sludge drying beds known as "Greenhouse" until 2 P.M. on Monday July 30th, 1984. Carried. Mayor Zegarelli reported that the next work session of the Board is tentatively scheduled for July 25, 1984. Mayor Zegarelli reported that the members of the Board were in receipt of a memorandum from the Village Attorney regarding Gleason vs. Jandrucko etal and normally it would not be public record but due to the circumstances he moved, seconded by Trustee Salman they be made part of the official minutes of the Village. Carried. (See Official Minutes) Trustee King moved, seconded by Trustee Galgano that the bills submitted on the General Fund and Water & Sewer Warrants dated July 16t 1984 be paid after approval of department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attach ed to the warrants. Carried. There being no further business to come before the meeting, Trustee Galgano, moved, seconded Trustee Salman that the same be duly adjourned. Carried. Day Camp and Tot Camp is underv/ay with some 226 children enrolled. The children are enjoying arts and crafts, sports, swimming, games, and much more under the direction of Nick Nardullo. 3. We are still taking registrations for our Computer, Science, and Sports Camp, interested should contact the Recreation Department. Anyone ill 4. Tennis Lessons have begun at the Andrews Lane Tennis Courts under the direction of Janet Leftkowitz. Registration is now underway for Session II which will begin July 30th. Anyone interested should contact the Recreation Department. There are 12 mothers and their 1-6 month old infants enrolled and enjoying our MotherChild Playgroup held at the Warner Library. The program runs through Aug.8th. Anyone interested in signing up should contact the Recreation Department. ,v On Monday, July 9, 150-200 residents of the Tarrytowns enjoyed the sounds of "Southern Ccokin"' (a country-western band) and Slim Sterling calling.a square dance at Patriots Park. Festivities started at 6:30 and ended at 9:45 PM. I 7. On a storm threatening evening, Wed. July 11, 31 musicians of the Local 398 played the Bap Band sound to 75 residents of North Tarrytown. The concert was cut a J hr short when the rains finally did come. This weeks concert is on Wednesday, July 18 at 7PM at the Morse School Blacktop and will feature a Dixieland Band. J\ Softball and Baseball leagues are in full swing. The Lumber Company is in first place at this time in the Mens Softball League. The Skylarks are in front in the General Motors League. The Jr. and Sr. Babe Ruth Baseball Teams are just getting under way because of rain outs. The Girls Basketball Team of the Tarrytowns are 1 & 1 and Girls Teen Softball will have its first game this Tuesday vs. Woodlands. 9. Weight lifting, wrestling and Flag Football have some 40 youths of the Tarrytowns signed up and started June 25 and will run through Aug. 17th. 10. There was vandalism at the Memorial Field Utility Building a»few weeks ago. A $40.00 microphone was stolen and one of the doors was damaged causing an estimated total of $24C worth of damage. i. w> iw 11. Two new counselors have been hired for the Day Camp at $65 per week for six weeks, Their names are Terance Hales and Barbara Coldrich. '*', 12. The complex nature of our changing times requires the appointment of a full-time Village Administrator. a) U: Such a person would be more responsive to the present and future needs of the Village. b) Increasing rate of societal, political, and governmental changes requires/demands that a person be knowledgeable in budget, tax matters as well as business analysis and forecasting. 2.
