August 13, 1984 A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present Philip E. Zegarelli, Mayor James J. Timmings Vincent Buonanno William McBride Robert King Susan Galgano Steven Salman, Trustees Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Buonanno moved, seconded by Trustee King that the minutes of the meeting held on July 16th be approved with the following corrections: Page 3 - amount should be $400 and not $400,000. and page Trustee Salman voted "Aye" and not "Nay" for L.L. #3. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so. Mrs. K. Lingardo, 27 Pine Close, inquired if there is any truth in the rumors that an entrance into Rockwood Park will be made through Gory Brook Road. Mayor Zegarelli stated that there is absolutely no truth to the rumors pertaining to the use of Gory Brook Road as an entrance site for the park now or in the future that in fact, the Village has held a section of Gory Brook Road under its control to prevent any use by the State, of Gory Brook Road as an entrance into the park. The State has assured us in writing that they do not intend to use Gory Brook Road as any entrance for public use of the park, said the Mayor. �r -2Mrs. Lingardo stated that at the intersection of Pine Street and Fine Close, water comes up from the road and during cold weather freez causing a hazardous condition. Mrs. Lingardo suggested that three trees be removed on Pine Stre one of which is Mr. Tucci's. She stated that the tree is in bad condition and is causing water problems to the house next door. In answer to the Mayor's query, John Biros stated that the Villag had put down gravel and stone. Mr. Tucci stated that the tree was trimmed, however, the tree now leans on the other side over his house. Mayor Zegarelli stated that a letter was received dated July 13, 1984 from Mr. Herberger of the Environmental Office in which he states that the tree is good and healthy, but in need of trimming. Mayor Zegarelli stated that he will refer the matter to Public Works Committee and John Biros to call in the Coffin Tree Company. Mr. David Aruj, owner of the Exxon Service Station on North Broadway, addressed the Board that he is tired of being harrassed by Robert Carpenter, a tenant in the adjacent building. Mr. Aruj refuted the comments of Mr. Carpenter in his complaint forms, after which Mayor Zegarelli noted his remarks for the record. Mayor Zegarelli stated that the matter will be deferred to normal procedure instituted by the Village. I Mr. Felix Pascarel, 212 Beekman Avenue, complained about the taxi stand on Beekman Avenue. He stated that residents of the street do xioi have a place to park. The parking stand is being abused by employees of the taxi owner. Mayor Zegarelli stated that the Board discussed the matter at a work session. According to the local ordinances, the Chief of Policf has the sole authority to designate taxi stands. The Board, however, informed the Chief that they did not agree with his designation. Trustee King stated that he discussed the matter with Mr. Serina if he would like to have the stand and was told that he would not. Signs will be removed in the morning, said Trustee King. Mr. Achilles Ligeros, Irving Place, stated that he has been tryiflj for about six months to get two parking spaces into his property. Basi on his personal feelings and documents, he stated that he would be abli to have the spaces. He stated that his rights are being violated. Mr. James Margotta, Building Inspector, explained that there is n enough distance between the sidewalk and his house for a driveway, he were to park the cars, they would overhang on the sidewalk. �{ 3 ^r *M 'v ,u Following a discussion, Mayor Zegarelli informed Mr. Ligeros that he could appeal the decision of the Building Inspector to the Zoning Board of Appeals. ° i. Mrs. Anna DeLuca, 10 Millard Avenue, stated that she wrote a letter to the Board regarding a tree and requested that it be inspected to determine if it was on the Village line. She stated that another tree on her property is decayed and on advice of a tree company is requesting permission to have it removed. Mr. J. C. Perri, 143 Hunter Avenue, stated that he submitted two petitions to the Board to abandon any easements which the Village may have on property at 143 Hunter Avenue and to accept the ten ft. drainage easement and also to abandon any easements which the Village may have on property at 141 Hunter Avenue and to accept a ten ft. sanitary sewer easement. ti m The matter was referred to the Village Attorney for approval. Trustee Buonanno moved to recess for five minutes, seconded by Trustee King. Carried. Mayor Zegarelli stated that the normal course of business will be suspended to enable Trustee King to make a statement. Trustee King made a statement that he will be resigning in September as Trustee to take a position in Washington D. C. He stated that during his five months as Trustee, he found the experience very rewarding and thanked the staff and residents for their cooperation and confidence. Mayor Zegarelli thanked Trustee King on behalf of the Board for his services and hoped that the short time he had been on the Board will have helped him in his position. The Federal government's gain will be our loss, said the Mayor. REPORTS OF COMMITTEES ADMINISTRATION ;•> l •• > Si) . Trustee Buonanno stated that at the last meeting, a proposal was received from Sal Zambellitti which was reviewed and approved by the house committee. A letter of approval was sent to Mr. Zambellitti, he said. Trustee Buonanno stated that the air condition was broken in the building and he, together with the Mayor, approved the cost of repairing it. Trustee King moved, seconded by Trustee Timmings that action of the Mayor and Trustee Buonanno be confirmed. Carried. Trustee Buonanno moved, seconded by Trustee Timmings that the Clerk and Treasurer be granted permission to attend the Annual Training School for Clerks and Treasurers at Grossinger's on September 12th. Carried. Trustee Buonanno stated that the committee discussed rate increases for part-time employees and arrived at a proposal which would include l: �r -4seniority and commitment to the Village. Trustee Buonanno moved the following pay scale for part-time employees, effective September 1, 1984, seconded by Trustee Timmings: Newly hired One year Three years Six years 10 yrs & above - $4.25 per hour ii 4.50 it it II 4.75 it M 5.00 ii II 5.50 The above includes sanitaticmlaborers,^schoolcrpssing guards^ parking enforcement off icer n^T^c^eaXion, clerical'/^^faborers r-A~^ v Mayor Zegarelli stated that this is not to become a procedure, but rather a policy. Trustee McBride stated that part-timers should get an increase, but he did not think the scale is consistent. He stated that although he would vote for the increases, he was not in favor. Increases shouli be based on the type of work performed, he said. Trustee Buonanno stated that this proposal will essentially give every part-time employee some sort of raise. Trustee Timmings stated that some people have demonstrated a high level of skill. He wouldn't want to hire low-skilled people as school crossing guards. Motion carried. GOVERNMENTAL RELATIONS Trustee McBride stated that he would like to attend a meeting on September 6th in White Plains which is being arranged by Congressma Ottinger regarding the proposed shipments of radio active materials which will go through Westchester County. The meeting will be held, together with Westchester elected officials and the Brookhaven Nationa Lab of Long Island. Mayor Zegarelli authorized Trustee McBride to attend the meeting on behalf of the Village. MANAGEMENT & BUDGET Trustee Timmings stated that the committee met with ADP with regard to computering Village records. A meeting will be scheduled with several computer firms. Trustee Timmings reported a balance of $46,822.60 in the General Fund as of August 13, 1984. Trustee Arbitrator's calculations spelling out Timmings stated that he received a copy of the State report. He stated that he found a minor error in the that existed. He stated that he had a letter typed his objection to the proposed agreement which was acknow �r -5by the State arbitrator. Neither side has any objection to the award as suggested and it will be approved by the three member arbitration panel. The chairman of the panel will release the information to all concerned and will also review the final type-written document and moved that the Mayor be authorized to sign said document providing that there are no typos existing in translation of the police contract since the document as soon as the document is typed and proof-read, seconded by Trustee King. Carried. Trustee Timmings noted the passing of Salvatore DeSimone, chairman of the Technical Service Review Board and offered the following resolution, seconded by Trustee Buonanno: WHEREAS Almighty God has seen fit to take unto Himself the soul of the late Salvatore DeSimone, and WHEREAS the said Salvatore DeSimone was the Chairman of the Technical Service Review Board of North Tarrytown and resident of the Village for many years having been held in the highest esteem by all those who knew him, now, therefore, be it RESOLVED that the Board of Trustees take official notice of Salvatore DeSimone's death, and be it further RESOLVED that this resolution be made a part of the official minutes of this meeting and a copy sent to the family of the deceased. Carried. PUBLIC SAFETY Trustee King stated that he is in receipt of the police report for the month of July as follows: (In detail official minutes) Trustee King stated that a letter was received from the Employees' Retirement System that Ptl. John Thomas has been placed on disability retirement. The Board had appointed John DiCairano a month ago and moved that the Treasurer be authorized to pay Ptl. DiCairano out of "Police-Other" in the budget, seconded by Trustee Timmings. Carried. Trustee King moved, seconded by Trustee Buonanno that specifications be prepared and bids be returned on September 24th for a 1985 four door sedan for the department, seconded by Trustee Buonanno. Carried. Trustee King moved, seconded by Trustee Salman that Lt. Brophy be granted permission to attend the Police Baton Instructors Course in Connecticut and reimbursed for the course and motel. Carried. Trustee King reported that during the month of June,$651 was collected in parking summonses and in July, $827. PUBLIC WORKS Trustee Salman moved, seconded by Trustee Buonanno that the position of laborer in the Water & Sewer Department be posted at the present salary rate. Carried. �r• -6Trustee Salman gave the following report: The department excavated the cave-in on Bellwood Avenue and backfilled and blacktopped same. Helped the highway department with sewer jet to clear out culver along Bedford Road. Repaired the leak in the meter pit on the corner of Highland and Bellwood Avenue. Trustee Salman moved, seconded by Trustee Timmings that the Superintendent of Public Works be granted permission to attend the fall meeting of the NY Section of American Water Works Assoc, from October 2-5 at the Nevele with expenses. Carried. Bank balance as of August 10th, 1984 is $12,308. The department repaired the fence, drainage ditch and catch basin at the end of Van Tassel Avenue. I Defective sidewalks on Pocantico, Depeyster, Chestnut and Elm j Streets have been replaced. j The culvert along route 9, a State road, was rehabilitated. The State refused to take care of their facilities so it was necessary for for the department to do the work. We have been informed that funding for the Faus V road repair wo (Sleepy Hollow Road) would not be available for this construction sea Trustee Salman moved, seconded by Trustee Buonanno that specifica be prepared and bids be returned for repaving of Cortlandt Street, fro Clinton Street to Beekman Avenue, funding from the CHIPS program. Bid to be returned on September 24, 1984. Carried. Trustee Salman moved, seconded by Trustee Buonanno that the proposal of M.S. Iron Works in the amount of $6000 be accepted for the rehabilitation of the greenhouse. Carried. Trustee Salman reported that the Cimino Contracting Company has completed the catch basin, sidewalk project in Census Tract 116, funde by Urban County. Trustee Salman moved, seconded by Trustee Buonanno that specific* tions be prepared and bids be returned on September 24th for a 1985 25 yard sanitation truck. Carried. Trustee Salman moved, seconded by Trustee Timmings that the Treai be authorized to obtain the necessary bonding resolutions up to $100,000.00 from the bonding attorney. Carried. i RECREATION Trustee Galgano moved, seconded by Trustee Timmings that specifi tions be prepared and bids be returned on October 9th on athletic and activity equipment. Carried. �r -7Trustee Galgano moved, seconded by Trustee Timmings that the Mayor be authorized to sign the N.Y.S. Division for Youth State Aid application, monies to be received in the amount of $3397. Carried. Trustee Galgano reminded the Board that the Village Officials Softball game has been slated for September 7th at Memorial Field, rain date September 8th. MAYOR'S REPORT: Mayor Zegarelli stated that he is in receipt of maps from DOT regarding areas in need of upgrading on route 9 and suggested that Board members review them. Mayor Zegarelli acknowledged a certified letter received from Mr. Giovanni Tucci, 31 Pine Street, concerning his tree. Mayor Zegarelli acknowledged a letter from David Perlmutter, Bellwood Avenue, who expressed his unhappiness with the present taxi service provided by Stefan's taxi. Trustee Timmings moved, seconded by Trustee Galgano that North Tarrytown observe a day in November as "Youth Month". A county-wide observance is being planned. Mayor Zegarelli stated that the AAA luncheon will be held on September 19th and North Tarrytown will be presented with an award. Mayor Zegarelli moved, seconded by Trustee King that the week of September 9-15 be designated as United Way Week. Carried. Trustee Timmings moved, seconded by Trustee Buonanno that the following resolution be adopted in connection with the Urban County Community Development Program and that the Mayor be authorized to sign the agreement after review by Counsel: (copy in detail official minutes) Carried. Mayor Zegarelli stated that the Board has been invited by the Senior Citizens to celebrate their 9th birthday on August 24th. COMMUNICATIONS Communication from P. O'Connell, 9 Francis Street, requesting the trimming of a tree in front of her property was read and referred to the public works committee and tree foreman. Communication from Mr. & Mrs. Joseph DiChiara, 11 Depeyster Street, requesting tree work was read and referred to public works and tree foreman. Communication from Stanley Pulaski, 144 Depeyster Street, requesting sidewalk repairs was read and referred to the public works and tree foreman. Communication from Mr. & Mrs. Fernando Corona, 126 Depeyster Street, requesting sidewalk repairs was read and referred to the public works committee. �r• -8Communication from Richard Gross, Sec'y. of Rescue Hose Apparatus Committee, stating that equipment has been received from AAA Emergens Supply Company for its new apparatus was read. Mayor Zegarelli moved, seconded by Trustee King that the Treasure be authorized to pay for the equipment when a bill is received. Carri* Communication from James Boumis, 105 Gordon Avenue, requesting the trimming of a tree in front of his property at 47 Lawrence Avenue was read and referred to public works and tree foreman. Communication from A. Millow, 138 Depeyster Street, requesting a new sidewalk at 138 Depeyster Street and Cedar Street was read and referred to the public works committee. Communication from Louis Zimmer, 525 Riverside Drive, requesting tree trimming in front of his property was read and referred to the public works and tree foreman. Communication from Charles Mack, 515 Bellwood Avenue, requesting tree trimming work in front of his property was read and referred to the public works and tree foreman. Communication from Barbara Kunz, 13 Chestnut Street, requesting sidewalk repairs at her property was read and referred to the public works committee. Communication from Joseph DeMichele, 33 Amos Street, requesting * the removal of trees which had fallen from North Street in the rear I of his property was read and referred to the public works committee. I Communication from Grace Cresswell, 48 College Avenue, complaining about major conditions caused by housing units recently constructed on North Washington Street to her property was read. Mayor Zegarelli stated that the building inspector has replied to her letter. Communication from Thomas Curtin, President of Rescue Hose, requesting permission to erect a sign across Beekman Avenue, as well as at the intersection of Beekman and Broadway and Beekman and Pocantii Street to advertise their Flea Market which will be held at the General Motors lot on September 15th was read. Trustee Timmings moved, seconded by Trustee King that permission be granted. Carried. Certified letter from Giovanni Tucci, 31 Pine Street, stating that the Village had cut five healttyroots on the tree in front of his property, 6-8" in diameter without balancing the tree and causing the 234 year old tree to become very weak and rotten on the north side Mr. Tucci stated that the Village is directly responsible for damages | if due to a major storm the tree falls on his house and is requesting that the tree be cut completely to avoid a possible lawsuit. Mr. Perri stated that he cannot obtain a c.o. unless the Village accepts the petitions. Mayor Zegarelli stated that upon approval of Counsel, the Clerk will poll the Board by phone for their approval. \0' Trustee Timmings so moved, seconded by Trustee Buonanno to confirm the Mayor's suggestion. Carried. UNFINISHED BUSINESS Trustee Timmings stated that that we have not completed our negotiations with the teamsters union. The State Fact-Finder's report has not been submitted even though it was promised for June 1st. He stated that we should obtain Counsel's opinion pertaining to unilaterally establishing holidays. m l'« . 1 Trustee Timmings stated that another sloppy grievance was filed. He stated that vague information was typed on to a sheet of paper. Either we live by the contract that grievances be properly filed or we will have to find other ways of doing business with these people, he said. The Mayor suggested that Counsel send the unit a lett er that grievances be completed in property form, prior to the Board entertaining them. Trustee Buonanno moved, seconded by Trustee Timmings that the bills submitted on the General Fund and Water & Sewer warrants dated August 13, 1984 be paid after approval of department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Carried. There being no further business to come before the meeting, Trustee King moved, seconded by Trustee Buonanno that the same be duly adjourned. Carried.
