September 10, 1984 A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present Philip E. Zegarelli, Mayor James J. Timmings Vincent Buonanno William McBride Robert King Susan Galgano Steven Salman, Trustees Robert J. Ponzini, Counsel Mayor Zegarelli called the meeting a prayer and salute to the flag. to order at 8:00 P.M. with Trustee Buonanno moved, seconded by Trustee King that the minutes of the meeting held on August 13, 1984 be adopted with the following corrections: Pg. 4, Par. 2 - The structure of payment for part-timers include Sanitation-fiscal year; parks-recreation-seasonal; clericalfiscal year; laborers-fiscal year; school crossing guards-seasonal; parking enforcement officer-fiscal year. > [ Trustee Salman amended the resolution to correct page 9 "Unfinished business", par. 3 as follows: Trustee Salman stated that some grievances are filed forjbmployees by other employees without their knowledge. Other grievances are filed by the individuals themselves. Trustee Buonanno seconded the motion. Carried. Trustee Buonanno moved, seconded by Trustee King that the minutes be adopted as corrected. Carried. 5-*-*- /^^---> , g^ iy/-^yfpf^ \ \ Mayor Zegarelli called for bids on a 1985 police car. f Treasurer Amato opened the following bid: 1 Russell Chevrolet, Connecticut J 1985 model 1984 model package $11,899 10,699 Mayor Zegarelli moved that the bid be referred to the police committee for a report back to the Board, seconded by Trustee King. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board. Mr. Joseph Ortiz, 42 Hudson Street, on behalf of several residents of Hudson Street, inquired as to what the Village intends to do with the vacant lot which is being used as a dumping ground. \\ �r -2Mayor Zegarelli stated that the Village is in the process of making it into a parking lot and on questioning Mr. Biros, was told that it will take at least 6 - 8 weeks. This is to coincide with the street paving work which is being contemplated. On a question of Mr. Ortiz as to when it will be cleaned up, Mr Biros stated that it had been. Mayor Zegarelli instructed Mr. Biros to have the lot cleaned up again as soon as possible. Counsel suggested that anyone seeing any dumping should contact the police. Mr. Teagle, Hudson Street, stated that the only way to remedy the matter, wpuljl fre to level it down and erect a fence. Trustee Buonanno moved that Mario Seminara be authorized to purchase material and tacks for twenty chairs in the fire department social rooms, not to exceed $250, seconded by Trustee Timmings. Carri Trustee Buonanno moved that Mario Seminara be authorized to re-upholster ten chairs at this time at a cost of $75 each, seconded by Trustee McBride. Carried. GOVERNMENTAL RELATIONS Trustee McBride stated that Cable TV increase went into effect September 1st. | Trustee McBride stated that bus shelters are no longer a possibj He stated that we did not seem to have the space on sidewalks. There is a limited amount of bus shelters available, he said. The County i using a system of its own. MANAGEMENT-BUDGET Trustee Timmings stated that the long-awaited fact finder's repo from the Teamsters has just reached Village Hall this evening at 8:15 He stated that he has no idea of what it contains. He stated that he will ask Counsel to define what our position is now. We will respon in quick fashion as soon as possible, said Trustee Timmings. Trustee Buonanno stated that the fact finder's report was due | June 1st and it was delivered September 10th. Trustee Timmings stated that there was another disagreement on settling the police contract having to do with effective date of frin benefits which were included. Trustee Timmings reported a cash balance of $349,148.48 in the General Fund as of September 10, 1984. Trustee Timmings moved, seconded by Trustee Buonanno that action of the Treasurer in depositing C D . notes in the amount of $300,000.00 and $900,000.00 for thirty days at 8% in the First National Bank of North Tarrytown be confirmed. Carried. Trustee Timmings moved that the following resolution be adopted, seconded by Trustee Buonanno: •If I BOND RESOLUTION, DATED SEPTEMBER 10, 1984, AUTHORIZING THE ISSUANCE OF $100,000 SERIAL BONDS OF THE VILLAGE OF NORTH TARRYTOWN, PURSUANT TO THE LOCAL FINANCE LAW, TO FINANCE THE ACQUISITION OF A MOTOR VEHICLE FOR THE VILLAGE. (In detail official minutes) Trustee Buonanno stated that he, together with Trustees Timmings and King are members of the local negotiating committee working on behalf of the Village. Situations arise during the years where they are publicly criticized with vicious quotes such as the flyer which was posted in the lobby of the building, and which are completely untrue. He stated that the committee has not had a meeting since early May because it was waiting for the fact finder's report. As part-time employees, they have to take off from their respective employment to represent the Village, he said. Ill Trustee Buonanno quoted from the flyer which attacked both Trustee Buonanno and Trustee Timmings. Trustee Buonanno stated that he had the unfortunate situation of having tires slashed on Beekman Avenue. He stated that he hoped the Village would do its utmost to protect the Trustees. )\ Trustee Timmings concurred with Trustee Buonanno. If the Teamsters Union had good common sense, they would have a contract, he said. PUBLIC SAFETY Trustee King moved, seconded by Trustee Galgano that the police report for August be entered into the minutes: (in detail official minutes) t II �f -A- Trustee King stated that we are changing over parking meters from 5c per one-half hour to one dime for one-half hour. He stated that approximately 55 meters have to be replaced and moved that specifications be prepared and bids be j/eturrTied on October 9, 1984 fc 21 single meter headst^^^^^^^^^^^or^ no. Carried. I On the question, Trustee Timmings inquired about funding; eithei have a pay-as-you-go arrangement with the contractor or a two year capital note. Trustee Timmings moved to amend the motion by authorizing the Treasurer to pressure the requirement of a capital note in the amount of $11,000 when we receive bids or whatever option is feasible, secow by Trustee King. Carried. Trustee King stated that the meters should be changed over withii the next two weeks. Trustee King stated that Rescue Hose apparatus committee request! two changes in the truck specifications, i.e., aluminum tread plate o. step under the canopy and two-tone paint upper part of cab and moved that action of the committee be confirmed in an additional amount not to exceed $800, seconded by Trustee Timmings. Carried. i PUBLIC WORKS ! Trustee Salman offered the following resolution, seconded by Trustee Timmings: WHEREAS Almighty God has seen fit to take unto Himself the soul of the late James Roberto, and WHEREAS the said James Roberto was the former Assistant Road Foreman of the Village and resident of the Village of North Tarrytown for many years having been held in the highest esteem by all those wh< knew him, now, therefore, be it RESOLVED that the Board of Trustees take official notice of Jamei Roberto's death, and be it further RESOLVED that this resolution be made a part of the official minutes of this meeting and a copy sent to the family of the deceased Carried Unanimously. Trustee Salman offered the following resolution, seconded by Trustee Timmings: WHEREAS Almighty God has seen fit to take unto Himself the soul of the late Olive Howard, and WHEREAS the said Olive Howard was the sister of Hercules Shubric Sanitation Foreman, having been held in the highest esteem by all the who knew her, now, therefore, be it �r -5RESOLVED that the Board of Trustees take official notice of Olive Howard's death and be it further RESOLVED that this resolution be made a part of the official minutes of this meeting and a copy sent to the family of the deceased. Carried Unanimously. Trustee Salman stated that on August 30th, a meeting was held between the fire department representatives, Assistant Chief Richard Green, Supt. of Public Works, John Biros, Trustee King and himself drafting a policy relating to public works employees and their duties to the public works department and fire department. He stated that there is a problem of public works employees responding to fires and not returning to their jobs. He stated that a final draft will be presented at the next Board meeting. Trustee Salman gave the following report: The department trimmed bushes around the hydrants. Located our underground facilities at the entrance to Sleepy Hollow High School at Broadway in order for a contractor to construct concrete bases for traffic lights. Rebuilt sanitary sewer manhole and replaced frame and cover on Elm St. Trustee Salman stated that the ten days posting for a position as Laborer in the Water & Sewer Department has expired and moved that Richard Chulla be appointed laborer at a salary of $15,080, $500 less than that of a regular laborer for six months probationary period effective September 14, 1984, seconded by Trustee Buonanno. Carried. Bank balance in Water fund as of September 10th is $13,285. Defective sidewalks on Depeyster, Cedar, Continental Streets, Hudson Terrace, College, Pierson and Bellwood Avenues. Leveled and covered with dirt disposal area at Phelps Memorial Hospital. Cleaned out greenhouse in preparation for contractor to start demolition of the first third of structure, which will commence on Monday. Received the new 1% ton truck with plow from Willow Motors which will be placed into service as soon as paper work is completed. Trustee Salman moved, seconded by Trustee King that specifications be prepared and bids be returned on October 9, 1984 for repair work on the gabion wall on Dell Street which was damaged by the floods in April Carried. Trustee Salman moved, seconded by Trustee Timmings that Counsel Ponzini be authorized to draft charges against a full-time employee* Carried. �r -6Trustee Salman moved, seconded by Trustee King that Dennis Fitzgerald be appointed hearing officer at the prevailing rate. Carrie Minor repairs were made on various street, police and fire equip! RECREATION-SENIOR CITIZENS Trustee Galgano stated that the fall and winter brochure has beer mailed out. A meeting will be held with the committee and commission to discu fall programs, said Trustee Galgano. Trustee Galgano stated that a meeting will be held with David DeLucia regarding Community Development Funds for rehabilitation of parks and what we will do with the money. Mayor Galgano stated that the game between Tarrytown and North Tarrytown Village Officials was cancelled and no new date has been scheduled. Trustee Galgano stated that three letters of commendation were received regarding the Tot Camp and people involved were congratulated Trustee Galgano reported vandalism in the parks and repairs were made. Trustee Galgano stated that we received a cut-back in funds for flood damage in the amount of $12,000. Trustee Galgano stated that the Senior Citizens celebrated their 9th Anniversary. Mayor Zegarelli sent congratulations on behalf of the Board, said Trustee Galgano. A meeting will be held with the recreation committee and commissi! with a representative from the Westchester Residential Opp. Club to discuss housing for senior citizens. MAYOR'S REPORTMayor Zegarelli stated that a letter has been received from the Tarrytown Chapter of the DAR requesting that Sept. 17-23 be proclaimed Constitutional Week and moved that the following resolution be adopted seconded by Trustee Buonanno: WHEREAS, September 17, 1984, marks the one hundred ninety-seventh anniversary of the drafting of the Constitution of the United States oi America by the Constitutional convention; and WHEREAS, to accord official recognition to this memorable anniverf and to the patriotic exercise that will form a noteworthy feature of t occasion, seems fitting and proper; and WHEREAS, Public Law No. 915 guarantees the issuing of a proclamat each year by the President of the United States of America designating* September 17 through September 23 as Constitution Week, �3«y r -7NOW, THEREFORE, I, Philip E. Zegarelli by virtue of the authority vested in me as Mayor of the Village of North Tarrytown in the State of New York do hereby proclaim the week of September 17 through 23 as Constitution Week, in the Village of North Tarrytown, and urge all our citizens to pay special attention during that week to our Federal Constitution and the advantage of American Citizenship. Mayor Zegarelli read a letter from Norman VanValkenburgh, Director, Division of Lands and Forests, Dept. of Environmental Conservation, that North Tarrytown has been declared a 1984 Tree City. Mayor Zegarelli acknowledged receipt of letter from John Carroll which he referred to Trustee King. Letter concerned the removal of parking meters in front of Holy Cross Church. Mayor Zegarelli noted the pre-dated letter received from Search for Change and his letter in answer, copies of which were placed on each Trustee's desk. He explained the meeting which was held with Ruth Stern and Richard Lang, together with Trustee Buonanno and himself and the and the results of same. The Mayor expressed his displeasure at Search for Change' tactics in post-dating a letter which could create problems in our response to their application. Trustee Buonanno stated that this was typical of the maneuvers this group has with us on an on-going basis. They are deceitful and cannot be trusted, he said. They will do anything in their power to get this construction, said Trustee Buonanno. We should be conscious of their actions when dealing with them--they are not to be trusted, he said. Mayor Zegarelli stated that nine out of eleven people who were asked to serve on the Economic Council have agreed to serve. He stated that on the local level, we have finalized the economic package of incentives and motives, together with Alfred DelBello to keep General Motors in North Tarrytown. Mayor Zegarelli stated that he was appointed by County Executive A. O'Rourke to serve on the Town/Village task force headed by Sal Prezioso. COMMUNICATIONS Communication from Maureen Patten-Chung, 12 Dell Street, stating that the residential lot adjacent to her home was still being used for commercial purposes was read. Mrs. Chung referred to a letter she had written to the building inspector regarding a complaint she filed with him on a zoning violation. Mr. Margotta stated that he has been investigating the complaint and the tenant renting the property is complying with his orders. The matter was referred back to the building inspector. Communication from Ray Hordell, Executive Director, North Tarrytown Housing Authority, requesting the Board review employee salaries for their approval was read. �r -8Mayor Zegarelli stated that additional information, such as the percentage of the increase, etc. be obtained. Communication from Ruth Swaby, 12 Spruce Street, regarding the condition of the street at the end of Spruce Street, as well as a sidewalk curb was read and referred to public works. Communication from Roberto Perozzi, 124 Millard Avenue, requesti sidewalk repairs was read and referred to the public works committee. Communication from S. J. Schiavone of A & S Machine Shop, Cortlai Street, requesting permission to park a trailer behind his plant in the Village reacreation area to discharge debris as a result of a fir* in his plant was read. Mayor Zegarelli stated that in order to expedite the cleanup, he had granted permission to Mr. Schiavone. Mr. Schiavone has agreed to repair recreation equipment, said the Mayor. Trustee Timmings moved, seconded by Trustee Galgano that action of the Mayor be confirmed. Carried. The Clerk stated that the contract for snow removal on County roads for the 1984-85 year was approved as to form by Counsel. Trustee Buonanno moved, seconded by Trustee King that the Mayor be authorized to sign the agreement between the County and Village for snow removal on County roads. Carried. NEW BUSINESS Trustee Timmings stated that the committee is attempting to work out an agreement with the Teamsters to move holidays around so that bulk pickup can be made during a week which would have holidays. He stated that Wednesday is bulk pickup. If a holiday occurs during that week,there would be no bulk pickup. He stated that November has several holidays where there would not be bulk pickups for several weeks. The committee would like to have some coordination in establish holidays. Trustee Timmings noted recent complaints regarding conditions in certain areas of the Village and moved that the Board meet in the futui as a committe of the whole with residents of Philipse, Sleepy Hollow Manors and Webber Park to review our present zoning ordinances for suggestions for changes, if need be, seconded by Trustee Salman. Carri< Trustee Timmings stated that we are in receipt of a letter from the State Legislator's office regarding additional retirement service credit for employees who are eligible to retire and moved that a survej be made to see if anyone in the Village would be interested in early retirement if conditions were correct, seconded by Trustee Buonanno. | Carried. I �3&*J5 r -9In connection with the new law effecting municipalities which provides for increased exemption for veterans of World War II, Korean and Viet Nam conflicts, Mayor Zegarelli moved, seconded by Trustee Timmings that a public hearing be held on September 24, 1984 to consider a proposed Local Law providing for increased exemption from real estate taxes for veterans of World War II and the Korean and the Viet Nam conflicts. Carried. Trustee Timmings stated that the management and budget committee will also review the new percentage of exemption scale which the State recently signed into law for a public hearing. Trustee Timmings moved, seconded by Trustee Galgano that the bills submitted on the General Fund and Water & Sewer warrants dated September 10, 1984 be paid after approval of department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. BE IT RESOLVED by the Board of Trustees of the Village of North Tarrytown, New York as follows: Section 1. The Board of Trustees shall issue its Serial Bonds of the aggregate principal amount of $100,000 pursuant to the Local Finance Law of New York, in order to finance the specific object or purpose hereinafter described. Section 2. The specific object or purpose (hereinafter referred to as "purpose") to be financed by the issuanc of said bonds is the acquisition of a sanitation truck for us by the Village. Section 3. The Board of Trustees has ascertained and hereby states that (a) the estimated maximum cost of the sanitation truck is $100,000; (b) no money has heretofore been authorized to be applied to the payment of the cost of the purpose; (c) the Board of Trustees plans to finance the purpose entirely from funds raised by the issuance of obligations herein authorized. �Section 4. It is hereby determined that the pur- pose is an object or purpose described in Subdivision 29 of Paragraph a of Section 11.00 of said Local Finance Law and that the period of probable usefulness of the purposeis five years. Section 5. Subject to the terms and conditions of this resolution and the Local Finance Law, and pursuant to the provisions of Sections 30.00, 50.00 to 60.00, inclusive of said Law, the power to authorize bond anticipation notes in anticipation of the issuance of the Serial Bonds authorized by this resolution and the renewal of said notes and the power to prescribe the terms, form and contents of said Serial Bonds and said Bond Anticipation Notes, and the power to sell and deliver said Serial Bonds and any Bond Anticipation Notes issued in anticipation of the issuance of such bonds is hereby delegated to the Village Treasurer of said Village. The Village Treasurer is hereby authorized to sign any Serial Bonds issued pursuant to this resolution and any Bond Anticipation Notes issued in anticipation of the issuance of said Serial Bonds, and the Village Clerk is hereby authorized to affix the corporate seal of said Village to any of said Serial Bonds or any Bond Anticipation Notes and to attest such seal. -2- �r Section 6. This resolution shall be published in full by the Village Clerk of said Village, together with a notice in substantially the form prescribed by Section 81.00 of said Local Finance Law, and such publication shall be in The Daily News, a newspaper having a general circulation in said Village. The validity of said Serial Bonds or of any Bond Anticipation Notes issued in anticipation of the sale of said Serial Bonds may be contested only if such obligations are authorized for an object or purpose for which the Village is not authorized to expend money, or the provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity, is commenced within twenty days after the date of such publication; or if said obligations are authorized in violation of the provisions of the Constitution of New York. Section 7. This resolution shall be effective immediately upon its adoption.
