September 24, 1984 A regular meeting of the Board of Trustees of the Village of North Tarrytown was held on the above date. Present Philip E. Zegarelli, ^ Mayor James J. Timmings Vincent Buonanno William McBride Steven Salman, Trustees Robert J. Ponzini, Counsel Absent Robert King Susan Galgano, Trustees Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Buonanno moved, seconded by Trustee McBride that the following paragraphs be added to the minutes of September 10, 1984 which were inadvertently omitted and moved that the same be duly approved: Carried. Administration "Trustee Buonanno moved, seconded by Trustee Timmings that after conversation with attorneys from the Tarrytown Pistol Club and our Attorney the Mayor be authorized to sign the agreement between the Village and the Pistol Club. Carried. Trustee Buonanno stated that permission was previously granted to the firemen to build a canopy over a picnic area and it is now in use. Trustee Buonanno reported that Capko Company of Hawthorne has done a preventive maintenance and service on boilers at Union and Rescue Hose. There was a gas leak in the administration building which precluded similar action be taken." Mayor Zegarelli called for bids on a 1985 garbage truck. Treasurer Amato opened the following bid: Theo. Carried. * if Mayor Zegarelli called fox bids on resurfacing work on Cortlandt Street, from Clinton Street to Beekman Avenue. Treasurer Amato operated the following bid: County Asphalt, Inc., Tarrytown, K.Y. $48,723.00 Bid bond enclosed. Mayor Zegarelli read the notice of bearing on a proposed local law or resolution approving or disapproving inclusion of the Village in the provisions of Chapter 525 of 1984 providing for increased exemption from real estate taxes for veterans of World War II and the Korean and the Viet Nam Conflicts and asked if there was anyone present who would like to address the Board. !!!• l;l ii Mr. Richard Green, 65 Mew Broadway, stated that as a Veteran of the Viet Nam conflict, requested that the Village accept the State's proposal and offer this exemption-as being given to the World War II veterans. 11 Mr. Armando Galella, 40 Depeyster Street, stated that the State acted in haste when they passed this bill. It is the Board's right to disapprove and opt out. He stated that every Veteran should have a right-off on their income tax. i^ Trustee Timmings stated that this hearing involves a cruel hoax on the part of the State of Slew York. Let us examine the facts: It is publicized to be an effort on the part of the State to reward the veterans of the United States military services. To start with, the benefit completely ignores the contribution of the many veterans who are not property owners. For those who qualify, the benefit is not what it seems to be. First, in the normal sequence of events, a community spending budget is developed and the total amount of money to be raised from property tax is determined. Next, the total tax collection is divided by the total assessment roll to obtain the tax rate. Consequently, any reduction in assessment demands a higher tax rate and the dollar benefit is less than the percent decrease in assessment The majority of homeowners itemize deductions for Federal and State income tax. Property tax is a ligitimate tax deduction and whatever reduction is obtained froam this legislation becomes taxable at Federal and State Income Tax rates. lihat is left for the veteran? It must be recognized that this reported benefit, offered by the State of New York, is a ploy to increase its income and a cruel abuse of the veteran property owners. It should also be recognized that if the State of New York would enact a full fiscal impact law, the Legislature would have the means to provide a true benefit when they are about to make the claim of a benefit. "U �v3?/ r -3Mayor Zegarelli stated that according to the legislation, we have to decide to opt out by October 2nd, 1984. Mr. Vincent Chebetar, Chaplain of the Veterans Organization, stated that many veterans have not taken advantage of an exemption on their assessments. He stated that there is a list available of veterans in North Tarrytown. Following a discussion, Mayor Zegarelli moved, seconded by Trustee Timmings that the hearing be closed. Carried. Mayor Zegarelli moved that the following Local Law #4 of 1984 be adopted, seconded by Trustee Buonanno: A local law in relation to the alternative veterans exemption from real property taxation. Be it enacted by the Board of Trustees of the Village of North Tarrytown as follows: Section 1. The purpose of this law is to provide that no exemption from real property taxes shall be granted pursuant to section 458-a of the Real Property Tax Law of the State of New York. Section 2. Pursuant to the provisions of subdivision 4 of section 458-a of the Real Property Tax Law of the State of New York, no exemption from real property taxes shall be granted purusant to section 458-a of the Real Property Tax Law for purposes of real property taxes levied for the Village of North Tarrytown. Section 3. This local law shall take effect immediately upon its filing with the Secretary of State. Carried Unanimously. Mayor Zegarelli moved that a committee of three trustees, Mayor, together with the Village Assessor, Treasurer and representatives from the respective Veterans group and interested citizens be established to assess the financial impact of the proposed legislation and gather whatever data necessary, seconded by Trustee Buonanno. Carried. Mayor Zegarelli moved for a brief recess, seconded by Trustee Buonanno after which the meeting resumed. Mayor Zegarelli moved that the Local Law be forwarded to the Secretary of State by federal express or whatever means would be faster, seconded by Trustee Buonanno. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board on any other matter. Mr. Armando Galella stated that two weeks' ago, an article appeared in the paper regarding a package deal with General Motors and inquired as to the conditions of the proposal and effect it will have on the community. Mayor Zegarelli stated that another meeting is being held tomorrow to go over the proposal. It has not been delivered to General Motors, he said. He stated that there is a series of incentives. The package is coming out of the Dept. of Commerce. The whole package will be unveiled shortly, said the Mayor. �vSfoL r -4Mr. John Carroll stated that there was a report in the N.Y. Times that General Motors was going to invest 50 million dollars in six plants in the mid-west for a paint job. This plant called for 200 million dollars for a paint job. Mr. Rocco Martello, 50 Pocantico Street, inquired about the latest development regarding Search for Change. Mayor Zegarelli stated that he received another letter explaining the letter which was post-dated. We will be writing a letter formally responding to their request. Mr. Martello complained about the parking situation on Pocantico Street and suggested the painting of parking spaces on the west side of the street. The matter was referred to John Biros. REPORTS OF COMMITTEES ADMINISTRATION Trustee Buonanno moved, seconded by Trustee McBride that the next meeting of the Board be held on Tuesday, October 9, 1984, instead of October 8th during which Columbus Day will be celebrated. Trustee Buonanno stated that complaints were received regarding the improper storage of a trailer at the Exxon station at Pocantico St. and Broadway. He stated that Mr. Margotta has been pursuing the issue and read the report from the Building Inspector. Mr. Aruj has sixty days tojremove the trailer. Trustee Buonanno stated that the defective boilers in the administra tion building and Rescue Hose building are being taken care of. Trustee Buonanno stated that the complaint from Mrs. Geldern, Andrews Lane, regarding a water problem eminating from the ambulance garage has been corrected. Trustee Buonanno stated that there are a lot of problems connected with the air condition unit. We are looking to Mr. Carey for advice as to what he feels has to be done with the unit in order for it to be made more functional. Trustee Buonanno stated that there is a slight problem with the generator system which is being corrected and because of this, we were not checking the fire alarm system on Wednesdays. GOVERNMENTAL RELATIONS Trustee McBride noted a bulletin from the Westchester County Village Officials' Association regarding the sales tax question. He stated that it may be necessary to petition our Board of Legislators of our feeling to share in the 1%% tax. Trustee McBride stated that with regard to the question of the new veterans exemption law, we should position ourselves to the State to �*3W r -5point that it become a check write-off. equitable to all veterans, he said. It would be fair and MANAGEMENT & BUDGET Trustee Tiiranings moved that the Village take out a one-half page advertisement in the N.Y:S. Municipal Bulletin, seconded by Trustee Buonanno. Carried. Trustee Timmings stated that the State Comptroller considers the Village Officials Annual Dinner-Dance an official function and moved, seconded by Trustee Buonanno that any member of the Board who does attend will be able to charge the expense back to the Village, however, any member who chooses to take either his wife or husband, will be an expense to the family. Carried. Trustee Timmings stated that the annual report from the State Board of Equalization & Assessment shows a rate of 19.37%. There is a provision for appealing if we choose to do so at a hearing scheduled for November 5. With regard to the hearing on exemption for senior citizens over 65 years of age or over, Trustee Timmings moved, seconded by Trustee Buonanno that a public hearing be held on October 22, 1984 on the following proposed scale: Income Percentage of Exemption Up to 10,500 50% 11,000 45% 11,500 40% 12,500 35% 13,000 25% 13,500 20% Carried. Trustee Timmings reported a cash balance of $223,187.33 in the General Fund as of September 24, 1984. Trustee Timmings moved that action of the Treasurer in depositing two c.d. notes in the First National Bank of North Tarrytown at 9% be confirmed, seconded by Trustee Buonanno. Carried. Trustee Timmings stated that he left the amounts out because the police negotiating committee took an exerpt from the minutes and "butchered" the intent of what was said. For the rest of the year, said Trustee Timmings, he intends to omit the amount. This is money we will be using later on in the year, he said. Trustee Timmings moved, seconded by Trustee Buonanno that the Mayor be authorized to sign the contract in the amount of $2,816 to be used for the senior citizens mini-bus. Carried. Trustee Timmings reported that the Treasurer received a check in the amount of $79,860 from OSHA for compliance with safety and health orders issued by the Dept. of Labor on May 15, 1984 against the Village's old highway garage. �v#/ r -6Trustee Timmings moved, seconded by Trustee Buonaimo that the Treasurer maintain copies of all paper work and documents in connection with this check in the event we have to provide a final accounting to the governmental agency. Carried. Trustee Timmings stated that the Chief of Police is entitled to the same dollar increase as the Lieutenant and moved that Chief Spota be granted a salary increase, in the dollar amount, that was granted to the Lieutenants at the new rate and the retro pay will be provided in a separate check when it is done for everyone else, seconded by Trustee Salman. Carried. With regard to the Civil Service contract, Trustee Timmings moved that the Village Counsel be authorized to meet with the Teamsters Counsel in an effort to establish a contract without having to resort to a legislative hearing, seconded by Trustee Buonanno. Carried. Trustee Timmings stated that the police union has still not signed the stipulation drawn by our Counsel and we are progressively pursuing the document. PUBLIC SAFETY In the absence of Trustee *King, Mayor Zegarelli stated that he will temporarily fill in until he appoints a new Trustee. Mayor Zegarelli moved that the bids which were received at the last meeting of the Board on a 1985 car be rejected, seconded by Trustee Salman. Carried. Mayor Zegarelli moved that specifications be prepared and bids be returned on October 9, 1984 on a 1984 four door sedan, seconded by Trustee Salman. Carried. Mayor Zegarelli stated that there were problems recently with the alarm system and instructed the Clerk to contact Mr. Morabito for a report. PUBLIC WORKS Trustee Salman stated that the committee is in the process of redoing the Village parking stickers and we hope to have them in effect by January 1st. Trustee Salman stated that he is starting a new system in our requests for sidewalk repairs and tree work whereby the requests will be numbered and consequently put them into a computer. Trustee Salman moved that the following policy for employees responding to fires be adopted, seconded by Trustee Timmings: Any N.T.P.W. Employee who is a fireman may respond to an alarm when their company is called, except if they are working on concrete, snow and/or ice control, or a water main break. This policy shall also apply to Ambulance Corps members. It is the responsibility of the N.T.P.W. Employee to return to work immediately after their company is back in service. If a Fire Chief requests a N.T.P.W. Employee to remain after their company is back in service, it is then the responsibility of �<3£J r • -7the N.T.P.W. employee to request permission to remain from their immediate supervisor. Violations of this policy will result in disciplinary action by Public Works supervisory personnel. Carried. Trustee Salman gave-the following report: Routine inspection and cleaning of sanitary sewers with jet. Locating curb boxes in Sleepy Hollow Manor for emergency access to water shut-off valve. Water tap was made for new house on New Broadway. Bank balance as of 9/24/84 is $28,211. Replaced defective sidewalk at College Avenue at Broadway. The defective section of the greenhouse has been removed by the contractor and we have cleaned out and lowered the south section which is toremain. This portion is being blacktopped and will be the storage area for the sand and salt mixture. Levelled proposed parking lot area on Hudson Street and placed large concrete slabs across front to prevent illegal dumping. Cut down dead trees as per Tree Commission recommendation on Anderson Avenue, Elm Street, Sleepy Hollow Road and two on Lawrence Avenue. Checked out new 1% ton dump truck and placed in service. Car 503 (K9) complete brake job and grease. Inspected the ambulance, water department and Fire Chiefs' cars. Replaced emergency brake, plugs and blinkers on Cushman (Police). Prepared leaf vacuum for service. Replaced rearbrakes, etc, on two fire chiefs' cars. Minor repairs on Police Chief's car and patrol cars. New tires were placed on front of Recreation truck and aligned. Trustee Salman read a report of his findings in an investigation of actions of various Village employees relative to the use of a highway department truck for the removal of railroad ties from the backyard of Trustee Buonanno. He stated that he has obtained written and oral statements from those involved. He stated that he finds no evidence to indicate any wrong-doing by members of the highway depart.ment who were following orders when they delivered and removed the truck to and from the residence of Trustee Buonanno. Trustee Salman stated that at times, the Village has been liberal with services rendered to taxpayers and whenever possible, the Village has attempted to cooperate with residents in situations wherein unusual circumstances prevail. During emergency situations, all Village departments have demonstrated theioeagerness and ability to meet the increased services required and to provide a service to those in need. In a situation �6f(° r -8where there are no hard and fast rules or policy, said Trustee Salman, one must use personal judgment to ascertain whether or not there is a deviation from the norm. Where regulations exist, it is much easier to render an opinion. The Board feels that Village services should be available to all residents on an equal basis. We do not desire nor can we afford to stretch our services or to afford priority services, except under unusual circumstances, said Trustee Salman. The Village does not have a strict policy indicating how far it should extend itself under unusual circumstances, he said. He stated that Trustee Buonanno feels that he has done nothing wrong and was only availing himself of a service that was afforded to others in the past, said Trustee Salman. Trustee Salman stated that he is in receipt of a letter from Joseph Bozelli resigning as Heavy M.E.O. in the public works department effective October 5, 1984 and moved that his resignation be accepted with regret, seconded by Trustee Timmings. Carried. RECREATION In the absence of Trustee Galgano, Trustee Salman gave the following report: Registrations are being accepted for fall and winter programs. Not listed in the brochure will be foul shooting contest, co-sponsored with the Tarrytown Rec Dept. on Nov. 24th at 1 P.M. in front of Pierson School. Starting the week of October 8th, our After School program will begin. Some programs being offered are Computer Animation, E-Z Cooking, Model Making, Video Workshop, Holiday Crafts, Chess and much more. MAYOR'S REPORT Mayor Zegarelli stated that he is in receipt of a letter of resignation by Trustee King, effective September 30, 1984 to take a position in Washington and moved that his resignation be accepted with regret, seconded by Trustee Salman. Carried. Mayor Zegarelli stated that he is in receipt of the contract from the County for snow removal on State roads which has been approved by Counsel. Trustee Timmings moved, seconded by Trustee Buonanno that the Mayor be authorized to sign the agreement between the County and the Village for snow removal on State roads for the 1984-85 winter season. Carried. Mayor Zegarelli stated that Counsel has submitted the supporting documents and outlines for the North Tarrytown Parking Authority and we may now proceed to take the necessary procedure to obtain legislation and he so moved that Counsel be authorized to act in our behalf to contact Senator Flynn and Assemblyman Sullivan to introduce the proper legislation this fall or by the opening session, seconded by Trustee Buonanno. Carried. Mayor Zegarelli noted the letter from CRISP acknowledging receipt of his previous letter on behalf of the Board. He stated that he will have a response within the time allocated. �^1 r -9COMMUNICATIONS Communication from Leonard Galante, President, Central Veterans Committee, inviting Trustees to attend the Memorial Services on Veterans' Day as well as requesting permission to hold the services in Patriots Park was read. Trustee Timmings moved that permission be granted and thanked Mr. Galante for the invitation, seconded by Trustee Buonanno. Carried. Communication from Richard Green, Sec'y. of Fire Council, regarding changes in personnel in Fire Patrol, Rescue Hose, Union Hose and Columbia Hose Companies; requesting an exempt certificate for Barry Parnell and requesting a meeting with the Board to discuss certain items was read. Trustee Timmings moved, seconded by Trustee Buonanno that action of Council regarding changes in personnel be confirmed and an exempt certificate be granted to B. Parnell. A meeting will be scheduled with Council. Carried. Communication from F. Esteban, Pleasant Street, requesting the trimmings of trees in front of his property was read and referred to the public works committee and Tree Inspector. Communication from Mr. & Mrs. A. Ceconi, 36 Amos Street, regarding a tree adjoining their property was read and referred to the public works and tree inspector. Communication from Bessie Levy requesting sidewalk repairs at 57-59 Chestnut Street and 36 Kendall Avenue was read and referred to the public works committee. Communication from Mrs. Frances Centofanti requesting sidewalk repairs at 18 Cedar Street was read and referred to the public works committee. Communication from Richard Green, Sec'y. Fire Council, stating that the Council has recommended Richard Gross and John Cellante as Chief Fire Inspectors in connection with the Multi-Family Inspection Program was read. Trustee Timmings moved, seconded by Trustee Buonanno that action of Council be confirmed. Carried. Communication from Mr. & Mrs. A. Sirois, 25 Tappan Avenue, requesting the removal of a tree in front of their property was read. This is the second request. The matter was referred to the public works committee. Communication from Mrs. K. Fries, Town Clerk, requesting permission to use Central Headquarters for Registration Days, Oct. 9th and 13th was read. Trustee Timmings moved, seconded by Trustee Buonanno that permission be granted. Carried. �3^ r -10Communication from T. Cavalieri, M. DiFelice, Co-chairmen of the Annual Columbus Day-Dance sponsored by the Italo-American Club of the Tarrytowns requesting that the week of October 8th be designated as "Italian Heritage Week" was read. Mayor Zegarelli so moved, seconded by Trustee Timmings that the week of October 8th be designated as the same. Carried. Mayor Zegarelli acknowledged a note of appreciation of sympathy from Mrs. DeSimone. Mayor Zegarelli noted a letter from Edward Davies, Depty. Commissioner, Solid Waste Management, informing the Board in connection with the solid waste agreement between the County and Village that the Resource Recovery Facility at Charles Point will be fully operational on or about October 22, 1984. The notice is being issued in accordance with Section 203. Mayor Zegarelli noted a letter from Edward Reynolds, Director, Highway Safety Division of Criminal Justice Services, that Ptlmen. Camp and Cappello have successfully completed the recent Alcohol Enforcement Program held in Poughkeepsie Sept. 11-14. Mayor Zegarelli noted a letter from Lee Laster, Assistant Director, FBI, thanking our local police department for its participation in the FBI Progtam relating to diplomatic vehicle sightings and incidents. Trustee Buonanno moved, seconded by Trustee McBride that the bills submitted on the General Fund and Water & Sewer warrants dated September 24, 1984 be paid after approval of department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Carried. There being no further business business to come before the meeting, Trustee Timmings moved, seconded by Trustee Buonanno that the same be duly adjourned. Carried.
