November 30,1984 A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present James J. Timmings, Deputy Mayor Vincent Buonanno William McBride Frank Mangieri, Jr. Susan Galgano Steven Salman, Trustees Robert J. Ponzini, Counsel Absent Philip E. Zegarelli, Mayor n Deputy Mayor Timmings called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Deputy Mayor Timmings stated that the Mayor was attending a business dinner meeting in New York City this evening. • r Deputy Mayor Timmings asked if there was anyone present who would like to address the Board. Mr. Achilles Ligeros, 15 Irving Place, stated that he has been trying to get permission, since last March, for of f -street HftOk stated that John Biros, former building inspector, and James Margotta, building inspector, have denied him a permit for off street parking. Mr. Ligeros stated that he received permission from the Zoning Board of Appeals which allows him access to park one car in his front yard. He inquired if they have the power to invalidate the variance. I; *;: On advice of Counsel, Deputy Mayor Timmings stated that once the matter is introduced to the Zoning Board of Appeals, the Board of Trustees has no legal means of action of his complaint. He suggested that he contact the Zoning Board to ascertain what is taking place in the period that the variance was granted to date. He stated that he was sure that Mr. Margotta is not looking to deliberately by-pass decisions rendered by the Zoning Board. P . Mr. Ligeros stated that he spoke to John Arcate and the Mayor who suggested that he come before the Board. He quoted the duties of the building inspector from the Zoning Ordinance and it was his feeling that neither Mr. JBiros or Mr. Margotta have the power to invalidate the rules of the Zoning Ordinance. \w • Mr. Ligeros stated that he was being discrimihated|against, after which Counsel responded that he was not. f Counsel Ponzini asked Mr. Ligeros if the Zoning Board directed Mr. Margotta or Mr. Biros to issue a building permit, but he did not answer. '$ If �-2Mr. Margotta stated that they were not directed by the Zoning Board to issue Mr. Ligeros a permit. He stated that after the initi variance was granted, Mr. Ligeros was asked to come to the next mee of the Zoning Board. The determination was that Mr. Biros had valid rights for not allowing Mr. Ligeros access to his front yard, said M Margotta, because of a telephone pole and fire hydrant. Mr. Margott stated that he will not issue him a permit until he has access to th property. Counsel stated that the most the Board of Trustees can do now is ask the Zoning Board for a report. Mrs. Ligeros stated that a police officer had called her husbam names. Deputy Mayor Timmings stated that the Board of Trustees does no! have any authority in this situation. Based on the charge of disc mination and improper conduct of a police officer, Deputy Mayor Timmings stated that we will try to identify the police officeiA? Trustee Buonanno moved, seconded by Trustee Galgano that the minutes of the meeting held on November 13, 1984 be approved with mii corrections. Carried. REPORTS OF COMMITTEES ADMINISTRATION Trustee McBride stated that Election Day is a few months ahead us. The Town combined the second district with the first district in the November Election. He stated that we should stand unified am leave the second district at La Terrazza Hall. Trustee McBride stats that he had not heard of any complaints regarding the hall. Trustee McBride moved, seconded by Trustee Buonanno that Distrif #2 be continued at the La Terrazza Hall, 128 Cortlandt Street. Trustee Galgano stated that she received complaints that there was too much confusion in November when the districts were combined. Motion carried. Trustee McBride stated that there have been numerous complaints about the maintenance and condition of Union Hose and Central Fire Headquarters. He stated that Mr. Thaler has beer working on a part-time basis. Following a short discussion, Trustee McBride moved that Mr. Thaler's work schedule be increased one day or whatever period of tit it takes, after which he would go back to the original contract basi for which he was hired, seconded by Trustee Buonanno. Carried. Trustee McBride moved, seconded by Trustee Buonanno that the Mobil Service Station on North Broadway be used for just emergency repairs as was done at the former Tom's Exxon station, in the event our garage is not available. Carried. �#*/ * If:' -3Trustee McBride stated that regarding our request for an analysis of our insurance coverage, he received a call from our present carrier \tfho is aware that we are obtaining figures. GOVERNMENTAL RELATIONS Trustee Mangieri stated that he had written to Mr. Giraud, Westchester County Div. of Housing, to have food surplus delivered to the Holy Cross hall for our senior citizens instead of having it delivered to the C.O.C., but he has not received any answer. Trustee Mangieri stated that the Economic Council sent letters to four property owners on Beekman Avenue to attend a meeting to discusj possible parking facilities. We hope to obtain funds for this project from Urban County program. »a Trustee Mangieri stated that Counsel drafted a proposed local law on a Village Administrator. He stated that the Board has not met to discuss the draft in detail. Following a short discussion, a work session was scheduled for December 12th. MANAGEMENT & BUDGET Trustee Timmings reported that the Treasurer has given a cash balance for November 26th and if anyone would like to see the figures, may do so. Certificates of deposit were made at the First National Bank of North Tarrytown which mature December 10th, said Trustee Timmings. Trustee Buonanno moved to confirm action of the Treasurer, seconded by Trustee Galgano. Carried. Deputy Mayor Timmings stated that Mayor Zegarelli received notice from the Board of Equalization and Assessment that our final equalization rate is 19.37%. Deputy Mayor Timmings stated that the Mayor is in receipt of the audit report from the Dept. of Audit & Control June 1, 1982-5/31/83. Deputy Mayor Timmings stated that the monthly financial report through the month of October has been placed on each Trustee's desk. PUBLIC SAFETY Trustee Buonanno stated that at a previous meeting, the Board adopted a resolution increasing the fee for parking meters to 10c per half hour. We are disregarding the purchase of new meters, said Trustee Buonanno. He stated that all meters can be converted. Trustee Buonanno stated that a meeting was held to establish a plan to implement the current fee. It will take about 15 working days to convert, he said. He suggested overtime for Charles Annicchiarico who could work on a Saturday in order to implement the conversion. Jr i �r -4Trustee Salman stated that the problem is that people are insert] slugs, glue, etc. into the meters which takes time to remove. Therej no meter that can prevent this type of vandalism, he said. Counsel suggested that another person be taught the job and act as a backup which would reduce the work-load. Trustee Buonanno stated that the fine for overtime parking will be increased from 5 - 7 dollars, effective January 1, 1985. Trustee Buonanno reported that our two new policemen will be graduating from the Municipal Training School on November 28th. Trustee Buonanno stated that we were served with four grievances which are currently being monitored by the Labor Relations Committee. Following a discussion, a meeting was scheduled for December .th to review and hear the issues before the Board of Trustees and Po. ee Bargaining Unit, Step III. Trustee Buonanno stated that in order for Ptl. Schrank to be certified as Breath Test Operator, a class is being offered on Doc. 6t in Rochester. Since he will be in the area on vacation, there will no be any additional expenses, such as mileage, etc. Trustee Buonanno moved, seconded by Trustee McBride that Ptl. ' Schrank be permitted to attend the class in Rochester at a cost of $58 Carried. Trustee Buonanno stated that the former Manor Garage property whereftr^S-police cars were being parked has been undergoing renovatioi work. The owner of the former 21 Beekman Avenue property has offeree the lot for parking of official cars. He is requesting that the Village be liable for any damages before an agreement is made. Trustee buonanno moved that Counsel enter into an agreement with Mr. J?rank Capozza to hold him harmless in the event we utilize the lot for Village official cars only, seconded by Trustee McBride. Carri In connection with the MRD Program, Trustee Buonanno stated that General Electric was the lowest bidder and given the award. Trustee Buonanno stated that we are in receipt of a request from the Fire Chiefs and Council for a meeting to discuss mutual problems. A meeting was scheduled for December 12th. Trustee Buonanno stated that at a previous meeting, the Board discussed a preventive maintenance for fire apparatus with Excelsior Machine Works as per outline in their letter of October 31st, at a cost not to exceed $500, seconded by Trustee Galgano. Carried. In connection with the new Rescue Hose fire apparatus, Trustee Buonanno moved, seconded by Trustee McBride, on recommendation of Rescue Hose Fire Committee that he be authorized to sign the warranty for parts from Detroit Diesel and for the undercoating warranty from Rusty Jones Company. Carried. �^ .'£ -5PUBLIC WORKS Trustee Salman stated that the telephone pole which was installed in the middle of a crosswalk will be removed. Trustee Salman gave the following report: i j) |j V We are back on our normal water supply (Catskill Aqueduct) as scheduled. ;j r The old water service to the former treatment plant now the control ;: building has been cut off at the main on Hudson Street.. All fire hydrants: have been winterized. ; Trustee Salman moved, seconded by Trustee Buonanno that Richard Chulla be granted permission to attend a Grade IIB Water Treatment Plant school in White Plains December 3-7, at a cost of $200. Carried. Bank balance in the Water account is $5523. Continued loose leaf pickup with three vacuums. Residents are reminded that effective December 1, the requirement of placing leaves in containers will be reinstated. j:; !J \> I? j j, i'! i' Curb cuts were made as entrance and exit to Hudson Street parking lot. Lot is now being utilized. Replaced missing curb at south side of Gordon Avenue at Jenny Station and removed the damaged Cavalry pear tree on Beekman Avenue and blacktopped the area. V ', ' Trustee Salman stated that the department tried to clean the graffiti' on street light poles. The results were not very encouraging. He stated that anyone posting notices on the poles will have to remove •• them. i; ? ;1 Preparing Christmas trees for mounting on street light poles. i i\ Repaired leaf vacuum used with Chevrolet truck. Starter and repaired!;!, the spring system on #4 GMC. ;ii Tuned up water department #2 truck and sewer jet. Minor repairs to hoses exhaust system and cooling system to Fire Dept. cars 2313 and 2312, recreation truck and leaf blower and police cars 510 and 503. Trustee Salman moved, seconded by Trustee Buonanno that Otto Armstrong be appointed Sanitation Man at a salary of $18,000, less $500 or $17,^0 until he serves a six months probationary period, effective November 30, 1984. Carried. i'1! Trustee Salman stated that a disciplinary hearing was held at Village Hall and the decision was to suspend the sanitation man for thirty days. Trustee Buonanno moved, seconded by Trustee Galgano that Counsel be authorized to so notify the employee of his thirty day suspension, without pay, effective December 3, 1984. Carried. (K. Berry) i'. �-6Trustee Salman stated that he contacted Metro-North on a program called "Adopt Station Program" for the leasing of the station for a minimal fee so that we can spruce it up and improve the area. He sta that he has not received an answer from them as yet. RECREATION & HUMAN RESOURCES Trustee Galgano stated that since our present park foreman will be leaving, it will be necessary to replace him and so moved, secondedl by Trustee Buonanno that the Village Clerk be authorized to advertise for a park foreman at a salary of $14,500. Carried. Trustee Galgano stated that the roller skating trip held on November 17th was a success. The first annual foul shot contest which was held at McDonal 1!s parking lot November 24th was also a success, said Trustee Galgai . Trustee Galgano stated that an appointment has been scheduled win Dan DeLucia to discuss Urban County funds for our parks, after which a full report will be made. MAYOR'S REPORT: Deputy Mayor Timmings stated.that the Mayor is in receipt of a letter from the New York Power Authority regarding the recovery of some money in connection with gas and oil. Deputy Mayor Timmings stated that there will be one meeting in December, December 17th, the 110th anniversary of the Village, after which light refreshments will be served. Deputy Mayor Timmings stated that the Mayor is in receipt of a letter from the State Assembly requesting comments or ideas on industrj revenue bonds which will be referred to Counsel. Deputy Mayor Timmings stated that the Mayor received a report froi John Biros of projects completed in order to receive County grants. Deputy Mayor Timmings noted several letters sent to our legislate*] urging them to repeal the Wick's law. COMMUNICATIONS Acknowledgment of sympathy from the Wright family was read and fill Communication from Anthony Delmerico, 34 Lawrence Avenue, requestij the removal of a hazardous tree in front of his property was read and referred to public works and tree inspector. Communication from Sec'y. of Fire Council Richard Green that effective November 13, 1984, all Scott 2 Air Packs non-positive pressu^ will be taken off all apparatus due to safety standards set by OSHA was read and filed. Communication from Sec'y. of Fire Council, Richard Green, confirmil as of October 10, 1984, the changes in membership in Union, Columbia and] Pocantico H & L Companies, as well as an exempt certificate for Martin Yurkovic was read. �Ysf K >' f;? -7A resubmitted letter of 1982 from Mrs. G. Scappaticci, 59 College Avenue, requesting the removal of a tree which is causing sidewalk problems was read and referred to the public works and tree inspector for study. j UNFINISHED BUSINESS > i Trustee Galgano noted to the Board that three members of the Technical Review Board met with Board members to discuss space requirement lib * Trustee Buonanno moved, seconded by Trustee Galgano that the bills submitted on the General Fund and Water & Sewer warrants dated November 26 1984 be paid after approval of department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants.
