Present Philip E. Zegarelli, Mayor James J. Timmings Vincent Buonanno William McBride Frank Mangieri, Jr. Susan Galgano Steven Salman, Trustees Patricia Granfel, Counsel (sub. for R. Ponzini) Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. u Mayor Zegarelli announced that tonight is a special night. The Village is celebrating to the day, its 110th Anniversary. He stated that he invited various members of boards, commissions, etc. who serve, without pay, to attend the celebration. \< Trustee Buonanno moved, seconded by Trustee Timmings that the minutes of the meeting held on November 26, 1984 be approved. Carried, REPORTS OF COMMITTEES ADMINISTRATION Trustee McBride stated that every year at this time, people are given an opportunity to park for one hour, without charge; so in keeping with the holiday spirit, moved that plastic covers be placed over meters allowing one,hour free parking, seconded by Trustee Timmings. Carried. Trustee McBride reported that the much-awaited trophy case for Union Hose is in. Trustee McBride called for a meeting of his committee and Union Hose committee for January 3rd to discuss problems. Trustee McBride moved, seconded by Trustee Buonanno that Village offices be closed on Christmas Eve and New Year's eve at 12 noon. Carried. GOVERNMENTAL RELATIONS Trustee Mangieri reported that applications were received from the County to join the food surplus program. The application will be completed so that the distribution of cheese, etc. for seniors can be held at the Holy Cross hall, said Trustee Mangieri. This should end the long lines at the COC, said Trustee Mangieri. m �Trustee Mangieri stated that the Village received a donation of 800 tulip bulbs in honor of our 110th anniversary which were plantet in front of Village Hall and at Robertson Park. Trustee Mangieri stated that two work sessions have been held to discuss the Administrator position and moved that a public hearii be held on January 21, 1985, seconded by Trustee Timmings. Carried. MANAGEMENT & BUDGET Trustee Timmings stated that a seminar on computing was being held in Ossining tomorrow and moved that the Treasurer represent North Tarrytown, seconded by Trustee Buonanno. Carried. Trustee Timmings stated that the November fiscal reports are out today. Trustee Timmings stated that as a committee of the whole, the Board met with representatives of the police department to listen to four grievances that were filed. After hearing the grievances, the Board voted unanimously to object. PUBLIC SAFETY " Trustee Buonanno gave the'following police report for November: (in detail official minutes) Trustee Buonanno stated that the two newly appointed officers, John DiCairano and Jimmy Warren, have completed the Municipal Train:! Course. I Trustee Buonanno stated that Rescue Hose' new truck was tested for various aspects before it was placed into service and proven successful. He stated that there was equipment missing and Counsel drafted a letter to the manufacturer regarding same. Trustee Buonanno moved, seconded by Trustee Timmings that actio of Counsel be confirmed. Carried. Trustee Timmings stated that most people saw the article in the newspaper where he and Trustee Buonanno were the targets on the part of the police bargaining committee. He stated that his daughter was washing their car this afternoon and was given a ticket.. Although she was parked on the wrong side, several other cars on the street were not ticketed, he said. He stated that he personally feels that this is harrassment against him. PUBLIC WORKS Trustee Salman gave the following report: ' Routine cleaning of sanitary sewers with sewer jet in the Village proper and routine painting of hydrants in the Village pro] Repaired leaking hydrant on corner of Evergreen Way and Lakevie Made water tap for new house at 30 Continental Street. balance as of Dec. 17, 198A is $28,030. �Vt/ )', r K *."" -3Completed loose leaf pickup and are now on routine pickup of branches and leaves. Pickups are Mondays and Thursdays and must be at curb before 7:00 A.M. Sand barrels have been placed at strategic locations. Our supply of empty barrels has been seriously depleted. Parking meters have been changed over to dimes. Newly designed parking decals are expected in ten days. They have been redesigned, said Trustee Salman. Bradhurst Site Construction Corp. has completed the repair of the gabion wall along the Pocantico River at Dell Street. This is a flood damage reimbursement. Sand spreaders have been mounted on the old rack truck and Unimog. The Water Department pony motor on the sewer jet was tuned. tires were mounted on the ambulance and checked antifreeze. Snow & Replaced starter, fuel pump and thermostat on car 2313. Two tires were replaced on the Brockway, #4 GMC and old rack truck. V. Replaced universal on driveshaft of car 503 K-9. RECREATION-HUMAN RESOURCES Trustee Galgano moved, seconded by Trustee Timmings that Robert Volpacchio be paid his full salary, retro-active to Dec. 3, 1984 or $6.85 per hour. Carried. MAYOR'S REPORT: Mayor Zegarelli stated that he is in receipt of the Transportation Reimbursement Agreement between the County and the Village of North Tarrytown which has been approved by Counsel. fcs Trustee Timmings moved, seconded by Trustee Buonanno that the following resolution be adopted: RESOLVED, that the Mayor be authorized to execute the Westchester County Prisoner Transportation Reimbursement Agreement, effective January 1st through December 31, 1985. Carried. 111 ,k ;/ Mayor Zegarelli stated that a memo has been received from Counsel Ponzini regarding our local swimming pools regulations for review. COMMUNICATIONS Communication from John Vydareny, Recording Secretary of Rescue Hose Company, requesting the removal of a tree in front of their quarters.was read and referred to the tree inspector and public works committee. Communication from Richard Gross, Sec'y. of the Apparatus Comm Rescue Hose Company, notifying the Board of equipment received for t new fire apparatus was read and filed. Communication from Richard Gross, Sec'y. Apparatus Committee notifying the Board as to the results of the Underwriters Laboratory Tests on the new Rescue Hose fire apparatus was read and filed. Communication from Emilie Spaulding, Director Community/Goverra Relations, requesting in accordance with Section 595 of the Rules anc Regulations of the New York State Commission on Cable Television, a hearing for the adoption of the line extension policy was read. Mrs. Spaulding stated in her letter that the State directs that cable television service will not be denied potential subscribers eve if they live in an area with less than 35 homes per linear mile of aerial cable. Following a short discussion, Mayor Zegarelli moved, seconded t Trustee Timmings that a public hearing be held on January 28, 1985. Carried. UNFINISHED BUSINESS Trustee Timmings moved, seconded by Trustee Galgano that the following resolution be adopted: WHEREAS, in recent years the cost of tort liability for local government has increased dramatically, especially in New York State; WHEREAS, New York is one of only two states with unlimited liability exposure for local government entities; and WHEREAS, such unlimited liability has caused serious fiscal problems for local government budgets, which combined with reductions infederal assistance and volatile economic conditions, threatens the financial health of public treasuries and diverts limited tax dollars from the provision of essential services; and WHEREAS, the unpredictability of large damage awards and settlements is a constant threat to many of the State*s smaller jurisdictions which may simply not be able to afford a catastrophic los s; and WHEREAS, the State Legislature can take action to moderate loca government liability at no cost to the State; be it �W3 r -5RESOLVED, that the Village of North Tarrytown respectfully requests the New York State Legislature to pass, and the Governor to sign into law a bill for the purpose and effect of: 1. Amending the doctrine of joint and several liability to limit damages governmental defendants are required to pay to their equitable share of judgments; 2. Limiting recovery for non-economic losses (e.g. pain and suffering) to cases where significant injury is proven according to objective standards; 3. Establishing a resonable cap on recovery against governmental tort defendants or some other appropriate means of limiting local government liability; and be it further •« RESOLVED, that this Village urges the State Legislature to act favorably on the legislation currently pending before it, or a comparable alternative thereto, which would accomplish the afore-mentionet goals; and be it further RESOLVED, that this resolution be sent to Governor Cuomo and the members of the New York State Legislature. Tr i: ,J Trustee Buonanno moved, seconded by Trustee Salman that the bills submitted on the General Fund and Water & Sewer warrants dated Dec. 17, 1984 be paid after approval of department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Carried. There being no further business to come before the meeting, Trustee Salman moved, seconded by Trustee Timmings that the same be duly adjourned.
