January 28, 1985 A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present James J. Timmings, Deputy Mayor Vincent Buonanno William McBride Frank Mangieri, Jr. Susan Galgano Steven Salman, Trustees Robert J. Ponzini, Counsel Absent Philip Zegarelli, Mayor Deputy Mayor Timmings called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. 4 Trustee Buonanno moved, seconded by Trustee Salman that the minutes of the January 14th and 21st (special meeting) be approved as written. Carried. Clerk Fallacaro read the notice of hearing to consider a proposed resolution adopting a line extension policy in accordance with Section 595 of the rules and regulations of the N.Y.S. Commission on Cable Television pursuant to a State directive that cable television service will not be denied potential subscribers even if they live in an area with less than 35 homes per linear miles of aerial cable. Deputy Mayor Timmings asked if there was anyone present who would like to address the Board on said hearing. Deputy Mayor Timmings inquired of Counsel if the President's signature on new legislation pertaining to Cable TV has any impact on this particular hearing. Counsel stated that this hearing pertains only to a mandate to extend service to those people who do not have it, he said. This is something that the company is obligated to do and we have to comply with it. No other comments, Trustee Buonanno moved, seconded by Trustee Galgano that the hearing be closed. Carried. Deputy Mayor Timmings asked if there was anyone present who would like to address the Board on any other matter. Mr. Alexander Fudali, 123 Gordon Avenue, inquired if the issue regarding the Village Administrator will be put before the public so that the citizens will have a direct say or will the public views not be taken into consideration. He stated that it has been said that the Village Administrator position will be of no or very little cost due to the fact that the money will be used from the vacancy created by John Biros' retirement. He inquired if Mr. Biros submitted his resignation for retirement and if so when. ^W^S^*"" �r -2Deputy Mayor Timmings stated that he submitted a letter expressi his intention to retire, at no date. He stated that the Board has no set a firm decision on whether or not there would be a public referen on the issue. He stated that it was too late to place the matter 01 the ballot. To put the issue to a public referendum would solve either a special election or put it off until the November election, He stated that it was the feeling and majority of this Board that it would be a beneficial arrangement for the Village. If the majority of the Board shares the feeling, it is likely that the subject would voted by the Board rather than being placed" on public referendum, sai Deputy Mayor Timmings. REPORTS OF COMMITTEES ADMINISTRATION Trustee McBride reported that Union Hose complaints have been satisfied. A meeting will be held with Rescue Hose representatives on February 3rd to discuss their problems, ,said Trustee McBride. Trustee McBride moved, seconded by Trustee Galgano that Village offices be closed on Lincoln's Birthday, February 12th. Carried. Trustee McBride offered the following resolution, seconded by Trustee Buonanno: WHEREAS Almighty God has seen fit to take unto Himself the soul of the late Rita Galgano, and WHEREAS the said Rita Galgano was the Mother of Trustee Susan Galgano, and a resident of the Village of North Tarrytown for many years, having been held in the highest esteem by all those who knew i her, now, therefore, be it RESOLVED that the Board of Trustees take official notice of Rita Galgano's death, and be it further RESOLVED that this resolution be made a part of the official minutes of this meeting and a copy sent to the family of the deceased Carried. GOVERNMENTAL RELATIONS Trustee Mangieri reported "progress". MANAGEMENT & BUDGET Trustee Timmings reported a balance of $712.43 in the General Fund as of January 28, 1985. Trustee Timmings stated that he received the annual report of the State Comptroller whereby he noted budget expenses of several municipalities comparable to North Tarrytown. Trustee Timmings moved that the Treasurer be authorized to conta the Villages of Mt. Kisco, Rye Brook, No. Syracuse and Fanningdale to obtain a copy of their budgets to ascertain their expenses as compare with North Tarrytown's, seconded by Trustee Buonanno. Carried. n �,- 9ty nra r «*> •* -3PUBLIC SAFETY Trustee Buonanno stated that the committee reviewed the architectural plans for the former water department office to be used for the detectives and have recommended approval of same and moved that the plans as outlined be accepted, together with a camera to be installed in the lobby which will be monitored at the officer's desk, seconded by J Trustee McBride. Carried. Trustee Buonanno moved, seconded by Trustee McBride that the matter be turned over to the management and budget committee to ascertain the means of borrowing for the work, not to exceed $10,000. Carried. Trustee Buonanno stated that the Chairman of the police bargaining unit, the committee and Chief of Police have signed an agreement as to the official items which specifically constitutes a policeman's uniform and moved that the following items be declared as a policeman's uniform allowance: f/ Shoes (Black) Pants (seasonal) Hat Tie Shirts (seasonal) Jackets for each season Belt Glove s (winter) Gloves (dress) Leather attachments (such as baton holder, mace holder, bullet holdei Thermal underwear 1 Socks (dark blue or black) j I Motion carried. I K ", iv ii Trustee Buonanno stated that we are in the process of ordering new tickets and before doing so inquired as to the Board's views regarding the increase in meter fines. \ j I Trustee McBride stated that he was opposed to the increase when it was first adopted and is still opposed to it. He stated that $7 was an excessive amount. jj J j j ii Deputy Mayor Timmings stated that we would have to go through j the procedure of having a public hearing to repeal the law. He stated j that a public hearing was held and there was no negative comment on it. ( He stated that he would be in favor of leaving the law on the books and if it is objectionable, we would hear about it. ! Trustee Buonanno stated that Sgt. Booth has submitted recommendations! in utilizing the lot adjacent to the greenhouse on River Street for an ! impound lot. Following a short discussion, the matter was referred to the public works committee. <-«v*' /: �r -4Trustee Buonanno stated that the Youth Court of the Tarrytowns j is underway. He stated that the two chiefs of the Villages will meei to decide what kind of an agreement will be made. Deputy Mayor Timmings stated that the Mayor sent a letter to May< Barbella of Tarrytown regarding a combined and expanded Youth Court. Trustee Buonanno moved, seconded by Trustee Galgano that action of the Mayor be confirmed. Carried. Trustee Buonanno stated that the recently purchased Scott Air Pa4 for the fire department have to be repaired or rehabilitated, and mov^ that Chief Kosilla be authorized to take them to New Jersey to get th< work done and bring them back, seconded by Trustee Salman. Carried. PUBLIC WORKS Trustee Salman gave the following report: Replaced hydrant on Sleepy Hollow Road damaged by unknown motor ii during snow storm on January 17th. Repaired 8" water main break on River Street at Village line. Helped highway in plowing operation during snow storm on Jan. 171 Bank balance as of January 28th $30,905. Salted and plowed Village streets during snow storm on Jan. 17th seven pieces of equipment. Cleaned snow around catch basins and refilled sand barrels. Removed ice buildup on New Broadway near Route 9 and Hemlock Drii at Fremont. Added one length of 30" pipe to drainage system at our disposal area at Phelps Memorial Hospital. Kim Berry is out complaining of a knee injury. Compensation cas< Mechanic is still out on compensation due to a back injury. Ass: mechanic is working. Replaced clutch assembly in highway rack truck. Made minor repairs as required to keep equipment operable, parti< larly during cold spell of Monday and Tuesday, January 21 and 22. RECREATION Trustee Galgano stated that some 75 youths participated in the annual ice skating Olympics held at the Tarrytown Lakes on January 27 Trophies and hats were presented from Citibank to the winner of each group. <* �&£ r -5Winter/spring programs will begin this week. in some of the classes. There are openings Trustee Galgano moved, seconded by Trustee Mangieri that Pat Lofaro be granted permission to attend a seminar on recreation in Suffern on February 2nd, with expenses. Carried. MAYOR'S REPORT: Deputy Mayor Timmings stated that Mayor Zegarelli is in Albany addressing the legislature on the budget. He stated that our request for a parking authority has now reached a formal printing and is being submitted to the legislature. Senate Bill 1000, Assembly bill 1467. Deputy Mayor Timmings stated that a ballot was received from Perma Board of Directors regarding three candidates seeking re-election to the Board and that the Mayor sent in the ballot on behalf of the Village. Trustee Buonanno moved, seconded by Trustee Galgano that action of the Mayor be confirmed. Carried. Deputy Mayor Timmings acknowledged letters from Senator Flynn that new bills in which the Village would be interested must be re-introduced in 1985. Deputy Mayor Timmings acknowledged letter from Minority Leader, Manfred Ohrenstein regarding our support for the repeal of the Wick's Law. Deputy Mayor Timmings read a letter from Senator Flynn acknowledging our letter regarding legislation on Day Camps. Senator Flynn stated in his letter that there is a provision in the legislation allowing the State Commissioner of Health to waive any requirements of the Code which would cause undue hardship resulting in the closure of the camp. He also stated that the Commissioner is authorized to grant such waivers until December 31, 1985, upon the written request from an operator of a camp, such as the Village of North Tarrytown. He stated that he would be happy to follow up with both Commissioner Axelrod and with Senator Levy (sponsor) for appropriate legislation if needed. Deputy Mayor Timmings reported that the prisoner transportation reimbursement agreement has been received and will be forwarded to the police Chief. Deputy Mayor Timmings read a letter from County Executive O'Rourke regarding a "Police Emergency Mutual Air Program" in which he enclosed for the Board's review, an agreement for participation in the program. The matter will be referred to the public safety committee and Chief of Police, said Deputy Mayor Timmings. Deputy Mayor Timmings acknowledged receipt of the annual report of the Warner Library which indicates that North Tarrytown now has a 37.49% of the usage of the library. �-6Deputy Mayor Timmings acknowledged a letter from the Division of Equalization and Assessment pertaining to the filing of the Assessor' report. Deputy Mayor Timmings stated that the Mayor sent a letter to the D.O.T. regarding the timing of the newly installed light at Broadway and Depeyster Street which was only supposed to be working during sch hours. Trustee Galgano stated that the light works better all the time, since children have been going to the playground. Deputy Mayor Timmings stated that the Mayor sent a memo to vario department heads who operate Village-owned vehicles. He stated that would like the reports submitted to committee chairmen early in March to ascertain whether or not they will meet the requirements of the Federal Income Tax laws. COMMUNICATIONS Communication from Mrs. Rosemary Phillips, 138 Kelbourne Avenue, regarding County House Road whereby several accidents have occurred a the bend was read and referred to the public safety committee. Communication from Sec'y. Fire Council, Richard Green, regarding changes in membership in Columbia Hose Company and an exempt certific for Raymond Henshaw was read and on motion of Trustee Buonanno, secon by Trustee Salman action of Council was confirmed. The Clerk informed the Board that notice was received from S. Vieira, 40 Church Street, Tarrytown, who is requesting a variance on property located at 27 New Broadway in North Tarrytown. She stated that this is a requirement of our Zoning Ordinance to notify property owners within a 200 ft. radius. UNFINISHED BUSINESS * Trustee Salman stated that the Board discussed the possibility of obtaining an additional parking area at the Philipse Manor Station. There are two programs which the Board can undertake; i.e. "Adopt a Station" through matching funds for improvement of the present statio The committee is in the process of ascertaining how much is available and what type of construction we will be able to do. The other program would be the possibility of leasing property adjacent to the station for increased parking. A meeting will be scheduled within a week with Metro-North to ascertain what is availab In the meantime, they are requesting that the Mayor write a letter to the effect that the Village is interested in leasing the property. Trustee Salman moved, seconded by Trustee Buonanno that the Mayo be authorized to contact Metro-North for additional information regarding "Adopt a Station, seconded by Trustee Galgano. Carried. �% # r -7With regard to the old Village garage, Trustee Salman moved, seconded by Trustee Galgano that the Supt. of Public Works and Counsel Ponzini prepare the necessary specifications in connection with the demolition of the old Village garage and that bids be returned on February 25, 1985. Carried. With regard to the hearing on Cable TV, Trustee Buonanno moved, seconded by Trustee Salman that disposition of the matter be made at the next Board meeting. Carried. NEW BUSINESS Trustee Buonanno stated that there was a severe fire at 15 Holland Avenue over the weekend. The firemen were able to stop it in a timely manner. Deputy Mayor Timmings stated that the fire department always does an excellent job. Trustee Buonanno moved, seconded by Trustee Galgano that the bill of Fred Clark for Zoning Consultant services be paid in the amount of $4,575. Carried. Trustee Buonanno moved, seconded by Trustee Galgano that the bills submitted on the General Fund and Water & Sewer warrants dated Jan. 28, 1985 be paid after approval of department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Carried. There being no further business to come before the meeting, Trustee Salman moved, seconded by Trustee Galgano that the same be duly adjourned. Carried.
