May 13, 1985 / 6 v A regular meeting was held before the Board of Trustees of the Village of North Tarrytown, N.Y. on the above date. Present Philip E. Zegarelli, Mayor James J. Timmings Allen Williams Steven Salman Frank Mangieri, Jr. Susan Galgano Phillip Blecker, Trustees Robert J. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Timmings moved, seconded by Trustee Galgano that the minutes of the April 22nd meeting be approved with the following correction: Page 8 - New Business: Trustee Salman stated that he is in receipt of a communication from PMIA indicating that they are interested in ascertaining how the Coastal Zone Management program could be used to protect this waterfront property. It was discussed that a new building to house the new Metro North transformer was being slated for construction on the River side of Harwood Avenue. PMIA feels it should be placed between Philipse and Sleepy Hollow Manors, but Sleepy Hollow Manor Taxpayers Assoc, do not agree." Carried. Trustee Timmings moved, seconded by Trustee Galgano that the minutes of the meeting held on April 29, 1985 be approved. Carried. Mayor Zegarelli called for bids on the street light maintenance contract for the year June 1, 1985 - May 31, 1986. Treasurer Amato opened the following bid: Edward McCarthy, Andrews Lane, N. Tarrytown Check in the amount of $728 was enclosed. $7,280.00 Mayor Zegarelli moved, seconded by Trustee Galgano that the bid be referred to the police committee for review and recommendation. Carried Trustee Timmings moved to suspend the normal agenda, seconded by Trustee Williams. Carried. V �Mayor Zegarelli presented Joseph Finnegan with a Proclamation citing him for his many civic deeds, as well as being the former Village Historian for North Tarrytown and proclaimed May 13, 1985 as Joseph P. Finnegan's Day and wished both he and Mrs. Finnegan well. (Mr. & Mrs. Finnegan are now residents of Somers, N.Y.) Mr. Finnegan thanked the Mayor and Board for this honor. He said "You can take Joe Finnegan out of North Tarrytown, but you cannot take North Tarrytown out of Joe Finnegan". Mayor Zegarelli stated that through the County Executive, Mr. O'Rourke, he contacted the MTA and members of the PMIA and Philipse Manor Beach Club to meet with representatives at 5:00 P.M. this Wednesday at the station to discuss alternate sites for the power station. Through Trustees Salman, Williams and Blecker, alternate sites were proposed, as well as Village owned lands that MTA is willing to address for some additional parking needs as part of this overall project. Trustee Timmings stated that General Electric has been working on the voltage needs. The Village is on top of the matter, he said. Mr. Curtis Heath, Chairman of the Conservation Council, stated that it is quite objectionable not only in the proposal that the railroad is now making, but the alternate site further to the north plot of land near the yellow rocks. He stated that he feels that this is undesirable in the sense that it would obstruct the view and the noise element would be great. He stated that the transformer will emit almost as many as sixty decibles. Mayor Zegarelli stated that the Village must have sight as to how best it can fit into the environment and scheme. We will try to offer solutions and that we desire to have the decision-making process remain at the local level. Mr. Nicholas Robinson stated that if the MTA is as open as we believe it will be, we can probably come up with accomodations. They have not, to his knowledge, come to the Village. They are not going to do much • before fall, he said. He suggested that the Village should be in char J of Village-owned land usages. There is a powerful home rule law in the 1 Country which puts the local Village in charge of all Federal and State agencies. Mr. Robinson stated that when you adopt a plan for waterfront property pursuant to steps you have the benefit of/consistency clause. No Army Corps of Engineers, Federal and State agencies can take any action not consistent with the Village plan. He suggested a study group which would stabilize coastal usage. Mayor Zegarelli asked Mr. Robinson to provide an outline that can be incorporated into our advisory boards. Mr. Reggie Cardwell, 126 Valley Street, inquired as to when Friendshi Park was going to be dedicated in memory of Rev. Sykes. Mayor Zegarelli stated that he had met with County representatives and we are looking towards after Labor Day for this dedication. i �-3- 4" Mr. Cardwell suggested that the spaces at the Valley Street parking lot be numbered. The matter was referred to the police committee. REPORTS Of COMMITTEES ADMINISTRATION Trustee Blecker offered the following resolution, seconded by Trustee Galgano: WHEREAS Almighty God has seen fit to take unto Himself the soul of the late Louis Tonelli, and WHEREAS the said Louis Tonelli was a member of the Technical Service Review Board of North Tarrytown and resident of the Village of North Tarrytown for many years having been held in the highest esteem by all those who knew him, now, therefore, be it RESOLVED that this resolution be made a part of the official minutes of this meeting and a copy sent to the family of the deceased. Carried. Trustee Blecker reported progress on the computer aspect. He is reviewing some background and guidelines of some of the vendors. Trustee Blecker stated that he will review the provided by the Treasurer for bidding. Mayor Zegarelli stated that the money market has tightened up. GOVERNMENTAL RELATIONS Trustee Mangieri stated that he is in receipt of several resumes for Village Administrator position. Mayor Zegarelli appointed the following Administrator Screening Committee: Armando Galella William Andrews Vincent Buonanno Marjorie Remick Kay Gralla John Reiners Richard Herbek, Mgr. of Croton Gerry Faiella, Adm. of Tarrytown Lowell Tooley, Manager of Scarsdale Peggy Daly, Adm of Dobbs Ferry Trustee Timmings moved, seconded by Trustee Galgano that action of the Mayor be confirmed and that Counsel be authorized to advertise the ad in the chain newspapers. Carried. MANAGEMENT & BUDGET Trustee Timmings stated that the committee continues to meet with the Teamsters Union in trying to negotiate a new contract. Three meetings �-4have been held to date, he said. Trustee Timmings moved, seconded by Trustee Galgano that the committei be authorized to forward to Counsel a draft of the proposed changes in the contract language so that we may be able to make a commitment. On the question, Mayor Zegarelli inquired about the existing contract after which Trustee Timmings explained that the present contract in existence is between the CSEA and the Village. The Teamsters being a new member, we will have to revise the contract. Changes have to be made in the wording to reflect the change in representation, he said. Motion carried. * Trustee Timmings reported a balance in the General Fund and moved top confirm the action of the Treasurer in depositing c.d. notes in the Firs^ National Bank of North Tarrytown for thirty days at 7%%, seconded by Trustee Galgano. Carried. Trustee Timmings stated that we have a good chance of making a good year in the General Fund. Committees are being monitored. The water finance report is available for the month of April, said Trustee Timmings We are going to be under budgeted on income and expenses in this water account, he said. PUBLIC SAFETY On recommendation of the committee, Trustee Williams moved that the bid for rehabilitation and expansion work in the police department be awarded to Peter DiVito, Inc., of Eastchester, low bidder, whose bid was modified, seconded by Trustee Salman. Mayor Zegarelli polled the Board as follows: Trustee Timmings " Williams " Salman - Yes - Yes - Yes Mayor Zegarelli voted "Yes". Trustee Mangieri " Galgano " Blecker - Yes - No - Yes Motion carried. Trustee Williams stated that a referendum that occurred recently regarding an intoxicated prisoner has deemed it necessary to have a male jailer. He stated that this was mandated by the State. Following a discussion, Trustee Williams moved, on recommendation of the committee, that a male jailer be appointed on a part-time basis, seconded by Trustee Blecker. Counsel stated that the Chief assured him that the person would be trained. Mayor Zegarelli suggested that when an individual comes before the Judge in court as a result of being in jail, the cost of the jailer be added on to his fine. He stated that no financial remuneration comes back to the Village when we are doing the State a service. Following a discussion, Trustee Timmings amended the resolution authorizing the hiring of a jailer on a temporary basis until the subjed can be studied by the Board for permanent action, seconded by Trustee Galgano. �-5- <~(, Mayor Zegarelli polled the Board as follows: Trustee Timmings " Williams " Salman Carried. - Yes - No - Yes Trustee Mangier! " Galgano " Blecker - No - Yes - Yes Trustee Williams stated that General Motors employees have been parking at the west end of Beekman Avenue and have been taking spaces away from businesses. Trustee Williams moved, seconded by Trustee Salman that a public hearing be held on June 17, 1985 to extend meter parking on Beekman Avenue on the south side of Hudson Street, westerly, to the end of General Motors parking lot and on the north side, from the main office lobby of the General Motors Office Building, westerly, to the entrance of the General Motors Plant. Carried. Trustee Williams moved, seconded by Trustee Blecker that a public hearing be held on a proposed local law for 24 hr. alternate side parking on Rice Avenue, 7 days per week. Carried. Trustee Williams stated that the stop sign at the bottom of Gordon Avenue and Dell Street will be removed. There is no local ordinance for this site. Trustee Williams stated that it was recommended by the committee that residents using police dark house service be advised to notify police headquarters when they have returned from vacation. Trustee Williams commended Ptl. Schrank for responding with "Mike" in tracting down escapees in a recent jail break. Trustee Williams reported all apparatus in good working order. Rescue Hose new apparatus is being serviced by Excelsior under the warranty at no cost to the Village. Trustee Williams stated that Mr. Biros is in receipt of a letter from Con Edison advising the Village to remove all Village signs and fire alarm boxes from their poles and placed on new poles. The estimated cost for the work is $4200. Mayor Zegarelli stated that he met with Counsel to formulate a bid proposal to move the existing police call boxes and fire boxes from the old poles to the new poles. In the process, it was suggested that we cut back on the total number of call boxes and automatic boxes and maybe convert to a single unit that includes both. Trustee Williams stated that the ambulance responded to two calls and fires at the new State Rockefeller Park. Trustee Williams stated that the Chief received a check in the amount of $500 for the Youth Court from the Community Chest of the Tarrytowns and moved that the Treasurer be authorized to deposit the check in the General Fund earmarked for this purpose, seconded by Trustee Timmings. Carried. �-6- b PUBLIC WORKS Trustee Salman moved that effective, as soon as possible, that anyone using 1,200,000 cu. ft. of water be now billed monthly, seconded by Trustee Timmings. Carried. Trustee Salman moved, seconded by Trustee Galgano that the water rate be increased $1 from $6 - $7 per thousand cubic ft. commencing at the next billing, effective June 1st. He stated that this is the first time since February 1, 1982 that the rate was increased. Carried, Trustee Salman gave the following report: (In detail official minutes) Trustee Timmings suggested that with the water rate increase, we should have provision to bill the monthly people at the end of June so that they are meeting their proportion and so moved that these people paying on a monthly basis be billed at the new rate on the next monthly billing, seconded by Trustee Galgano. Carried. RECREATION Trustee Galgano stated that Thursday, April 25th was Arbor Day. Nortl Tarrytown was appointed "Tree City USA". We received a flag and signs. She stated that school children from St. Teresa's School took part in the ceremonies and the Mayor received a plaque from Mr. Herberger from the State Conservation Department. Although we did not receive newspaper coverage, the ceremony was successful, said Trustee Galgano. Trustee Galgano stated that the committee will be interviewing for Day Camp counsellors this Wednesday. The commission will hold a meeting to discuss new regulations, said Trustee Galgano. Trustee Galgano stated that applications for the recreation supervise position will be closed May 17th. Interviews will be held next week. Hopefully, we will have a recommendation by the next meeting, she said. MAYOR'S REPORT: Mayor Zegarelli moved that one meeting be held in June, June 17th, seconded by Trustee Williams. Carried. Mayor Zegarelli stated that the second annual Bed Race will be held in Port Chester. No one volunteered so Mayor Zegarelli stated that he will send a note to Mayor Iasillo of our regrets. Mayor Zegarelli stated that Counsel approved, as to form, the dog control contract with the SPCA for June 1, 1985-May 31, 1986. Trustee Timmings moved, seconded by Trustee Blecker that the Mayor be authorized to sign the contract. Carried. Trustee Timmings moved, seconded by Trustee Galgano that the Mayor be authorized to sign the inter-faith agreement drafted by the County concerning the future maintenance of the Rev. Sykes Park. Carried. �-1- H Mayor Zegarelli stated that we were allocated $110,000 from Urban County Block Grant. In further discussions, most of it was towards economic development whereby we will be able to attack existing problems. While the Mayor had hoped we would receive additional funds, he checked with Lawrence Salley in the County about the availability of monies from other programs in the economic development areas. The Mayor stated that on a case by case basis, several of the plans outlined in our Urban County Grant could be funding directly through existing and available funds that the County holds. Mayor Zegarelli stated that he is in receipt of a resolution endorsing NYCOM'S Tort Liability. New York State does not have updated limits on liability insurance. He stated that this has presented physical problems to local governments and he is presenting our case on May 16th. Trustee Timmings moved, seconded by Trustee Galgano that the Village endorse NYCOM'S position. Carried. Mayor Zega'relli stated that the County is putting together a journal which includes ads from respective Villages to entice people into their communities. He stated that he wrote a historical commentary on North Tarrytown. One-half page is $800 and a full page $1500. Mayor Zegarelli moved, seconded by Trustee Williams that a full page ad be placed in the journal in the amount of $1500. Carried. Mayor Zegarelli stated that Portuguese Club had requested permission to hold their Procession on May 11th and Trustee Timmings moved that action of the Mayor be confirmed, seconded by Trustee Galgano. Carried. Mayor Zegarelli stated that he is in receipt of a letter from County Executive O'Rourke announcing the declaration of a water emergency. COMMUNICATIONS Communication from James Lerario, 41 Kelbourne Avenue, regarding damage to his curbing and driveway by the street plow was read and referred to the public works committee. Communication from Charles Allen, 17 Pokahoe Drive, regarding the removal of a tree at the corner of his property was read and referred to the public works committee and tree inspector. Communication from Matteo Scarfi, Hudson Terrace, requesting sidewalk repairs was read and referred to the public works committee. Communication from James Vallo, 1 Holland Avenue, requesting the removal of a tree in front of his property for a driveway was read and referred to the public works committee. Communication from Thomas Curtin, President of Rescue Hose Company, requesting permission to erect a sign across Beekman Avenue, as well as two signs at the intersection of Beekman and Broadway announcing their Flea Market on June 8th was read. �vA -8- Trustee Titranings moved, seconded by Trustee Galgano that permission be granted. Carried. Communication from Thomas Duffy, Chairman of the Division of Alcohol beverage Control of New York, regarding amendments to Subdivision 2a of Section 64 and Section 109 of the Alcoholic Beverage Control Law requiring applicants for a license or who are renewing their licenses to notify the Clerk of the Village, Town, etc. was read. The notice is given so that the Municipality, if they desire, may express an opinion for or against granting of a license or renewal of a license. The Clerk informed the Board that a certified letter from Richard Ayres, Off Broadway Deli at 84 Beekman Avenue of his intention to renew his Grocery Beer License. UNFINISHED BUSINESS Trustee Williams reported that all impounded cars at the old Village Garage have been removed. NEW BUSINESS Mayor Zegarelli stated that we are still looking into the lighting in the area of historical sites in North Tarrytown. Trustees Mangieri and Williams, together with Ron Turnquist are still reviewing the matter. Mayor Zegarelli stated that if there are any outstanding bills which have yet to come in to so notify the Treasurer by May 22nd, since our fiscal year ends May 31st. Mayor Zegarelli moved, seconded by Trustee Galgano that the bills submitted on the General Fund and Water & Sewer warrants dated May 13, 19 be paid after approval of department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Carried. There being no further business to come before the meeting, Trustee Timmings moved, seconded by Trustee Galgano that the same be duly adjourned. Carried. Excavated and replaced curb shut off valve on lower Cortlandt St. Completed meter reading of second quarter of calendar year 1985. Completed billing approximately 60% of second quarter of calendar year 1985. Due to the drought restrictions imposed by the County, the regularly scheduled flushing ( hydrants will be eliminated this Spring, lance as of 5/13/85 $25,710. Highway Department Regular scheduled pick up of bags and containers of leaves and bundles of brush continues on Mondays and Thursdays. Residents are reminded to have these containers out prior to 7:00 AM on designated days. Filled "pot holes1' throughout the Village. Placed blacktop overlay on spalled and misaligned concrete slabs on Clinton St., Elm St. and Lawrence Ave. Sleepy Hollow Road from Webber Ave.to Village line had a high priority for repavement in the FAUS v State & County program. The state, however, determined that the road did not meet standards and was therefore eliminated from the program. The State Parks & Recreation also denied funding in spite of the fact that the road is adjacent to the now Rockefeller Park noting that the road is winding and narrow and they do not wish to encourage its use for customers to their park. We are therefore in the process of placing a blacktop overlay on the deteriorated sections of the road.
