June 17, 1985 v ' k A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present Philip E. Zegarelli, Mayor James J. Timmings Allen T. Williams Steven Salman Frank Mangieri, Jr. Susan Galgano Phillip E. Blecker, Trustees Robert J. Ponzini, Counsel Mayor" Zegarelli called for a moment of silence for the American hostages in Beirut. Trustee Salman moved, seconded by Trustee Blecker that the minutes of the meeting held on May 28, 1985 be approved as read. Carried. Trustee Galgano moved that the order of business be suspended for a brief period of time, seconded by Trustee Timmings. Carried. Mayor Zegarelli stated that it was his pleasure to swear in and issue certificates to members of the Youth Court. North Tarrytown has joined in following the lead of Tarrytown, said the Mayor, after which he swore in 26 members of the Tarrytowns Youth Court. Mayor Zegarelli called for bids on a 1966 international dump truck. No bids received, Mayor Zegarelli asked the Public Works Committee to dispose the vehicle. Mayor Zegarelli read the notice of hearing to consider the adoption of a proposed Local Law amending Section 57-38 - Schedule of Parking Meters to extend meters on Beekman Avenue on the north side from the main office lobby of the General Motors office building, westerly 420 ft. and on the south side, from Hudson Street, westerly 250 ft. and asked if there was anyone present who would like to address the Board. Mr. Steve Serina, Beekman Avenue, inquired as to what brought this about to extend the parking meters. Mayor Zegarelli stated that the Board received a request from a business man in the area. Mr. Serina stated that he operated a local tavern in the area for 15 years and never requested any parking meters. �-2Trustee Mangieri stated that workers from General Motors have been using the street for parking. Mr. Serina stated that employees from General Motors do not want to walk to their designated area. He stated that in the '60's parking was prohibited from 7 - 9 and does not know where 7-8 came in. He stated that there was no problem then. He suggested that instead of installing parking meters, the time limit should be changed from 7-8 to 7-9# Mr. Chris Juncker, Beekman Avenue, stated that he lives next to th tavern in question. He stated that there are 14 different families along the stretch and only 12 parking spaces to be left. There are ] more than 12 cars involved, he said. He stated that he does not thin parking spaces would be the answer and agreed that the time should be \ moved up. Mr. Joseph Schwer, 95 Beekman understanding that monies received go to parking. Every time you put space away from someone to park in Avenue, stated that it was his from the meters are supposed to in a meter, you take a parking front of his home, said Mr. Schwer. Mayor Zegarelli stated that meters were removed on Teresa Street to provide for five additional spaces. He stated that we have a grant to have our own parking authority. We are trying to provide for an independent parking authority where we can buy land and structures for parking, said the Mayor. Following a discussion, Trustee Timmings moved, seconded by Trustee Galgano that the hearing be closed. Mayor Zegarelli read the notice of hearing on a proposed Local Law restricting parking on the north side of Rice Avenue on Tuesday, Thursday and Saturday, from 8 A.M. to 8A.M. of the following day and on the south side of Rice Avenue on Monday, Wednesday, Friday and Sunday from 8 A.M. to 8 A.M. of the following day and asked if there was anyone present who would like to address the Board. Trustee Timmings referred to slides showing cars parked on both , sides of the street and parked illegally. He stated that the purpose of the change is for fire apparatus to have better access responding to fires in the neighborhood. Trustee Timmings quoted from the minutes of October 15, 1973 where it was said that alternate side parking would be impractical, fire apparatus was taken on a drill test. It was also difficult to get the stabilizer out, said Trustee Williams. The parking situation interferes with fire department operations, he said. Trustee Galgano inquired if other streets were taken into consideration which are just as narrow. Trustee Timmings stated that the Neighborhood Association did support the fire department recommendation. following a discussion, Mayor Zegarelli stated that the matter will be taken under advisement. Trustee Timmings moved, seconded by Trustee Blecker that the hearing be closed. Carried. Mayor' Zegarelli asked if there was anyone present who would like to address the Board. Mrs. Catherine Krolicki, Cedar Street, inquired as to what the Board is going to do about the situation in her area. Mrs. Krolicki stated that she has previously complained about the happenings occurring at 107 Cortlandt Street and the Clinton Street playground. Mayor Zegarelli stated that we have signed contracts to rehabilitate Friendship Park and once that is done, the Clinton Street playground will be closed. He stated that the playground has to be kept open until the other park is completed. We have been told by the County not to close the park. Chief Spota stated that the place (107 Cortlandt St.) was raided and an arrest was made. Mayor Zegarelli inquired that if the place was raided, why is it still functioning and was answered by Chief Spota that it is not supposed to be functioning. It is not a business. The matter is pending in court, said Chief Spota. Mayor Zegarelli advised the people present that they should be very significant to register a complaint. The department has to respond. If there are any code violations, we will go after them, said the Mayor, and summonses will be issued. Mrs. Margaret Kantowicz, Cedar Street, stated that when she had called the police for noise, they would answer the calls. After the police leave, the noise would continue, she said. Mrs. Annie May Lewis, Cedar Street, complained that cars are parked on the sidewalk and she was almost struck by one. An unidentified resident of Cedar Street complained about obscene language coming from the area. She stated that the police cannot control the people. She also stated that b-b guns are being fired at houses. �-4Following a discussion, Mayor Zegarelli suggested that the group air their complaints with the building inspector, Chief of Police and Village Attorney so that the property owner in question can be ordered to correct his violations. REPORTS OF COMMITTEES ADMINISTRATION Trustee Blecker stated that he will have a report at the next meeting. He stated that subsequent to the last Board meeting, he had been involved in a problem, but recently has balanced himself out of it. 4 nI GOVERNMENTAL RELATIONS / Trustee Mangieri stated that he is in receipt of 40 resumes for the position of Village Administrator and he will be calling a meeting. MANAGEMENT & BUDGET Trustee Tiinmings stated that the Treasurer has reported a cash balance at the close of business today and moved to confirm the action of the Treasurer in depositing c.d. notes in the First National Bank of North Tarrytown, seconded by Trustee Blecker. Carried. Trustee Timmings stated that we have had a number of complaints regarding the disposition of paychecks and moved that the Village establish one policy for the disposition of checks and the responsibility of investigating be referred to the management committee, seconded by Trustee Galgano. Carried. Regarding a dental plan recently requested by several non-union employees, Trustee Timmings moved, seconded by Trustee Galgano that ten non-union members be provided with a dental plan, GHI, cost to be borne by the Village. Carried. tj Trustee Timmings stated that he received a completed draft of j the Teamsters contract. This is supposedly to reflect the change from the CSEA to the Teamsters and moved that the draft be turned over to the Village Attorney for reading and consultation with the committee for update and approval, seconded by Trustee Galgano. Carrie PUBLIC SAFETY Trustee Williams moved that the Chief of Police be authorized to attend the N.Y.S. Chiefs of Police Training Conference in Buffalo from August ll-15th with expenses. Carried. Trustee Williams reported that the desk rehabilitation is moving along and the two interrogation rooms have been made sound-proo Trustee Williams reported that the ambulance corps response to calls has been fantastic. There are about 18 people responding to a call,he saidTrustee Williams moved, seconded by Trustee Timmings that the Mayor be authorized to sign the application for the Division for Youth grant in the amount of $3,046.00. PUBLIC WORKS Trustee Salman gave the following report: is; (see attached) RECREATION & HUMAN RESOURCES; Trustee Galgano reported that interviews were held for recreation supervisor and on recommendation of the committee and commission moved that Mary Coyne be appointed Recreation Supervisor on provisional basis until such time as she takes the Civil Service exam, at a salary of $22,500, less $500, for a six month probationary period, effective June 17, 1985. Carried. f, Trustee Timmings moved, seconded by Trustee Williams that the recreation department provide for a liaison between the Board and Village Officials' Association for the forthcoming picnic in the fall. Carried. MAYOR'S REPORT: Mayor Zegarelli noted a letter he sent to Mr. Aston, Metro-North regarding an alternate location for their power station. The letter reflects the Board's position and its concern for the people in the area. Mayor Zegarelli noted another letter to Mr. Aston requesting Metro-North to allocate $100,000 for rehabilitation work on the PhiUpse Manor station. i i Mayor Zegarelli noted a letter he sent to Mr. Blum, Department of Transportation regarding hazardous conditions on the Headless Horseman bridge. Mayor Zegarelli stated that we received grants for monies for rehabilitation work in Barnhart Park. He stated that Mr. Margotta attended the meeting in White Plains in regard to the Village's application and it was requested that an outline be presented of what the Village plans on doing at the park. ||j [m Mayor Zegarelli noted a letter from Mrs. Amenta regarding the status of her request on her property for tax abatement under Section 485b The matter was referred to Counsel. Mayor Zegarelli noted a letter from Dr. Szapur regarding the Open Door. He voiced his disapproval of the clinic. Trustee Timmings stated that the Board is in receipt of letters from local doctors expressing their disapproval of the clinic. Mayor Zegarelli stated that he will contact Mayor Caputo of Ossining to find out what reaction he had regarding the Open Door in Ossining. 1 �-6Trustee Salman stated that to the best of his recollection, when the Board was approached last year, Trustee Buonanno inquired of the representative of the Open Door, if they wanted any money from us and the Board was informed that they did not want any funds. Mayor Zegarelli stated that there are people who are interested in purchasing 79 College Avenue. He stated that some of the people living in the apartment should have first preference. An outside agency wants to purchase the building also, said the Mayor. The matter was referred to Trustee Mangieri's committee. Mayor Zegarelli noted letter from Assemblyman Sullivan regarding'] property tax reforms, as well as a letter from Senator Mary Goodhue ' who agrees with the Village regarding tax reform. I Mayor Zegarelli noted a letter from the Department of Environmental Conservation regarding our application for reimbursement funding. He stated that he will contact Curtis Heath. Mayor Zegarelli noted letter from Con Edison regarding cut-off of services at 52 College Avenue for non-payment of utility services. Mayor Zegarelli noted an additional restriction notice from the County Executive regarding the drought situation. Mayor Zegarelli stated that he received a call from Assemblyman Sullivan's office concerning North Tarrytown's Parking Authority. He stated that the bill will be passed by the Assembly, however, because of a minor point, another resolution must be adopted. Trustee Timmings moved, seconded by Trustee Salman that the Home Rule message be granted in favor of the North Tarrytown Parking Authorit and that a messenger be sent to Albany with the necessary papers. Carrie COMMUNICATIONS A Communication from Rev. Anthony Fagnani requesting permission to'] hold a bazaar on August 15, 16,17,18, 22, 23,24 and 25 was read. Trustee Timmings moved, seconded by Trustee Galgano that permissic be granted and that the police and fire chief be notified of same. Carried. Communication from Sec'y. of Fire Council Ron Biro regarding changes in personnel in Pocantico H & L and Rescue Hose Companies was read and on motion of the Mayor, seconded by Trustee Timmings that action of Council be confirmed. Carried. Communication from Ruth Effort, on behalf of the Shiloh Baptist Church, requesting the use of Friendship Park on June 22nd for a picnic was read and on motion of Trustee Timmings, seconded by Trustee Blecker permission was granted. It was stated that since part of the park is in the Village of Tarrytown, permission should be obtained from Tarrytown also. �-7- Af/ Communication from Mr. & Mrs. Edward Simnowski, 14 Anderson Avenue, regarding curbing in front of their residence was read and referred to the public works committee. Communication from Lucy Lee, 61 Hemlock Drive, requesting the removal of a dead tree in front of her property was read and referred to the public works committee and tree inspector. UNFINISHED BUSINESS Counsel stated that the police contract for June 1, 1983May 31, 1985 has been finalized for the Mayor's signature. Trustee Timmings moved, seconded by Trustee Blecker that the Mayor be authorized to sign same. Carried. Mayor 2Jegarelli stated that he sent a mailgram to the New Rochelle Water Company on behalf of the Village to repair the water main break on Route 9 (North Broadway and Beekman Avenue). A copy was sent to the County Executive, he said. Trustee Timmings moved to confirm action of the Mayor, seconded by Trustee Galgano. Carried. NEW BUSINESS Trustee Timmings stated that he attended the executive meeting of the Village Officials Association and voted North Tarrytown's position which is in favor of the Westchester Village Officials proposal on the County sales tax. Mayor Zegarelli moved to confirm action of the Deputy Mayor regarding the sales tax, seconded by Trustee Galgano Carried. Trustee Timmings questioned the Day Camp registration number of out-of-town residents attending, mainly from Tarrytown. He stated that we are subsidizing their recreation programs. We have always contributed to their programs, he said. Trustee Timmings stated that he would like to see a revision of the agreements in North Tarrytown's favor. Mayor Zegarelli stated that we will have another meeting with Tarrytown to discuss this and other matters. With regard to the hearing on additional parking meters, Trustee Galgano moved, seconded by Trustee Timmings that the following Local Law #3 of 1985 amending Section 57-38 - Schedule of Parking Meter Zones - be adopted: Zone 1. Beekman Avenue: South side: d. From Hudson Street, westerly, One Hundred Sixty Feet (160 ft.). law. This Local Law shall take effect within the time prescribed by Carried. �-8On recommendation of the Village Prosecutor, Trustee Blecker moved, seconded by Trustee Timming that a public hearing be held on July 15, 1985 to amend the General Code pertaining to "Heating of Buildings, Paragraph 11-5 - Penalties and Housing Standards-Chapter 30-5 Violations and Penalties, for a fine not to exceed $250. Carried. Trustee Blecker stated that there is an over abundance of shrubs obstructing the view of drivers in the Manor. Counsel stated that the Association should give the building inspector a list of property owners and he will send a notice to correct the condition. Trustee Blecker stated that after the dredging of Fremont Pond, j we are getting a buildup in the outgoing pipes and inquired if the ( Association pays for the cleaning or the Village. Counsel answered, "The Association". Trustee Blecker stated that now that summer is here, there is an increase amount of dragging and speeding and the Association is considering speed bumps. They would like to know the pros and cons of the Village. Counsel pointed out the safety hazards and has received opinions from the Westchester County Dept. of Transportation. Mayor Zegarelli stated that it would also create a supreme potential for liability. Trustee Salman stated that these speed bumps would wreck our plows and there would be drainage problems. Mayor Zegaarelli stated that he received a petition from residents of 1 Riverside Drive against any proposed alternate side parking north of the Palmer Avenue bridge. Mayor Zegarelli noted a letter from the County requesting the designation of houses in the Village as landmarks. 1 Trustee Timmings moved, seconded by Trustee Galgano that action of the Mayor regarding negotiations with Frank Capozza for parking of Village and employee vehicles on their property on Beekman Avenue be confirmed. Carried. Trustee Blecker moved, seconded by Trustee Timmings that the bills submitted on the General Fund and Water & Sewer warrants dated June 17, 1985 be paid after approval of department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attache to the warrants. Carried. There being no further business to come before the meeting, Trustee Timmings moved, seconded by Trustee Blecker that the same be adjourned.
