July 15th, 1985 A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. PRESENT Philip E. Zegarelli, Mayor James J. Timmings, Allen T. Williams, Susan Galgano, Phillip E. Blecker, Trustees Steven Salman, Trustee * ABSENT arrived late Robert Ponzini, Counsel Frank Mangieri, Trustee Mayor Zegarelli called the Public Hearing to order at 8 P.M. Trustee Galgano moved, seconded by Trustee Williams that the minutes of the meeting held on June 17, 1985 be approved as read, Carried. Mayor Zegarelli read the Notice of Hearing to amend the General Code of the Village of North Tarrytown as follows: Chapter 11 - Heating of Buildings - Paragraph 11-5 "Penalty for any violation of this Local Law shall be up to $250.00 per unit per day that the violation shall continue". Furthermore, violators of this Local Law shall be deemed disorderly persons pursuant to the Penal Code of the State of New York and the appropriate sanctions therein shall apply. Housing Standards - Chapter 30-56 - Violations and Penalties: For any and every violation of the provisions of this code...be subject to a fine not to exceed $250.00. Furthermore, violators of this Local Law shall be deemed disorderly persons pursuant to the Penal Code of the State of New York and the appropriate sanctions therein shall apply. Mayor Zegarelli asked if there was anyone present who would like to speak. Robert Peirce, Village Prosecutor stated that several months ago, on behalf of the Village he prosecuted a case where a landlord of an apartment building did not have heat for three days and was only fined $25.00. It was so cold in the apartment that there was ice on the inside of the window. He felt that the village should be in a position to invoke stricter penalties in cases where the law was being abused. He strongly urged the village to pass the local law. �-2- / There being no one else to speak on the subject Trustee Timmings moved, seconded by Trustee Galgano that the matter be referred to the Administration Committee. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board. Carmen Capossela, 100 Rice Avenue stated that several houses were being built in his area and that parking areas were being constructed for the new houses and houses already there. It seems some of the lots will be parking lots and stated he felt this was against the Zoning Ordinance. He stated this was a residential area and he didn't want to look out his window at parking lots. He questioned whether the contractor was conforming to the codes. Mr. Margotta, Building Inspector stated that the house across from Mr. Capossela was making a parking area for two cars and there is a two car garage in use now. The parking area is along side of his house and he is conforming to the code. Mr. Capossela stated that the new house is on a very dangerous bend between Rice Avenue and Broadway (Route 9) and it creates a hazard and he did not feel that they should be allowed to put in more driveways. REPORTS OF COMMITTEES ADMINISTRATION Trustee Blecker moved, that he be authorized to contact Mr. Ronald Turnquist, Architect concerning the renovation of the third floor of the municipal building into office space for offices temporarily housed elsewhere. Seconded by Trustee Timmings. Carried. Trustee Blecker reported that he had received numerous inquiries from various computer companies who are interested in submitting proposals to the Village and he will be setting up appointments to meet with them. Trustee Blecker reported that a contract between 21 Beekman Avenue Corp. (Capozza) and the Village, leasing the property known as 21 Beekman Avenue has been received by the Village and is acceptable. Trustee Blecker moved, seconded by Trustee Timmings that the Mayor be authorized to sign the contract, rental to be $180.00 per month and parking to be for village owned vehicles and village employees. Carried. He also stated that all employees will be issued parking stickers without charge. GOVERNMENTAL RELATIONS Mayor Zegarelli stated that Trustee Mangier! was on vacation. Mayor Zegarelli reported that the Village has received many resumes for the position of Administrator. The resumes have been turned over to the screening committee who will provide a rating system. The rating system will be broken down into three categories and candidates will be invited for interviews prior to a final decision. The screening committee will meet with the Board to review all candidates. Mayor �-3- X' Zegarelli stated if there was anyone still Interested in applying they may send their resume to him. The village will try to keep to its original schedule of Labor Day for the hiring of the Administrator. MANAGEMENT & BUDGET Trustee Timmings reported a cash balance in the General Fund as of July 15, 1985 of $437,459.57. Trustee Timmings reported that the Village has received a Grant for $2,816.00 from the County of Westchester under Title III-B of the Older Americans Act for the year July 1st, 1984 thru June 30th, 1985, which the Treasurer had applied for. Trustee Timmings reported that the Treasurer had three Certificates of Deposits with the First National Bank of North Tarrytown and moved that the action of the Treasurer be confirmed. Carried. Trustee Timmings moved, seconded by Trustee Galgano that permission be granted to the Village Attorney to represent the Village in matters of land acquisition and disposal of excess properties. Carried. Trustee Timmings moved, seconded by Trustee Galgano that Counsel be authorized to contact the Teamster's Attorney informing them that the Village is preparing its documents in preparation of negotiations and suggested an August 5th meeting. Carried. Trustee Timmings reported that a request had been received from the owners of Section 16 Block 7 Lots 6, 7, and 8 for assessment reduction, which request had been denied by the Board of Assessment Review. (Amenta Property) Trustee Timmings moved, seconded by Trustee Galgano that the owners of the property be covered under the terms granting 50% reduction in assessment for new construction as passed by the Village in 1977. Carried. Trustee Timmings moved, seconded by Trustee Williams that the position of Court Interpreter be established at the rate of $7.00 per hour effective June 1st, 1985. Carried. Trustee Timmings stated that the employee acting as a clerk in the Police Department also acts as interpreter to the court when needed. PUBLIC SAFETY Trustee Williams reported that the construction in the desk area of Police Headquarters is progressing smoothly and stated that painting has been completed and they are preparing to knock down a wall. Trustee Williams moved, seconded by Trustee Blecker that the Village advertise for a 1985 mid-size car for the use of the Chief of Police, bids to be returnable September 16th, Carried. Trustee Williams reported that the new car would replace car #510 presently used by the Chief which will be assigned to the �-4- h*t Youth Officer for his use. i» Trustee Williams reported that the Public Safety Committee along with Sgt. Booth will meet with representatives of A . T . & T. to discuss the new computer system to be installed in Police Headquarters and to be connected countywide. .f'l Trustee Williams reported that Patrolman John DiCairano has successfully completed one year probationary period and moved that he be appointed to permanent status. Seconded by Trustee Timmings motion carried. Trustee Williams reported that Patrolman Jimmy Warren Jr. had successfully completed one year probationary period and moved that he be appointed to permanent status. Seconded by Trustee Timmings motion carried. Trustee Williams reported he had received a letter from Jerry Garafolo, owner of Uncle Jerry's Deli, commending Fire Chief Biro who acted heroically in saving a man who had driven across Route 9 and Pocantico Street into the lake at the Sleepy Hollow Restorations. Chief Biro had acted beyond the course of his duty and without regard to his own safety and should be commended. Trustee Williams moved, seconded by Trustee Blecker that Fire Chief Biro be commended for his heroic act and that a copy of the letter be placed in his personnel file and a copy sent to the Board of Fire Wardens. Carried. ;l FIRE Trustee Williams reported that Rescue Hose apparatus has been accepted and all adjustments have been completed and moved, seconded by Trustee Blecker that the $5,000. withheld to insure conformance be paid to Tyler Apparatus. Carried. Trustee Williams reported that the Armstrong Floor Covering Corp. of Lancaster, Penna. had purchased the old Rescue Hose apparatus. 3 J ! Trustee Williams reported that the Fire Inspector severe inspecting various sites in the Village and will be submitting their recommendations ' to the Village Building Inspector. Trustee Williams reported that situations have arisen where Fire Department memberslplaying softball were not covered if they were injured and moved, seconded by Trustee Blecker that the Village sanction the fire department softball team and that they be covered by the Village insurance program. Carried. J ( "t f 1 Trustee Williams reported that sometime ago the Mayor had | written to the Exxon Corp. regarding the use of the building owned by f Exxon and located on Broadway (Route 9) . The Mayor had requested that \ Exxon donate the building to the Village for use as an Ambulance Building. ', At the time the Ambulance Corps, was not in favor of the site but after >, consideration feel that the site would be ideal and asked that the Village proceed to attempt to acquire same from Exxon. V �-5PUBLIC WORKS Mayor Zegarelli stated that Trustee Salman was attending a service for the late Mrs. Friou and would be arriving late. REACREATION & PARKS Trustee Galgano stated that the Village of Croton-on-Hudson had challenged the Village of North Tarrytown Officials and employees to a softball game to be held at Croton on Thursday, July 25th, 1985 at 6 P.M. and moved that the Mayor and Board of Trustees and Heads of Department and employees be authorized to attend and participate. Seconded by Trustee Blecker motion carried. IE1 Mayor Zegarelli stated that many people had applied for their children to attend "Tot Camp". They had been accepted but did not live in the Village of North Tarrytown or the school district. They had to be denied. He requested permission to send letters to all those families who were involved explaining why they were not eligible. Trustee Timmings moved, seconded by Trustee Galgano that the Mayor be authorized to send letters to those parent whose children were unable to attend our "Tot Camp" due to non-residence. Carried. :» MAYOR'S REPORT Mayor Zegarelli reported that the State Assembly, House and Governor had approved closed political caucuses giving majority parties the right to conduct public business in private and stated that he felt this action was in direct violation of the state's open meetings law and that the village has always complied with the law. ' jij J i Mayor Zegarelli moved that the Village of North Tarrytown abide by the outline under the original open meetings law, seconded by Trustee Blecker. Carried. Mayor Zegarelli stated that the Board feels that they should convey to the residents of the Village their feelings and allow all residents to speak and give information when requested, and directed that letters be sent to the Governor and the New York State Conference of Mayors noting the Village's position on the open meetings law. Mayor Zegarelli reported that he had sent a letter to Larry Salley regarding a followup meeting with the Economic Advisory Council asking for additional funds for work the village intends to do from Broadway, down Chestnut Street to Valley Street. Mayor Zegarelli reported that he and John Biros had attended a meeting in White Plains with various officials of other villages and county officials regarding the Pocantico River basin and Hudson River waterfront. He reported that he had written a letter to Urban County requesting additional block grant funding in order to conduct a study. There would be six villages involved and would cost each village approximately $14,000. Trustee Timmings moved, seconded by Trustee Blecker that the Mayor be authorized to send a letter to the County to seek funds ^e n i '< n, 'i m* F t. •' �-6- /•'•< for a study regarding the Pocantico River basin and Hudson River waterfront. Carried. Mayor Zegarelli reported that all members of the Board had received a memo from Counsel Ponzini regarding the Local Bridge Program , N.Y.S. Transportation Bond Act contracts that were prepared by Westchester County. Counsel Ponzini reported that the contracts were correct with respect to legality and form. Trustee Timmings moved, seconded by Trustee Blecker that the Mayor be authorized to execute the agreement and a copy of resolutio be certified and attached to the contract. Carried. Mayor Zegarelli reported that the bill creating the North Tarrytown Parking Authority was passed by both houses of the State Legislature and is being presented to the Governor for his signature and should be signed momentarily. Mayor Zegarelli reported that there were two vacancies on the Technical Services Board. One vacancy is for a P.E. and one for C.E. for five year terms. Mayor Zegarelli stated that he had appointed Jerome Fine of Philipse Manor to the vacancy of C.E. for a term of five years. Trustee Timmings moved, seconded by Trustee Blecker that action of the Mayor be confirmed. Carried. Mayor Zegarelli reported that he had received a letter from the M.T.A. thanking him for his part in the successful selection of a parcel of land for the new sub-station. Mayor Zegarelli stated that all those concerned were satisfied with the selection. Trustee Williams stated that Mayor Zegarelli should be recognized for his efforts in helping to obtain a site agreeable to all those parties involved. The Mayor had spent many hours in meeting with all groups involved and was instrumental in the final agreement. Trustee Williams moved, seconded by Trustee Timmings that the M.T.A. be granted permission to use village property to transport construction equipment and materials to the construction site. Carried. Mayor Zegarelli read a letter from John Biros, Supt. of Public Works stating that he planned to retire effective February 28, 1986 and that he would be using unused vacation and accumulated sick time for the period October 1st, 1985 to February 28, 1986 and is to continued on the payroll with all rights and benefits until February 28, 1986. Trustee Timmings moved, seconded by Trustee Galgano that the board approve Mr. Biros' plan for retirement effective February 28, 1986. Carried. �-7Nayor Zegarelli stated that the village offers it6 thanks and best wishes for many years of service to our community and looks forward to his working during the overlapping period when the Village Administrator comes on board. Mayor Zegarelli stated that he had received verbal requests from Resc H u m Rescue Hose and Union Hose fire companies regarding repair of the sidewalks in front of their respective buildings* due to damage during the last winter and referred the matter to the Administration Committee. •[ * io 'i II i Mayor Zegarelli stated that he would be meeting with Congressman DioGuardi on July 29th, at 10 A.M. at the County Office Building in White Plains regarding various matters, and invited any member of the Board to attend. COMMUNICATIONS Communication from Maureen Barbelet, who managed the YOUTH Employment Service for the Village informing the Board that she had accepted a position with the Tarrytown Day Camp, and was resigning effective July 5th, 1985 was read and upon motion duly made and seconded was accepted with regret. Carried. '.lit Communication from Angelo Verdi, 2 Farrington Avenue regarding a tree in front of his property was read and upon motion duly made and seconded was referred to the Tree Committee. Carried. ;i !J Communication from Mrs. Willard Nelson, 2 Harwood Avenue regarding a tree in front of her property was read and upon motion duly made and seconded was referred to the Tree Committee. K e Mli'sli The Clerk notified the Board that she had received a Notice from Paul Richmond, Attorney for Grace Cresswell owner of 48 College Avenue, regarding the condition of the property at the rear of her property which has created a water problem and a nuisance, was upon motion duly made and seconded ordered filed. Carried. The Clerk notified the Board that she had received notification from the New York State Liquor Authority that the following establishments had renewed their liquor licenses: Toyos Grocery Corp. at 173 Beekman Avenue, R. & Q. Grocery Store, Inc. at 68 Beekman Avenue. i'l It .'! Furthermore, violators of this Local Law shall be deemed disorderly persons pursuant to the Penal Code of the State of New York and the appropriate sanctions therein shall apply. Carmen Capossela stated that Rescue Hose Company would like permission to have a Flea Market sometime in September due to the fact the previously scheduled one was rained out. Trustee Timmings moved, seconded by Trustee Galgano that permission be granted Carr ied . PUBLIC WORKS Trustee Salman gave the following Public Works report: (See Attached) Trustee Salman moved, seconded by Trustee Timmings that the permanent appointment of Otto Armstrong be postponed until the August meeting. Carried. Trustee Salman reported that he had received reports from Gus Paese, Consulting Engineer. One report was on the drainage system from Route 9 down Chestnut Street to Valley Street and the other a report on the condition of the Hudson Street Parking Lot. Trustee Timmings moved, seconded by Trustee Galgano that the bills submitted on the General Fund and Water & Sewer warrants dated July 15th, 1985 be paid after approval of Department Heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants.
