August 12, 1985 s lf L f A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present Philip E. Zegarelli, Mayor James J. Timmings Allen Williams Frank Mangieri, Jr. Susan Galgano Phillip E. Blecker, Trustees Robert J. Ponzini, Counsel Absent Steven Salman, Trustee Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Mayor Zegarelli stated that the minutes of the meeting of July 15, 1985 were just distributed and will be taken up at the next Board meeting. Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time. Mr. Alexander Fudali, 127 Gordon Avenue, inquired about the Mallory situation and how the Board discovered the matter. Mayor Zegarelli stated that samples have been taken and formal analysis have not been made available to him, as yet. He stated that through his own investigation, we suspected that something was wrong when the potential buyer of the plant requested a hold harmless clause in the contract for sale, after which Duracell informed him (the Mayor) that they were going to do some analysis. The preliminary findings were related to him, said the Mayor, by Duracell and they stated that mercury had been dumped on the site up to about 25 years' ago, that the building would have to be cleaned inside and out, that it would take approximately seven weeks to clean up the site, including the possible excavation of existing mercury contaminated soil and the replacement with clean dirt. Mr. Fudali inquired as to why did the Village wait as long as it did to go after these findings. Mayor Zegarelli stated that primarily, the people of North Tarrytown's health and safety were of the utmost concern. We were not going to wait for the company to come up with the data. We called in the State, County and Federal government in the meantime to do our own testing. He stated that he does not think anyone acted any quicker on this issue and in particular, we did not want to create needless panic by not having enough information. The Village acted properly in all aspects of this issue. �-2- l\ </t Mr. Fudali stated that this might have occurred in 1960, why do we wait 25 years before there is some sort of investigation. Mayor Zegarelli stated that another administration was in office at the time. He stated that he was twelve years' old, 25 years' ago. He stated people should point with pride at the Mayor and Trustees for their quick action. i fi Trustee Timmings stated that with the comments he heard, this was not a love canal which posed a serious potential danger to the neighborhood before anyone became aware of the potential danger. The Mayor was alerted to recognize/t?fte clearance documents that there might be something wrong. He has protected the people of North Tarrytown where a conaition existed for some 20-25 years. His action caused the proper agency to become involved in this before there was any serious impact on the people of North Tarrytown. Trustee Mangieri stated that we tried to obtain information from the company. We do not know what is underground. We want to know what they dumped in there and how much, he said. This was our only means of forcing them. 1 * hayor Zegarelli stated that we found it and uncovered the matter within three weeks. We are working with the Federal government, as well as seeking our own Environmental Council Duracell since has admitted publicly that there was mercury there and that they will have to clean up the site. We called the State, County and federal government in the meantime to do our own testing. III REPORTS Of COMMITTEES ADMINISTRATION Trustee Blecker stated that the September 16th meeting falls on High Holy days and moved that the September meeting be held on Wednesday, September 18th, instead, seconded by Trustee Timmings. Carried. w! I Trustee Blecker stated that he has received and heard growing concern about the speed limits within the Village, especially in the summer time. re , : :CM} following a discussion, Trustee Blecker moved, seconded by Trustee Timmings that a public hearing be held on September 18th, 1985, at 7:30 P.M. to obtain views and opinions on speed limits within the Village. Carried. GOVERNMENTAL RELATIONS I Trustee Mangieri stated that the Administrator Committee is down to fifteen candidates, after which five will meet with the Board some time before the end of the month. MANAGEMENT & BUDGET Trustee Timmings stated that he would like to review, with the 11 I'J ! �I t Russo and moved that a copy of the letter be placed in Ptl. Biro's folder, seconded by Trustee Timmings. Carried. Trustee Timmings moved, seconded by Trustee Williams that a copy of the letter be also sent to fire Council. Carried. Trustee Williams stated that the fire inspectors are making inspections. Chief Ferguson, present in the audience, stated that the inspectors have found several apartments in basements of homes which have been referred to the building inspector. Mayor Zegarelli stated that the Village is "cracking" down on these types of violations. RECREATION Trustee Galgano stated that the department has been experiencing difficulty with the lawn mower and during a discussion at a work session, the committee agreed to go to State purchasing for a new one. Trustee Timmings moved the authorization of a capital note not to exceed $4,000 to cover the cost of a new lawn mower at State price, seconded by Trustee Galgano. Carried. Trustee Galgano moved, seconded by Trustee Timmings that the committee be authorized to purchase a lawn mower through the State purchasing agency not to exceed $4,000. Carried. MAYOR'S REPORT: Mayor Zegarelli stated that he is in receipt of a letter from the American Automobile Association that North Tarrytown will receive an award on September 18th and has asked members to notify him as to who will attend. Mayor Zegarelli stated that he has been notified by the Westchester County Division of Housing & Development that the Villages of Tarrytown and North Tarrytown have been selected to receive revitalization funds for their Main Street project and revitalization of North Tarrytown's pilot project (Beekman Avenue). Trustee Timmings moved to confirm action of the Board in authorizing coverage by the National Union Fire Insurance Company effective July 30, 1985, seconded by Trustee Galgano. Carried. Mayor Zegarelli stated that we are in receipt of a $2000 grant from the Office of the Aging. Mayor Zegarelli stated that he is in receipt of a letter from County Legislator Pirro on proposed legislation concerning the sale of spray paint to minors. The matter was referred to the public safety committee. �Mayor Zegarelli stated that he is in receipt of a letter from the Department of Transportation regarding 448, that the condition of the road (right turning lane) was their problem and they will repair the road. Mayor Zegarelli moved, seconded by Trustee Timmings that a public hearing be held on October 28, 1985 to amend the existing peddling local law. Carried. Trustee Mangieri moved, seconded by Trustee Galgano that the application for recertification of North Tarrytown as Tree City, USA be referred to the recreation committee for completion. Carried. Mayor Zegarelli stated that he is in receipt of a letter from Michael Dwyer, President, AOH requesting permission to erect a sign at the triangle on Beekman Avenue and Broadway to mark Irish Heritage Day festival at Kingsland Point park on August 25th and moved that permission be granted provided that the organization meets with all regulations through the police department, seconded by Trustee Timmings. Carried. COMMUNICATIONS Communication from John & Grace Malandrino, 104 Gordon Avenue, requesting the removal of a tree from the side of their property was read. The Board confirmed action of the Clerk who stated that the letter was forwarded to the Tree Inspector previously. Communication from Dr. Murray Roberts, 217 Highland Avenue, regarding the removal of a tree was read. Communication from John Murphy, Chairman, fireworks of the Tarrytowners and Proud Of It, thanking the Board for its contribution towards the fireworks on July 4th was read and filed. Communication from Louis Tallarini, Managing Agent, for 1 Riverside Drive, requesting the trimming of trees in front of the property was read and referred to the public works committee. UNFINISHED BUSINESS Mayor Zegarelli noted an unsigned letter from "Concerned Parents" regarding the property at 141-143 Hunter Avenue. jTfrf. letter complained about heavy equipment being stored in the yard/cr^atSSf6^. dangerous situation. Mayor Zegarelli stated that the building inspector issued a violation order to the owner and a follow-up will be made within the prescribed time. �Report of Public Works August 12, 1985 Water b Sever Dcpt. Jacobsen, ' Mayor Zegarelli stated that the Village would hire an outside engineer to answer questions of fact and to provide assistance in the problems that may result to sanitary and storm sewers. The subdivision is being heavijy opposed to by residents. In particular, the Village will hire its own engineer after engineers for both parties have reviewed their findings and discussed points of agreement and disagreements . y Mayor Zegarelli moved to confirm action of the Board to hire an outside engineer as necessary, seconded by Trustee Timmings. Carried. Mayor Zegarelli stated that the Board is invited to attend the fire inspections exercises on September 7th commencing at 5 P.M. Referring to the letter from "Concerned Parents", Trustee Blecker stated that it is too bad that people do not sign their names. The Village cannot answer them as to what action we have taken, he said Mayor Zegarelli suggested that he write to Patty Neuwirth, President of the Philipse Manor Improvement Association, to notify residents in their newsletter to identify themselves whenever they have a complaint. NEW BUSINESS Mayor Zegarelli stated that at the work session of the Board, he was authorized to write to the New Rochelle Water Company to investigate the legal method of purchasing water and land as an alternative site for water. This would be a secondary source of water, said the Mayor. Trustee Blecker moved, seconded by Trustee Galgano that the bills submitted on the General Fund and Water & Sewer warrants dated August 12, 1985 be paid after approval of department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Carried. No further business to come before the meeting, Trustee Williams moved, seconded by Trustee Timmings that the same be duly adjourned.
