Zegarelli, Mayor James J. Timmings Allen T. Williams Steven Salman Frank Mangieri, Jr. Susan Galgano Phillip E. Blecker, Trustees Robert J. Ponzini, Counsel Mayor *ZegareHi called the meeting to order at 7:30 P.M. with a prayer and salute to the flag. Mayor Zegarelli read the notice of hearing to obtain views and opinions from residents on the speed limits within the Village. Trustee Blecker stated that he had informed the residents who were going to attend that the hearing would be held later in the evening, after which Trustee Salman moved, seconded by Trustee Galgano that the hearing be suspended temporarily until after the business session. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board. Mrs. Henrietta Brand, 107 Cortlandt Street, complained about the garbage being strewn around from the person operating the store at 111 Cortlandt Street. She stated that he should obtain a dumpster. Mrs. Brand also complained about the young person living across the way at 100 College Avenue playing a stereo very loudly which is annoying. When the police are called, the person lowers the stereo when they arrive, she said. § ' v e ';i 1 Mrs. Brand stated that she received a number of tickets in violation of the parking regulations because tenants from 100 College Avenue are parking on the street instead of in the parking lot. She asked if the Village could require them to park in the lot instead of on the street so that other residents would have a place to park. Mayor Zegarelli suggested that she try to rent a space from the apartment owner. The matter of garbage was referred to public works. Mr. Julius Simyon, Devries Avenue, stated that his school taxes have gone up and asked if it was a result of the agreement with General Motors. •'if .'Hi n| ! it « Mayor Zegarelli stated that the Village does not handle the school tax. Taxes will effect next year's tax, he said. He suggested that Mr. Simyon< approach the School Board. ; (' ?* .M �-2- Mr. Simyon inquired as to how many local people work in the plant and was answered about 10% from the Tarrytowns. He also asked how much business are they giving us and the Mayor answered that merchants did say that they have a lot of business from General Motors. On a question of Mr. Simyon as to what will happen next year, Mayor Zegarelli stated that we are rebuilding Beekman Avenue which will broaden our tax base and widen taxes. Mrs. Sandy Galef, County Legislator, asked the Board's support on behalf of the Board of Legislators regarding solid waste. She stated that the Village of Mamaroneck has an agreement that they would be paid to handle their garbage down to Mt. Vernon at $1.50 per ton. This will have an impact on other municipalities who do not get paid to go to Peekskill. She stated that she hoped the Village would make a decision and send it to the next County Board of Legislators meeting to be held on September 30th. Mr. Donald Caetano, Lawrence Avenue, inquired about the procedure of opening and replacing of a sidewalk. He had a leak on his property and inquired if the Village should replace it. Mayor Zegarelli explained that the plumber who has a bond with the Village, opens and replaces the sidewalk. He obtains a permit prior to opening the sidewalk. If he does not replace the sidewalk, the Village will do the same and he will forfeit the deposit. Mayor Zegarelli called for bids on a 1985 car for the police department. Clerk fallacaro opened the following bid: Russell Chevrolet, Connecticut $8,777 Trustee Williams moved, seconded by Trustee Galgano that the bid be referred to the public safety committee for a report at the next meeting. Carried. Trustee Williams moved, seconded by Trustee Blecker that we suspend the regular order of business for a presentation. Mayor Zegarelli presented a proclamation and thanked Chief Richard Green for his heroic efforts in rescuing a boy from a fire in Tarrytown. Mayor Zegarelli asked if there was anyone present who would like to address the Board on the hearing regarding speed limits. Trustee Blecker recapped the speed limits in areas of the Village, as well as fines and violations. Mr. Ed Friedner, Sleepy Hollow, stated that traffic in the manor runs at high speeds, especially between Riverside and Pokahoe Drive. He suggested a reduction in the speed limit and perhaps speed bumps. �-3- ., Mayor Zegarelli stated that the idea of the hearing came from Trustee Blecker. The hearing is to solicit information and thoughts from neighborhood groups throughout the Village,he said. The suggestions will be taken under advisement and the Board will come up with a master plan to take into consideration the various points. With regard to speed bumps, Mayor Zegarelli stated that they would be very difficult to put in. They would create an additional problem for liability. If someone has an accident, the Village could be held liable, he said. During the winter, the snow plow can be damaged also, he said. Trustee Timmings stated that he read in an engineering magazine wherety a series of tests indicated that certain cars run over speed bumps better at a high speed. Mr. Mark Rosenthal, Sleepy Hollow Manor, stated that he has seen plastic speed bumps. Trustee Salman stated that several months' ago, he suggested that the speed limit be reduced to twenty miles per hour. Mrs. Muriel M., Sleepy Hollow Manor, suggested the lowering of the speed limit. The area is being used as a drag strip, she said. At one time she saw a car traveling on two wheels. Trustee Williams stated that he talked to the Chief about the situation and he will investigate the matter. Mr. Donald Caetano suggested that the police officers spend more time in the Manors rather than waiting on Route 9 for speeders. Mr. Heinz Kloecker, Sleepy Hollow Manor, suggested better usage of stop signs, especially at Hemlock and Lakeview Ave. Mayor Zegarelli stated that the Board is contemplating on recodifying all the VT laws in the Village. First under consideration will be speed limits, parking and signs, he said. Mrs. Barbara Nackman stated that drivers are speeding on Riverside Drive and Bellwood Avenue. for. Hans Peter Walden stated that if you get used to signs, you can get used to speed bumps. He suggested more attention be given to the area. Mr. Rosenthal suggested using the auxiliary police on a volunteer basis. Mayor Zegarelli stated that we have exceeded the use of the auxiliary police more than we should. We have to watch the liability, he said. The matter will be investigated. Mr. Mario Belanich, No. Washington Street, suggested that a sign be posted in the beginning of each street indicating the speed limit, not in the middle of the block. �! | , 1 - 1 Counsel Ponzini stated that regarding speed bumps, this was suggested several years' ago. He had received opinions from the D.O.T., Attorney General's office, Dept. of Audit & Control, etc. and it was the unanimous opinions that we should not install them. ! Carried. j ADMINISTRATION ; Trustee Blecker offered the following resolution, seconded by Trustee Timmings: REPORTS Of COMMITTEES WHEREAS Almighty God has seen fit to take unto Himself the soul of the late Emma Lynch, and ,i I j, i WHEREAS the said Emma Lynch was the Sister of William Haggerty, Custodian for the Village of North Tarrytown, having been held in the highest esteem by all those who knew her, now, therefore, be it RESOLVED that the Board of Trustees take official notice of Emma Lynch's death, and be it further RESOLVED that this resolution be made a part of the official minutes of this meeting and a copy sent to the family of the deceased. Carried. Trustee Blecker stated that the committee has been involved and completed, with Trustee Timmings, negotiations with the Teamsters Union, after which we will be meeting to discuss the computer system. GOVERNMENTAL RELATIONS f ;• ; Trustee Mangieri reported that the administrator selection committee met and have condensed the list of candidates to six people. The candidates will be interviewed by phone, after which, personal interviews will be held by the Board and selection committee within two weeks, said Trustee Mangieri. MANAGEMENT & BUDGET Trustee Timmings outlined the stipulation agreement with the Teamsters (copy in official minutes). He stated that the members of the committee have reviewed the stipulation and are in agreement with same. Trustee Timmings moved that the Mayor be authorized to sign the stipulation of agreement with the Teamsters, seconded by Trustee Galgano. Carried. �-6Trustee Titranings reported that the Treasurer is in receipt of a check for storm damage which occurred last year. PUBLIC SAFETY Trustee Williams offered the following resolution, seconded by Trustee Blecker: WHEREAS Almighty God has seen fit to take unto Himself the soul of the late Florence Detfalco, and WHEREAS the said florence Detfalco was the Mother of Sgt. Carmen Dei?alco of the North Tarrytown Police Department, having been held in the highest esteem by all those who knew her, now, therefore, be it RESOLVED that the Board of Trustees take official notice of Florence Defalco's death, and be it further RESOLVED that this resolution be made a part of the official minutes of this meeting and a copy sent to the family of the deceased. Carried. Trustee Williams moved, seconded by Trustee Timmings that Lt. brophy be granted permission to attend the Handgun Retention Instructor Course to be given in Cherry Hill, N. J. on Sept. 26-27, at a cost of $215. Carried. Trustee Williams reported that Trustee Mangieri and Chief Spota attended the 1984 Pedestrian Award Dinner sponsored by the American Automobile Association whereby North Tarrytown was awarded a plaque for no pedestrian fatality. Trustee Williams reported that police rehabilitation work is continuing. The project was curtailed because of some problems which have been corrected. Completion should be by the end of the month, he said. Trustee Williams moved, seconded by Trustee Salman that five flashlights (mag) be purchased and placed in their patrol vehicles. Carried. Trustee Williams stated that this is in settling with a past grievance by the department. (Village equipment and not uniform.) Trustee Williams moved, seconded by Trustee Blecker that the Village authorize leasing the new telephone equipment with AT & T in conjunction with the desk area. On the question, Trustee Blecker inquired if the service can be upgraded for use in the entire building. He suggested that a letter be given in writing by the company assuring us that we can expand the system to the entire building and moved the amendment to the resolution, seconded by Trustee Galgano. Motion carried. > �-7- ^ Trustee Williams reported that the annual fire Inspection was held last Saturday and all apparatus is working well. Trustee Williams noted the numerous problems in Union Hose Company. The roof will be taken care of first, he said. He stated that there are housekeeping problems in Central firehouse. It was suggested in a work session for an assistant to help out. The committee will be working with the Administration Committee, he said. Trustee Williams stated that an ambulance demonstrator will be on view. He stated that it has an '84 chassis. The cost of it is $53,000, said Trustee Williams. Trustee Williams reported that fire inspectors were given permission to purchase work uniforms for use while making inspections. Trustee Williams reported that Erick Pfeifer, Ambulance Corps, will be administering Blood Pressure tests on Saturday, Oct. 5th. PbbLIC WORKS Trustee Salman offered the following resolution, seconded by Trustee Williams: WHEREAS Almighty God has seen fit to take unto Himself the soul of the late Paul Vydareny, and WHEREAS the said Paul of John Vydareny, employee the Village for many years by all those who knew him, Vydareny was a former employee and father in the Water Department, and resident of having been held in the highest esteem now, therefore, be it RESOLVED that the Board of Trustees take official notice of Paul Vydareny's death, and be it further RESOLVED that this resolution be made a part of the official minutes of this meeting and a copy sent to the family of the deceased. Carried. Trustee Salman stated that in view of the retirement of the Supt. of Public Works, John Biros on October 1, 1985 and in lieu of the unanimous agreement among the Board of Trustees and the Mayor, he has directed the foremen to be in charge of the individual departments of Public Works as of January 1, 1985 and moved that as of October 1, 1985, the position of Superintendent of Public Works be eliminated and that the position of Supt. of Water & Sewer be eliminated as of October 1, 1985 also. Carried. Trustee Salman stated that the 1983 Impala (white) will be transferred to the North Tarrytown Police for use as a SEAS car and so moved that the car be turned over to the police on Friday, September 20, 1985 at 4 P.M., seconded by Trustee Blecker. Carried. �-8Trustee Salman reported that interviews were held about two weeks' ago for positions in Public Works. Trustee Salman moved, seconded by Trustee Blecker that Charles DePaolo be appointed Sanitation Man, effective September 27, 1985 at a salary of $20,290 less $1500 to serve on probation for six months. Mayor Zegarelli polled the Board as follows: Trustee Timmings " Williams " Salman - Abstained - Yes - Yes Trustee Mangieri - Yes " Galgano - Yes " Blecker - Yes Motion carried. Trustee Timmings stated that a good deal of the negotiations had to do with the potential of having to lay employees off to maintain the tax rate. He stated that adding people to the payrolls might be premature. Trustee Salman stated that they are not adding people, but replacing them. He stated that these people are necessary to the department. Trustee Salman moved, seconded by Trustee Galgano that Lawrence Verdi be appointed Laborer in the Water Department, effective September 23, 1985, at a salary of $20,290, less $1500 subject to six months probationary period. Mayor Zegarelli polled the Board as follows: Trustee Timmings " Williams " Salman Motion carried. - Yes - Abstained - Yes Trustee Mangieri - Yes " Galgano - Yes " Blecker - Yes Trustee Salman moved, seconded by Trustee Blecker that George Crouch, M.E.O. be elevated to H.M.E.O. effective September 20, 1985 at a salary of $22,678. Carried. Interviews will be held for Mr. Crouch's replacement in the near future, said Trustee Salman. Trustee balruan stated that three sweepers were tested. He stated that we are contemplating replacing the old mechanical broom sweeper. The replacement will have a large vacuum, he said. The machinery we have is inadequate. We are trying to get catch basins cleaner. Water restrictions are still in effect, said Trustee Salman, and compliances have been set. He stated that we are in the fall season whereby people will be feeding their lawns. Residents are reminded that they are in violation of the law to water their lawns. The trees were cut down by Coffin Tree Service and the residue (branches) were removed by the Highway department. Filled pot holes with blacktop as well as earlier temporary excavations on Beekman Ave. and Devries Ave. Central Garage Amoved & replaced power steering piston on (1979) Water Dept. truck, also installed universals in mini shaft, changed oil and filter and greased. Replaced a/c compressor in car 504 & also removed, had recored & replaced radiator. Changed oil & filter in car 508. Installed muffler* tail pipe, (2) clamps & rear hanger on car 512, also changed oil & filter & greased. Changed right rear tire on New Mack & left front tire on sweeper. Removed defective engine in car 508 and started to replace with rebuilt unit. Installed points & condensor' {adjusted on GMC #4. Installed water pump & lower radiator hose on fire department 2313. �-10RECREATION Trustee Galgano stated that "Icabod Revisited" sponsored by the friends of the Mozartina Musical Arts Conservatory of Tarrytown would like an advance of $1000 for the program, said money to repaid at the end of November. She stated that this had been granted a couple of years' ago. Trustee Galgano moved, seconded by Trustee Blecker that $1000 be advanced to Mozartina Conservatory with the stipulation that it will be returned to the Village in November, 1985. Carried. Trustee Galgano reported that the Village is sponsoring a tree planting program and anyone who would like a tree should leave their name with the recreation department. Trustee Galgano stated that the 1985 fall/winter brochure has been mailed and registration is now taking place. MAYOR'S REPORT Mayor Zegarelli stated that the Village printed water saving tips and mailed them out to users. Mayor Zegarelli stated that he is asking individuals if they would be interested in being a member of the Parking Authority. If people are interested, they should contact Trustee Mangieri, or himself. Mayor Zegarelli noted a notice of claim received by the Clerk and referred it to Counsel. (Gonzalez - Ptl. Nevelus). Mayor Zegarelli stated that he received a letter from the DOT which stated that the right-turn lane on 448 entering North Broadway has been corrected. Mayor Zegarelli stated that he issued a proclamation in conjunctioi with the 300th Anniversary of the Old Dutch Church. i Trustee Blecker moved, seconded by Trustee Galgano that the I meetings in October be held on October 15th and 28th. (Oct. 14th-Columbi Day). Carried. Mayor Zegarelli moved, seconded by Trustee Salman that North Tarrytown join the Chamber of Commerce. Carried. Mayor Zegarelli stated that he is in receipt of the contract for snow removal on State roads which has been approved as to form by Counsel. Trustee Timmings moved, seconded by Trustee Galgano that the Mayor be authorized to sign same. Carried. Mayor Zegarelli stated that he is in receipt of the contract for snow removal on County roads which has been approved by Counsel. Trustee Timmings moved, seconded by Trustee Blecker that the Mayor be authorized to sign same under protest. Carried. �- 11 " /A/ Mayor Zegarelli stated that he is in receipt of a letter from Lawrence Sally, Deputy Commissioner, Division of Housing & Community Development, that they are making $85,000 available from the County's Community Development Block Grant in connection with the rehabilitation of Beekman Avenue. The money will also be utilized to provide a storm drain system. He stated that Gus Paese will prepare the specifications for the program. Trustee Timmings moved to confirm the Mayor's action, seconded by Trustee Galgano. Carried. Mayor Zegarelli stated that we requested that some of the monies be used for the Pocantico water shed but we were turned down. We will re-evaluate the matter, he said. Mayor Zegarelli stated that he is in receipt of a letter from Con Edison notifying the Village that electricity will be turned off at 52 College Avenue because of non-payment. Notification was also received for 111 Cortlandt Street, said the Mayor. Trustee Timmings moved, seconded by Trustee Galgano that action of the Mayor in granting the Portuguese American Culture Organization permission to hold a parade on September 28th on Cortlandt Street be confirmed. Carried. Mayor Zegarelli stated that there was a time limit involved. Mayor Zegarelli asked Trustees Blecker and Salman to attend the meeting of the N.Y. S. Waterfront Revitalization Program in White Plains Mayor Zegarelli noted a letter from the North Tarrytown Housing Authority regarding salary increases for the staff. Mayor Zegarelli noted receipt of letter from the State Board of Equalization and Assessment that the tentative equalization rate is 17.98%. In connection with the General Motors agreement, the following resolutions were proposed: Trustee Timmings moved the following resolution, seconded by Trustee Galgano: RESOLVED, that ^action of the Mayor signing the Payment in lieu of Taxes Agreement between the Village of North Tarrytown and the Mount Pleasant I. P.A. be ratified. Carried. Trustee Timmings moved the following resolution, seconded by Trustee Blecker: RESOLVED, that the action of Mayor in lieu of Taxes Agreement between the Village Mt. Pleasant I.D.A., General Motors, County District of the Tarrytowns, be ratified. signing the Payment in of North Tarrytown, the of Westchester, and School Carried. �-12Trustee Timmings moved the following resolution, seconded by Trustee Blecker: i RESOLVED, that the action of the Village Attorney in signing the various stipulations settling the tax petitions filed by General Motors and the Village of North Tarrytown be ratified. Carried. ] | I Trustee Timmings moved, seconded by Trustee Blecker that the Village designate Ralph Manna, Department of Environmental Conservation to file building permits with the Village of North Tarrytown on behalf of General Motors. Carried. Trustee Timmings moved the following resolution, seconded by Trustee Blecker: I I RESOLVED, that the Mayor be authorized to sign the Quitclaim Deed and related transfer documents to conclude the transfer of title of the sliver of Village-owned property behind 21 Hudson Street to Roger Rodriguez. Carried. ™ Trustee Timmings moved, seconded by Trustee Galgano that the Planning Board of the Village of North Tarrytown be authorized and directed to study and recommend to the Board of Trustees the changes required for the North Tarrytown Zoning Code and Map to permit the development of Cluster Housing and that they be permitted to incur those expenses that are reasonable and necessary to accomplish that end. Carried. COMMUNICATIONS Communication from Donald Carey of Carey & Walsh, 230 No. Washington Street, requesting the removal of a parking meter and curb cut in front of their property was read. Mr. Carey stated that financi; burdens due to increased overhead makes it imperative to sell the buildinj The potential buyers would like to use the curb-cut for inside access capability. The letter was referred to the police committee and building inspector. I | The Clerk noted a letter from Mrs. M. Timmings, 119 Rice Avenue, regarding a tree in front of her property. The matter was referred to public works and tree inspector. Communication from Mrs. Mae Jacobsen, 35 Harwood Avenue, requesting the trimming of trees in front of her property was read and referred to public works and tree inspector. Communication from Mrs. M. Buonanno, 76 New Broadway, requesting an inspection of Village property in front of her property was read and referred to the public works committee. Communication from David Cappello resigning as Sanitation Man effective August 26, 1985 was read and on motion of Mayor Zegarelli, seconded by Trustee Galgano was accepted with regret. Carried. r �-13Communication from Mrs. John James, 49 Pierson Avenue, requesting the pruning of trees in front of her property was read and referred to the public works and tree inspector. The Clerk noted a letter from J.P. Ryan, Secretary of Union Hose Company, requesting the course of action taken by the Board regarding problems in the company. The matter was referred to Public Safety committee. Communication from Sec'y. of Fire Council, Ronald Biro, regarding changes in personnel in Fire Patrol, Rescue Hose, Union Hose and Columbia Hose Companies, as well as exempt certificates for Roger King and Frank Rizzi was read. Trustee Timmings moved, seconded by Trustee Galgano that action of Council regarding changes be confirmed and exempt certificates be granted to the above. Carried. Communication from requesting permission to Lakeview from 1 - 6 P.M. rain date Sept. 29th was L. Higman, Vice-President of the SHMTA, block off the intersection of Evergreen and for their annual picnic to be held on Sept. 28th, read. Trustee Timmings moved, seconded by Trustee Galgano that the matter be referred to the police department and if found in order, permission be granted. Carried. ii. UNFINISHED BUSINESS Trustee Timmings moved, seconded by Trustee Blecker that the minutes of the meetings held on July 15, 1985 and August 12, 1985 be approved as written. Carried. NEW BUSINESS Trustee Timmings moved that the bill from the Westchester County Village officials Association be paid as soon as it comes in, seconded by Trustee Galgano. Carried. Trustee Timmings stated that there is a new Federal law that requires at least all industries with PCB on their property to notify the local fire department. He suggested that Counsel be granted permission to research what the Federal law actually is on the matter. This is to protect firemen who are entering a burning building from a health hazard, he said. i r .ve Trustee Galgano moved, seconded by Trustee Blecker that the bills submitted on the General Fund and Water & Sewer warrants dated Sept. 18, 1985 be paid after approval of department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. WHEREAS, the parties have engaged in negotiations in good faith in an effort to arrive at a successor agreement to a contract that expired on May 31, 1984 ' and ? WHEREAS, the parties have arrived at a tentative agreement; NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties hereby stipulate and agree as follows: (1) The provisions of this Stipulation are subject to ratification by the respective parties to the contract. (2) The respective negotiating committees agree to recommend this Stipulation for ratification. (3) A copy of this original document has been furnished to representatives of The Village of North Tarrytown and Local 456, 1,B,T1,1 (4) All proposals not covered herein made by either party during the course of negotiations, shall be deemed dropped. (5) The provisions of the prior Agreement shall be carried forward except as modified below. (6) Unless otherwise noted, all dates involving the duration of the Agreement shall be conformed to the duration of the negotiated Agreement. �(7) The term of the contract shall be two years commencing on June 1, 1984 and expiring on May 31, 1986. (8) Effective June 1, 1984, there shall be an across-theboard wage increase of four percent (47«) of the wage rate effective on May 31, 1984. Effective Deceihber 1, 1984, there shall be an additional wage increase of four percent (4%) of the wage rate effective on November 30, 1984. Effective June 1, 1985, there shall be an additional wage increase of three and one-half percent (3 l/27o) of the wage rate effective on May 31, 1985. Effective December 1, 1985, there shall be an additional wage increase of three percent (3%) of the rate effective on November 30, 1985. (9) Article IV, Section 2 of the present contract shall be amended to provide that the probationary rate for new employees shall be increased from $500, to $1500. below the perscribed rate for the classification. All employees who are promoted with- in the unit shall not be subject to a probationary rate. (10) Article VI, Section 1 shall be amended to provide that all employees who are required to work on the seventh day of their work week shall be paid at double their normal hourly rate of pay for such work. Said employees shall not be required to work the sixth day in order to be eligible for the payment of double their normal hourly rate of pay for the work on the seventh day. > �/~?o (11) Article VII, Section 1 shall be amended to eliminate the holidays of L i n c o l n ' s Birthday and Election Day (November). These holidays s h a l l be replaced with the employees' personal birthday and the day a f t e r Thanksgiving for a l l employees except in the s a n i t a t i o n department who s h a l l receive a floating I holiday of t h e i r choice.
