Present Philip E. Zegarelli, Mayor James J. Timmings Allen T. Williams Steven Salman frank Mangieri Susan Galgano Phillip E. Blecker, Trustees Robert J. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Salman moved, seconded by Trustee Blecker that the minutes of the meeting held on November 25, 1985 be approved as written. Carried. Mayor Zegarelli welcomed members of the various Boards and Commissions, as well as other residents to the 111th Anniversary of the Incorporation of the Village of North Tarrytown. He stated that he was pleased and honored that they could be here this evening. He stated that these are people who take time out of their own busy lives to volunteer their services to the Village. Mayor Zegarelli called for bids for the re-roofing of Union Hose Company, Treasurer Amato opened the following bids: Edward Monks, Montrose, N.Y. $14,640 Alt. #1 (Includes plywood roof sheathing.) 6,855 Check in the amount of $1464.00 enclosed. Mortelliti Roofing Company, Elmsford, N.Y. Alt. #1 Bid bond enclosed. $14,100 5,895 Mayor Zegarelli moved that the bids be referred to the Administration and public safety committees for recommendation at the next meeting, seconded by Trustee Timmings. Carried. Mayor Zegarelli called for bids on a Modular Ambulance. Treasurer Amato opened the following bid: Professional Vehicle Sales, Bronx, N.Y. Extras 7,291, $59,500. �-2Trustee Timmings moved that the bid be referred to the public safety committee and fire chiefs and Counsel for legality and report back to the Board at the next meeting, seconded by Trustee Williams. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time. No one appearing before the Board, the regular order of business resumed. REPORTS Of COMMITTEES ADMINISTRATION Trustee Blecker stated that we are still waiting for a report from the State as to how far the Village can go in assessing fines to repeat violators. Trustee Blecker stated that the Dept. of Audit & Control has criticized the Village for not having a retainer agreement with the Village Counsel. Mayor Zegarelli asked the Village Prosecutor to review the agreement. He stated that recommendation will be taken up later in the meeting. GOVERNMENTAL RELATIONS Trustee Mangieri stated that a final meeting was held on December 9, 1985 for the selection of an Administrator and it was the committee's recommendation that R. Thomas Homan be selected. Mayor Zegarelli thanked the committee for their efforts. After outlining his qualifications, Mayor Zegarelli appointed R. Thomas Homan as Administrator, effective January 1, 1985, at a rate" equivalent* $37,500 per annum. Trustee Timmings moved to confirm the Mayor's appointment, seconded by Trustee Galgano. Carried. MANAGEMENT & BUDGET Trustee Timmings moved, seconded by Trustee Galgano that a capital note be authorized for street light improvement on Route 9 in an amount not to exceed $6,000. Carried. Trustee Timmings moved, seconded by Trustee Galgano that the application for Corrected Village Real Property Tax filed by the N.Y. Telephone Company dated Nov. 22, 1985 and attached hereto be granted. Carried. Trustee Timmings stated that we have been notified by the State that telephone equipment is not taxable. Trustee Timmings stated that we have a new labor management Ooxiniittee to investigate schedules in the police department and moved that a note be forwarded to the Chief of Police for information concerning various budgetary items, seconded by Trustee Blecker. Carrii �-3- H) Trustee Timmings stated that the typos were corrected in the 1985-87 contract and is ready for the Mayor's signature and moved that the Mayor be authorized to sign the police contract for 1985-87, seconded by Trustee Galgano. Carried. Trustee Timmings stated that the Village Officials have taken action in trying to convince the State legislature to put a cap on court liability. New York is the only State that does not have a cap on liability, said Trustee Timmings and moved that a letter be sent to the State legislators, Governor, Village Officials Association and NYCOM regarding the matter, seconded by Trustee Galgano. Carried. Trustee Timmings stated that veterans of the two recent conflicts have come forward for real property tax exemption. The Village Officials' Association feels that this was discriminatory for veterans who served in combat, but did not own property and on property owners where there was a large number of veterans which would have a large deduction in assessments. He stated that the Village Officials Association introduced legislation which would grant veterans of all conflicts or their surviving, unmarried spouses, an income tax reduction Trustee Timmings moved that the Board confirm the Village Officials' action and that copies be sent to the local veterans organizations with an indication that the Village will support it and we will meet with them if they want additional information, seconded by Trustee Galgano. Carried. PUBLIC WORKS Trustee Salman stated that this is the last week that leaves will be picked up, after which leaves should be bagged. The crew has been filling in pot holes. Trustee Salman moved, seconded by Timmings that action of the committee in awarding the three wheel sweeper to Trius, Inc. in the amount of $73,881.00 be confirmed. Carried. Trustee Williams stated that the old radio equipment from police headquarters will be installed in the public works trucks when the MRD system comes in. Trustee Salman moved, seconded by Trustee Williams that D. Pulsoni be authorized to install the radios in the public works vehicles Carried. Trustee Salman stated that Gus Paese is preparing specifications in connection with the problem in the sewer line and County line on Continental Street. PUBLIC SAFETY Trustee Williams stated that the new police desk area is working fine and work will be commenced on the records room. Trustee Williams stated complimentary holiday parking be placed over meters between holidays, seconded by Trustee that the chief would like to allow and moved that Christmas parking bags December 21st - January 5th for the Timmings. Carried. �-4Trustee Williams stated that Ptl. Bernard Foley will be graduating on December 18, 1985. Trustee Williams stated that the new dog has arrived. Trustee Williams reported all apparatus in good working condition. Trustee Williams stated that the fire at General Motors was contained by the fire department and commended the men for a good job. With regard to the parking situation on Rice and Gordon Avenue, Trustee Williams stated that one of the maintenance men marked off fire zones. He stated that 15 ft. will not take away new parking spaces and will not cause any problems. Mayor Zegarelli stated that he had informed the Neighborhood Association at a previous meeting that the Association will be given an opportunity to see how it works before final action is taken. RECREATION Trustee Galgano reported that money which was advanced to the Montessori Conservatory for their production of Ichabod was returned to the Village. MAYOR'S REPORT: Mayor Zegarelli stated that a letter of thanks was received from Roy Roberts, plant manager of General Motors, to the fire department for their outstanding job in containing the recent fire at the plant. Mayor Zegarelli stated that there will be a joint meeting of the Zoning and Planning Boards on December 19th to discuss several matters.f Mayor Zegarelli read a letter from Covenant Insurance Co. acknowledging the claim of Thomas Gleason, Nov. 28, 1978, and that they have retained Jacobson & Schwartz of Rockville Center, to repres< the Village in this action. Punitive damages are not covered under our policy. Mayor Zegarelli asked Counsel to acknowledge the letter in the Village's behalf and for those people who have been summoned. Mayor Zegarelli stated that he is in receipt of a letter from Stephen Chen who is requesting information on the purchase of a portion of Village property. The matter was referred to the Administration Committee. COMMUNICATIONS Communication from Marcello and Susan Viscogliosi, 183 Valley St., requesting a curb cut was read and referred to the public works committee. �/7J UNFINISHED BUSINESS With regard to the retainer agreement with the Village Attorney, Village Prosecutor, Robert Peirce, stated that having reviewed the proposed retainer agreement, advised the Board that it has been prepared in a manner customary as to form and content. He further advised that the retainer accurately reflects the relationship between Counsel and the Village and recommended that a resolution be adopted authorizing the Mayor's signature and made a part of the official record. Trustee Blecker moved, seconded by Trustee Galgano that the Mayor be authorized to sign same. Carried. Mayor Zegarelli moved, seconded by Trustee Timmings that the bills submitted on the General Fund and Water & Sewer warrants dated December 16, 1985 be paid after approval of department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Carried. No further business to come before the meeting, Trustee Timmings moved, seconded by Trustee Blecker that the same be duly adjourned. Carried.
