January 13, 1986 / A regular meeting of the Board of Trustees of the Village of North Tarrytown was held on the above date. p I£s£S;t: Philip E. Zegarelli, Mayor James J. Timmings Allen T. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Salman moved, seconded by Trustee Williams that the minutes' of the meeting held on December 16, 1985 be approved as written. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so. Mr. Donald Caetano, 27 Lawrence Avenue, inquired as to the supervisor in charge, as far as distributing gas to different vehicles-who would have the key. Mayor Zegarelli stated that meters at the Village garage work on a key basis. Each department head has its own key, he said. Mr. Caetano stated that it was said to him that the department supervisor has a key or the key can be picked up by anyone or signed for. He inquired if there was any private car obtaining gas if it would be registered. Mayor Zegarelli stated that there are no private vehicles to the best of his knowledge receiving Village gasoline. He stated that there are unmarked cars that are registered with the Village who would obtain Village gas. Trustee Timmings stated that anyone using their personal cars for Village business is entitled to reimbursement. He stated that under no circumstances should a personal car be hooked up to the Village pump. Mr. Caetano inquired if the three police dogs are used on every shift. Trustee Williams stated that the schedule will be worked out whereby there will be one on every shift. On an inquiry of Mr. Caetano as to how successful or effective they have been, Trustee Williams cited an incident which happened in �-2- Tarrytown during which our K9 was called in and alleviated the problei Mr. George fitzpatrick, Hunter Avenue, inquired if the Board was aware of singles renting houses. He pointed out a dwelling in Philipse Manor whereby five single people were living in a house. He stated that the court of appeals overturned Oyster Bay's ordinance regarding this. Very few ordinances can stand up to this, he said. Mr. Margotta stated that the Village does not have any ordinances on singles renting homes. He quoted a section in the code where no more than two unrelated persons can occupy an apartment. He suggested that the Village look into the County's code. # The matter was referred to Counsel Ponzini. I Mr. A. Volpac'chio, 11 Cedar Street, stated that his property was assessed by a previous assessor before he obtained a building permit. The present assessor has no record of how his assessment was arrived at and is requesting that his assessment be lowered. Counsel Ponzini stated that when he appeared before the Board last year, his grievance application was denied. He would have to go to the courts. Mr. Checchi stated that he was the building inspector at the time and explained how Mr. Volpacchio's assessment was increased. Following a discussion, Mayor Zegarelli advised Mr. Volpacchio to submit another grievance application on February 18th for review by the Assessment Review Board. REPORTS OF COMMITTEES ADMINISTRATION Trustee Blecker stated that we have not heard from the State regarding how far the Village can go in assessing fines to repeat violators. ;j ij Trustee Blecker stated that the committee will meet with the administrator to discuss computers. Trustee Blecker offered the following resolution, seconded by Trustee Timmings: WHEREAS Almighty God has seen fit to take unto Himself the soul of the late Margaret White, and WHEREAS the said Margaret White was a former Trustee of the Village of North Tarrytown and a resident of the Village for many years having been held in the highest esteem by all those who knew her, now, therefore, be it RESOLVED that the Board of Trustees take official notice of Margaret White's death, and be it further �-3- hj RESOLVED that this resolution be made a part of the official minutes of this meeting and a copy sent to the family of the deceased. Carried. Mayor Zegarelli stated that it was a breakthrough to have her on the Board and pleasure in the way she served the Village. She will be missed, he said. GOVERNMENTAL RELATIONS Trustee Mangieri stated that there will be a meeting of the Parking Authority, together with the Administrator. The Economic Council will also meet on February 5th. MANAGEMENT & BUDGET Trustee Timmings noted an uninitialed claim for payment from R. Turnquist for services in connection with the rehabilitation of the desk in police headquarters. Mayor Zegarelli suggested that the claim be reviewed and discussed and if the services were done under our authority as agents, that it be paid. Trustee Timmings stated that the December fiscal statement has been placed on each Trustee's desk. Trustee Timmings moved that department heads be instructed to submit their 1986-87 budget requests to the Administrator by the first Monday of February, seconded by Trustee Galgano. Carried. Mayor Zegarelli stated that he is now appointing Thomas Homan budget officer for the purpose of putting together the 1986-87 budget. Trustee Timmings moved, seconded by Trustee Galgano that the Mayor appointment be confirmed. Carried. PUBLIC SAFETY Trustee Williams offered the following resolution, seconded by Trustee Timmings: WHEREAS Almighty God has seen fit to take unto Himself the soul of the late Sante J. Chessari, and WHEREAS the said Sante J. Chessari was the former Village Attorney for the Village of North Tarrytown and a resident of the Village for many years having been held in the highest esteem by all those who knew him, now, therefore, be it RESOLVED that the Board of Trustees take official notice of Sante J. Chessari1s death, and be it further RESOLVED that this resolution be made a part of the official minutes of this meeting and a copy sent to the family of the deceased. Carried. �-4Mayor Zegarelli stated that Mr. Chessari served the Village for many years. He left his mark in North Tarrytown, he said. Trustee Williams stated that letters have been received from citizens commending officers Caxiera, Whalen and Brophy for services and moved that they be placed in their folders, seconded by Trustee Timmings. Carried. Trustee Williams stated that two resignations were received from Mrs. Patricia Baker and Kenneth Powers, Parking Enforcement Officers, because of the rate of pay. The matter will be discussed in executive session, he said. a Trustee Williams stated that the Fire Chief has received 7 scottl air paks, 15 air bottles, 21 helmets and 29 prs,of boots. New tires I have been placed on Union Hose apparatus. After review of the ambulance bid, Trustee Williams moved, seconded by Trustee Blecker that the bid be awarded to Professional Vehicle Sales, Inc. for a Demo Modular Ambulance mounted on an 11,000 lb G.V.W. 158" wheelbase chassis (1985) in the amount of $59,500.00, plus the amount of $7291.00 for additional items as specified in their bid for the total amount of $66,791.00. Carried. Trustee Williams stated that it does not look very hopeful that the Village will get the Exxon building for the ambulance. Mayor Zegarelli stated that the price is predicated by its use. The high price that they are asking is based on what they expect someone to be able to use it for, said the Mayor. He stated that he does not think it could be used as a gas station anymore. PUBLIC WORKS Trustee Salman stated that we expect to receive the new sweeper this month. The sweeper will have a vacuum, he said. , Trustee Salman gave the following report: l Mobil radios were installed in trucks 1 and 2. Locating curb boxes throughout the Village. We have to develop a permanent way of locating the boxes, he said. Installed temporary cold patch on excavation on Beekman Avenue. Jetting trouble spots in the Village. RECREATION & HUMAN RESOURCES Trustee Galgano stated that Mary Coyne, Recreation Supervisor, has satisfactorily completed her six months probationary period on December 17, 1985 and moved that she receive her full salary, seconded by Trustee Timmings. Trustee Galgano stated that Miss Coyne is on provisional basis until she takes the civil service exam. Motion carried. Trustee Galgano stated that Mr. Homan met with Mr. DeLucia of the County of Westchester, Dept. of Parks, regarding park renovations. Before work can commence, certain equipment has to be removed and this will be coordinated with Miss Coyne. Construction should commence in the spring, said Trustee Galgano. Mayor Zegarelli stated that he would like a final recommendation from the Commission to formally close the Clinton Street park. There are certain individuals interested in purchasing the land, he said. MAYOR'S REPORT: Mayor Zegarelli referred to Counsel regarding several court cases. Counsel Ponzini stated that the case dealing with Thomas Gleason (Nassau County) has been dismissed. There are several other cases with Mr. Gleason which should be handled by an outside attorney, said Counsel. Mayor Zegarelli moved, seconded by Trustee Timmings the authorization of an outside attorney to handle these cases. Carried. Trustee Timmings moved, seconded by Trustee Galgano that a memo be directed to department heads to put a "brake" on spending. Carried. Mayor Zegarelli moved that Monday, January 20, 1986 be observed in honor of Martin Luther King, seconded by Trustee Blecker. On a question about the holiday, Mayor Zegarelli stated that employees have the option of having the holiday in place of another. The Village office will be open. He stated that negotiations with the teamsters and other unions and personnel were to establish that type of flexibility. Mayor Zegarelli stated that we received a check in the amount of $975,000 as the first increment of our share of the pilot in payment in lieu of taxes from General Motors agreement. He stated that this payment equals 3/4 of the cost General Motors would pay to us. The money is for the next tax year. It was invested at 7%% at the First National Bank of No. Tarrytown and will be used for the next tax year. �-6Mayor Zegarelli stated that in a memo received from Counsel regarding Duracell, we have not had any response from the Attorney General regarding the toxic reports. He stated that Counsel wrote and told them of our concern and asked them to review all details available. We have not received any acknowledgment from the Attorney General's office. Mayor Zegarelli stated that he received a letter from J. J. Gleeson, Dept. of Transportation, regarding the Headless Horseman bridge. Work will commence as soon as weather permits on the sidewalks, balustrade and masonry cladding on the arch spandrel. He stated in his letter that the bridge is structurally sound, and no work is necessary on the primary load-carrying members, the arch itself. Mayor Zegarelli stated that a turn-off notice has been received from Con Edison on Radhame Pichardo, 111 Cortlandt Street because of non-payment of electric bills. Mayor Zegarelli stated that we had asked to lease from MetroNorth, the parcel of property, which was previously designated as the sub-station, for commuter parking. We have received a memorandum from M. Gagliardi which he sent to L. Levine of Metro-North to review our request, said the Mayor. Mayor Zegarelli stated that a mailgram was sent on behalf of the Village to the N.Y.S. Parole Board in Albany and Governor Cuomo voicing our opposition to the parole of Gary McGivern. Mayor Zegarelli stated that Mr. McGivern was found guilty in the murder of William Fitzgerald. Trustee Williams moved, seconded by Trustee Salman that action of the Mayor be confirmed. Carried. COMMUNICATIONS ________________________ ( Communication from Mr. & Mrs. James Bick, 266 Harwood Avenue, I requesting sidewalk repairs was read and referred to the public f works committee. UNFINISHED BUSINESS In connection with the Capital Note adopted for the re-roofing of Union Hose Company, Trustee Timmings moved to amend the original motion to increase the amount to $25,000, seconded by Trustee Williams. Carried. Mayor Zegarelli moved that a telephone poll be authorized for the awarding of the roof bid after review of the bids by the administr tor and chairman of the administration and fire committees, seconded bj Trustee Galgano. Carried. NEW BUSINESS Trustee Timmings stated that at the executive committee meeting of the Village Officials' Association, a discussion was held as to �what action could be taken against the State who claim that they are not responsible for highway maintenance curb to curb. Many Hudson River communities have had undo expenses in the current year, he said. There is a strong feeling to petition the State to have legislation passed making D.O.T. responsible for road maintenance. In their discussions, said Trustee Timmings, the approach would be to either have public interest to Westchester County or State legislation. The issue now stands at pros and cons, he said. Trustee Salman stated that we paid over three thousand dollars to hire a company to clean out the storm sewers and we are now looking to additional expenses on the shoulders of Route 9. We all feel that it is the State's responsibility, he said. Trustee Timmings stated that the Village Officials' Association is requesting municipalities to write to Albany expressing our desire that the legislators take immediate action regarding municipal insurance liability and moved that a letter be sent to the State legislature, copies to NYCOM and WVOA, to resolve the crisis for governments getting adequate and lower cost insurance coverage, seconded by Trustee Galgano. Carried. Trustee Timmings moved that the same people support the Village Officials plan that veterans of all wars be granted income tax relief in preference to assessment reduction on property, seconded by Trustee Blecker. Carried. The Board took up the following resolutions in connection with thejjrdrthcoming Annual Village Election: Trustee Timmings moved, seconded by Trustee Williams that we have ten (10) Election Districts, the same as used in the Town Election of this Village, except that District #21 and District #33 in the Town Election shall be #9 and #10 respectively in the Village Election. Carried. Trustee Williams moved, seconded by Trustee Salman that Registration Day be held on March 8, 1986 from 12 noon to 9 P.M. Carried. Trustee Salman moved to have Registration in the lobby of the Municipal Building, seconded by Trustee Mangieri. Carried. Trustee Mangieri moved, seconded by Trustee Galgano that Election Day be held on March 18, 1986. Carried. Trustee Galgano moved, seconded by Trustee Blecker that hours for Election Day be from 7 A.M. - 9 P.M. Carried. Trustee Blecker moved, seconded by Trustee Timmings that the Clerk be authorized to publish and post the proper notices of Registration and Election Days and also purchase the necessary supplies. Carried. Trustee Timmings moved, seconded by Trustee Williams that the matter of requesting the loan of eleven (11) voting machines from the Town of Mt. Pleasant for use in the Annual Village Election to be held on March 18, 1986, be left in the hands of the Administration Committee, also the placing of rails, booths, etc. in the polling places. Carried. �- 8Trustee Williams moved, seconded by Trustee Salman that Voting machines be used in the forthcoming Village Election on March 18, 1986, Carried. Trustee Salman moved, seconded by Trustee Mangieri that the Administration Committee be directed to ascertain if the same polling places are available at the same rental, $50.00 for Election Day. Carried. Trustee Mangieri moved, seconded by Trustee Galgano that $4.25 per hour be paid to Election Inspectors on Registration and Election Days. Carried. Trustee Galgano moved, seconded by Trustee Blecker that the Chairperson be paid $5.00 extra. Carried. Mayor Zegarelli moved, seconded by bills submitted on the General Fund and January 13, 1986 be paid after approval the Treasurer be authorized to pay same resolution be attached to the warrants.
