February 10, 1986 A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present Philip E. Zegarelli, Mayor James J. Timmings Allen T. Williams frank Mangieri Susan Galgano Phillip E. Blecker, Trustees Robert J. Ponzini, Counsel Absent Steven Salman, Trustee Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Galgano moved, seconded by Trustee Blecker that the minutes of the meeting held on January 27, 1986 be approved as written. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time. No one present to address the Board, the regular order of business resumed. REPORTS Of COMMITTEES ADMINISTRATION Trustee Blecker stated that he, together with the Administrator, looked at a computer system and members of the office staff will go to Peekskill to look at the computers. Trustee Blecker stated that he submitted to the Village Attorney the proposed changes he has recommended regarding parking violation fines. Trustee Blecker moved that a public hearing be held on february 25th, 1986 to increase penalties and provisions relating to the parking of motor vehicles throughout the Village, seconded by Trustee Timmings. Carried. Mayor Zegarelli stated that the regular meeting scheduled for february 24th will be held on february 25th to allow Board members to attend the G. Washington's Dinner on that evening. �-2GOVERNMENTAL RELATIONS Trustee Mangieri stated that the Economic Council held a meeting on February 5th during which discussions were held on the market study. Another meeting will be held on February 19th with local business people. MANAGEMENT & BUDGET Trustee Timmings stated that the January water statement is on each Trustee's desk. Trustee Timmings stated that the Administrator met with the teamsters regarding outstanding grievances. We will have an early resolution of other problems, he said. PUBLIC SAFETY i Trustee Williams reported that the new ambulance has arrived, minus some of the equipment which is still on order. Mr. Homan stated that he talked to the Fire Chief regarding the disposition of the ambulance we have now. We should move ahead to dispose of it, he said. Trustee Williams reported letters commending action of Officers DiCairano and Bizzaro and moved that copies be placed in their folders seconded by Trustee Timmings. Carried. Trustee Williams read a report from the Chief of Police regarding the number of calls that the police made to Michael's II on Beekman Avenue. Mayor Zegarelli stated that we intend to make mention any complaii which will be forwarded to the State Liquor Authority regarding these establishments. He stated that he would like to have the Chief investigate and report if there are any cabarets or cabaret licenses issued. PUBLIC WORKS In the absence of Trustee Salman, Mayor Zegarelli read the following report: Plowing, salting and sanding on February during the snowfall. The water department helped with snow plowing. One of our highway trucks caught fire. Two trucks with broken plows are now being repaired. The new sweeper is in and will be demonstrated to the men. We will be removing snow on alternate sides daily with no overtifl involved. Working with recreation on preparing parks for renovations in the early spring. �-3- /£* flags were erected in honor of the Presidents' holidays, Lincoln and Washington. Completed quarterly readings of water meters. Tapes were brought to Newburgh for print-out sheet. Still locating curb boxes throughout the Village. are being repaired. Broken o.r.d.s Jetting when weather permits. Balance as of February 10th, $28,603. Mayor Zegarelli stated that the highway department did a fantastic job during the snow storms. He stated that people from around the County remarked that we did a good job. RECREATION-HUMAN RESOURCES Trustee Galgano stated that we will be rehabilitating three parks, i.e., Barnhart Park, Margotta Courts and friendship Park and moved that specifications be prepared and bids be returnable on March 10, 1986 for rehab work, seconded by Trustee Mangieri. Carried. MAYOR'S REPORT: Mayor Zegarelli stated that we still have pending litigation with Thomas Gleason. In a discussion with the Board and Counsel, we have requested the hiring of Arthur Olick as special counsel. Trustee Timmings moved that Arthur Olick be retained as special counsel in the T. Gleason litigation, on an hourly basis, not to exceed $5,000, seconded by Trustee Galgano. Carried. Mayor Zegarelli stated that in discussions with the building inspector and Board, he has appointed William Herlihy, Assistant Sanitary Inspector, at no salary, effective immediately. Trustee Timmings moved to confirm the Mayor's appointment, seconded by Trustee Williams. Carried. Mayor Zegarelli stated that he had increased the chairperson of election to $10. Trustee Timmings moved to confirm the action of the Mayor, seconded by Trustee Blecker. Carried. Mayor Zegarelli stated that his term expired on PERMA Board of Directors. Trustee Timmings moved, seconded by Trustee Williams, the re-appointment of the Mayor on the Board of Directors of PERMA. Carried. Mayor Zegarelli stated that he is asking people to serve on a Senior Citizens Housing Panel. Their work will consist of obtaining grants and locating sites for senior citizens rental housing in North Tarrytown. He stated that four members of the Senior Citizens Commission will serve on the panel. He will obtain additional members. �-4Trustee Williams stated that in order to complete work in police headquarters, additional monies will be necessary for painting and ceiling work. A discussion was held, after which the Administrator was instruct to obtain estimates for paint work in the Village offices, main lobby, etc., as well as paint work and ceilings in police headquarters, so that financing can be combined as one. COMMUNICATIONS Acknowledgement of sympathy from the Chessari family was read and filed. Communication from the Italian American Ind. Club requesting permission to hold a dance on February 15th, from 9-12 midnight at the Van Tassel auditorium was read. Trustee Timmings moved, seconded by Trustee Williams that permission be granted and that the police be notified of same. Carried Communication from the VFW, North Washington Street, notifying the Board that the Tarrytowns Post #1939 intends to renew its retail liquor license was read and filed. The Clerk informed the Board that the 1986 Assessment Roll has been completed. In connection with the Assessment Roll, the Clerk informed the Board that Grievance Day will be held on February 18, 1986 between the hours of four and eight in the afternoon. The Clerk informed the Board that Village Treasurer Irene Amato had filed her report of unpaid taxes for the year 1985 as of January 31, 1986, totaling $53,865.53 and in connection therewith, the following resolution was offered by Trustee Timmings, seconded by Trustee Galgano and was adopted: RESOLVED that the Board of Trustees sell all unpaid taxes for the year 1985 on March 20, 1986, pursuant to Section 1A36, 1450, 1452, and 1454 of the Real Property Tax Law and amendments thereto the same terms and conditions as the sale held on March 14, 1985 at the Village Hall, 28 Beekman Avenue and the Treasurer be and she hereby is directed to publish the proper legal notice for three consecutive weeks beginning February 28th, March 7th and March 14th, and be it further RESOLVED that a copy of this resolution be given to the Treasurer with the return of unpaid taxes as certified to by the Board. Carried, NEW BUSINESS Mayor Zegarelli stated that he is in receipt of a letter from Senator Flynn regarding tax relief for veterans and he is submitting a bill which would provide for tax relief. �-5- /?/ Trustee Timmings stated that the veterans have come back to the Village Officials. He stated that an Assemblyman from Long Island stated that the income tax credit is a dead issue. They are again asking for assessment reduction. He stated that the Governor and members of the legislature want to hear from the people. He stated that if veterans of this State would start a campaign to go after income tax relief in lieu of tax assessment, it is highly probable that they can back these people for some action. Mayor Zegarelli stated that he is in receipt of the Westchester County Board of Legislators legislative objectives from Ed Brady. Mayor Zegarelli stated that he is in receipt of a communication from Westhab who are purchasing 79 College Avenue. Counsel Ponzini stated that we are waiting for approval from the Federal Government. Mayor Zegarelli stated that Westhab met with tenants who have agreed to an increase in rent. Mayor Zegarelli stated that he is in receipt of a letter from Jerry Faiella, Administrator of Tarrytown, regarding the library contract. He asked Counsel to review same. Mayor Zegarelli stated that he received a letter from the National League of Cities, Alan Beals, Executive Director, to write our legislators opposing cuts in municipal programs and revenue sharing, etc. Trustee Timmings moved, seconded by Trustee Galgano that letters be sent to our legislators to re-enact general revenue sharing funds, housing grants, highway and public-transportation programs, etc. Carrie UNFINISHED BUSINESS As per inquiry of Trustee Blecker regarding the generator, Mr. Homan stated that the company has to coordinate its work with Mr. Morabito. He will contact him. On an inquiry of Trustee Blecker regarding Ross Hardware violations, Counsel Ponzini stated that he talked to Chief Ferguson and was told that some of the violations were corrected. A report will be given to the Board, said Counsel. Mayor Zegarelli stated that he received a copy of proposals from County Executive Andrew O'Rourke regarding planning and zoning. He stated that it was his personal feeling that they should be retained locally. Our roll with the County has been exemplary, said the Mayor. On behalf of the Village and his personal feeling, he has registered a "No" at this point. He stated that we take both these codes seriously in North Tarrytown. What :".s good for one municipality might not be good in North Tarrytown, said the Mayor. �-6Mr. Hotnan stated that 448 is getting worse and he will be addressing a letter to Mr. O'Rourke that the road is in bad shape. Trustee Tixnmings moved, seconded by Trustee Blecker confirming his act ion. Carr ied. Trustee Timmings noted the bill on the new street sweeper and moved that payment be withheld until a report is received that it is completely satisfactory, seconded by Trustee Galgano. Carried. Mayor Zegarelli stated that he is in receipt of a letter from the Salvation Army requesting permission to establish a shelter for the homeless at 115 Wildey Street. He stated that he sent a letter to the Salvation Army referring the request to Tarrytown since part i of the Village of North Tarrytown, said the Mayor, and sent Mayor J Barbella a copy also. Mayor Zegarelli stated that he is in receipt of a letter from Lawrence Salley, Deputy Commissioner, Division of Housing and Communis Development, Dept. of Planning, outlining various allocations to North Tarrytown in regard to the Urban County Community Development Block Grants. Trustee Timmings stated that Senate Bill 5248, Assembly Bill A265 have been introduced in Albany at the request of the PBA which force police grievances into binding arbitration. He stated that we have grievance procedure negotiated in our contract. This would be an infringement on collective bargaining, he said. Trustee Timmings moved, seconded by Trustee Galgano that letters be sent to the Governor, Senator flynn, Assemblyman Sullivan, copies to NYCOM and WCVOA expressing the opposition of the Village of North Tarrytown to both these bills. Carried. Mayor Zegarelli moved, seconded by Trustee Timmings that the bills submitted on the General Fund and Water & Sewer warrants dated February 10, 1986 be paid after approval of department heads and that the Treasurer be authorized to pay same and that a copy of this | resolution be attached to the warrants. Carried. J There being no further business to come before the meeting, Trustee Timmings moved, seconded by Trustee Blecker that the same be duly adjourned. Carried.
