February 24, 1986 ''' A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present , Philip E. Zegarelli, Mayor James J. Timmings Allen T. Williams Steven Salman Susan Galgano Phillip E. Blecker, Trustees Robert J. Ponzini, Counsel Absent frank Mangieri, Trustee Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Salman moved, seconded by Trustee Galgano that the minutes of the meeting held on January 27, 1986 be approved as written. Carried. Mayor Zegarelli read the notice of hearing to consider amendments to Chapter 57, all sections, to increaselpenalties and provisions relating to the parking of motor vehicles throughout the Village. Before hearing comments from the audience, Mayor Zegarelli called upon Trustee Blecker who was instrumental in gathering all information regarding the proposed amendments. Trustee Blecker explained the reason for the increase in fines, as well as for the repeat violators. He stated that he had contacted Mr. James Marisano, President of the Municipal Computer Services Corp. who service other municipalities in pursuing parking violators who do not pay tickets within thirty days. He stated that the corporation will run plates and identities, as well as issue a series of letters and attempts to collect money, after which they would go to a collection agency or garnishee wages or become liens. The Village would not lose any revenue on money turned over to the agency, he said. Mr. Leo Schwartz, Alter's Bakery, stated that they have been in business over 50 years and serve customers from out-of-town. If these people get a ticket, they do not come back any more, he said. He inquired as to why the fines are being doubled. Trustee Blecker stated that the laws were not being proposed to create problems. Mayor Zegarelli stated that the Board reviewed all parking areas, including fire hydrants and the use by automotive dealers of public streets ::or car sales. Mrs. Peggy McClintock, 95 Beekman Avenue, stated that there is not a parking space in the Village. She asked how fees could be increased when there are no spaces. She suggested putting in some parking lots. �\ \ \ Mayor Zegarelli stated that meters were removed from Irving Place to allow for additional parking, as well as parking in the Morse School and additional parking lots on Elm Street and Hudson Street. The Board has met with some owners for the acquisition of their properties to allow for more parking which was not responded favorably by the owners as yet. He stated that there is a possibility of condemining properties Mayor Zegarelli stated that the parking authority will have the ability to acquire properties. Mrs. Diane Martello, Pocantico Street, stated that she has appeared before the Board several times regarding the painting of parking lines? on Pocantico Street, which were promised, but not done. j Trustee Salman stated that people objected to the lines on the street which would make the street unsightly. j The matter was referred to the administrator. Mr. Rocco Martello, Pocantico Street, stated that before doubling the fines, residents should be provided with parking. Mrs. Roberta Southerland, 95 Beekman Avenue, stated that she receii a parking ticket which she paid by check. Her check was returned to hei with a letter to the effect that either a money order or cash would be accepted. She stated that this was an inconvenience for her to go to the post office for a money order because of her working hours or even paying in person. She also stated that she saw cars parked all weekend in the same place on Beekman Avenue which were not ticketed. Mayor Zegarelli stated that the matter is before the Judge. in charge of all the collections. This is his policy. Hei; The matter regarding cars not being ticketed was referred to Trustee Williams. Mayor Zegarelli stated that we have to send the Village's money t the State. The Village is out the money when checks bounce, said the Mayor, because we have already sent in our check. We lose, not the 8 State, he said. Mayor Zegarelli stated that under the parking authority, meter money and fines collected will be used to purchase property for parking etc. Mr. Joseph Schwer, 95 Beekman Avenue, stated that money from the parking meters is supposed to have been used for this purpose. He inquired if 90% of the people who have received tickets are local peopl He also stated that apartments are being turned into rooming houses which are causing a real congestion. The Village should look into this, he said. Mr. Mario Belanich, No. Washington Street, stated that when he sees violators, he calls the police. He stated that he was opposed to the $10 increase. He stated that North Tarrytown residents will pay their tickets, however, most of the money will go to this Corporati who will get the higher percentage. i �-3- £** Mayor Zegarelli stated that he was wrong. Mr. Belanich stated that there are many laws on the books, but are not enforced. He stated that he surveyed the Philipse and Sleepy Hollow Manor areas and found 36 cars parked on the street without tickets. He reiterated that he opposed the $10 increase in fines. Mr. Marisano stated that his company will receive about 50c on every ticket that the Court Clerk sends him. Trustee Blecker stated that as soon as a ticket goes to the company, a $10 fee for paper work is tacked on to the ticket. Mrs. McClintock reiterated that the fines should remain the same and that the repeaters be the ones who have to pay. No other comments, Trustee Galgano moved that the hearing be closed, seconded by Trustee Williams. Carried. Mayor Zegarelli asked if there was anyone present who would like to speak on any other matter. Mr. Mario Belanich inquired about the General Motors settlement. Mayor Zegarelli stated that the Village, Town and Public Schools were being sued for back taxes for the last three years. The potential liability was close to $10,000,000.00, said the Mayor. An analysis was made as to how much it would cost to go to court, said the Mayor, and the cost would have been close to a quarter of a million dollars for an appraisal, without court costs. The percentage of winning is 1%, said the Mayor. The New York State Board of Equalization and Assessment agreed with General Motors and against the Village, Town and Schools. He stated that we will get approximately $178,000 less this year from General Motors as per part of the agreement. It steps down over the next ten years to a total of $110,000. The Village was forgiven in court costs and potential liabilities, said the Mayor. This was a good proposal for the Village, he said. Mr. Belanich stated that the Village, Town and Schools should not give them anything. We should encourage them by giving them a break on expansion or modernization work, he said. Trustee Timmings stated that their water treatment plant, as well as their changes in their paint operation are tax exempt. There is no leverage to bargain with them, he said. Trustee Salman stated that we know what our income will be exactly in the next ten years. We have eliminated future certioraries, he said. Carried. Trustee Blecker stated that the office staff is continuing evaluation of computers. GOVERNMENTAL RELATIONS In the absence of Trustee Mangieri, Mayor Zegarelli stated that the' committee is working on the improvement program which is being sponsored by the County. A liaison representative will meet with owners of properties on Beekman Avenue and Cortlandt Street. MANAGEMENT & BUDGET | Trustee Timmings moved that taxes in the amount of $2,105.46 be I cancelled on the American Cable Association because the payment of gross receipts exceeded the amount of taxes due, seconded by Trustee Galgano. Carried. Trustee Timmings moved that taxes in the amount of $3,042.55 on Special Franchise-N.Y. Telephone Co., be cancelled in conformance with the laws passed by Albany, seconded by Trustee Galgano. Carried. Trustee Timmings stated tht he is withholding three bills on the warrant for the new street sweeper, new ambulance and architect's bill for rehab work in police headquarters. These are being withheld until proof of satisfactory completion is available, he said. �-5cZU><£L. PUBLIC SAfETY Trustee Williams stated that as a result of the installation of the new AT & T system, the Village can expect a savings of $31,000. The annual bill was $48,000, he said. Trustee Williams stated that the ambulance has not yet been accepted. We are waiting for a letter from the ambulance corps and fire Council. M Trustee Williams read a report from Richard Gross, fire Inspector, regarding a re-inspection of the premises of Ross Hardware. It was stated in the report that the violations will be corrected. PUBLIC WORKS r, Trustee Salman gave the following report: Still locating curb boxes throughout the Village. Repairing broken o.r.d.s. on buildings in the Village. Jetting trouble spots in the Village. Replaced broken hose on sewer jet. Wit'.-, •fie : &! Water bills will be ready to be sent out the beginning of next week. m Oil burners in all water department buildings were inspected and evaluated by service company. They will give the administrator a report concerning their findings and possible service contracts. 'h. Snowplowing during recent snowfall, filling sand barrels throughout the Village. Patching pot holes in the Village with blacktop. Developing a list of these potholes and will plan on making permanent repairs after the thaw. ! New sweeper has arrived and will be placed into service when the vehicle's functions are demonstrated to the H.M.E.O's and found fully functional. In the meantime, the men are sweeping the streets by hand. RECREATION n is ,-v Trustee Galgano moved, seconded by Trustee Timmings that the Mayor be authorized to sign the amended contract with the County for the rehabilitation of friendship Park (Rev. Sykes Park), Barnhart Park and Margotta Park. Carried. MAYOR'S REPORT: * • V •;r (*••< IP Mayor Zegarelli read a letter from Vincent Chebetar, Chaplain of the V.f.W. Post 1939 requesting permission on behalf of the Veterans to erect a memorial to the deceased veterans at the Robertson Park. The Veterans are requesting that the Village pour the concrete footing and all other costs will be borne by the veterans, said the Mayor. Trustee Timmings moved, seconded by Trustee Galgano that permission be granted. Mayor Zegarelli stated that he is in receipt of a request from a photographer who would like to film a commercial in Rescue Hose Company and referred the matter to Counsel. UNFINISHED BUSINESS Mayor Zegarelli stated that he is in receipt of a letter from Joseph Ungaro, Gannett, requesting a survey of grants that we know of that Gannett donates money. Mayor Zegarelli stated that he is in receipt of a letter from a Mrs. Lucy Lee, Hemlock Drive, commending Gordon Ferguson for aiding her family. Trustee Williams stated that he is in receipt of letters commending Ptlmen. DiCairano and John Cappello and moved that they be placed in their folders, seconded by Trustee Timmings. Trustee Timmings moved, seconded by Trustee Galgano that the bills submitted on the General Fund and Water & Sewer warrants dated February 24, 1986 be paid after approval of department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Carried. There being no further business to come before the meeting, Trustee Galgano moved, seconded by Trustee Williams that the same be duly adjourned. Carried.
