April 28, 1986 • A regular meeting was held before the Board of Trustees of the Village of North Tarrytown on the above date. Present , Philip E. Zegarelli, Mayor James J. Timmings Allen T. Williams Steven Salman Frank Mangieri, Jr. Susan Galgano Arthur B. Ceconi, Trustees Robert J. Ponzini, Counsel Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Trustee Galgano moved, seconded by Trustee Williams that the minutes of the meetings held on March 24, 1986, March 26, 1986 and April 7, 1986 be approved as written. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time. Mrs. Carol Caro, 262 Farrington Avenue, inquired about several items in the proposed 1986-87 budget which were explained to her by the Mayor. Mrs. Caro encouraged the Board to continue to support the library. Mayor Zegarelli clarified a statement made by Mrs. Caro that the library Trustees prepared the library budget and not the Village Trustees. Mr. John Margotta, 82 Pocantico Street, Commander of the VFW thanked the Village for installing the foundation for their monument at Robertson Park. He also stated that the veterans are inserting a time capsule and would like a letter signed by the Mayor listing all officials of the Village. He stated that the monument will be dedicated after the Memorial Day Parade. Mr. Carmen Capossela stated that Rescue Hose is requesting permission to erect a sign across Beekman Avenue advertising their Flea Market. Since the senior class of Sleepy Hollow High School has one already there, he is requesting permission to erect the sign on Beekman Avenue, at the UAW hall. The matter will be taken up under Communications. At this time, Mayor Zegarelli called Michael Apollonio, recently retired foreman, to come forward and presented him with a certificate of appreciation. Mayor Zegarelli stated that Michael was a dedicated employee who came out in all kinds of weather and thanked him for a job well done. Mr. Apollonio was congratulated, after which he thanked everyone �3>3 -2- Mr. Homan, Administrator, stated that he has requested the Economic Development office in Washington for a grant in the amount of $316,000 to be used to extend the continuation of water distribution at the northern end of the Village. He stated that he picked up where John Biros left off. He stated that projects are limited these days. The total project is $600,000, however, should we get an agreement, we should share 1/3 each for the program, he said. Mr. Homan stated that the parks project began today and will continu for the next 6 - 8 weeks. The Village Improvement Program, coordinated with the County Planning Department, is scheduling a meeting for Wednesday. We are organizing a merchants' committee for imput of the various projects, he said. REPORTS OF COMMITTEES MANAGEMENT & BUDGET Trustee Timmings reported that the Treasurer is maintaining a cash balance in the General fund. Trustee Timmings moved, seconded by Trustee Galgano that action of the Treasurer in depositing two c. d. notes in the First National Bank of North Tarrytown be confirmed. Carried. Trustee Timmings questioned the two payments on the warrant to the Village of Tarrytown for the Warner Library. He asked the Treasurer's office to review the payments through the past year to make sure that 12 payments were sent and not 13. PUBLIC SAFETY Trustee Williams stated that Chief Spota received a letter from Eugene Aronowitz, Commissioner, Dept. of Community Mental Health, that he has been selected to receive an award for his efforts in the area ot suicide prevention. The award will take place on May 2nd. Mayor Zegarelli congratulated Chief Spota. Unable to attend the ceremonies, Mayor Zegarelli suggested Trustees who can, to attend. Trustee Williams stated that awards night will be held on May 14th and the Board is invited to attend. Trustee Williams reported that the new police car will replace 502 and will arrive shortly. Trustee Williams stated that the new fire chief's car is on order. He questioned the amount of insurance coverage on the fire apparatus which was referred to the Administrator. PUBLIC WORKS Trustee Salman stated that the street light maintenance contract expires on May 31st and move d that specifications be prepared and bids returned on May 12, 1986 fc a new contract commencing June 1, 1986 May 31, 1987, seconded by Trustee Williams. Carried. �-3- <£3U Trustee Salman moved, seconded by Trustee Timmings that specifications be prepared and bids returned on May 27, 1986 for the furnishing of labor and materials for repair and restoration of curbs and sidewalks. Carried. Money will be used for this project through the Chips program. Trustee Salman moved, seconded by Trustee Timmings that specifications be prepared and bids returned on May 27, 1986, for the replacement and repair of a 20" sewer line under ramp of General Motors. Carried. Governmental Relations Trustee Mangieri reported "progress". RECREATION Trustee Galgano reported "progress". ADMINISTRATION Trustee Ceconi moved, seconded by Trustee Galgano that specifications be prepared and bids returned on May 27, 1986 for roof repairs to the Municipal Building. Carried. The financing will be made through a bond anticipation note. Trustee Ceconi offered the following resolution, seconded by Trustee Timmings: WHEREAS Almighty God has seen fit to take unto Himself the soul of the late Frank Mangieri, Sr., and WHEREAS the said Frank Mangieri, Sr. was the Father of Trustee Mangieri and a resident of the Village for many years having been held in the highest esteem by all those who knew him, now, therefore, be it RESOLVED that the Board of Trustees take official notice of Frank Mangieri, Sr. death, and be it further RESOLVED that this resolution be made a part of the official minutes of this meeting and a copy sent to the family of the deceased. Carried unanimously. Mayor Zegarelli offered Trustee Mangieri the sincere condolences of the Board in the passing of his Father. MAYOR'S REPORT: Mayor Zegarelli stated that Con Ed will begin their yearly street excavations on April 29th to improve services. The program will cause some traffic delays and inconveniences. Mayor Zegarelli stated that a sign contest will be held for North Tarrytown residents during which a $100 bond will be awarded for new signs at the entrances of the Village. Sketches should be submitted to the Mayor and Trustees no later than May 27th, after which the Boarc will decide the winner. The Village will pay the cost of making the sign, he said. *^* Trustee Salman moved, seconded by Trustee Galgano that Stephen Vincek be appointed Road Maintenance Foreman at a salary of $27,500 plus longevity, subject to six months' probationary period, effective April 7, 1986. Carried. �b -4- Mayor Zegarelli stated that the matter was discussed with the County Department of Planning who have agreed to assist the Village in re-designing the island at Broadway and Beekman Avenue. It is hoped that the project will be done in time for the September festival contemplated for the Village, said the Mayor. Mayor Zegarelli stated that the Board is working on a family fun run which will be called "The Legend of Sleepy Hollow". The course will be solely in North Tarrytown and will be held on September l; rain date, Sept. 14th. Mayor Zegarelli stated that a food festival will also be held not * only on Beekman Avenue but on adjacent streets. The Village will I coordinate the events, said the Mayor. I Mayor Zegarelli stated that the Rotary Club is requesting a $50 donation towards the conversion of a "quiet room" for chaplains at the hospital and Trustee Ceconi so moved, seconded by Trustee Galgano. Carrie Mayor Zegarelli stated that in keeping with our desire to highlight some of the historic areas, a proposal has been prepared for a proposed law in keeping various areas of the Village as landmarks and historical areas and stated that an informational hearing will be held on May 27th to review the proposal. Mayor Zegarelli stated that James Beach will be retiring as Presides of the library board and will be honored on May 4th. Trustee Ceconi moved, seconded by Trustee Williams that a letter of appreciation be sent to Mr. Beach on behalf of the Board. Carried. Mayor Zegarelli stated that a ceremony will be held on May 4th at the Sleepy Hollow Cemetery by the N.Y.Regiment of the Guard in honor of those men who defended the N.Y. City water supply during World War I and Trustees are invited to attend. Mayor Zegarelli stated that he contacted some various artisans in the Village who have agreed to work on some of the historical monuments, especially Fremont Fountain. I I I COMMUNICATIONS Communication from Chief A. Apollonio, Sec'y. of fire Council, regarding changes in personnel in Fire Patrol, P H & L and Rescue Hose Companies was read and on motion of Trustee Williams, seconded by Trustee Timmings, action of Counsel was confirmed by the Board. Carried. Communication from Chief A. Apollonio, Sec'y. of Fire Council, requesting permission for Fire Patrol to take its apparatus to Mt. Kisco on July 11th and Millwood on July 24th, together with the Chief's car; Pocantico H & L to take its apparatus to Croton on June 14th, with the Chief's car and Rescue Hose to Mamaroneck on July 1st, rain date, July 2, with the Chief's car was read and on motion of Trustee Williams, secondec by Trustee Timmings, permission was granted. Carried. �*3£ Communication from Mrs. L. Lemme, 255 Highland Avenue, requesting the trimming of three trees bordering her property was read and referred to the tree inspector. Communication from Spencer Hayden, 166 Farrington Avenue, requesting curb repairs was read and referred to public works. Communication from Thomas Curtin, President of Rescue Hose Co., requesting permission to erect a sign across Beekman Avenue, as well as at the intersection of Beekman Avenue and Broadway to advertise their annual Flea Market at the General Motors lot on May 31st from 6 A.M. - 5 P.M. was read. Trustee Ceconi moved, seconded by Trustee Williams that permission be granted. Carried. Communication from Mrs. Irene Deely, 31 Palmer Avenue, requesting inspection of two trees in front of her property was read and referred to the tree inspector. Communication from Mrs. Florence Fiala, 40 Depeyster Street, requesting sidewalk repairs was read and referred to the public works committee. Communication from Mrs. Helen Gelston, 34 New Broadway, requesting the removal of a tree was referred to the tree inspector and public works committee. Communication from Mr. & Mrs. Rocco Martello, 50 Pocantico St., regarding the condition of the lot adjacent to their property was read. Mr. Margotta stated that an order to remedy the violation was issued to the owner and the owner did clean up the property. Communication from Irving Neimark, Attorney for Joseph Migilarese, advising the Board that Mr. Migliarese believes that the tree roots of the trees planted by the Village when his house was built, now extends into his sewer line. Although there is no clogging yet, Mr. Migliarese anticipates trouble in the near future. Mayor Zegarelli stated that as part of Tree City USA, we do not take down trees merely because it is suspected that a problem, which has not arrived yet, might exist. The matter was referred to the tree inspector. Trustee Ceconi stated that he was called to look at the trees and found them to be healthy. Communication from William Ault, 151 Harwood Avenue, requesting sidewalk repairs was read and referred to public works. Communication from Seymour Pollak, Tarrytown, requesting that licenses for amusement devices be reduced to their previous cost of $25 because the video machine business has died was read and referred to the police committee. �-6Communication from Mrs. Marie Timmings, 119 Rice Avenue, requesting the removal of a tree at her property was read and referred to the tree inspector. Communication from Martin Ruane resigning as a member of the Zoning Board of Appeals was read. Mayor Zegarelli moved to accept his resignation with regret, seconded by Trustee Timmings. Carried. Mayor Zegarelli appointed Jane Hogan to the Zoning Board of Appeals to fill Mr. Ruane's unexpired term (1987). Trustee Timmings moved to confirm the Mayor's action, seconded by Trustee Ceconi. Carried. Mayor Zegarelli stated that in accordance with a new law, an alternate can be appointed to the Zoning Board to fill in for an absent member and asked members for suggestions for an alternate. Communication from Andrew Sarcinella, 154 Farrington Avenue, requesting curb repairs was read and referred to the public works committee. Communication from John Morabito, Commander of the VFW, requests permission to conduct its annual Poppy Sale in North Tarrytown during the month of May was read. Trustee Timmings moved, seconded by Trustee Galgano that permission be granted. Carried. Communication from John Morabito, Commander of the VfW, inviting members of the Board to attend the dedication ceremonies at Robertson Park honoring deceased members on May 26th. Communication from Lois Indorf, Sec'y. Westchester Corvettes, requesting assistance in a Corvette Caravan "Vettes Across America" to be held on May 25th starting at the General Motors lot through Beekman Avenue to Mt. Kisco was read. Trustee Timmings suggested that the motorcade allow time for parishioners of St. Teresa's Church who will be attending 10:00 A.M. Mass. Trustee Timmings moved, seconded by Trustee Williams that permission be granted. Carried. Mayor Zegarelli stated that the Sleepy Hollow Restoration will again celebrate Pinkster at the Philipsburg Manor, Upper Mills, from 10 A.M. - 5 P.M. on May 17-18, and has requested assistance in crossings to and from the Old Dutch Church. Mayor Zegarelli moved, seconded by Trustee Williams that permission be granted and police department notified of same. Carried •» �The Clerk stated that she is in receipt of a list of delinquent water accounts of the Water and Sewer Department to be entered on the 1986 assessment roll in the amount of $21,521.59. Trustee Timmings moved, seconded by Trustee Ceconi that the amounts be entered on the 1986 Village Tax Assessment Roll. Carried. UNFINISHED BUSINESS Mayor Zegarelli stated that he received by Courier, four volumes pertaining to the Duracell plant from consulting firms hired by Duracell. The report indicates high levels of toxic disposal both interior and on site. It extends into areas of neighboring houses. It was noted that excavation of soil will be made in some cases to a depth of 18% ft - 20 ft. in neighbors' yards. The Village has, on its own, hired its own consultant, said the Mayor, and we will meet with him in the next ten days, or two weeks. On its own, the Village notified the residents in the immediate area that we have the report and they will be invited to a meeting with the consultant, as well as access to the materials. NEW BUSINESS Trustee Timmings moved, seconded by Trustee Salman that the Westchester County Village Officials legislative committee be granted permission to use the Board room for a meeting on May 3rd. Carried. Mr. Donald Caetano, Lawrence Avenue, stated that the curb in front of 39 Lawrence Avenue is in need of repair. Trustee Salman moved, seconded by Trustee Ceconi, that the bills submitted on the General fund and Water & Sewer warrants dated April 28, 1986 be paid after approval of department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Carried. There being no further business to come before the meeting, Trustee Williams moved, seconded by Trustee Salman that the same be duly adjourned. Carried.
