Present T. R. Homan, Administrator Philip E. Zegarelli, Mayor Susan Galeano James J. Timmings Allen T. Williams Steven Salman frank Mangieri, Jr. Arthur B. Ceconi, Trustees Robert J. Ponzini, Counsel Trustee Timmings moved, seconded by Trustee Williams that the minutes of the meeting held on August 11, 1986 be approved as written. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board may do so at this time. Mr. Emanuel Lobato, 21 Anderson Avenue, stated that he was here on behalf of himself and Stephen Maceyak and because of the aftermath of events happening, would like the Board to accept bumper stickers which state that North Tarrytown supports its police and that the same be placed on Village vehicles, as well as anyone else who would like one. He stated that they were concerned about the treatment which the Village received in the newspaper. The statement in the paper "Village divided" was unfair to the Village, said Mr. Lobato. Trustee Timmings moved, seconded by Trustee Williams that the stickers be accepted with the thanks of the Board and after review of Counsel as to whether or not there will be no conflictt will be placed oothe vehicles. Carried. Mr. Anthony Sarli, Harwood Avenue, stated that with respect to the failure of the storm drains which he spoke to the Board about at the last meeting, two severe storms occurred in which the storm drains failed. He stated that pictures of the catch basin were taken. Mr. Sarli inquired if we received the "as built" drawings. Mr. Margotta stated that they have not yet been received. Mr. Sarli thanked everyone for information he had received. Mr. Sarli stated that a Mr. James Cropper, District Conservationist made a survey of the existing drain system. Mayor Zegarelli stated that we received the four-page report, but we have not read it yet. It will be discussed in a work session, he said. The report will be made available to him, he said. �-2Miss Patricia Damin, 14 Dell Street, stated that Messrs. Shibetti and Buonanno own property at 18 Dell Street. His tenants are parking their cars on Dell Street, she said. She has asked him to ask his tenants to park on Gordon Avenue, so that she would have a space on Dell Street. She stated that she has one car and cannot find a parking space. Miss Damin stated that they own another lot on the street which is looking like a dump. Mayor Zegarelli stated that they were supposed to have cleaned it up i The matter was referred to the building inspector and Administratl Mayor Zegarelli asked Chief Spota if he would check into the parking situation on Gordon Avenue and Dell Street. Trustee Timmings stated that the Zoning Board granted a variance to Mr. Maceyak for most of his construction. The neighborhood does not have sufficient parking for the number of people living there. There are a number of illegal apartments created in the neighborhood which makes the situation worse, he said. Mr. Armando Volpacchio, Cedar Street, complained about the noise and fumes eminating from the property next door to his property. He stated that his next door neighbor has a garage business. He stated that he was told by the building inspector that he could do nothing about it. Mr. James Margotta stated that an inspection was made. The person owns about six cars himself. Most of the cars are registered in his name, said Mr. Margotta. He stated that when an inspection m made, the person was working on a car which was owned by him. Mayor Zegarelli requested a report as to the zoning, if he is taking in cars, etc. The matter was referred to the building inspector, Chief of Poli< and the Administrator. Trustee Salman stated that it would be of interest if he is fixing the cars and selling them, to which the Mayor stated that we will investigate the matter. Mr. Volpacchio stated that the police issued him a ticket for lighting a fire for a barbecue. He inquired as to what can be done about the ashes eminating from 100 College Avenue on to his property. He also inquired about the loud music from radios. The matter was referred to the police committee. REPORTS Of COMMITTEES ADMINISTRATION Trustee Ceconi offered the following resolution: �-3- 33*/ WHEREAS Almighty God has seen fit to take unto Himself the soul of the late Leonard Galgano, Sr., and WHEREAS the said Leonard Planning Board Chairman James Galgano and a resident of the held in the highest esteem by therefore, be it Galgano, Sr., was the Brother of Galgano and Uncle of Trustee Susan Village for many years, having been all those who knew him, now, RESOLVED that the Board of Trustees take official notice of Leonard Galganofs death, and be it further RESOLVED that this resolution be made a part of the official minutes of this meeting and a copy sent to the family of the deceased. Carried unanimously. Trustee Ceconi reported that a draft was received from Barry Strock, consulting associates, regarding computers and a report will be made at the next meeting. GOVERNMENTAL RELATIONS Trustee Mangieri reported "progress". MANAGEMENT & BUDGET Trustee Timmings reported that a fiscal report through the month of August has been placed on each Trustee's desk. PUBLIC SAFETY Trustee Williams moved that Jose Cotarelo be appointed Police Patrolman in and for the Village of North Tarrytown, effective immediately, at a salary of $20,000 per annum (Grade V) subject to twelve weeks' probationary period. Carried. Trustee Williams stated that we are broadening the police department. Mr. Cotarelo, present at the meeting, gave a short biography of himself. In connection with the forthcoming festival to be held on September 13th, Trustee Williams moved that the "Alcoholic Beverage on Public Property" Law be waived on September 13th, from 12 noon to 4:30 P.M. - in the event of rain, Sept. 14th, seconded by Trustee Timmings. Carried. In connection with the festival, Trustee Williams moved that a parking emergency be called for September 13th in the manors and adjacent streets to enable residents to attend the concert and fireworks display at Kingsland Point park, seconded by Trustee Salman. Carried. �-4Trustee Williams moved that Lt. Brophy be granted permission to attend the Persuader Instructor's School in Atlantic City on Sept. 2526, at a cost of $205, seconded by Trustee Galgano. Carried. Trustee Williams stated that the department has a hot line for anyone to call reporting drug transactions, etc. The number to call, which will not be taped, is 631-0766. The call will come directly into the main desk, he said. Trustee Williams stated that the fire department inspection will be held on September 27th and a picnic on September 28th at Kingsland Point Park. i Trustee Williams reported that estimates will be obtained for downspouts and screening of gutters on Rescue Hose quarters. I Mr. Homan stated that progress is being made on the bathroom in Union Hose quarters. The men are debating whether or not the other wall should be completed. The cost would be $700, he said. Trustee Williams stated that during the month of August, there were a lot of false alarms being set, many of which were between 5:30 - 6:30 P.M. He stated that Fire Council is reviewing the matter of removing the boxes. We are waiting for a report, he said. PUBLIC WORKS Trustee Salman stated that residents should have received a new notice regarding pickup schedule in their water bills. Everything must be bagged, except branches, he said. Trustee Salman stated that allegations were made by Mr. Caetano at the last meeting regarding some of the people in public works. He was going to come forward with some information, said Trustee Salmar which he never did. Trustee Salman stated that he is considering Mr. Caetano's comment unsubstantiated at this time. Work on sidewalks and curbs has been contracted out, said Trustee Salman. We are trying to get in as many as we can before it freezes. RECREATION Trustee Galgano stated that Mary Coyne passed the Supt. of Recreation exam and is on the eligible list for appointment. Trustee Galgano moved, seconded by Trustee Timmings that Mary Coyne's position of Recreation Supervisor be terminated, effective immediately. Carried. Trustee Galgano moved, seconded by Trustee Timmings that Mary Coyne be appointed Supt. of Recreation to continue at her present salary of $24,453, effective immediately, subject to twelve weeks' probationary period. Carried. �f' -5- 336 Trustee Galgano moved that Mary Coyne be authorized to attend a recreation conference in Anaheim, California, from Sept. 17-20, with expenses to include air fare and lodging, seconded by Trustee Salman. Carried. MAYOR'S REPORT: Mayor Zegarelli stated that a mailgram was sent to the NYS Cable Commission in Albany regarding a governmental access channel. We received a letter informing us that Channel 26 has been officially designated as the governmental access channel. Mayor Zegarelli stated that the comment from the Mayor of Tarry town concerning the potential moving of the Post Office from Tarrytown to North Tarrytown would be reprehensible, is precisely that this type of comment creates ill-will between the two villages when it comes to joint support for places like the library, C.O.C., etc. Mayor Zegarelli stated that the report received from the Immigration & Naturalization service reflected on people arrested and convicted of felonies during the last several years. The report also designates one of the individuals arrested furing the June 29th disturbance as a convicted felon and an illegal alien. Mayor Zegarelli stated that the Village is doing something that is very unique. We are trying to come to grip to make sure that laws are enforced. The Village does not have to take an unfair burden in the form of providing a domain for illegal aliens, he said. We always welcome people who are willing to work hard and live within the social and regular norms of the community and are willing to contribute to the well-being of our Village, said the Mayor. �-6Counsel stated that according to legislation adopted by the County of Westchester, if the Zoning Board wishes to over-rule a decision of the Westchester County Planning Department, it requires a vote of a majority, plus 1. He suggested that the Board adopt this legislation. Trustee Ceconi moved, seconded by Trustee Galgano that a public hearing be held on Monday, October 27, 1986 to amend Chapter 62 of the General Code. Carried. stated Noting a memo from Counsel, Trustee Timmings/that the courts have been overturning zoning ordinances pertaining to residences and what constitutes "family". He stated that Counsel has researched i and recommended the definition of family amendment. ] Trustee Timmings moved, seconded by Trustee Galgano that a | public hearing be held on October 27, 1986 to amend Chapter 62 of the General Code regarding the definition of "family". Carried. Mayor Zegarelli stated that the Zoning Board will be asked for any comments they may wish to make. COMMUNICATIONS Acknowledgement of sympathy from Lt. M. 0'Shaughnessy was read. Communication from Armando Volpacchio, 11 Cedar Street, requestinj sidewalk repairs was read and referred to public works. Communication from Sec'y. of Fire Council, Ron Biro, requesting an exempt certificate for John Cappello was read. Trustee Williams moved, seconded by Trustee Timmings that the certificate be granted. Carried. Communication from Mrs. Lucille Ceconi, 36 Amos Street, requestin that the tree in front of her property be trimmed was read and refern to public works. Communication from Mrs. Marie Timmings, 119 Rice Avenue, complair about ball playing on Van Tassel Avenue, as well as violation of Sections 50-6-2-7 of the General Code (automobiles being driven into yards over curbs and sidewalks) was read and referred to the police committee. Communication from Lidia Cruz, 45 Clinton Street, requesting the removal of a dead tree in front of her property was read and referred to public works. Communication from Joseph funigiello requesting permission, on behalf of the Tarrytown Post Office, to use Douglas Park for a picnic on September 28th was read. Trustee Timmings moved that permission be granted and that the police and recreation departments be notified. On the question, Trustee Galgano stated that she understands that the department does not have insurance. �-7- B3§> Permission was granted contingent upon review of Counsel. Carried. Communication from Thomas Russo submitting his resignation for retirement as Assistant Mechanic, effective October 2, 1986 was read. Trustee Ceconi moved, seconded by Trustee Salman that his resignation be accepted with regret and that a certificate of appreciation be sent to him. Carried. Mayor Zegarelli stated that he is in receipt of an invitation to attend a testimonial dinner for Senator John Flynn. He stated that a letter of appreciation and/or proclamation should be sent to him for his long term in government. As a non-partisan person, he was most helpful to the Village, said the Mayor. Trustee Timmings moved, seconded by Trustee Galgano that a letter be sent to him. Carried. Mayor Zegarelli stated that he is in receipt of a letter regarding the professional Bike Race which will start in Goshen and come through North Tarrytown on September 14th. He stated that there may be some inconveniences. The matter was referred to the Chief of Police. Mayor Zegarelli stated that the festival will be held on Beekman Avenue on Saturday, after which a band concert and fireworks will be held at Kingsland Point park. Mayor Zegarelli stated that we have a memo from Counsel regarding action commenced by Thomas Gleason against officials and former employees and officials and it is requested that an outside firm represent the Village. Mayor Zegarelli moved, seconded by Trustee Timmings that the firm of Anderson, Russell, Kill and Olick be authorized to represent the Village officials and former employees and officials. Carried. Mayor Zegarelli stated that people should be aware that we have expended $17,000 in legal expenses to defend former officials. These are events which were filed against the Village for events that transpired eight years' ago, he said. Mayor Zegarelli moved, seconded by Trustee Salman that a proclamation be made for United Nations Week, October 24th. Carried. Mayor Zegarelli stated that Counsel reviewed the contract for snow removal on County roads and were approved as to form and content. Trustee Salman moved, seconded by Trustee Timmings that the Mayor be authorized to sign said contract. Carried. Trustee Timmings added "under protest". NEW BUSINESS Trustee Timmings stated that one of the local churches had an article from the Pastor commending the police and fire departments and �-8tnoved that it be inserted in the minutes, seconded by Trustee Williams. Carried. Mayor Zegarelli stated that the Transfiguration Church is holding a meeting on September 25th, guest speaker, Fr. Terry Attridge, who will speak on Drug Prevention. All are invited to attend. Mayor Zegarelli stated that in connection with our Festival on Saturday, the Sleepy Hollow Restorations has announced half-price admission at Philipseburg. This is their contribution to attract people to the restoration, said the Mayor. Mayor Zegarelli stated that we will be redecorating the Headlessl Horseman bridge and Fremont fountain as part of restoring our own history which was overlooked for so long. Mayor Zegarelli stated that he is in receipt of a letter from Congressman DioGuardi regarding a forthcoming meeting with all officials, school boards, clergy, etc. of the community to discuss crack and drug abuse. The date and place has not yet been designated he said. Trustee Salman suggested the high school auditorium. Trustee Williams stated that he and Trustee Mangieri witnessed a number of black birds flying around the chimney. Trustee Mangieri stated that they were chimney swifts. It was mentioned that a screen' be placed over the chimney. The matter was referred to the administrator. ! ] Trustee Ceconi moved, seconded by Trustee Salman that the bills submitted on the General Fund and Water & Sewer warrants dated September 8, 1986 be paid after approval of department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Carried. There being no further business to come before the meeting, Trustee Ceconi moved, seconded by Trustee Timmings that the same be duly adjourned. Carried. For many it marked the end of summer, the beginning of school and most importantly, a tribute to the working man/woman. It is not unfitting that we salute those who work in the Tarrytowns for our safety, health, and well )eing. am thinking particularly of the olice department, our firemen and the ambulance corps. These people, our neighbors and fellow parishioners, give their time and energy for us. Some calls to which they respond may be inconsequential; others involve life and death situations. They respond to all sections of the Village equally. Life or property may be at stake. A parishioner at church needed immediate attention. Within thirty seconds a police car was here with oxygen. The ambulance followed shortly. Race, country of origin, length of time in the Village these were never asked by those responding to the call. A crisis was averted. When you hear the fire signal go off, or see the ambulance heading to Phelps or see a police car, with lights aglow, heading for some unknown destination, please say a short prayer for these men/women who are laboring on our behalf, and for our neighbors they are serving. We salute you, members of the police, fire and ambulance!
