October 27, 1986 Mayor Zegarelli called the meetir<f to order at 8:15 P.M. and stated that this special meeting was to discuss the financial figures and various audits done or to be completed by Pat Pilla, accountant for the COC. Present T. Homan, Adm. Philip E. Zegarelli, Mayor Allen T.Williams Steven Salman tfrank Mangieri Arthur B. Ceconi, Trustees Absent Susan Galgano James J. Timmings Trustees Robert J. Ponzini, Counsel Mayor Zegarelli stated that as a result of a telephone conversation today with John Keels, he was notified that the financial summary would not be available to the Board tonight, and those numbers that were available and furnished, but not released, were to be discussed with members of the Board of Directors prior to sitting down with us. He notified Mr. Keels that the time frame for our response would be left for their side. He informed Mr. Keels that we would await the numbers and presentation, not only with himself present, but with Mr. Pilla, and preferably, before the next meeting. Their proposed deadline is the end of this month, said the Mayor. Trustee Salman stated that we were promised this information at the Board meeting last week. Mayor Zegarelli stated that based upon information that will be available to us, we were assured that we would have the numbers for us to discuss and review their financial picture. It is mandatory on our part to await the report. Trustee Ceconi inquired if this would mean that the C.O.C. will close and was answered by the Mayor that it would not. There is an insurance grace period, said the Mayor. Trustee Ceconi stated that their insurance policy expires on October 30th. Mayor Zegarelli stated that they are not to be without insurance at the end of the month. Without the audit numbers, there is not much for us to go by in reaching a decision. Mr. Lewis is out-of-town. Trustee Ceconi stated that before the next fiscal year, we should be notified in advance of their requests so that we are not caught in this same predicament. No other business to come before the meeting, Trustee Ceconi moved to adjourn, seconded by Trustee Salirian. \>&arried. Res Philip E. Zeg Acting Clerk �-2Mayor Zegarelli noted that the price differential was 2-1 and recommended that they be fully reviewed. Trustee Timmings moved, seconded by Trustee Salman that the bids be referred to the Administrator, Chairman of the Publics Works and the representative from the County for review to make sure that the bidders were bidding on the same item and project. Carried. Mayor Zegarelli asked if there was anyone present who would like to address the Board. Mr. Joseph Valcarce, Jr., owner of Knapp-McCarthy Taxi, stated that he submitted a letter at the last meeting requesting an increase, in taxi rates. 1 Mayor Zegarelli stated that the letter was received but no action was taken in order to allow him to make a presentation in person. I Mr. Valcarce stated that the increase requested was being made because of the increase in insurance premiums, liability insurance increased 7.65%, he said. He stated that he is having difficulty in obtaining drivers and he would like to increase their rate of pay so that he would get better quality workers. He stated that he has the lowest rates of all the Cab Companies in Westchester County and he would like to be brought up to their rates. He stated that TarrytoW granted him an increase. Mayor Zegarelli stated that according to our taxi law, a public hearing would have to be held for any changes made to it. Following a short discussion, Mayor Zegarelli moved, seconded by Trustee Williams that a public hearing be held on December 15, 1986 on a proposed amendment to increase taxi fares. Carried. Mrs. Kay Lingardo, Pine Close, noted an article in the Daily News regarding the proposed adoption of the "family" law by the Village. Being in the real estate business, she stated that she hadl asked the Building Inspector that if she wanted to rent an apartment I in her house to serve single people, could she do it and was answered in the negative. She stated that there are college students coming from out of State who need housing in this area and who cannot afford the rent so they share apartments. She inquired if this was taken into consideration. She stated that she rented an apartment to six individuals. She said that not much publicity was given. Mayor Zegarelli stated that the Board held a public hearing whic was on Cable TV. The reporters knew about it, he said. The fault does not rest with the Board, said the Mayor. The definition of a "family" came from the County. He stated that we know from other sources that the zoning violations in the Village have been broken. Homes are being turned into boarding houses. One family homes have been converted into 2 - 3 families, said the Mayor. Mayor Zegarelli inquired of Mrs. Lingardo that he assumed that the apartment which was rented to the six individuals was a legal one and if the landlord was paying his fair share of taxes to the Village by the fact that it has one apartment with six individuals. He told her to look at the additional cars on the street. �On an inquiry of Mrs. Lingardo as to how the law will be enforced, Mayor Zegarelli stated that if a complaint is received, we will apply it. Counsel stated that the law was sufficient to eliminate everyone of the situations she was talking about. He stated that the definition was approved by the Westchester County Planning federation for use County-wide. It defines relatives, group homes, non-related relatives, etc. It preserves the sanctity of family residence, he said. Mrs. Lingardo also inquired about the Tappan Motors "Pickwick Post" plans, as well as the hearing on the former Exxon property. She stated that she knows that the plans were approved and asked if any commitment was made and was answered that final plot plans have to be submitted. Mrs. Lingardo stated that although the Planning Board wrote a letter against the variance on the former Exxon property and that Trustee Williams appeared before the Zoning Board on behalf of the Board of Trustees against the variance, nothing is being said by the Board of Trustees about this zoning problem. Mayor Zegarelli stated that he had talked to members of the Zoning and Planning Boards and that the Board of Trustees did provide information to the Rockefeller, Taconic, etc., to look at the site to make it an asset to the Village as compared to its use as a car lot, but they were not interested. The Zoning and Planning Boards are autonimous boards and we cannot intervene in their authority. The Kahn property was handled according to law, he said. REPORTS Of COMMITTEES ADMINISTRATION Trustee Ceconi stated that 14 processing proposals were received in response to the Village's request for a computer system. Mr. Barry Strock will assist the Village in the selection of a system. If all goes well, implementation would take place the first and second quarter of 1987, said Trustee Ceconi. Trustee Ceconi moved, seconded by Trustee Galgano that the Mayor be authorized to sign the contract with Barry Strock, subject to review of Counsel, as to form and content. Carried. Trustee Ceconi stated that after meetings with the staff of Complus Data Innovations, the Board and other representatives of the Village, Complus will install a violations management system for the processing of all parking and moving violations. The new system is expected to improve the operation of the court, said Trustee Ceconi and moved that the Mayor be authorized to sign the agreement with Complus Data Innovations, Inc., seconded by Trustee Galgano. Trustee Timmings moved to amend the motion that the contract may be terminated upon thirty (30) days written notice by the Village, seconded by Trustee Ceconi. Motion and amendment carried. �-4Trustee Ceconi stated that the Village will hold its first auction of surplus equipment on November 22nd, at 9 A.M. and moved that the Mayor sign an agreement with Col. Jill Donerty, auctioneer, seconded by Trustee Timmings, Carried. Trustee Ceconi stated that plans are 75% complete for the renovation of Village hall and bidding will probably take place at the end of this year or the beginning of next year. Trustee Ceconi moved the following resolution, seconded by Trustee Timmings: WHEREAS the Board of Trustees must designate for officers will be held on March 18, 1987, and WHEREAS the Board of Trustees must designate by resolution and publish the offices which are to be filled in such election and the terms thereof, now, therefore, be it resolved: Section 1. That the Board of Trustees designates the following offices as vacant at the end of the current official year, to be filled at the Village Election to be held on March 18, 1987 for the following terms: Mayor - Two years; Three Trustees - Two years each. Section 2. The Village Clerk is hereby directed to publish the resolution in full in the Daily News, a newspaper of general circulation within the Village. Section 3. This resolution shall take effect immediately. Carrie GOVERNMENTAL RELATIONS Trustee Mangieri stated that a meeting was held with Morton Yulish, Market Study Co. on graphics, who will appear before the Council for suggestions as to what can be done at the former Exxon property on North Broadway. Trustee Mangieri stated that a proposal is being submitted for a 24 unit housing project in the central Village which will probably be in the middle income range and eight units for senior citizens. He stated that this is good news for the Village. MANAGEMENT & BUDGET Trustee Timmings reported that we continue to maintain a cash balance in the General fund as of November 10, 1986. Trustee Timmings stated that the Treasurer deposited a c.d. note in the amount of $1,300,000 for 14 days at 5%% interest in the first National Bank of North Tarrytown and moved that her action be confirmed, seconded by Trustee Galgano. Carried. Trustee Timmings stated that the annual audit of the Village was completed and in a meeting with the auditing firm found the Village to be in a sound position, after which the Mayor said it was in an excellent position. �Trustee Timmings noted another bill in connection with the Gleason case and stated that we have now wiped out the Contingency fund. We are obtaining a financial status of all accounts. A report has been received from the finnegan firm regarding the Village assessment picture and we should be ready to move forward. Trustee Timmings moved, seconded by Trustee Galgano that a capital note be obtained in the amount of $8500 for drainage study in the two manors which will be conducted by George Lackowitz. Carried Trustee Timmings stated that we joined with the Westchester Village Officials and Tri-County Village Officials in petitioning the State for an increase for the services of their Justice Courts in certain criminal proceedings and other proceedings from $5 - $10 and at the last legislative session, the increase was passed. PUBLIC SAfETY Trustee Williams stated that a hearing was held on October 14th regarding a proposed amendment to Section 57-7 of the General Code which would allow parking on the east side of Andrews Lane. He stated that no one came before the Board in opposition. This is a means of allowing parking spaces available to residents, said Trustee Williams. Trustee Williams moved, seconded by Trustee Timmings that the following Local Law #4 of 1986: (Law in detail official minutes) Trustee Williams moved that Ptl. Manuel Caixeiro be appointed Detective, effective December 1, 1986 at a salary of $35,716, plus longevity, subject to twelve weeks probationary period, seconded by Trustee Mangieri. Carried. Trustee Williams gave a brief background of Ptl. Caixeiro's qualifications, and presented him with a Detective's badge. Trustee Williams moved, seconded by Trustee Galgano that Bobby Checchi be appointed Patrolman at a salary of $20,000 per annum, effective December 1, 1986, subject to twelve weeks* probationary period and subject to the Municipal Training School, seconded by Trustee Galgano. Carried. Trustee iKilliams gave a brief background of Mr. Checchi and presentea/with a patrolman's badge. Trustee Timmings stated that a new patrolman has to have a supervised period before being released on his own. By appointing Mr. Checchi as a patrolman effective December 1st, he will have the month of December to be under a supervised patrolman. When he completes the school, he should be in a position to be an independent operator in the police department, said Trustee Timmings. Trustee Williams reported all fire apparatus in good working condition. The painting of Union and Rescue Hose and Central headquarters will be taken up in a work session, said Trustee Williams. �-6Trustee Williams stated that the old ambulance, fire Chief's car and police cars will be included in the public auction. PUBLIC WORKS Trustee Salman stated that the Chestnut Street drainage project should begin some time in early December. Trustee Salman stated that the public works equipment replacemew schedule is being taken care of. Included in the request, will be a leaf collection equipment and a catch basin truck. Trustee Salman in late November. stated that the sidewalk program should end Trustee Salman stated that the Jacobsen property drainage specifications have been prepared and are being reviewed by the Jacobsens. Trustee Salman stated that the Lackowitz Engineering Company is making a study of the drainage problem and will develop a rainfal] study model of the area. The report should be ready in March, he said. Mr. Lackowitz has done similar studies in Pleasantville, Briarcliff and Ossining, he said. Trustee Salman moved, seconded by Trustee Timmings that the Board confirm Mr. Lackowitz's study of the drainage problem. Carried Trustee Salman stated that repairs were made to the sewer under the General Motors ramp. He stated that this line had tied into the County line. There was no cause or relation to say that the damage was caused by the construction of the General Motors ramp, said Trustee Salman. Trustee Salman moved that the Christmas lights be turned on December 5th, hours for illumination would be when the street lights come on and off, seconded by Trustee Ceconi. Carried. Trustee Salman moved that Stephen Vincek be appointed General foreman, Dept. of Public Works, effective immediately, at a salary of $32,000 per annum, plus longevity, subject to six months' probationary period, seconded by Trustee Ceconi. Trustee Salman stated that the salary includes any increase which will be given retroactive to June 1, 1986. He will not be entitled to any other increase retroactive to June 1, 1986, said Trustee Salman. Trustee Salman stated that Steve is a very capable individual and is pleased to recommend him. RECREATION & HUMAN RESOURCES Trustee Galgano stated that Tarrytown had re-arranged the schedule for the senior citizens van. She stated that instead of two trips on Tuesday and Wednesday, there would be two trips on Wednesday. She stated that Tom and Mary will attend the senior citizens meeting and will ascertain if there are any problems. �l:i -7- 38k UN1 * Trustee Galgano stated that all work has been performed in the parks. The contractor planted a lot of trees which were dead, but will be replanting in the spring. The committee is checking into lighting costs for the lighting up of Sykes courts for night-time basketball. i'/r r MAYOR'S REPORT: '<«1 I Mayor Zegarelli stated that a new section was added to the Real Property tax law which authorizes the legislative bodies of local governments to appoint temporary members of Boards of Assessment Review to serve on administrative hearing panels. He stated that the panels are granted the same powers as those of the Board of Assessment review, except that the panels may not determine the final assessments, but are to provide recommendations to the Board as to final assessments. ' • i > Mayor Zegarelli asked the Clerk to obtain additional information regarding this advisory panel. Mayor Zegarelli stated that a check in the amount of $1786.60 was received from Mrs. E. Spaulding, Director, American Cable System in franchise fees for the period ending June 30, 1986 and has been deposited by the treasurer. * fie .1! J Mayor Zegarelli stated that we will be having the final hearing on the Closure permit of Duracell at the VJFW hall on North Washington Street, November 13th, at 3 P.M. and 7 P.M. This is to review the closure permit itself, he said. i v' ."I ;; Ii Mayor Zegarelli noted that the Village paid out in legal fees the amount of $100,000 in connection with the Gleason case in order to protect the Village officials. Counsel stated that w e can o n l y comment to a limited e x t e n t . He stated that the m o s t recent action w a s d i s c o n t i n u e d v o l u n t a r i l y by h i s a t t o r n e y b e c a u s e the action w a s w i t h o u t m e r i t . ' S • ' > I Mayor Zegarelli noted the Closure plans by Albert Klauss regarding the Duracell facility which will be kept open for anyone's review. h COMMUNICATIONS Communication from the Village Clerk in Tarrytown notifying the Board when a change of use is proposed on a piece of property within 500 ft. of another municipality was read. The property in question is 3 Hudson Street and the variance being requested is for the conversion of the upper two stories into six small, one-bedroom residential apartment units, three on each floor. , / 1 The matter was referred to the building inspector. - I if ill i ^ n< �-8Communication from Anne Watt, Principal of John Paulding School, thanking the police department for allowing the school to use the road at Patriots Park for a Halloween parade was read and filed. Communication from the N.T.F.D. Convention Committee requesting monetary assistance in celebration of Rescue Hose and Union Hose 100th Anniversary to be held on June 18, 19 and 20, 1987 was read and referred to Trustee Williams for a report. Communication from Mrs. Edith Galgano, first Fice President of the Italian American Ind. Club requesting permission to hold a dance on Saturday, November 22nd from 7:30 - 12 midnight in the Van Tassel auditorium was read. Trustee Timmings moved, seconded by Trustee Galgano that permission be granted and police department notified of same. Carried Mayor Zegarelli stated that he granted permission to the Sleepy Hollow Student Council to hold a student parade the night before the football game with Ossining, Trustee Timmings moved to confirm action of the Mayor, seconded by Trustee Galgano. Carried. Trustee Williams inquired as to who will pay for the overtime. Chief Spota stated that all they were requesting was an escort. Mayor Zegarelli suggested that the auxiliary police be called upon to help out. UNFINISHED BUSINESS Trustee Timmings stated that at the last meeting, a public hearing was held on October 27th to exempt from Village taxes within the control of the Village to the extent of 50% of assessed value, properties owned by one or more persons 65 years of age or over. He stated that no one appeared pro or con and moved that the followii resolution be adopted, seconded by Trustee Galgano: (see attached) Trustee Timmings stated that a public hearing was held on October 27th on a proposed amendment to Chapter 62 of the General Code defining "Family". He stated that the Westchester Village Officials Association have expressed concern over maintaining zoning in communities. Since we only heard very limited objection, Trustee Timmings moved the following, seconded by Trustee Galgano: (See attached "family") �NEW BUSINESS Trustee Timmings stated that in talking to local firemen, especially those in the ambulance corps, he has been informed that many houses do not have numbers clearly identifying their houses. This is also a problem for the police department. Because of the impact on the safety of the people in residences, Trustee Timmings recommended that the public safety committee review this matter and if need be, hold a public hearing to regulate this problem. Trustee Salman stated that his wife was looking for a house for a half hour because there was no house number. Mr. Homan stated that there is a traffic problem between the hour of 2:30 - 3:30 on Beekman Avenue with the left turn on to Pocantico Street and which is causing congestion. He stated that a Mr. James Maxwell, Dept. of Public Works Traffic Survey has made a proposal and he would like this additional assistance. Trustee Salman moved, seconded by Trustee Galgano that the Administrator proceed to obtain this analysis from the County. Trustee Timmings moved, seconded by Trustee Galgano that the bills submitted on the General Fund and Water & Sewer warrants dated November 10, 1986 be paid after approval of department heads and that the Treasurer be authorized to pay same and that a copy of this resolution be attached to the warrants. Carried. There being no further business to come before the meeting, Trustee Ceconi moved, seconded by Trustee Timmings that the same be duly adjourned. Carried.
