March 23, 1987 *«w A regular meeting of the Board of Trustees of the Village of North Tarrytown, was held on the above date. PRESENT: Philip E. Zegarelli, Mayor James J. Timmings Allen T. Williams Steven Salman Susan Galgano Frank Mangieri, Jr. Arthur B. Ceconi, Trustees Robert Spencer, Counsel ALSO PRESENT: R. Tom Homan, Administrator Mayor Zegarelli called the meeting to order at 8:00 P.M. with a prayer and salute to the flag. Mayor Zegarelli stated that minutes will be brought up at the next meeting. Mayor Zegarelli read the notice of hearing to consider the James House, Phelps Memorial Hospital to be be used for catered affairs and similar activities. He stated that the James House and Hospital representativies have been most cooperative in our desire to have everything done legally for insurance purposes, Certificate of Occupancy and building permits. He also stated that he wants to make sure that people do not get confused about the fact that there are other things pending before this Board and the Planning Board in regards to additional work and proposals at the Hospital. This is totally separate, he said. Mayor Zegarelli asked if there was anyone present who would like to address the Board. Nora Gowen , Director of Volunteer at Phelps Memorial Hospital Auxiliary stated that the James House has been used in the past for meetings and was rented out to keep up with expenses. The James House is an important house historically, she said. It was built in 1851 and was designed by the architect of Grand Central Station. Catered parties local photographers and florists have used the house. Administrator Homan reported that the Hospital and he have been working together, and progress is being made to resolve the water situation which is not adequate, he said. He also stated that they have been working with the Village Consulting Engineer and Planning Board regarding the concern on fire qualability at the James House. The hospital has been before the Planning Board with plans for a Day Care Center. One of the questions that came up is the availability of water. Once the question is answered, he said, that will answer the question of fire qualability. �-2- c-wr Trustee Williams moved that there being no further comment before the Board, the hearing be closed, seconded by Trustee Ceconi. Carried. MAYORS' REPORT: Mayor Zegarelli stated that there is an opening on the Recreation Committee with the resignation of Eva Piedimonte and appointed Jimmy Warren to fill her unexpired term. Trustee Galgano moved that the action of the Mayor be confirmed, seconded by Trustee Ceconi. Carried. Mayor Zegarelli stated that there was an alternate vacancy on the Zoning Board of Appeals and appointed James J. Timmings an alternate for a term of 3 years. Trustee Ceconi moved seconded by Trustee Salman that action of the Mayor be confirmed. Carried. Mr. Armando Galella, 40 Depeyster Street, stated that he read an article in the newspaper whereby General Motors would be given a ten year extension. Mayor Zegarelli stated that he read the same article and it was sort of 65-75% correct. When we negotiated with General Motors about 4 years ago, said the Mayor, it was due to two items. General Motors filed for three consecutive years tax certiorari claims against the Village. General Motors was looking for a tax cut because based on its assessment, they felt they were over assessed. When faced with that, we would have to go to court, said the Mayor. General Motors itself was curtailing production on its export body car. They had to cutback from 2 shifts to one shift and ended up with a situation where the plant itself was in jeopardy because they had not been awarded or granted what would be the next line. We were faced with the possiblity of the plant being shut for good or still being in court to fight the tax certiorari. Mayor Zegarelli stated that we looked into the cost if we went into court. Based on initial discussions with appraisers and lawyers, it would cost approximately one half million dollars to defend the Village Assessment, he said. He stated that if we did go to court and won, we would end up staying exactly the way we are. We stand to lose. Only 3% of tax certioraries against large corporations were won by municipalities, he said. He stated that General Motors is paying a pilot in payment, in lieu of taxes. If the plant closes, they have to pay whatever is in the stipulation, said the Mayor. Any new buildings going on, said the Mayor, would be subject to full assessment. General Motors came in to file for permits in the amount of $14,000. Mayor Zegarelli stated that the bottom 1 ine is that we have a pilot to save the plant, three year tax certioraries forgiven, thereby saving the Village money if we had to go to court. Mayor Zegarelli stated that General Motors did not get an additional 10 year extension. Mrs. Irene Deely thanked the Mayor and Trustee Timmings for their years of service to the Village. �Dr. Edward Zegarelli pointed out the reasons for the Mayor not running for re-election and stated that he worked very hard for the Village. He wished the Trustees, who were not returning, well and thanked them for their services. REPORTS OF COMMITTEE Management & Budget: Trustee Timmings,"reported progress.** Public Safety & Light: Trustee Williams stated that Rescue Hose and Central Headquarters, and Hook & Ladder painting is almost completed. Public Works: Trustee Salman moved that Steven Vincek, considering the time he worked while the former general foreman was out on disability, be appointed General foreman, effective March 23, 1987, seconded by Trustee Ceconi. Carried. Trustee Mangieri,"reported progress." Administration: Trustee Ceconi,**reported progress.'* Recreation: Trustee Galgano,"reported progress.'* COMMUNICATIONS Mayor Zegarelli stated that he received a letter from the County Executive regarding the homeless that a meeting for Mayors and Supervisors will be held at a future date and referred the letter to the new Mayor. Mayor Zegarelli received a letter from the National League of Cities, re: Block Grant, CVBA Program and referred it to the Administrator. Administrator Homan reported that bids were opened on Friday morning at 10:00 A.M. on purchasing of equipment, 2 - 5 yd. dump truck, backhoe, vacuum and catch basin. Recommendations for the awarding of the bids will be made at the next regular meeting. Unfinished Business: Hayor Zegarelli moved, seconded by Trustee Galgano that the following Local Law #3 of 1987 be adopted: �^V7 Local Law #3 of 1987, hereby amends H Hospital District "Permitted Accessory Uses adding the following language: "Temporary use of existing buildings and facilities for fund raising activities, including leasing of space for catered affairs and other similar activities. Carried. New Business: Mayor Zegarelli stated that there will be a tentative meeting on March 31, 1987 for any items that have to be disposed of. Mayor Zegarelli stated that as is the tradition in the last meeting of the Board for this Village year, We will call upon those elected officials, particularly those who will not be returning for their parting words and thoughts. Trustee Williams thanked the existing Board for the tremendous opportunity to work with such professional caliber people, In the two years he has been on the Board, Trustee Williams stated that they did a lot of things good for the Village." They had problems and they addressed them the best they could. He stated that he worked with Chief Spota to help rid the*Village of drugs, weapons and assault. He stated that he never thought that he would be involved with a situation such as the one we had on June 29th. Through it, he said, gave him priceless management insights into the community and into problems at large. One of his goals he said in the fire Dept. was to help increase the equipment and make sure that our volunteer firemen, who are also taxpayers, are safe when they go into buildings and thinks he has succeeded in this. He vowed to return back to the Board. Trustee Mangieri stated that We had problems and faced them, we represented the Village to the highest. He stated that it was not easy to make some of the decisions we made, especially with General Motors. We stood together and stood by our decisions, he said. He stated that he believes wholeheartedlythat the decisions we made were for the best interest of the people of North Tarrytown. He stated that he appreciated all the support everyone gave him. Trustee Mangieri stated that if General Motors took us to court, it would have been disastrous. Trustee Timmings stated that 15 years ago tonight, he was elected for the first time and was set to start. It was not a very good year as that we started out in a minority position, however, he stated that they finally convinced the Democratic Mayor that we were more interested in North Tarrytown than his fellow party members. �-5By the end of the year, the 4-3 votes were going their way with the Democratic Mayor being the 4th of the deciding votes. In looking at all these years, there have been more good, than bad, he said. He stated that he thinks people will recognize that he contributed to the Village of North Tarrytown. Trustee Timmings quoted the late Margaret White when she told the incoming administration "not to get comfortable in the seats, we'll be back? I'm sure the Republicans will, said Trustee Timmings. Mayor Zegarelli stated that 13 yrs.' ago when he first ran, the meetings would be twice a month. He stated that he found it has taken more and more time. The Village absorbs time and people to do things. That is what you have in a spirit-community. There is a certain type of magnetism to draw people back and will draw others back to take various people places on this Board, he said. Mayor Zegarelli thanked all individuals who have come before and worked together. He thanked the outgoing Trustees. He stated that he cannot really say enough about the people of North Tarrytown. They were most cordial. He stated that he was the President of the West. County Village Officials and N.Y. State Conference of Mayors and received support from a bus load of senior citzen and others who attended his installation when he was President of the Conference. He stated he was given support when they went to battle at the State "House" for increase revenue sharing. He thanked everyone for this type of thing. Mayor Zegarelli commended and thanked all departments, office staff, Boards and Commissions for their good work. Mayor Zegarelli cited some of the things done, in settling the General Motors matter, Historic Landmarks, festival etc.. It was things of this nature which were so important to revive the spirit. Mayor Zegarelli stated that he is looking forward to spending more time with his family. He stated that he has volunteere his services to help in any type of transition or in tackling some of the problems. Trustee Salman commended Mayor Zegarelli for his good work and stated that he really encountered such a person with honesty, compassion, ability and dedication. He stated that he was disappointed that he didn't run again and extended the appreciation of the Village for his untiring efforts. Trustee Salman stated that he held the highest regard for Trustee Timmings. During contract negotiation, many people on the labor side stated that Jim was always a tough negotiator, but he was honest and fair, said Trustee Salman. �-6- He stated that Jim always kept an eye on North Tarrytown. He was well-appreciated by our accountants and his methods brought praise from the State Auditors, said Trustee Salman. His engineering background was very useful in many of our major contracts, he said. Trustee Timmings spent many hours pouring over our fiscal status and always had valuable monthly reports for us, said TrusteeSalman. We'll miss him, he said, and thanked him. Trustee Salman stated that Trustee Williams has been an asset to the Village in a number of ways. His familiarization with the fire and police departments was exceptional. He worked with Chief Spota on the MRD System. His input to the development of the specifications of the ambulance was also most helpful. Trustee Salman thanked Al for his input over the past two years and stated that we will always be proud of his accomplishments. Mayor Zegarelli thanked the Cable System representation for their outstanding work. He stated that it is important that this municipal channel be maintained. He volunteered to work with Hal and Sunny on the "Tappan Zee Chronicle", a biweekly program, particularly on the government side. Mayor Zegarelli stated that Counsel is negotiating a contract with the Cable System for the use of the Water Dept. building, on a temporary basis, until a permanent location is found. Administrator Homan stated that he was the Villages first Administrator. It was difficult for him and at times, probably difficult for the Village, however, it was made much easier and enjoyable to him by the support and input given by the outgoing Trustees and Mayor. Without their support and input on many items, said Mr. Homan, it would have been more difficult. He thanked the outgoing members for their support. Mr. Joseph Ruscigno thanked the Mayor, on behalf of the Senior Citizensifor all he has done for them and wished him well. Mr Sunny, McLeanfthanked the Mayor and Trustees, on behalf of Cable Television denter, for the support and cooperation in bringing the municipal channel to function. Trustee Williams moved, seconded by Trustee Timmings that bills on General fund and Water & Sewer warrants dated March 9, 1987 be paid after approval of Department Heads and that the Treasurer be authorized to pay same and that a copy of this Resolution be attached to the warrants, Carried. There being no further business to come before the Board, Trustee Mangieri moved, seconded by Trustee Salman the same be duly adjourned. Carried.
