PUBLIC HEARING : RE: Amendment to Section 52-19 of the General Code of the Village of North Tarrytown, entitled "Taxicab-License Tor VehicTes" Mayor Gandolfo read the attached Public Notice. Mayor Gandolfo stated that if there was anyone who would like to address the Board regarding this Public Hearing to please do so at this time. Mr. Steve Serina, of 222 Beekman Avenue, North Tarrytown, New York asked if the other Public Hearings regarding this matter could be opened also. Mayor Gandolfo stated that she would open the other two Public Hearings regarding this matter at the same time. PUBLIC HEARINGS : RE: Amendment to section 52-18 of the General Code of the Village of North Tarrytown, entitled "TaxicabsLicense Fee for Vehicles" RE: Amendment to Section 52-13 of the General Code of the Village of North Tarrytown, entitled "Taxicabs-Fees for taxicab drivers' license" Mayor Gandolfo read the above captioned Public Notices and announced that all three Public Hearings were now open for Public Comments. Mr. Serina asked why the high increase from $25.00 to $50.00. -3- �Mayor Gandolfo stated that there is a lot of paper work involved for the staff to process the applications which takes time. Mr. Serina stated that Tarrytown charged $20.00. Mayor Gandolfo stated that each Municipality must govern their own licenses. The Mayor further stated that the reason for the increase in fees is because the Administrative cost is increasing. Mr. Sheldon of Knapp & McCarthy stated that the estimated business done in North Tarrytown is 15%. He further stated that they are caught between two Villages. What has to be done in Tarrytown also has to be done in North Tarrytown as far as licensing. He stated that these prices were way off base as Ossining only charges $10.00. The Mayor stated that when Administrator Homan made these recommendations to the Board he was looking at other municipalities. Mayor Gandolfo stated that this will be discussed at the work session and a decision will be made at the July Board meeting. PUBLIC HEARING : RE: Amendment to Section 3-4 A_. o£ the General Code of the Village of North Tarrytown, entitled "Alarm Systems Application for Permit" Mayor Gandolfo read the attached Public Notice. Mayor Gandolfo stated that if there was anyone who would like to address the Board regarding this Public Hearing to please do so at this time. Trustee Salman asked is a transmitted signal was one that went directly into Police Headquarters or if it was any signal the Police may hear. Mayor Gandolfo stated that the intent of the Code was that it was for signals that were transmitted directly to Police Headquarters* Mr. Fitzpatrick stated that years ago, people were charged for false alarms that when off three and four times. Trustee Salman stated that he thought fifty dollars was too much for the protection of a person's home. _4_ �Mayor Gandolfo stated that perhaps there could just be a charge for frequent false alarms and that this matter would be taken up at the work session. She will speak with the Chief of Police to get a report on the frequency of false alarms. PUBLIC HEARING : RE: Amendment to Section 3-7 of the General Code of the Village of North Tarrytown, entitled "Alarm Systems ^ Permit Fees" Mayor Gandolfo read the attached Public Notice. Mayor Gandolfo stated that if there was anyone present who would like to address the Board regarding this Public Hearing to please do so at this time. Mr. Galella asked where these figures were coming from. Mayor Gandolfo stated that these numbers were taken from a survey from comparable municipalities. Mr. Fitzpatrick stated that he has a business in Tarrytown and that they do not charge as much. Mr. Policki asked why he should pay the Village for having an alarm. He also stated that the Village should pay him for doing a service because by having an alarm meant that the Police Department did not have to watch his house as much. Mr. Caetano stated that he felt that it was a good policy of the Village to charge however, fifty dollars is too high. He further stated that when someone installs an alarm system in their home they are actually preventing crime in the Village which also looks good for the Police Department and helps the community. Trustee Salman stated that the administered cost is the initial license and then after that it is a renewal. Therefore, he feels that the charge should be for frequent false alarms. Mayor Gandolfo stated that this would be discussed at t ie work session. Since there were no further Public comments Trustee Galgano moved that this Public Hearing be closed seconded by Trustee Fudali. Carried. BID OPENINGS: None -5- �PUBLIC COMMENTS: Mayor Gandolfo stated that if there was anyone who would like to address the Board on any issue to please do so at this time. Canine Department; Edna Belanich of 153 North Washington Street, North Tarrytown, New York stated that she was in receipt of a cover-letter acknowledging a petition which was submitted to the Board on June 2, 1987. This petition contained approximately 219 signatures in favor of keeping all three dogs in the Canine Department. Ms. Belanich then read this letter to the Board. Mayor Gandolfo stated that this was to be addressed at this meeting. The petition was looked at during a work session and it was the majority opinion of the Board to leave the Canine Department as originally decided. The Board members do not feel it is appropriate for the Village of North Tarrytown to have more than one dog in the Canine Department. Ms. Belanich stated that she did not feel safe in this Village and that there are 219 signatures from people in the Village who feel the same. Trustee Fudali stated that half of the signatures on the petition did not have addresses. They were just signatures. Trustee Salman stated that a lot of money was spent to train the dogs and the officers and that he would prefer to keep the dogs as is. Mr. Tom Policki stated that if the dogs had not been in the Department this summer during the riot that there would have been more problems. Mr. Caetano stated that he feels the dogs are good and that strangers fear them. However, he further stated that he feels more than one dog is a big waste. Mayor Gandolfo stated that it is the feeling of the Board that the Canine Patrol was useful in certain instances but that they feel one dog is enough. No other Village has more than one dog. Mr. Galella asked how much it costs the Village for these dogs. Trustee Salman stated that it was about $12,000.00. �Mayor Gandolfo stated that there was also the cost of training and the overtime needed to train. Trustee Fudali stated that it bothers him people think the only way to resolve community relations is through the use of dogs. He feels problems should be resolved through discussion not dogs. Litter: Ms. Phyllis Lerner stated that she is thrilled that the Village is doing something to clean up the litter on the sidewalks and that she would like to join a group to clean up the Village. However, the tickets really turned her off because a lot of the litter isn't even the merchants. Mayor Gandolfo Btated that there is a custodian who she has asked to sweep twice a day. The Village is also trying to keep the gutters clean bu having a sweeper clean out the gutters in the afternoons. Trustee Galgano stated that a person could sweep ten times a day and still get a ticket. Perhaps the ordinance could be adjusted. Mayor Gandolfo stated that the Village has asked the schools to set up some kind of education program for the children to make them aware of the problem of litter. Also some members of the Department of Public Works are being deputized to give tickets to the litterers. This may deter people from littering. People will be deputized at the July meeting. Mr. Caetano stated that maybe an ordinance could be made in which the people are warned. For example, the merchants could know they have three hours to clean up in front of their stores before ticketing. Trustee Fudali stated that other municipalities that enforce these sort of ordinances do not have any grace periods. He further stated that since the issuing of tickets, he has seen people sweeping their sidewalks at 10:30 in the evening and he is amazed. Mayor Gandolfo suggested that the merchants form a group and stated that she would get together with them to help organize one. Mayor Gandolfo stated that as far as the tickets, she doesn't believe that anyone will have to pay a big fine. It is a way of getting the merchant's attention. -7- �Trustee Salman stated he would hesitate to support a statement about the fines, hopefully the judge will understand but can't guarantee that the merchants will have to pay the fines. It is up to the judge. Ms. Diane Martello stated that she had a signed complaint regarding the empty lot on Pocantico Street which is an eyesore and a dumpsite. At the Zoning Board Meeting a couple of weeks ago and the Building Inspector stated that it would only get cleaned if he received a signed complaint. She further stated that she felt when the people are paying taxes that there shouldn't be a need for a signed complaint. Ms. Martello read the above mentioned complaint to the Board. Mayor Gandolfo stated that she would have the Building Inspector contact the owner of the property, Thomas Hales, and have it cleaned up. Mayor Gandolfo asked Counsel Hughes if there was something the Village could enforce on Mr. Hales to keep this lot clean. Counsel Hughes stated that this was something that the Building Inspector should do. Deputy Village Treasurer t Mr. Galella stated that he was speaking Treasurer who probably is doing his job very a citizen of the United States. Mr. Galella that he felt the Village Treasurer should be of the Village well but is not further stated a citizen. Mayor Gandolfo stated that he is the Deputy Treasurer and the Village had contacted Civil Service. Mr. Shah is applying for his citizenship now and expects it in the near future. Civil Service advised that there was not a problem with this. Counsel Hughes stated that Mr. Shah is the Deputy Treasurer and an Acting Deputy Treasurer. At this point he is only acting in this capacity until such time which he secures his citizenship in the United States. Mr. Gallela stated that if Mr. Shah takes off or something that by law he should be Bonded. Counsel Hughes stated that Mr. Gallela is referring to the Village Law, Section 3-300 which says that every officer of the Village must be a United States Citizen. This was recognized when they received Mr. Shah's application which is why he was appointed Acting Deputy Treasurer. Bonding is if Mr. Shah does something within the scope of his duties which -8- �makes the Village liable. This is something that is between the Insurance Carrier and the Village and has nothing to do with the Village Law. Phelps Memorial Hospital and Day Care Center; Mr. Galella stated that he attended a meeting regarding the Phelps Memorial Day Care Center in which it was stated that the Village was supposed to pay one million dollars for the Day Care Center to get water. Mayor Gandolfo stated that Phelps does have an application for the Day Care Center which is going before the Zoning Board. Counsel Hughes -stated that Phelps has been before the Planning Board for about nine months. The reason they are before the Planning Board is because the Village Zoning Code requires site plan review for any new structures which are to be constructed within the Hospital Zone. This issue which the Village Consultant Engineer has engaged with the Hospital and their Engineer is the issue of fire protection and the water at Phelps which is necessary to fighi. a fire. There has been ongoing discussion and there has been no resolution to date. There has also been studies as the Village, as a Municipality, has to be certain that Phelps has enough water to fight a tragic fire if one was to happen. Mayor Gandolfo stated that the Village is trying to determine the extent of the new pipe lines they would have to put in. It is an ongoing discussion between the Hospital and the Village and the Hospital would be paying for the improvements. Trustee Ceconi stated that there is a problem with where the site is planned for the Day Care Center. The fire truck cannot swing up and around so provisions have to be made for a new entrance exit out of the hospital. He further stated that Phelps had originally planned to have one hundred children at one time but there would be four turnovers possible which would mean four hundred children. Water Rates: Mr. DeFelice asked if the water rates have been settled. Mayor Gandolfo stated that basically they have been settled and will be based on a three tiered system which was discussed before. This will be voted on at the July, 1987 meeting. -9- �Village Administrator Position and Evaluation: Mr. DeFelice asked about the Village Administrator position and the fact that he should be living within the Village. Mayor Gandolfo stated that the Board adopted a resolution stating that the Village Administrator has to live within a ten mile radius of the Village so that he would be close enough in case of an emergency. Mr. DeFelice asked if the Village Administrator has saved the Village any money. Mayor Gandolfo stated that the Village needs someone in this position to help the Village apply for grants and State Aid which takes time and a full time person is needed for this. Mr. DeFelice also asked about an evaluation. Mayor Gandolfo stated that the Village employees are evaluated everyday. It was also mentioned about the changes taking place regarding the automation and renovations. Trustee Fudali stated that the renovations are very disruptive and that employees should be moved and put somewhere where they can concentrate. Trustee Fine stated that this should be looked at in a longer review. Make bigger changes for much longer and much more viable financial situations. Mayor Gandolfo stated a contract was awarded to the contractor during the last Administration. That this is the end of the renovation. Trustee Salman stated that the law stated that it would be the option of the Board whether or not the Village Administrator had to move inside the Village. Parking: Mr. Martello stated that the Zoning Board stated that there is a stipulation about parking which meant that there would is 1.2 parking spaces per unit. This was made in 1978 and he further stated that he felt this should be changed. Mayor Gandolfo stated that the Village is looking at the total zoning codes to update them to 1987 conditions. The Planning Board and the Zoning Board realize the situation of condominiums which require more parking spaces and this is being looked at. -10- �Mayor Gandolfo stated that she would ask the Chief of Police and the Department of Public Works to look into the parking space situation. Mr. Caetano stated that fifteen years ago a petition was passed to make Lawrence Avenue a one way street. The Fire Department knocked it down. This street in Mr. Caetano 1 s opinion is not wide enough for double parking. According to the State the same street is not wide enough for parking and two way traffic. Mr. Cappello stated that parking has been an ongoing thing in North Tarrytown and Lawrence Avenue is one of the narrowest streets in North Tarrytown. Something has to be done. Mayor Gandolfo stated that Trustee Galgano has volunteered to look into this matter. All the variances have to be looked over and the conditions on both sides for the Village a:*d Tappan Motors. Then they must be compiled to see what is in violation and what is not. These will be studied and the properties will be looked at to see what can be done. Trustee Salman stated that on Old Broadway there is a lot and many cars parked on the sidewalk also on Broadway, Lawrence Avenue and Beekman Avenue there is an open culvert which is dangerous if cars are parked there. Mr. Cappello stated that he did not understand why a truck can unload in front of the school zone. Mayor Gandolfo stated that Village looked for several spots for a loading and unloading zone and at the time, this seemed to be a good place. It will be looked into. Trustee Salman stated that there are strict Federal Codes in which specifically state where to unload and load. He recommended that these be looked at. Mayor Gandolfo stated since there were no further comments the Public Comments portion of the meeting be closed. APPROVAL OF MINUTES; Mayor Gandolfo stated that the minutes will be reviewed at the work session and then approved at the July Board meeting. -11- �/ MAYOR'S ANNOUNCEMENTS: Mayor Gandolfo stated that she has a meeting with Senator Spano on Friday to go over the Village's State Aid package. His staff is starting to prepare a draft of the special legislation. After this is done the Village will have to start a massive campaign to get this State Aid package approved. The Parking Authority will be meeting with the Village at the next work session. This work session is scheduled for June 23, 1987. The Parking Authority has several proposals to be reviewed. Mayor Gandolfo passed around a report from the Chief of Police regarding the Foot Patrol. This covered the time period from May 28, 1987 to June 11, 1987. Officers have been walking at least twice daily. The Chief of Police will try to make it to the next work session per request of the Board. There will be one regular meeting on July 7, 1987 and not another one until the month of August. Mayor Gandolfo stated that she has also received an investigation from the Chief of Police regarding some complaints that were received. This will be discussed at the work session. The final recommendations has been received on the Tappan Zee study from the State. The upper Nyack and North Tarrytown site was considered a poor choice because of the impact on the vehicles per day and the opposition of Government Officials and residents. The Board would like to go on record as being opposed to the the Upper Nyack and North Tarrytown Site. Moved by Trustee Salman and seconded by Trustee Galgano the paper will work be started regarding 79 College Avenue. Carried. Mayor Gandolfo stated that there is a strip of property on Devries Avenue owned by the Village which she stated she would like to have surveyed to see how much property is there. Mayor Gandolfo stated that the other small strips of property will also be looked into. Mayor Gandolfo stated that the Board is invited to march in the Fireman's parade Friday and Saturday if anyone would like to attend. It will start in front of the church at 7:00 p.m. Friday night on June 19, 1987. -12- �VILLAGE ADMINISTRATOR'S REPORTS: None. RESOLUTIONS: Mayor Gandolfo stated that she had a Resolution for the late Steve Vincek. She read the attached Resolution. Be it resolved that the same be a part of the Village minutes of this meeting and a copy sent to the family of the deceased. Mayor Gandolfo then asked for a moment of silence in honor of Mr. Steve Vincek. CORRESPONDENCE FOR RECEIVE AND FILE: Mayor Gandolfo Btated that a letter was received from Phil Benzer regarding the traffic on Route 9 from the Church up to 117. This will be referred to the Chief of Police, An invitation from Walter Ruberger was received to invite the Board to a private viewing of the Budwieser Clydesdale Horses on Thursday, July 18, 1987 at Fox Hill Farms from 11:00 -3:00 p.m. A letter was received regarding an Ambulance which is parked in Webber Park at all times, day and evening which is disturbing the neighbors. This correspondence is being referred to Counsel Hughes who will report back to the Board. A letter was received from Joseph DeMichele, Jr. requesting access to his property on Cottage Street. He stated that he would like access which would require a permit from the New York State Department of Transportation. Mayor Gandolfo stated that this would be referred to James Margotta, Building Inspector. A letter was also received from a concerned citizen at Webber Park. It was written to inform the Board that extensions are going on without permits. Specifically, 18 and 29 Gordon Avenue. This will also be referred to the Building Inspector. Shirley Marmo stated that she received a letter from Chief Spota commending Patrolman Don Pellegrino and a request to have the letter become a part of his permanent file. Trustee Salman moved that this letter be part of Patrolman Pellegrino's permanent file seconded by Trustee Galgano. Carried. -13- �A letter was received from Filomena Fallacara announcing her retirement from her official duties as Village Clerk effective August 1, 1987. Trustee Galgano moved that her resignation be accepted with regret seconded by Trustee Ceconi. Carried. Trustee Ceconi moved that Filomena Fallacara be sent a certificate of recognition and a plaque seconded by Trustee Fudali. Carried. A letter was also received from the Immaculate Conception Church announcing a Bazaar to be held August 13, 14, 15, 16, 20, 21, 22 and 23rd from 6:00 p.m. until the time allowed by the Village Festival Ordinance. This letter further requested permission to close Depeyster Street between Broadway and North Washington Street during the period above stated. Trustee Ceconi moved that this be approved seconded by Trustee Fudali. Carried. Shirley Marmo was in receipt of a letter sent to Administrator Homan from Mrs. Horefsky requesting the sweeping of the streets. This is being referred to Counsel Hughes with a copy left on Administrator Homan's desk. Several letters requesting sidewalk repair were received and will be reported to the Public Works Committee. The letters were received from the following: Angel Gonzales of 14 Andrews Lane, James Spencer of 88 Depeyster Street, Elaine A. Pack of 145 Hunter Avenue, and Angelo Martello of 160 Cortlandt Street. A letter from Maureen Rowe of 217 Gordon Avenue requesting a tree to be removed was received and forwarded to the Tree Committee. OLD BUSINESS: Trustee Fudali stated that he felt the tennis courts should be resurfaced and a small fee charged for the use of these courts to keep them in good condition. Mayor Gandolfo stated that this could be brought up at the work session. Trustee Fine recommended to have the company that is contracted to fix these courts. Mayor Gandolfo stated that this matter will be further discussed at the work session. -14- �* Mayor Gandolfo referenced the name change and stated that she would like a financial study regarding the name change both for the Village and personal matters. Trustee Fudali stated that Chris Skelly would probably serve on the name committee. Trustee Fudali will contact. Mayor Gandolfo asked Trustee Galgano to work on the Tappan Motors matter. Trustee Galgano agreed. Mayor Gandolfo asked if the Village was moving along on the computerization. Trustee Fudali stated that Chris Skelly (an expert with computers) met with Administrator Homan and Deputy Treasurer Shah. He suggested -automating to P.C.'s. Mr. Shah will look into this matter. Trustee Fudali stated that on June 26, 1987 the County is having an Annual Computer show and he recommended Mr. Shah attend. Trustee Fudali moved that Deputy Treasurer Shah go to this Computer Show seconded by Trustee Salman. Carried. Trustee Fudali reference two vouchers for large amounts one from AT & T and New York Telephone. Trustee Galgano also noticed this and stated that she would not sign this voucher until an investigation was made. Trustee Ceconi moved, seconded by Trustee Galgano that the matter of leasing the old water board to the Television Center would be implemented and referred to Counsel Hughes. Carried. APPROVAL OF WARRANTS; Trustee Fudali moved, seconded by Trustee Fine that the bills on General Fund and Water & Sewer warrants dated June 16, 1987 be paid after approval of Department Heads and Treasurer be authorized to pay same. Carried. NEW BUSINESS: Trustee Salman stated that the problem at 100 College Avenue, are that some of the people seem to be prisoners in that building by a group of people who compose the large criminal element of the Village. He suggested that the Board investigate why those people localize at this building and not at any other public building in Tarrytown and North Tarrytown.
