A regular Public Meeting of the Board of Trustees, Village of North Tarrytown, was held on Tuesday, October 20, 1987 at 8:00 PM, Present Also Present: Mayor Gandolfo Trustee Fudali Trustee Fine Trustee Galgano Trustee Salman Trustee Caro Trustee Ceconi Roll Call R. Thomas Homan, Village Administrator John Hughes, Jr. Village Attorney Mayor Gandolfo called meeting to order at 8:00 PM with Pledge to the Flag. Mayor Gandolfo read the following Public Notice: Please take notice that the Board of Trustees of Village of North Tarrytown will hold a Public Hearing in the Municipal Building, 28 Beekman AvePublic nue, North Tarrytown, New York on Tuesday, October Hearings 20, 1987 at 8:00 PM to consider an amendment to Section 62-14(E) of the Zoning Code of the Village of North Tarrytown, "Off Street Parking and Loading Space" to change the required number of off-street parking spaces for multi-family residences from 1.2 spaces per dwelling unit to 1 space per dwelling unit plus % space for each bedroom or sleeping room." Dr. Sweet asked if this would apply to existing buildings. The Mayor stated that existing building is not affected by this amendment. Only the new multi-family dwellings in the Village would be affected. More spaces will be required per unit. Other residents inquired about existing illegal multi-family dwellings in areas which are not zoned to be multi-dwellings. The Mayor stated that this is a different ordinance and is not related to the amendment to zoning code on parking. Public Comments on Hearing No further comments, the Mayor made a motion to close the hearing. Trustee Fine so moved, seconded by Trustee Fudali. Hearing closed. Kay Grala wished to thank everyone involved in the Street Festival for a wonderful job. She stated that the Sleepy Hollow committee for the name change has obtained sufficient signatures on their petition to put a referendum on the ballot in March. Public Dr. Sweet said that the committee is aware of the concerns Comments of the people as to the cost factor. The committee will do a detailed cost analysis on the name change and present reports to the Board. �jMayor reopened the Public hearing with permission of Board to hear comments from Tom Hales, owner of property located at 48 Pocantico Street. Mr. Hales said that he felt the amendment to the zoning code is not fair. North Tarrytown has a large number of senior citizens and you cannot have affordable housing for them in the Village if owners have to cut down on the number of units that can be built due to the number of parking spaces needed. If they cut down number of units, they will have to raise their rents higher. He also felt that there was no problem with parking in the area he is proposing to build on, because there are spaces in the Van Tassel that are now being rented by Tappan Motors that could be utilized by the residents. No further comments, the Mayor made motion to close the Public Hearing. Trustee Salman seconded. Carried. Armando Galella commented on the money for the purchase of a Public computer for the Village being funded through the Water Depart- Comments ment. Trustee Fudali stated that it is not uncommon practice to interchange funds within departments. This purchase was funded through the Water Department because the computer will be used in this department eventually. Right now we are using this as a learning process for the Village. Mr. Galella again asked about further renovations to Village Hall. The Mayor stated there would be no more after the second floor was completed. On the subject of Tenant's Patrol Mr. Galella expressed concern about who would be responsible for the liability of the personnel. The Mayor said that the grant has been applied for under the auspices of our Auxiliary Police department and therefore is under the Village policy. The Tenant's Patrol would just be patrolling the building and if there was any problem, the police would be called in. Mario DeFelice asked that the Village give some thought to the new signs being proposed on Rte. 9. He said that they should read "Welcome to Historic Sleepy Hollow" rather than to Tarrytowns. This would be whether or not the name change was approved. Motion was made to approve minutes of September 1 with corrections. Trustee Fine so moved, seconded by Trustee Fudali. Carried. Motion was made to approve minutes of October 6 with corrections. Trustee Galgano so moved, seconded by Trustee Fine. Carried. Trustee Ceconi abstained because he was absent from that meeting. The minutes of August 4 will be reviewed and approved at work session. Trustee Caro stated he did not have copy of minutes in his packet. Mayor said public comments will be heard only at the beginning of meetings and not again at the end as stated in August 4 minutes. 1 �I /&/ -3- Mayor Gandolfo read a l e t t e r from Linda and Muriel Pankovic thanking us for g e t t i n g a r e l a t i v e t o the h o s p i t a l very promptly on October 30. Connunications Petitions Requests The Mayor received a letter from Peter Sullivan, who said he had received a letter from a resident of Kelburne Avenue, Mr. Kaplan, asking if a bill could be introduced into legislature to lower the speed limit on Route 9. Assemblyman Sullivan forwarded this to the Mayor to see if the Village could help in this matter. Mayor Gandolfo stated that we have had requests for a traffic light along Route 9 and the Village will be pursuing this with the State. Mayor Gandolfo received several requests from residents to lower the speed limit in Webber Park to 15-20 miles per hour. She stated that a public hearing must be called in order to do this. Our Village Attorney will check into this. The Mayor, Administrator and Trustee Fudali will go to Albany on October 21 to meet with Governor Cuomo's office to request state aid. We have received $100,000 grant from the Economic Development Office through the efforts of Senator Spano's office. Another public meeting will be held on October 26 at 7:30 PM at Morse School on reassessment.(copy of memo attached) Mayor's *^ On the subject of Tappan Motors, Bob Peirce and Jim Margotta are working very diligently on having the lot on Gordon and Katrina Avenue cleaned up. Tappan Motors has cleaned up the debris, but now there are new cars parked in there. They have been issued a citation for non-conforming signs and the parked cars. A resolution was passed authorizing the Mayor to sign contract # C-67-84-604 for Westchester Urban County Community Development project. (Beekman Avenue off-street parking lot) Trustee Caro so moved, seconded by Trustee Fudali, carried unanimously. Mayor asked that everyone stand for a moment of silence for Jack Brophy who recently passed away. He was Village plumbing inspector since 1962. She also asked that everyone stand for a moment of silence for Ed Penn who passed away this week. He was County Code Enforcement officer who was working with our building inspector. Mayor Gandolfo received correspondence from Senator Spano regarding efforts with the Duracell property, (copy of letter attached) The Administrator stated that leaf collection will begin in earnest starting October 26-December 23. Two new trucks will be delivered next week. The Administrator stated that we are now repaving a third catch basin along route 9 near Fremont fountain. m Administrator's Report �-4- On the subject of 79 College Avenue, the Administrator commented that West-Hab has considered the possibility of managing the building and then perhaps buying it. This could be done after repairs were done and rents were raised. The Administrator asked that motion be made to close Village Hall on Friday October 23 from Noon to 5 PM to allow employees to update files before moving into the new office. Trustee Ceconi so moved, seconded by Trustee Salman. Carried unanimously. The Treasurer said that each board member received an updated listing of spending till the end of September. Four month expenditures is only 26.37% of entire budget. The Treasurer asked the Board to approve progress payment of $21,377 from Capital fund to contractor for renovations. This to be added to warrant. Trustee Fudali made a motion authorizing the purchase of IBM computer 8580 and associated software at a price of $5200, funding through Capital note. Trustee Fudali made a motion to purchase a new telephone system which would save the Village money in the long run. Seconded by Trustee Ceconi. Carried unanimously. Funding will come from monies from bond taken out for renovations. Trustee Caro received correspondence from Metro-North stating that additional express stops at Philipse Manor station were not justified due to the low off-peak ridership. This matter will be pursued further by asking them how many people would be needed to ride this train in order to consider these stops. He would also poll the people and see who would ride this train if there were to be express stops. Trustee Fine read a letter from Richard Gross regarding action taken by Board of Fire Wardens at their October 13 meeting.(copy attached) Trustee Fine moved to accept changes listed, seconded by Trustee Fudali. Carried unanimously. She also commented that house inspections were done recently and the Ambulance Corps, roof is in need of immediate repair. Will be getting priority list from house chairman so that necessary repairs can be made to all fire houses that are in need. Trustee Fine stated that the contract with Nick Morabito and the Village is being reviewed by him now. Trustee Fine stated that the COC's financial situation has improved . due to federal subsidies and a donation from Rockefeller for $15,000. Trustee Fine stated that the Community Advisory Committee had a very fruitful meeting. They spoke on the Tenant's Patrol possibility at College Arms and the tenants are very much in favor of this. She commented that Reverend Sykes Parks has not been dedicated yet due to the mess in the park. We will aim for Arbor Day for the �I "3 , -5 dedication with the planting of a tree. Trustee Galgano stated that she has done research on the variances obtained by Tappan Motors. There has been only (1) sign variance granted in the past 25-30 years. A copy of this variance was given to the members of the Board. Trustee Ceconi read recreation report (copy attached). He commented that Reverend Sykes park is in such a mess that it cannot be dedicated until it is cleaned up. People are working on their cars and leaving auto parts in the park. The Mayor said that she would contact Mayor Pilla about more police patrol. Trustee Salman presented snapshots of Old Broadway and New Broadway where Tappan Motors has new cars parked on the street. There is a question as to whose property this is on Old Broadway. Bill Frandsen claims that he is the owner. Further research will be done to determine this. Cars are also parked at the Old Exxon station on Broadway and the lot near Frank's Florist, also the old Pickwick Post lot. (snapshots on file in Village Hall. Trustee Salman questioned whether the Village had an Ethics law on the books. The Mayor suggested that the Trustees read Section 19 of the Village law which is the Ethics, law. On the status of Duracell Mayor Gandolfo stated that the Department of Environmental Conservation will be submitting the final work order on the cleanup of Duracell. The state and Duracell have almost come to e final draft agreement. Hopefully another month. On the subject of the Hale's project, trustee Salman felt it was a bit different from ordinary building projects because it was meant to be a Senior citizen apartment house and that perhaps the parking requirements for them should be adjusted accordingly. The Mayor stated that the Board would discuss this further at a work session. All resolutions are attached. Added to the resolution H, a progress payment of $21,377 to the contractor for renovations should be added to the warrant. Total warrant is $64,851.37. Trustee Galgano stated that she received numerous complaints from residents of Sleepy Hollow Manor that the sweeper does not go through there. Adminsitrator commented that the old sweeper did not, but the new one will be able to. The General Foreman is working on a schedule for the new sweeper. Trustee Galgano made a motion to amend public hearing to put stop sign on North Street and Webber Avenue. Seconded by Trustee Fine and carried unanimously. Since there was no new business, the Mayor stated that the Board should adjourn to Executive session to discuss police contract and personnel matters. Trustee Fine so moved, seconded by Trustee Caro, and carried. Resolutions Old Business �-6- Ihe Mayor adjourned the meeting and the Board moved to Executive Session. Respectfully submitted, Deputy Village Clerk Executive Session Discussion followed on the appointment of a new Plumbing Inspector to fill the vacancy left by Jack Brophy who passed away. The two candidates being considered were Bill Herlihy and Ugo Checci. The question arose as to whether or not Bill Herlihy could be Plumbing Inspector since he did plumbing work for the Village. The Mayor commented that perhaps the only solution would be to amend the code to have an Acting Plumbing Inspector as well as a Plumbing Inspector. The only problem with this is that amending the code would take time and we do need an inspector now. Mayor Gandolfo also stated that if the code was amended, a term should be set for the inspector. After much discussion, no decision was made. The Mayor stated that the Board should discuss it further at their work session. On the matter of Police contract, the Administrator stated that the police have formally petitioned the Village for binding interest arbitration. Police are willing to sit down and still talk while waiting for the hearing. Administrator commented that the Village must file a report with PERB as to what we are doing in the meantime. The Village needs someone on the panel who will report back to the Board. Mayor Gandolfo entertained a motion to hire an attorney Rains & Pogrebin at the rate of $175 per hour with the stipulation that we get an itemized bill from them monthly as to what has been done. Trustee Galgano so moved, seconded by Trustee Ceconi. Carried unanimously. Prizes were awarded to the top 3 finishers in each age division. Fall programs have started, including adult aerobics, basketball, volleyball, Mother-Toddler and Mother-Infant playgroups; youth basketball, floor hockey and teen open gym. There are spaces available in all programs. The recreation department has been asked by the Town of Mt. Pleasant's Recreation Department to become involved with the town's upcoming bicentenial celebration. If anyone has any suggestions for programs please contact the N.T. Recreation Department. �a) RESOLVED: That, the Board of Trustees hereby approves an increase in the fees for a Taxi-Cab Drivers License to twenty five dollars for a three year license and ten dollars for a 1 year license.
