Present: Mayor Gandolfo Trustee Ceconl Trustee Salman Trustee Fine Trustee Fudali Trustee Caro Also Present: Roll Call R. Thomas Homan, Village Administrator John Hughes, Jr., Village Attorney Mayor Gandolfo called the meeting to order with a pledge to the flag. The Mayor read the following public notice: Please take notice that the Board of Trustees of the Village of North Tarrytown will hold a Public Hearing on the 2nd day of February 1988 in the Municipal Building, 28 Beekman Avenue, North Tarrytown, New York at 8:00PM to hear and consider an amendment to Section 57-46 of the Vehicle and Traffic Law to reduce the speed limit in the Webber Park area. Public Hearing Chris Skelly, a resident of Webber Park spoke in favor of the reduction in the speed limit. Dr. Sweet asked if every street in Webber Park would be affected. The Mayor stated that not all the streets in that area would have reduced speed limits. Some streets could be changed while others would remain the same. New Broadway would be one of those to be reduced. Chief Spota commented that reducing the speed limit is a common sense measure. Being no further comments on the Public Hearing, the Mayor entertained a motion be made to close the hearing. Trustee Ceconl, so moved, seconded by Trustee Salman, and carried. Victor Albanese of Devries Avenue spoke about the problems he has been having for over a year with regard to his neighbor's fence. Mr. Albanese complained that it has taken too long for decisions to be made by the Village in having this situation rectified by his neighbor. The Administrator stated that his neighbor has received a letter instructing them to remove the poles which were left up after the fence came down. This is to be done within the next two weeks. This should be the final phase. Public Comments �2Mario Belanich, a resident of Washington Street* commented on how the enforcement of the snow ordinance helped greatly in the removal of snow during the last snowstorm. He also stated that he felt the parking enforcement officers are doing a wonderful job in issuing summonses for alternate side of the street parking. Mr. ing the man Belanich asked about the resolution regarding the overnight parkof commercial vehicles on village streets. The Mayor stated that signs are on order, and as soon as they arrive, the General Forewill have them put up and we can enforce the law. Trustee Fine so moved, seconded by Trustee Salman to approve the minutes of January 19, 1988. The Administrator read a letter from Dennis Fitzgerald of Anderson Avenue regarding the congestion on this street due to parking on both sides of the street. This makes it very difficult for emergency vehicles to travel onto or through the street. The Mayor stated that a copy of his letter would be forwarded to the Fire Chief. The Mayor received a copy of a letter from New York State Department of Environmental Conservation regarding Frank's Fuel Wholesale, Inc. listing the state violations. (Letter made part of the minutes) The Mayor received a letter from Helen Stafford of 400 N.Broadway, giving some comments regarding the adverse conditions in existence on Old Broadway and her suggestions in trying to solve these problems. Mayor Gandolfo stated that the proposed Warner Library budget is on file in the Clerk's office. Mayor Gandolfo received an unsigned letter asking the Board's help in getting the American Cablesytem to air a mass on cable TV on Sundays for those people who cannot attend church on Sunday. This will be discussed at the next work session. The Mayor received a letter of resignation from Gregory Bartolomei, Acting Village Justice. She asked that a motion be made accepting his resignation with regrets. Trustee Galgano so moved, seconded by Trustee Salman and carried. The Board is looking for someone to fill this vacancy. Mayor Gandolfo said she is in receipt of a check for $2322.52 from American Cablesystems for franchise fee taxes for the quarter ending December 31, 1987. This check was given to the Treasurer. The Mayor entertained a motion that Frank Gallagher be appointed to fill the vacancy on the Parking Authority which was left by the resignation of Dr. Ippolito. Trustee Fine so moved, seconded by Trustee Ceconi, and carried. �-3 The Mayor stated that the Board will meet on February 11th with representatives of Duracell who have agreed to the clean up order that the State has proposed to them. After a Public Hearing Is held on that order, clean up would begin In thirty days. In regard to this, the Mayor commented that the State has not been too cooperative in the Duracell matter. <%7S~ Mayor's Report The Mayor asked that everyone present please stand for a moment of silence for Michael "Mickey" McKenna who passed away last week. Mr. McKenna was a resident of North Tarry town for over 65 years and former trustee. There was no Administrator's or Treasurer's report. All resolutions are attached. Resolutions Trustee Galgano stated that a written progress report from the NonConforming Use Committee meeting was given to the Board. A brief review of what was discussed was the possibility of rezoning certain areas to allow auxiliary apartments. Also,what to do with two family areas; whether It should be changed, remain the same, or something, fn between be allowed. Ability to enforce these laws was also discussed. How to Impose fines on violations of zoning will be discussed further. She commented that we need support and cooperation from the public; therefore, we should have a public meeting to get Input from the people. At some point, she said the committee will sit down with members of the Planning and Zoning Boards. Trustee Salman stated that with regard to the appointment of a Plumbing Inspector, the code does not say that the Inspector must be a licensed plumber in the Village of North Tarrytown. He suggested that the Board look over the whole General Code further at a work session; also possibly set a two year term for the Plumbing Inspector. Trustee Salman stated that there are many large pot holes and sunken areas in Sleepy Hollow Manor where the road should be dug up instead of just being patched again. There is a possibility that these areas are being undermined and suggested that the General Foreman look into this. Trustee Fine reported that the Tenants' Patrol will be off the ground very soon. The radios and jackets have been ordered. Regarding the Fire Department, Trustee Fine stated that the Superintendent of Alarms has done a good job inspecting the fire alarm sybcei*. He reported that ten boxes in the Manors are down and have been tagged. It will cost approximately $15,000 to put the boxes in order. The Board will sit down with the Fire Chief to see how many boxes in the Manors have actually been used in the past two years. Perhaps another method might be used in place of the boxes. The Mayor suggested that a meeting be called with both Manor Associations to discuss the alarm system. Trustee Reports �_4Trustee Fudall reported that he, the Administrator* Treasurer & Deputy Treasurer will meet vlth a representative from Johnson & Higglns insurance brokerage firm on February 8, 198B regarding our health Insurance program. They will provide for us, free of charge, an overall study of our present Insurance needs. They will compare the Empire plan with any other plan we have looked into. Trustee Fudall reported that the Vitcherkofskis have moved into their apartment in the Water Department garage. After all the loose ends are tied up, the Board would like to thank the Contractors who gave their services free of charge, at the next Board meeting. Trustee Galgano stated that a short time ago a Public Hearing was held to remove two meters from the west side of Washington Street, southbound near Beekman Avenue. Trustee Galgano made a motion that these two meters be removed, seconded by Trustee Ceconi. Motion carried. Trustee Ceconi made a motion to erect a No Parking sign on the west side of Washington Street, southbound near intersection of Chestnut Street and Washington Street. This would remove one parking space. Motion seconded by Trustee Fine and carried. Trustee Salman raised a question as to whether or not the resolution that was passed to increase the water rates in August was actually passed* He felt that this should be looked into because in order to pass this resolution, it needed the majority of the Board and not the majority of those Trustees present at the time. The Village Attorney vill check into this matter. Mayor Gandolfo asked the Village Attorney to give a report on the status of the Clinton Street lot (Section 16-Blk.8-Lots 28 & 29). He stated that at the last work session, he was asked to draw up a contract and send it to Mr. Schiavone. In the contract it would state that a certain portion be designated for residential purposes as the Board wanted. The deed would contain this restricted proviso. The Mayor asked that a motion be made for the Board to authorize the Village Attorney to take the necessary steps to consummate the sale. Trustee Ceconi so moved, seconded by Trustee Fine and carried. The Mayor asked that a motion be made to hold a Public Hearing regarding adding two alternates to the Planning Board. Trustee Fudali so moved, seconded by Trustee Fine and carried. Public Hearing to be held March 1. The Mayor commented that the work sessions will be held on February 9 and February 23. Grievance Day will be held on February 16th between &Pfti and 8PM. A regular board meeting will be held the same night at 8PM. Since March 15th is Election Day, the second meeting in March will be held on March 22nd instead of the 15th. March 8th and 29th will be work sessions. N �2*° -5- The Mayor asked if there were any questions regarding the warrants. A few minor questions were asked and warrants were approved by the Board. Approval Warrants The Mayor entertained a motion to go into Executive Session. Fudali so moved* seconded by Trustee Galgano and carried. Trustee Discussion regarding the extension of Jerry Navin's probationary period followed. The Administrator stated that he has spoken to this employee regarding his negative attitude and that said employee has agreed to try harder. The Board felt that based on this, they would vote on the resolution to extend it when they went back into regular session. Much discussion ensued regarding the replacement of Anderson Russell Kill & Olick law firm in the Gleason case due to the fact that the charges submitted by them have been very high. A few trustees felt that this should not be decided tonight and that the Board should give more thought to this decision. Mayor Gandolfo introduced Joseph A. Maria to speak to the Board and answer any questions they might have regarding his Law Firm. Mr. Maria stated that his firm has represented many municipalities and is currently representing North Tarry town in another law suit. He added that his fees would be much less than those of the current firm. After much discussion for and against hiring a new firm, the Mayor entertained a motion to return to regular session. Trustee Fine so moved, seconded by Trustee Galgano and carried. Executive Session Mayor Gandolfo read the following resolution: Resolved: That, upon the recommendation of the Village Administrator, the probationary period for Gerald Navin, Highwat Laborer, be extended 12 weeks to April 4, 1988. MOVED: Trustee Fine SECONDED Trustee Galgano VOTE 6-0 Mayor Gandolfo read the following resolution: It is hereby Resolved that the Board of Trustees does hereby designate the Law Firm of Joseph A.Maria, P.C. to represent the individuals named in the lawsuit entitled "Gleason v. N. Tarrytown et.al." to wit: Richard Spota James Whalen William Booth John J. Jandrucko to replace the Law firm of Anderson Russell Kill & Olick, subject to the approval of said substitution, by the above-named employees, pursuant to Section 31-3 General Code "Indemnification of Employees." Trustee Caro so moved, seconded by Trustee Fine. Trustees Ceconi and Galgano abstained. Trustee Salman voted NO. Trustees Fudali and Caro voted YES. Mayor Gandolfo voted YES. Motion carried. Brief discussion followed. Trustee Salman stated that he did not want to make a snap judgement without doing the necessary research. Trustees Ceconi and Galgano commented that they were not necessarily opposed to changing lawyers, but said they were surprised at the decision to do so and also would not make snap judgements. Trustee Galgano also stated that she did not know that this matter was going to be discussed or voted on until the Board went into Executive Session. (5) as follows: B. With respect to the foregoing matters, the Planning Board may make such requirements in furtherance of the purposes of this ordinance as will assure: 5. The reservation and designation of parkland and open space on areas considered for development, although where this objective is impracticable, the Planning Board may require a fee in lieu of such designation and reservation in the sum of One thousand dollars ($1,000.) per residential lot or per dwelling unit in the case of multifamily housing (condominiums or apartments) or per theoretical residential lot in commercial subdivisions. However, in the case of multifamily developments, the Planning Board may adjust the recreation fee in relation to the recreational facilities provided within the subject development. The Administrator stated that there has already been verbal approval of this grant, and that emphasis will be on the fire and safety code violations. RESOLUTION #: 2/030/88 Meeting date: 2/2/88 RESOLVED: That the Board of Trustees hereby takes the following action with regard to election day, Tuesday, March 15, 1988: - That registration day be held on Saturday, March 5, 1988 between the hours of 12 neon and 9 PM in Village Hall. - That the Village has ten (10) election districts, the same as used in the Town Election of this Village, except that district's #21 & #33 in the Town elections shall be #9 and 10 respectively in the Village election. - That election day be held on Tuesday, March 15, 1988 between the hours of 7 AM and 9 PM. �-2/ / - That the Clerk be authorised to publish and post the proper registration and election notices. - That the following be appointed election Inspectors and be paid fen hourly rate of $5.25 with the Chairperson receiving an extra $10.00. The Administrator stated that the fleet in the Police Department needs replacement. A detectives car and a police cruiser need to be replaced. The Village will purchase two cruisers and then- will pass on one police cruiser to the Detective. In the Fire Department, the station wagon has 100,000 miles and we are putting too much money into repairs. In the Public Works Department, the General foreman has been using his own car; whereas in the past the Foreman always had a village car. Tanks two and three each exhibited shell bulging at, two separate elevations per tank. Further, secondary containment did not exist since a gate which is part of the southerly dike structure was left open and showed evidence of having remained in that position for some time. Additional deficiencies of your secondary containment structure include but are not necessarily limited to; 1) Vehicles parked within the containment structure creating potential ignition sources and reducing available containment volume. 2) Rear garage door not sealed to provide reliable and permanent containment within the diked area. V) Questionable operation of your River Street front gate to provide for a complete peripheral containment structure whether truck loading is occurring or not at your loading rack. �Frank's Fuel Wholesale, Inc. January 22, 1988 Page 2 / / Notwithstanding the multitude of violations of local codes and federal U.S.C.G. regulations noted on 1/16/88, it is the determination of the undersigned that the above deficiencies constitute serious violations of your MOSF license 1103-2100, 6NYCRR §610 and §613, and New York State Navigation Law Article 12. Further, such violations constitute an imminent threat to the land, waters and environmental resources of New York State. Be advised that the inspection of your facility by this Department on 1/16/88 was in response to a reported potential oil spill and was not intended to be an MOSF facility inspection to determine compliance with all conditions of your license #03-2100. Sufficient information was gathered, however, to warrant the directive that no petroleum product be stored in any of the above ground tanks until such time as: 1) the tank(s) intended to store petroleum product are certified as being structurally safe and tight by a licensed New York State professional engineer representing a tank testing firm with experience in performing such tests. 2) an acceptable, permanent, and effective secondary containment structure is provided. Be advised that irrespective of previous Department determinations regarding the adeguacy of your secondary containment, conditions noted on 1/16/88 make it incumbent upon the undersigned to advise you that said containment facilities are totally unacceptable. Should you opt to ignore the aforementioned, this Department will seek prompt and severe prosecution against you. I trust, however, that will not be necessary. In closing, prior notice is given that unless all conditions of your 1987-1988 MOSF license are complied with and complete and total compliance exists with the New York State Navigation Law Article 12, 6NYCRR §610 as amended to incorporate appropriate sections of 6NYCRR §613 and §614, 17 NYCRR §30, 33 CFR Part 154, 40 CFR Part 112, 40 CFR Part 109 and ECL Article 17, your 1988-1989 MOSF license will be denied. �Frank's/ Fuel Wholesale, Inc.
