Present: Also Present: Mayor Gandolfo Trustee Fudali Trustee Fine Trustee Caro Trustee Treacy Trustee Hyland Trustee Coon R. Thomas Homan, Village Administrator John Hughes, Jr. Village Attorney Mayor Gandolfo called the meeting to order with a pledge to the flag. Public Hearings There were no public hearings. Mayor Gandolfo presented awards to Bruce Van Tassell and Larry Fraiola for their exceptional service to the people of North Tarrytown. They dedicated their time and services without any charge to the Village, in fixing up the apartment over the Water Department garage for the Vitcherkofski family. Public Comments Mr. Chris Skelly addressed the Board and asked that they think very seriously about not accepting the Administrator's resignation. He felt that this would hurt the Village tremendously if he were to leave the Village, He stated that he felt our current Administrator was a very capable and strong Administrator and that the Village should not let him leave. Mr. Belanich and Mr. Caetano both spoke against the possibility of the Village purchasing a motorcycle for the police department.They felt that a motorcycle in this Village would be not only dangerous, but very noisy. Mr. Caetano also stated that driving a motorcycle in small areas would cause many problems. A motorcycle is not useful in emergencies, either. Mayor Gandolfo commented that she has done a lot of research on the matter and felt that a motorcycle would be very helpful in patrolling the parks, monitoring speeding on Route 9, extending the walking post, and she felt it would help better public relations. She also stated that motorcycles are no longer used on highways. Dr. Sweet and Chris Skelly spoke in favor of the purchase of a motorcycle. 1 �Mrs. Napolitano, who lives in the Webber Park area, addressed the Board on behalf of herself and her neighbors. She complained about all the loose dogs in the area who are digging up lawns and gardens and also messing up property She wanted to know what ever happened to the leash law for dogs? She also stated that it is costing everyone a lot of money to have their lawns redone. Trustee Fine stated that she would check with the Police Chief to see if a stiffer penalty can be imposed upon those who do not obey the leash law and that the owners are supposed to be cleaning up after their dog's mess. Another resident complained about the dog warden from the Town. He had a dead skunk in his yard and he could not get anyone to remove it. He wanted the Board to check into what her responsibilities are as far as the Village is concerned. The Mayor said that they would check with the Police Chief on this matter, also. Trustee Caro spoke on behalf of a resident, Mrs. Pielusko, who called him about an ongoing problem of seepage of water into her basement. Mayor Gandolfo reported that this matter has been looked into many times by our Water Department foreman, our Village engineer and our retired Water Department Superintendent. They have all arrived at the same conclusion that it is not the Village's problem. Trustee Fudali suggested that the Village could possibly ask the help of a state agency in solving her problem. Approval of Minutes Trustee Caro so moved that the minutes of March 16, 1988 be approved, seconded by Trustee Fine and carried. Trustee Coon abstained because he was not at that meeting. Trustee Caro so moved that the minutes of March 22, 1988 be approved with minor corrections, seconded by Trustee Fudali and carried. Trustee Coon abstained because he was absent. Trustee Fine so moved that the minutes of the Reorganization meeting of April 4, 1988 be approved. Trustee Coon seconded the motion with reappointed as Acting Plumbing Inspector. one correction; Motion carried. Bill Herlihy was Administrator's Report The Administrator reported that the installation of a traffic signal at Bellwood and Route 9 that was requested by residents is being considered by Department of Transportation. We expect a report from the state within the month. 2 �Communications, Petitions, Requests Mayor Gandolfo reported that she has received o f f i c i a l n o t i f i c a t i o n of $250,000. grant from Senator Spano and Assemblyman Sullivan. The Mayor stated that the Village has received notice from the New York State Department of Environmental Conservation that we are almost at the last step of the Duracell process in the terms of the procedures before the work can begin in clearing up the s i t e . The Village will review the work order and then we will set up a date for a Public Hearing. The Administrator commented that the State has suggested Hay 24 as a possible date for an informational hearing on the Duracell consent order. Mayor Gandolfo stated that the Board will schedule the informational hearing for that date. The Mayor stated that she has received a copy of report of the Tarrrytown School Board's long term plans for s i t e s within the V i l l a g e . It w i l l be available to the Board and the residents of the Village to review, since we may be affected by some of their plans. Mayor Gandolfo read a proclamation declaring May 1988 Mental Health month, (copy attached) The Mayor also read a proclamation declaring May 2-8 National Drinking Water Week. Trustee Fudali made a motion to adopt this proclamation, seconded by Trustee Treacy and carried. The Mayor appointed Chris Skelly to the Community Advisory Development Board. Administrator's Report The Administrator reported that work on the Beekman Avenue off street parking l o t has begun. Expected completion i s in about four weeks. On May 4 the Village will be given a preliminary indication from the County of Westchester on how we fared in the grant process. Trustee's Reports Trustee Fudali reported that he was in receipt of a l e t t e r from the County regarding the legislation that was passed by the County Board of Legislators on April 4 setting up the Municipal Employees Benefits Consortium. Trustee Fudali asked that the Board pass a non-binding resolution accepting the concept of the consortium. (Copy of resolution sent to the County i s attached.) 3 �I Trustee Fine reported that she has the Police Report for the month of March (copy of report is attached). She also stated that Sgt. Gordon Ferguson will be given an award for his work as Youth officer. She reported that Mr. Blueglass, Superintendent of the Tarrytown Schools and Chief Spota met to discuss the removal of the loading and unloading zone in front of Sleepy Hollow High School to another specific area. Trustee Fine made a motion to hold a public hearing on May 17 to discuss changing the loading zone, seconded by Trustee Caro and carried. Trustee Caro suggested that the public hearing should be not only to discuss the removal from in front of the high school, but to discuss some specific alternatives. Trustee Fine reported that the COC will hold a mission meeting on April 27 to discuss the functions and future of the COC and what direction they should be taking within their resources. Representatives from the school and members of this board are all invited to attend. Trustee Fine reported that she has asked Nick Morabito to give us a mapping of the current situation of the alarms in both Manors where presently the alarms are that are not working and where he would suggest putting new ones. We are looking to the possibility of outside funding. Trustee Caro received a proposal from Vesthab to manage 79 College Avenue for the 79 College Avenue North Tarrytown Development Fund with an eye on possibly converting it to a co-op somewhere down the line. Our Village Attorney will review the proposal and it will be discussed at the next work session. Trustee Caro stated that the Division of Coastal Resources of the Department of State is going to send a representative to meet with the Environmental Council to discuss the village's participation in the coastal zoning program scheduled for May 12. Trustee Caro reported that the Rezoning Committee is scheduled to meet on April 27 at Village Hall. They are looking at a variety of specific rezoning houses; one is for Hudson Street, Old Broadway opposite the Restoration and the Duracell site. They have invited the Village Board, the Zoning Board, the Planning Board and the Environmental Council to attend this meeting. Trustee Treacy reported on the meetings that he attended concerning public access to cable TV programming. The first meeting was concerning the sixty day suspension of Sunny McLean. He stated that he believed that the pressure that was brought to bear on the Cable company by Richard Brodsky, Sandy Galef, Mayor of Pleasantville and himself representing North Tarrytown, helped to have the suspension lifted. Problems still remain that have to be dealt with concerning access to air time, editing time, equipment and other items that 4 �3s"C should be afforded the public as defined by the access standards of the NYS cable commission. At the second meeting, American Cablesysterns indicated that they would provide more air time. These meetings are very important in working out any difficulties in dealing with the public's rights to access programming on cable TV. Trustee Hyland reported that April 25 is the last day for loose leaves to be placed at the curb. After that date, the leaves must be bagged and placed at the curb only on Mondays. He also stated that there will be a Public Works committee meeting on Monday, April 25 at 8PM. Trustee Coon reported that the Library Board of Trustees will hold a meeting on April 21. He also reported that he and the Mayor met with Bob Finnegan to discuss some of the problems that they have been having with the reassessment. The major problem is personnel and they are looking to hire another full time data collector. Bob Finnegan has expressed that they can complete the data collection and the reassessment on time, but it will require that the data collectors currently working in the Newburgh office be sent here. The considerations that the Board has to take into account if we want to have them completed on time,is that in using a large number of data collectors there may be some minor inconsistencies in evaluating the condition of the property. One thing that the Board has to discuss is if we want Finnegan Associates to go through this and have it done on the original contract or allow them additional time. Trustee Coon reported that they have received several resumes for the position of Code Enforcement Officer and there seems to be two potential candidates. Resolutions All resolutions are attached. Old Business John Hughes, Jr., Village Attorney, asked that the Board call for a Public Hearing to enlarge the Planning Board frorc 5 to 7 members. Trustee Caro so moved, seconded by Trustee Fine and carried. The Village Attorney also asked that the Board call for a Public Hearing to increase fees for the demolition of buildings. Trustee Fudali so moved, seconded by Trustee Coon and carried. He also asked that another Public Hearing be called for amending the Indemnification law of employees. Trustee Treacy so moved, seconded by Trustee Caro and carried. These hearings will be held on May 3. The Mayor asked that the Public hearing to enlarge the Planning Board to seven members be extended to include the Zoning Board and Recreation Commission. Trustee Caro so moved, seconded by Trustee Coon and carried. 5 �Trustee Fudali commented that in order for the Village to keep the tax increase in the single digits, the Board is entertaining the concept of floating a deficit bond. New Business Trustee Fudali reported that the Board received a copy of a possible resolution for the Board to consider with regard to the Public Television center on the Hudson as a prime source of cable TV. Trustee Fudali made a motion to adopt this resolution, seconded by Trustee Treacy. Trustee Coon suggested that the wording of the first phrase be changed, making it clear that the Village does not provide the equipment. Trustee Caro made a motion to table the previous motion, seconded by Trustee Coon and carried. The American Cablesystems will be asked to review this possible resolution. Mayor Gandolfo stated that she is appointing the Board as the committee to search for a new administrator. The Mayor asked that a motion be made to add the delinquent water accounts to the tax roll for June. Trustee Treacy so moved, seconded by Trustee Coon and carried. Approval of Warrants Trustee Hyland made a motion to approve the warrants, seconded by Trustee Treacy and carried. Brief discussion followed.
