                  <text>A regular meeting of the Board of Trustees of the Village of North Tarrytown
was held on Tuesday, July 12, 1988 at 8:00 PM.
Present:

Mayor Gandolfo called the meeting to order with a pledge to
the flag.
Public Hearing
Mayor Gandolfo read the public notice which is attached.
There were several residents who commented in favor of moving the loading and
unloading zone from Broadway to River Street.
Other residents commented that they felt the Board should not make provisions
for Tappan Motors to load and unload their cars.
A former trustee, Mario DeFelice, commented that when he was on the Board, the
zone on Broadway was only a temporary location until Tappan Motors could find
another spot on their own property.
Mayor Gandolfo asked that the Village Attorney to look into this matter.
Being no further comments on the Public Hearing, the Mayor closed the hearing.
Public Comments
Mr. &amp; Mrs. Belanich asked the Board if anything could be done about all the
shopping carts left on the streets.
The Mayor commented that perhaps the Board could check with Tarrytown and have
them ask that the Grand Union put up barriers so that the carts couldn't be
taken out of the lot.
Another resident, Mrs. Lingardo, asked when the No Parking signs on Gordon
Avenue were going to be put back up.
The Mayor commented that the General
Foreman has ordered many signs and they should be up very shortly.

Ugo Checci requested that the Board of Trustees meet with the Parking
Authority to have a regular working meeting. A meeting for July 20 at 8:00 PM
was set up.

Being no further consents, the Mayor closed the public comment section.
Approval of Minutes
Trustee Fine made a motion that the minutes of June 14 be approved, seconded
by Trustee Treacy and carried.
Trustee Coon made a motion that the minutes of June 21 be approved, seconded
by Trustee Treacy with minor correction.

Communications, Petitions &amp; Requests
Deputy Village Clerk read a l e t t e r from the Pocantico Hook &amp; Ladder Ladies
Auxiliary, thanking the Mayor and the Board for the Recognition Party that was
given in their honor.
Mayor's Report
Mayor Gandolfo reported that the Street Festival w i l l be held on September 17,
1988. Mario DeFelice will be chairman of the f e s t i v a l and he needs volunteers.

Mayor Gandolfo reported that due to the large increase in our insurance
premium for compensation, she recommended to the Board that the Village switch
from PERNA to State Insurance Fund effective July 13, 1988. Trustee Treacy so
moved, seconded by Trustee Fine and motion carried.
Mayor Gandolfo reported that she received the contracts from the State for the
Palmer Avenue construction to l i f t and refurbish the bridge.
It will start
sometime in October and end in March or April. The Mayor entertained a motion
for the Board to authorize her to sign the contract with the State with
Counsel's approval.
Trustee Hyland so moved, seconded by Trustee Fine and
motion carried.
Mayor Gandolfo entertained a motion for the Board to authorize her t o sign a
contract with the County to refurbish the island at the top of Beekman Avenue
and Route 9. Trustee Treacy so moved seconded by Trustee Fine and motion
carried. The Mayor commented that the County will be paying for this project.
The Mayor a l s o commented that the County has been designing signs for us,
which the Sign Committee has been working on.
The Mayor received a l e t t e r from Frederick P. Clark Associates in reference to
the study of Beekman Avenue to see whether i t i s feasible to put in diagonal
parking at least on one side.

�Mayor Gandolfo reported that the V i l l a g e has received the $300,000. block
grant from the County for the refurbishing of Beekman Avenue. This will go
towards new sidewalks, curbs and new street lighting. There will be informal
public hearings on this to gather some input from the residents.
Mayor Gandolfo commented that a tree program will be started in the Fall in
conjunction with the Tree Commission.
Residents who are i n t e r e s t e d in
donating a tree will be able to donate one in memory of someone or any other
dedication.
The Village will plant the tree and take care of i t .
K plaque
will be in Village Hall with the names of the people who donated the tree and
in whose memory.
Treasurer's Report
The financial spending report for June shows that we have spent 6% of the
budget; therefore we are holding our own.
Trustee's Report
Trustee Treacy reported that he attended a meeting on June 22 at Elmsford
Village Hall concerning the homeless situation in Vestchester County and i t s
impact on local communities. Worth Tarrytown does not have any motels or
hotels to house these people, but he commented that there are 20 former North
Tarrytown residents living in homeless f a c i l i t i e s .
Westchester County will
spend approximately 54 million dollars t h i s year on temporary
housing
for the homeless. He feels that the County could better spend this money by
rehabilitating the buildings that these homeless people have been burned out
of.
Trustee Treacy reported that we are s t i l l waiting for Frederick P. Clark
Associates to complete the package for the proposed rezoning of Hudson Street.
When i t is completed, a presentation will be made at a public hearing on the
proposal. Fritz Wiedle i s a l s o preparing an a n a l y s i s of s e c t i o n s of the
commercial d i s t r i c t on Broadway and Old Broadway for the rezoning committee.
Trustee Treacy and Mayor Gandolfo met with representatives of the Community
Development Block Grant project on July 7.
At t h i s meeting d i s c u s s i o n s
concerning the County and the Village's responsibilities regarding project
c o s t s , construction schedules, and the scope of work t o be completed were
held.
Trustee Treacy commented that after some discussion with Cynthia Russell,
Director of Community Development, she agreed to reconsider the parking study
and possibly move the grant up to the second year. The next step towards
getting t h i s project off the ground i s t o commission a survey of Beekman
Avenue. Trustee Treacy made a motion that the Village go out to bid to have a
survey done of Beekman Avenue from Route 9 to St. Teresa's Hall, returnable
August 16, 1988, seconded by Trustee Fine and motion carried.

Trustee Fine reported that she met with the Philipse Manor Taxpayers
Association and several items were discussed.
One was the revision of the
ordinance of trash pickup; also that there i s no guard r a i l between the two
Manors; there are 2 temporary grey transformers put up by Metro North that
should be removed.
Trustee Fine submitted the Police Report for the month of June; that the
amnesty program for tickets i s progress now through July 31.
Trustee Fine reported that in the Spring she and the Chief of Police had set
some long and short term goals for the Police Department; to date we have
achieved a l l of the short term g o i l s , that i s , the addition of another police
officer, Barry Campbell; the appointment of full time youth officer and part
time a s s i s t a n t , Sgt. Ferguson and Officer Pellegrino; promotion of Walter
Schrank to Sergeant; the establishment of a motorcycle squad and the warrant
squad, and the second parking enforcement officer has a license to drive the
cuehrran. We have also put two new vehicles into service.
Trustee Fudali met with the Power Authority on July 11 for an emergency
meeting with a l l the municipalities. The basis of the meeting was to explain
that for the f i r s t time this summer the Power Authority has fully u t i l i z e d the
a l l o c a t e d power i t has from Con Edison. Whet they had to do i s reach an
agreement with Con Edison as to what the a l t e r n a t i v e s would be so that no
c r i s i s would arise. Trustee Fudali stated that he had a preliminary draft that
the Power Authority and Con Edison have put together, which he would like the
Village Attorney to check and get back to the Board as to how this would apply
to the Village of North Tarrytown.
Trustee Fudali commented that at the last Board meeting the Board tabled the
motion of adopting a formal Employees Rules of Conduct and a Personnel Policy
manual for our exempt employees and he would l i k e to adopt t h i s tonight.
Trustee Fudali read the following resolution:

WHEREAS, The Village of N. Tarrytown has not had a personnel policy manual
e s t a b l i s h i n g employee b e n e f i t s , general working conditions and personnel
practices, and
WHEREAS, The absence of such a peronnel
policy manual has r e s u l t e d in
administrative problems upon the h i r i n g , resignation and retirement of
employees; and
WHEREAS, The Village recognizes the importance of c o n s i s t e n t personnel
guidelines.
Now, Therefore, BE IT RESOLVED; That the Mayor and Board of Trustees do hereby
adopt the attached personnel manual, e n t i t l e d : Village of North Tarrytown
Personnel Manual, excluding one item which i s the vacation for part time
employees. Trustee Fudali so moved, seconded by Trustee Treacy.
Mayor Gandolfo asked that Trustee Fudali clarify the part of the manual which
deals with accumulated sick time retirement benefit.

Trustee Fudali commented that there is an item in the policy that states that
any retiring employee can accumulate up to a maximum of 165 sick days and at
this time they will be paid one-third of the unused sick time at their present
rate of pay.
Any retiring employee hired prior to January 1, 1980 will have
the opportunity to have their accumulated sick time prior to retirement,
reviewed by the Village Administrator and the Board of Trustees for possible
consideration for additional compensation. There are three employees now that
will be affected by that item. They Here led to believe when they were hired
that they would be entitled to payment of all their accumulated sick time up
to 165 days, therefore, they will be considered for possible additional
compensation.
Mayor Gandolfo felt that if there was a standard practice and people have
counted on that over the years, she did not believe that this should be
changed to the detriment of employees who have been with the Village for many
years, therefore she objected to the policy on those grounds, but approved
everything else.
Trustee Treacy commented that sick days are to be banked and used in case of
an emergency and not a retirement benefit. He felt that paying this sick time
in addition to all other retirement benefits is too much.
After this brief discussion the vote was taken. Trustees Fine,
Fudali and Treacy voted YES and Trustees Coon and Hyland voted NO. Motion
carried 3 to 2.
Trustee Fudali made a motion to adopt the Employees Rules of Conduct.

Trustee Coon reported that the informal meetings on reassessment will be
continuing throughout the summer; and the data collection phase of the project
is continuing in the Philipse Manor section.

Since Mary Zimmermann has resigned as Superintendent of Recreation, a
resolution was read appointing Emil Galassi to work in the Recreation
Department in the interim. Resolution attached. The search is going on to
hire a new Recreation Superintendent.
Trustee Hyland reported that the curb and sidewalk program is in full gear.
Trustee Hyland felt that there is misdirection on the part of the General
Foreman in many areas and felt the Board should reevaluate him.

Old Business
Trustee Fudali commented that the studies that were done by the County
pertaining to Lyme Disease showed that none of the parks in the Village were
tested, such as Douglas Park and Kingsland Point Park; he felt that the County

�should test the parks in our area too.
County requesting that this be done.

Trustee Fudali would write to the

Mayor Gandolfo reported on the Code Enforcement program and its progress. To
date, the officers have entered approximately 50 buildings and have found many
violations. The Code Enforcement officers would like to see a few changes in
our ordinance, one which would be to require all property owners of multi
family dwellings
to leave an emergency telephone number with the police or
Building Inspector. Also, they would like to change the code which now gives
the owner ten days to remedy the violation to
give the power to issue
summonses to the officers or the Building Inspector in emergency situations.
In order to make these changes a public hearing must be called.
The Mayor
asked for a motion to be made calling for a public hearing on August 2.
Trustee Coon so moved, seconded by Trustee Fudali and carried.

fill vacancy left by Frank Caro.
Mayor Gandolfo asked that motion be made to adjourn to Executive session to
discuss personnel matters. Trustee Coon so moved, seconded by Trustee Treacy
and motion carried.
Executive Session
Discussion ensued over the reprimand of the General foreman. It was felt that
this should be done in writing with a list of the items that the Public works
committee felt were not being followed.
The committee will meet on Monday,
July 18 at 7:30 to discuss these.
The Mayor and some of the trustees felt
that the General Foreman was doing a very good job under the circumstances
that he has been faced with. The Mayor asked that the foreman be present at
the next work session and spoken to about these problems.
On the matter of the increase for the Chief of Police, Trustee Fudali stated
that no increase is to be given to management personnel unless approved by the
board whether he is entitled to it or not. Brief discussion followed on
certain benefits he has been receiving under the union contract in addition to
his increases.
The Mayor stated that these are benefits that he has been
receiving since 1979 and you cannot take these away from him.
The Mayor
stated that she will ask the Public Safety Committee to go over what benefits
the Chief is receiving and make a recommendation to the Board as to whether he
should be getting this or whether the Board should follow a different policy
for the Chief, and if so, it must be put in writing.
On the matter of hiring a new Recreation Superintendent, a salary range of
$24,O00.-$28,00O. was set for this position in canvassing the civil service
list.

Mayor Gandolfo stated that right now ire have budgeted $12,000. for a l l
prosecution matters, which Bob Peirce i s presently handling, but i t i s too
much for one person. The Mayor stated that she has spoken to attorneys Jeanne
Mettier, Gary Raniolo and Art Brady about the p o s s i b i l i t y of handling a l l the
violations of the village code ordinances. Jeanne Mettler would be interested
in accepting the p o s i t i o n for $5000.a year and Bob Peirce would receive
$7000.a year for V&amp;T v i o l a t i o n s . Trustee Coon commented that Ms. Mettler
would not be able to practice in N. Tarrytown any longer, i f she accepts this
position.
After a brief discussion, i t was decided to table the motion to
hire her and our attorney would check into i t further.
Mayor Gandolfo stated that the Village has paid the firm handling the Gieason
case $155,000.and they were told that they have $15,000. to spend on an
appeal.

Mayor Gandolfo stated that she has asked Richard Ayers and Steve Maceyak to be
on the Sign Committee.
John Hughes, our Village Attorney, stated that there i s a environmental group
called NYPERB which is non profit organization who periodically go door to
door soliciting for their cause. He stated that the Village should revise our
s o l i c i t i n g local law to exempt these types of groups from having to pay the
fee for a license and be fingerprinted because they object to this law as a
violation of their rights and they do have the law on their side and it cause
the Village alot of problems. They will comply with every other aspect of the
law.
Trustee Fudali made a motion to give General Foreman the increase which was
promised to him by the Administrator when his probationary period was over.
Motion was tabled to be discussed at the work session.

The Mayor entertained a motion to confirm the treasurer's action of making
r e t r o a c t i v e payment to Chief Spota in the amount of $2995.47 from
6/1/87-5/31/88.
Trustee Hyland so moved, seconded by Trustee Coon and motion
carried. Trustee Fudali voted NO.
Being no further business, the Mayor adjourned the meeting and convene a
meeting of the 79 College Avenue Corporation.

Trustee Hyland made a motion to authorize the Mayor and Trustee Fudali as
deputy president of this corporation to sign the audit agreement. Motion
seconded by Trustee Coon and carried.

Tarrytown will hold a Public Hearing on Tuesday, July 12, 1988 at 8:00 PM
to add Section 57-43A to the Vehicle and Traffic Law of the Village of North
Tarrytown, entitled "Parking Limited for Trucks, Trailers and Commercial
Vehicles Unloading or Loading Vehicles in Transit."
A. No person, firm or corporation shall cause or permit his, her or its truck,
trailer or other commercial vehicle, if having a gross weight in excess of
five (5) tons, to park and load or unload vehicles in transit of any type or
size whatsoever on any street in the Village of North Tarrytown, except the
following, designated location:
On the west side of. River Street at a point beginning at the northerly side of
the entrance to the premises belonging now or formerly to Anchor Motor Freight
Corporation, running northerly a distance of 224 feet.
B. Penalties for offenses: Any person, firm or corporation violating any of
the provisions of Section 43-A shall be deemed a disorderly person and shall
be punished by a fine of not less than one hundred dollars ($100.00), not more
than two-hundred and fifty dollars ($250.00) for the first offense and by a
fine of not less than two hundred and fifty dollars ($250.00), not more than
four hundred dollars ($400.00) for each subsequent offense.
