Present: Mayor Gandolfo Trustee Fudali Trustee Fine Trustee Cicchetti Trustee Coon Trustee Hyland Trustee Treacy Also Present: John J. Hughes, Jr. Village Attorney William T. Regan, Village Administrator Mayor Gandolfo called the meeting to order with a pledge to the flag. Mayor Gandolfo presented Senator Spano with a certificate of appreciation for his help in getting grants for the Village of North Tarrytown. Senator Spano then presented the Mayor with a check for $250,000. Trustee Fine commented that the Tenant's Patrol grant for $11,000. has also been granted. Public Hearings- None Approval of Minutes Trustee Hyland Hyland made a motion to approve the minutes of October 18, 1988 as written, seconded by Trustee Fine and motion carried. Trustee Treacy abstained because he was absent; Trustee Fudali abstained because he had arrived late at that meeting. Communications and Requests Mayor Gandolfo read a letter from a resident of Kendall Avenue with regard to a parking space which another resident has made which he feels does not conform to regulations regarding footage from the street. Will be referred to Building Inspector. Another letter from Mary Torres regarding the No Parking of Commercial Vehicles on village streets after 9PM. She felt that certain small pick up trucks should not be considered as commercial vehicles. The Mayor commented that this was one of several complaints of this nature. The Board will look into this matter at the next work session. The Mayor read a letter from the Historic Hudson Valley asking for permission to hold a parade on November 5, 1988 at 12 Noon along Route 9 in conjunction with the celebration of the Royal Birthday of King George II. Trustee Fudali so moved, seconded by Trustee Cicchetti that permission be granted. Motion carried. 1 �I Mayor Gandolfo received a check in "the amount of $2712.59 covering Continental Cablevision's franchise fee taxes for the quarter ended September 30, 1988. Mayor Gandolfo read a letter from George and Eric Kahn of Tappan Motors commending the North Tarrytown Fire Department for their outstanding effort in putting out what might have been a disasterous fire in their service building on October 19, 1988. Copy of letter sent to Chief Appolonio, Mayor Gandolfo received a letter of thanks for our contribution to the Family Festival held at the COC on October 30, 1988. The Mayor read a letter of resignation from Bill Doorley who is the Commissioner of the Senior Citizens effective January 1, 1989. Trustee Hyland made a motion to accept his resignation with regrets, seconded by Trustee Fine and motion carried. Mayor Gandolfo read a copy of a letter sent to Senator Spano from Mrs. Margoshes, chairman of the Warner Library Board of Trustees thanking him for his efforts in obtaining $2000. to put towards their 1988/89 budget. Administrator's Report The Administrator reported that the Palmer Avenue bridge will be closed on November 7, 1988 for repairs, and will not be reopened until the Spring. The Department of Public Works is making a concerted effort to remove leaves on the east side of the tracks so that the cars may park there for the duration. The Administrator commented that the Village is in the process of canvassing the civil service Police Officer list. Negotiations with the Teamsters 456 will be held on November 3, 1988. Treasurer's Report The financial report as of 11/1/88 is $1,000,000. in CD's, approximately $50,000. in the money market and $46,000. in the checking account. Trustee's Report Trustee Fudali gave an update on the MEBCO plan; there will be an increase of approximately 13% over the current MEBCO premium. In light of the fact that other insurance costs will be increasing 15-20% this year and approximately 30% next year, the 13% is not a large percentage. A letter has been received from the Department of Civil Service pertaining to administrative cost assessment that the Empire Plan will be levying against our municipality, and he suggested that the Village Attorney check into this to see if there is a legal basis for this. 2 �T r u s t e e Fudali s t a t e d t h a t l e t t e r s have been sent out t o other m u n i c i p a l i t i e s , towns and c i t i e s in Westchester asking them i f t h e y have decided t o j o i n MEBCO p l a n , and we w i l l put together a list. At t h e P o l i c e Committee meeting, i t t h a t due t o the e f f o r t s of the Tenants' P a t r o l , the f a l s e alarms at C o l l e g e Arms has been reduced. Committee doubled i n was noted number of T r u s t e e Fine reported t h a t a study from the S t a t e showed a need for guard r a i l s between Sleepy Hollow Manor and P h i l i p s e Manor on R i v e r s i d e Drive. T r u s t e e Treacy reported t h a t the Rezoning committee has come t o a c o n c l u s i o n on t h e rezoning study of Beekman Avenue and Broadway area and t h e Board w i l l d i s c u s s t h i s at t h e n e x t work s e s s i o n . The f a c t t h a t we are u s i n g Wednesday for a r e c y c l i n g day has allowed us t o t a k e at l e a s t two garbage trucks o f f t h e road for p r e v e n t a t i v e maintenance. 3 �Hudson Micrographics • PO Box 640, Route 9W « Port Ewen, New York 12466 • 914/338-2200 �Trustee Fudali stated that letters have been sent out to other municipalities, towns and cities in Westchester asking them if they have decided to join MEBCO plan, and we will put together a list. Peekskill and Portchester have decided to join, and Buchanan and White Plains intend to stay with the Empire Plan. Trustee Fine commented that at the Public Safety Committee meeting it was reported that overall summonses have doubled in the past year. At the Police Committee meeting, it was noted that due to the efforts of the Tenants' Patrol, the number of false alarms at College Arms has been reduced. Trustee Fine reported that a study from the State showed a need for guard rails between Sleepy Hollow Manor and Philipse Manor on Riverside Drive. The Board will discuss this at the next work session. Trustee Fine read the following motion: Be it resolved, that the Board of Trustees does hereby approve advertising for bids to repair the floor of the Union Hose Company Fire House, said repairs should include the removal of the old floor and the installation of an epoxy quartz chemical flooring. Be it further resolved, that all bids should be filed with the Village Clerk no later than December 15, 1988 for construction during the period of January to March 1989. Motion seconded by Trustee Treacy and carried. Trustee Cicchetti had no report. Trustee Treacy reported that the Rezoning committee has come to a conclusion on the rezoning study of Beekman Avenue and Broadway area and the Board will discuss this at the next work session. He stated that the State Comptroller has disapproved the duty related disability retirement for Ron Biro. There is a certain time period where he may appeal this decision. Trustee Treacy reported that the new sign and awning program is progressing nicely. Towne Tavern, Bridgeview Inn, Sophie's Tavern and Huppy's Deli have erected new awnings; the old Malandrino Deli sign has been taken down; and the whole facade will be improved; work will be starting shortly on the Tarry Inn awning and Lemac Drug store will be refurbishing their sign and replacing their awning. Trustee Hyland reported that the new recycling schedule has started and seems to be progressing fairly well so far and they have been talking to the custodians of the large buildings asking them how they can help them to get their tenants to comply with the new rules. The fact that we are using Wednesday for a recycling day has allowed us to take at least two garbage trucks off the road for preventative maintenance. 3 �I Trustee Hyland reported that a bill for $1306.62 has been sent to the company responsible for the spill on the Avenue and Corlandt Street to pay for the cleanup. Trustee Hyland read the resolution awarding the bid for the backhoe. (Attached) Trustee Coon reported that the Warner Library is holding an exhibition called Floating Flowers throughout the month of November; Mondays and Thursdays, 1PM-9FM, Tuesdays, Wednesdays, Fridays and Saturdays, 10AM-5PM. Public Comments Aide Ceconi addressed the Board with a complaint about the lack of parking spaces in the evening on Beekman Avenue. He stated that he received a summons for parking in the lot by the post office when he attended a meeting of the Zoning Board. The Mayor asked that Mr. Checchi make recommendation to the Parking Authority for the possibility of leaving a few meters for the evening hours. Another resident, Mr. Belanich suggested giving members of different committees a complimentary parking permit so that they could park there when they attend the meetings. Mr. Caetano questioned the commercial vehicle parking ordinance. Trustee Cicchetti commented that a commercial vehicle is any vehicle which is used for commercial purposes, even though there is no commercial plate on the vehicle. He also commented that our Village Attorney stated that there is a broad definition of a commercial vehicle; any vehicle which looks like it is used for commercial purposes. Being no further comments, the Mayor closed the public comment section. Resolutions- All resolutions are attached. Old Business Trustee Fine reported that Manny Caixeiro has successfully completed a course in police supervision and offered him congratulations. The COC is having their annual dinner this Friday night. New Business Trustee Fudali asked the Board to consider adopting a resolution stating our opposition to legislation introduced in the US House of Representatives regarding the issuance of municipal bonds. (Resolution is attached) 4 �Trustee Treacy called for a meeting of the committee for the rebuilding of the sidewalks and street lights on November 21, 1988 at 8PM. Mayor Gandolfo stated the next work session will be on November 1 and the next board meeting will be held on November 15. Trustee Hyland made a motion to adjourn to Executive Session, seconded by Trustee Fudali, motion carried. Executive Session Discussion ensued regarding accidental disability retirement of police officer Ron Biro which had been denied. The Village Attorney stated that the Village has two choices, one is to have him come back to light duty or for him to apply for ordinary disability. The Village has applied for ordinary disability on his behalf and if this is denied; he can be terminated if he is out of work for one year on workman's compensation. The Village Administrator made a recommendation that we hire a police officer from the civil service list, effective November 14 which is when training session starts. A position for skilled laborer has become open due to the fact that Michael Timm has asked to return back to title of laborer. Jerry Navin has requested to be appointed to this position. As soon as Michael Timm submits his letter, Jerry Navin can be appointed. A brief discussion ensued on 79 College Avenue Corp. with regard to the repairs needed on the roof and the boiler, and increasing Irene Amato's monthly stipend. Also, the possibility of selling this building. The Mayor and the trustees the moved back to regular session. Approval of Warrants After a brief discussion on the bills, the warrant was approved with the addition of one bill to Sophie's Restaurant for reimbursement of payment of new awning. Mayor Gandolfo called for a special meeting on November 7, 1988 to discuss the possible hiring of a new police officer and to discuss the positions of laborer and skilled laborer. Being no further business the Mayor adjourned the meeting.
