Present: Mayor Gandolfo Trustee Fudali Trustee Fine Trustee Cicchetti Trustee Treacy Trustee Hyland Trustee Coon Also Present: John J. Hughes, Jr. Village Attorney William T. Regan, Village Administrator Mayor Gandolfo called the meeting to order with a pledge to the flag. Public Hearings Mayor Gandolfo read the public notice regarding parking on Tappan, Crane and Anderson Avenue. (notice attached) Ugo Checci, chairman of the Parking Authority, reported that this public hearing came about because of many complaints of residents and the Fire Department stating that there is not enough room for emergency vehicles to pass through those streets. James Weaver, a resident of Crane Avenue, commented that although he thought this possible amendment to the law was a good idea, he had some reservations and suggested that the Board study other alternatives other than the ones listed. Several other residents of Tappan Avenue and Anderson Avenue approached the Board with pros and cons of the proposed amendment. After several recommendations and discussion, Trustee Fudali suggested that an Adhoc committee be formed to see if there is a solution. Mayor Gandolfo then commented that after the Board and the Parking Authority consider all possibilities, the Public Hearing would continue at the next meeting. The Mayor then closed this public hearing. Mayor Gandolfo read the attached restricting parking on Bedford Road. Public Notice regarding Ugo Checchi told the Board that the reason this restriction should be passed is that several residents have complained that with parking on Bedford Road, they cannot see coming out of Webber Avenue, Sleepy Hollow High School and Hudson Terrace. He also stated that there is parking on the south side below Hudson Terrace. 1 �1° Mr. Slavin, a resident of 40 Bedford Road told the Board he supported this restriction and that he had initiated the original complaint. Bedford Road is not a residential street, but a major artery where there is very heavy traffic and excessive speed. He suggested that parking only be permitted on one side of Bedford Road at the lower end below Hudson Terrace. Being no further comments, the Mayor closed the public hearing. Approval of Minutes Trustee Fine moved, seconded by Trustee Coon to approve the minutes of November 1, 1988 as written. Motion carried. Trustee Hyland moved, seconded by Trustee Fudali to approve the minutes of the special meeting of November 7, 1988 with one minor change. On resolution #134, the probationary period should read not more than 26 weeks. Motion carried. Communications & Requests Mayor Gandolfo read a letter from Frank D'Eufemia resigning from the Parking Authority because of other commitments. Trustee Hyland moved, seconded by Trustee Fudali to accept his resignation with regrets. The Mayor read a letter from Charles Luberger of Harwood Avenue complaining about a missing street light fixture on an existing pole between Harwood and Kelburne Avenue. The letter would be referred to the Public Works Department. A letter from Stanley Baker of Lawrence Avenue was read regarding the bagging of leaves. He felt that the residents of the Manors should bag leaves as all the other residents of the Village do. This would help alleviate the drainage problem within the area of the Manor. Letter referred to Public Works Department. Mayor's Report The Mayor reported that work on the traffic island is almost completed. On November 19 a new sign will be arriving and on the 22nd of November the flag pole will be installed. We will be receiving two other signs through a grant that the Chamber of Commerce received from the County which will be going up in North Tarrytown to direct people to the business district. On November 27, between 3PM-6PM a small reception will be held in Columbia Hose headquarters to welcome our new Administrator. All residents are invited. Mayor Gandolfo reported that the Code Enforcement program is moving along very well. We now have 15 owners in court to answer code violations. 2 �i Administrator's Report The Administrator reported that a demonstration of a combination leaf pickup machine/street sweeper will be done on Wednesday at 8:30AM. The Administrator stated that due to regulations imposed by Metro-North, the NY State contractor rebuilding the Palmer Avenue bridge must work on Thursday, November 17 and Friday, November 18 from 10PM until 6 AM the next day. If the work is not completed in two nights then additional time will be needed on Saturday, November 19th from 10PM until Sunday, November 20 at 6PM. Permit parking signs have been installed on 1 Riverside Drive. We have received verbal notification that the Village has been awarded the $12,000. grant from the NY State Office for the Aging for Senior Citizen's program for the Village of N.Tarrytown. Trustee Coon reported on recent events already held and the upcoming events which is a Ranger/Devil Hockey Trip at the Meadowlands on December 27, 1988 at 6s 15PM. Present activities going on are adult and youth basketball, youth floor hockey, adult volleyball and mother/toddler play group. He also reported that there will be a Recreation Commission meeting on November 17. Trustee Hyland reported that the Elm Street parking lot is being enlarged and he thanked Duracell for the use of their lot in the interim; and also thanked Ken Forest for keeping it clean for us. The leaf pick-up is in full swing. Snow removal equipment is used to pick up leaves in the Manors to test it out before the winter sets in and to help pick up the enormous amount which falls in that area. The Public Works Committee has applied for a $10,000. re cling solid waste grant from Westchester County. Resolution t be passed at the next meeting. Trustee Treacy commented on possible changes in the village phone system due to an article in the newspaper regarding the misuse of municipal phones in New York City; for example a $6000. phone call to one of these new party line services that are being advertised. To prevent this from happening to our Village, he has contacted the telephone company to have all the municipal phones of the village blocked off from any pay type service that NY Telephone or any other company are offering. The survey of Beekman Avenue is continuing and the surveyor has informed us that his work should be completed sometime before the end of next month. Trustee Treacy commented that Mt. Vernon has made an $18,000. return on a $900.investment by using Boots which are vehicle restraint devices to keep scofflaws from moving their vehicles until their tickets are paid. He suggested that we purchase two boots to help in our collection program for those scofflaws who owe thousands of dollars. The cost would be $600. 3 �The Mayor suggested that we check with Complus to see how many we have outstanding and discuss it at the next work session. Trustee Cicchetti reported that the Conservation Advisory Council will be resuming work on the local waterfront revitalization program. According to NY State coastal area maps the entire Village is considered a coastal area. There will be some preliminary work done on identifying some areas to be considered and to do some mapping of same. The Council will be meeting on November 29 at 8 PM. The Board has had discussions with Metro-North to include parking facilities for those residents who use this commuter line. We are at present looking into the possibility of using some undeveloped Village property between Palmer Avenue and Devries Field. Because the County holds reserved rights on this land, we will need their approval before we can proceed to negotiate with Metro-North. Trustee Treacy is setting up a meeting on site with us and our County Legislator and Assessor to review the possibilities. Trustee Cicchetti attended a Recycling conference regarding the County's big push on recycling. There were many exhibits. The County has issued requests for bids from many recycling businesses in the County for glass, plastics, cardboard, newspapers and metals. Hope to have the winning bid selected by January. Trustee Fine entered the Police report into the minutes. She read a letter from the Chief of Police in Dobbs Ferry to our Chief thanking Sgt. Hayward and Police Officer DiCairano for their assistance in dealing with the activist group "Operation Rescue". A copy of the letter was put into their files. The COC dinner was a huge success. Trustee Fine congratulated the fire department in their ability to react in containing the two serious fires; one at Tappan Motors and the other on No. Washington Street. The Mayor commented that Tarrytown and Ossining fire departments should also be thanked. Trustee Fudali reported on the health insurance follow-up; four additional municipalities have expressed their intent to withdraw from the Empire Plan. He stated that he would like to call for a county wide meeting on November 22 at 8PM to discuss issues that are of concern to all of us. The Village has obtained a copy of the audit of the State Comptroller which will be discussed with other municipalities. Trustee Fudali received a memo from the NY State Housing Finance Agency; there is approximately 20 million dollars available in grants under the Infrastructure Development Administration program.Although it is specifically geared towards utility and sewer line connections, it does provide financing for affordable housing. Trustees Treacy and Fudali will look into funds that might be available for the Village for upgrading 79 College Avenue. 4 �6Z. Public Comments Two residents, Mrs. Belanich and Mr. Caetano commented on the bagging of leaves in the Manors. They felt that those residents should also bag their leaves to prevent the blocking of the storm drains and preventing accidents from occurring. Mrs. Belanich also asked if the K-9 Patrol was still in effect. The Mayor commented that as far as she was concerned, it had never stopped, even though Walter Schrank had been promoted to the position of Sergeant, he is still the K-9 officer. Dr. Sweet told the Board that he had attended a Hazardous Waste & Recycling Seminar at the County which was very informative. Recycling will be a part of our way of life in the very near future. Ugo Checci, chairman of Parking Authority, reported that in light of the problems associated with parking spaces for fireman when there is a meeting, Amenta Travel Agency has given us permission for the firemen to park in their lot on the night of their meetings. Resolutions All resolutions are attached. Old Business Trustee Fudali commented on an article which appeared in the newspaper regarding the Amnesty Program Phase II which is now in progress. Several months ago the amnesty deadline date was not extended; therefore we have approximately 1.7 million immigrants that were eligible for permanent resident status. The INS will be mailing applications directly to immigrants who qualified during the first part of the amnesty process. Because many will not receive this notice due to change of address, he suggested that the Village post notices in our building and the post office advising any immigrants of this. Trustee Fudali spoke on behalf of the Public Television Center who had requested space in this building. The Board will look into the room in the basement. Sunny McLean has advised him that there are many volunteers who can help them move, etc. and it will cost the Village no money. Trustee Fudali moved, seconded by Trustee Fine, that the Mayor be authorized to sign a contract entering into a towing agreement with Stiloski's Towing Service. The Village Attorney stated that he has gone over the specifics of the contract with Stiloski. After a brief discussion, the motion was carried. 5 �t.1t Mayor Gandolfo commented that the Sign Committee has held their meeting regarding amending the sign ordinance and w i l l be making several changes; then they w i l l meet with the Board;after which time the Public Hearing w i l l be continued. Mew Business The Mayor stated that the work session w i l l be held a t 7 PM and the meeting on the health insurance a t 8 PM on November 22, 1988. Approval of Warrants Trustee Fine so moved, seconded by Trustee Fudali, t o approve the warrants and authorize the treasurer t o pay the b i l l s , with the exception of the payments Rains & Pogrebin. Motion carried. Trustee Hyland made a motion to adjourn to Executive seconded by Trustee Fudali, and carried. session, Executive Session D i s c u s s i o n ensued on the n o t i c e of claim which t h e V i l l a g e received regarding a charge of abuse , f a l s e a r r e s t , e t c . against L t . Brophy an another o f f i c e r whose name was not mentioned. After much discussion, our attorney asked that a motion be made a u t h o r i z i n g him t o c l e a r i t with the Chief t h a t t h e Board be authorized t o h i r e an attorney t o do an i n v e s t i g a t i o n and secondly to s t a r t negotiations with an attorney t o see whether or not he would do an i n v e s t i g a t i o n . Trustee F u d a l i s o moved, seconded by Trustee Fine. Motion c a r r i e d , with Trustees Fine,Fudali, Cicchetti and Treacy voting YES, and Trustee Hyland voting NO. On the matter of Ron Biro's d i s a b i l i t y retirement, Attorney had no update. the Village The Village Attorney reported on the Olick case. On our position of defending ourselves against an action by t h i s firm t o recover the fees; his opinion was that i f Olick resorted t o l i t i g a t i o n he would be successful in recovering a very large measure of these f e e s . After stating some of the factors that the courts consider when trying to assess these types of c o n t e s t s , he recommended t h a t we somehow t r y to agress o u r s e l v e s t o t h i s p a r t i c u l a r problem. After some discussion, i t was decided t h a t the Village Attorney be authorized to pay Olick $50,000.now and negotiate the rest of the payment. Trustee Fudali stated that Jimmy Manca had a request that he work Saturdays until the sick time he owes us i s paid back. After a b r i e f discussion, i t was decided that t h i s would not be practical and would cause too many problems, t h e r e f o r e h i s r e q u e s t was denied. Motion carried. �Meeting Date: November 15, 1986 Resolution I: 11/136/88 BOND RESOLUTION, DATED NOVEMBER 15, 1988, AUTHORIZING THE ISSUANCE OF $45,000 SERIAL BONDS OF THE VILLAGE OF NORTH TARRYTOWN PURSUANT TO THE LOCAL FINANCE LAN, TO FINANCE THE ACQUISITION OF EQUIPMENT FOR THE PUBLIC WORKS DEPARTMENT AND APPROPRIATING THE PROCEEDS TO SUCH PURPOSE. BE IT RESOLVED by the Board of Trustees of the Village of North Tarry town, in the County of Westchester, New York, (the "Village") as follows: Section 1. The Village shall issue its Serial Bonds of the aggregate principal amount of $45,000 pursuant to the Local Finance Law of New York, to finance the specific objects or purposes hereinafter described. Section 2. The specific objects or purposes (hereinafter referred to as "purposes") to be financed by the issuance of such Serial Bonds is the acquisition of equipment for the Public Works Department including but not limited to the acquisition of a back hoe and equipment to facilitate snow removal from Village streets and costs incidental to such purposes. The proceeds of such obligations are hereby appropriated to such purposes. Section 3. It is hereby determined and stated that the combined maximum cost of such purposes as determined by the Village is $4 5,000 and that no money has heretofore been authorized to be applied to the payment of the cost of such purposes. The Village plans to finance such costs entirely from funds raised by the issuance of the obligations authorized by this bond resolution. Section 4. It is hereby determined that the purposes are objects or purposes described in Subdivision 32 of Paragraph a of Section 11.00 of the Local Finance Law, and that the period of probable usefulness of each such purposes is 5 years. Section 5. Subject to the terms and conditions of resolution and of the Local Finance Law, and pursuant to the �,1V 0 provisions of Sections 30.00, 50.00 and 56.00 to 60.00, inclusive, of the Local Finance Law, the power to authorize Bond Anticipation Notes in anticipation of the issuance of the Serial Bonds authorized by this resolution and the renewal of such notes, and the power to prescribe the terms, form and contents of said Serial Bonds and said Bond Anticipation Notes, and the power to sell and deliver said Serial Bonds and any Bond Anticipation Notes issued in anticipation of the issuance of such bonds is hereby delegated to the Village Treasurer, the Chief Fiscal Officer of the Village. The Village Treasurer is hereby authorized to sign any Serial Bonds issued pursuant to this resolution and any Bond Anticipation Notes issued to this resolution and any bond anticipation notes issued in anticipation of the issuance of such Serial Bonds, and the Village Clerk is hereby authorized to impress the corporate seal of the Village to any of said Serial Bonds or on any Bond Anticipation Notes and to attest seal. In the alternative, the Serial Bonds may be signed with the facsimile signatures of the appropriate Village officials and the Serial Bonds may be authenticated by a fiscal agent. Section 6. This resolution shall be published in full by the Village Clerk of the Village together with a notice in substantially the form prescribed by Section 81.00 of said Local Finance Law and such publication shall be in "'The Daily News*'. The validity of said Serial Bonds or of any Bond Anticipation Notes issued in anticipation of the sale of said Serial Bonds may be contested only if such obligations are authorized for an object or purpose for which the Village is not authorized to expend money9 or the provisions of law which should be complied with at the date of the publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity, is commenced within twenty days after the date of such publication? of if said obligations are authorized in violation of the provisions of the Constitution of New York.
