Presents Mayor Gandolfo Trustee Fudali Trustee Fine Trustee Cicchetti Trustee Hyland Trustee Treacy Absent: Trustee Coon Also Presents John J. Hughes, Jr. Village Attorney William T. Regan, Village Administrator Mayor Gandolfo called the meeting to order with a pledge to the flag. Public Hearing Mayor Gandolfo read the following public notice: PLEASE TAKE NOTICE that the Board of Trustees of the Village of North Tarrytown will hold a public hearing in the Municipal Building, 28 Beekman Avenue, North Tarrytown, New York on Tuesday, February 7, 1989 at 8:00 PM to hear and consider an amendment to Chapter 18 of the Electrical Code entitled "Liability for Damages", to permit a licensed electrician who is retired to apply for and maintain an honorary electrician's license, which honorary license shall entitle the licensee to hold office on the Board of Electrical Code Control on an unpaid, voluntary basis. By Order of the Board of Trustees Dated: January 27, 1989 North Tarrytown, New York Mayor Gandolfo commented that some of the retired electricians would like to hold office on the Electrical Board, but would need to maintain their license and insurance in order to do so, but to obtain liability insurance would be a great expense to them. The Board is looking to alleviate that responsibility for any licensed electrician who does serve on the Board of Electrical Control by a possible amendment to the code. The Mayor also commented that the Board would welcome any comments from the audience. Public Comments Peter Maccio of Mahopac, New York addressed the Board stating that he has an electrical license for 11 years but is not engaged in electrical contracting. He had suggested to the Electrical Board that an inactive license be issued until the electrician files for a job in the Village and then liability insurance must be taken out. 1 �I Mayor Gandolfo stated that they will consider all proposals and anyone watching could write a letter or call with their comments. She then asked that a motion be made to close the public hearing;Trustee Fine so moved, seconded by Trustee Treacy. After a short discussion, the Mayor asked that the motion be withdrawn to close the hearing and the Mayor adjourned the public hearing to a later date. Approval of Minutes Trustee Fine so moved to approve the minutes of January 17, 1989 as written, seconded by Trustee Fudali and motion carried. Communications and Requests The Deputy Village Clerk was in receipt of a letter from Michaels Tavern at 11 Beekman Avenue stating their intent to renew their liquor license. The Deputy Clerk was in receipt of a letter from Emil Vizvary of 85 New Broadway stating that he fell on the icy brick walk at the Traffic Island on January 12, 1989 resulting in a broken wrist. Mayor Gandolfo read a letter from M.J. Mignogna, Regional Traffic Engineer at State of New York Department of Transportation, regarding the creation of a parking lane on Route 448. He stated that a formal investigation has been initiated and study will be conducted at this location and the Village will be notified of the findings and conclusions. Copy of this letter was mailed to Mrs. Cycz and Mr. Scipioni who addressed this issue at the last meeting. Approval of Warrants Trustee Fine made a motion to approve the warrants and authorize the treasurer to pay the bills, seconded by Trustee Fudali and motion carried. Mayor's Report Mayor Gandolfo reported that on February 3, the Recreation department in conjunction with the Youth Bureau of the police department sponsored a trip to the Ice Capades. She thanked the merchants who donated the tickets and the buses; McCall Frandsen, G&R Getty, Inc. and First National Bank of N.Tarrytown. She also thanked Officer Pellegrino for all his work in soliciting the tickets for the residents and thanked her secretary and Kevin Connolly of the Recreation Department. Grievance Day will be held on February 21 in Village Hall from 4 to 8 PM. Any property owner will have the opportunity to petition and grieve to the Board regarding their assessment. The deadline for submitting the grievance is up until that date. 2 �I The Mayor has asked the police department to relax the parking restrictions in the church areas on Ash Wednesday until 11AM due to the fact that many people will be attending services that day and cannot find parking spaces. Mayor Gandolfo has received many comments regarding the lack of windows facing Pocantico Street in the new development called Pocantico Park and she has spoken to the contractor who has agreed to put in windows on that side. The Mayor stated that we are still looking for a Maintainer of Alarms and if anyone is interested, they should contact the Administrator. Mayor Gandolfo stated that staff is working on a legislative packet to send to Senator Spano and Assemblyman Sullivan's office. We have asked for a renewal of the $250,000. grant which we received last year and several member items such as economic development, senior citizens, public access television, auxiliary police, etc. The following resolution was read: #2/18/89: Resolved: That, the Mayor and Board of Trustees do hereby approve the Villages' 1989 State Legislative Package to be distributed by the Village Administrator to all State Legislators representing North Tarrytown as well as the leadership of the State Senate and Assembly. Trustee Fudali so moved, seconded by Trustee Treacy and motion carried. Mayor Gandolfo designated William Regan, Village Administrator as Budget Officer for year 1989-1990. The Mayor entertained a motion that the Board direct Bill Regan, Village Administrator to present a capital projects budget to the Board of Trustees. Trustee Hyland so moved, seconded by Trustee Fine and motion carried. The Mayor commented that the Lt. Brophy is in the process of conducting a field survey to check and see which signs are worn out and need to be replaced and check and see if the ordinances agree with the signs. Trustee's Reports Trustee Fudali commented briefly on the unpaid taxes due the Village. He stated that letters have gone out to all taxpayers who are in arrears for two years or more advising them that action would be taken by the Village Attorney if not paid. He also reported that letters have been sent out to the department heads stating that their budget be submitted by March 1; at which time take requests will be discussed in an attempt to construct a fiscal budget for the following year which needs to be filed with the Village Clerk by March 20. 3 �I Trustee Fine reported that on February 3, she met with Bob Rubenfeld, the liason for government affairs for Metro North and rode around the Philipse Manor train station discussing our complaints,plans and hopes for that area. In terras of the guard rail, a survey was done and the funding will have to be considered as part of our budget; but general improvements around the station area including lighting and a foot path were some things that Metro North would consider. She will continue to keep in touch with Mr. Rubenfeld on these matters. Trustee Fine met with board members of COC and representatives of Hitachi, General Motors and General Foods regarding fund raising plans. Trustee Fine reported that the Public Safety Committee met with a representative of the Hahn Fire Apparatus Company who gave a presentation about a fire pumper. They are competitors of Pierce Arrow who gave a presentation a few months ago on a their fire pumper. The Village is very interested in budgeting for a new pumper in 1989-90 and will be doing some research. Trustee Fine made a motion to confirm the action taken at the Board of Fire Wardens meeting held in January which concerned Larry Kosilla, seconded by Trustee Cicchetti and motion carried * Trustee Fine submitted the Police report into the minutes. Trustee Cicchetti commented that with regard to the Metro North commuter parking lot, we are only in the beginning stages and there are many issues that must be addressed before anything is done. Trustee Cicchetti attended an all day seminar with members of the Conservation Advisory Council. Dr. Sweet, who attended this seminar with Trustee Cicchetti spoke on what was discussed . He stated that it dealt with coastal management, federal and state programs with regard to local waterfront rehabilitation as well as strategies and methods for obtaining funds. Trustee Cicchetti attended a meeting with the Conservation Advisory Council and they reviewed an ordinance from the Westchester County Soil and Conservation District which conforms to all the state guidelines. They have prepared a model ordinance for wetlands protection,which he will present at the next work session. Trustee Treacy reported that the Sign and Awning Program is going along very well. Tarry Inn has a new awning, White Front and Off-Broadway Deli intend to erect awnings of that type, Brunt and Brooks has completely refurbished their store front which has made a tremendous improvement in that area. 4 �On January 25, 1989 there was a joint meeting with the Zoning and Planning Boards and Rezoning Committee. On the agenda was the possible rezoning of the Broadway-Beekman Avenue highway and commercial or C-l area. Research into this area found that the Hennessey property is currently zoned C-l an should be R-4 which is in keeping with the Webber Park area which is residential. Fritz Weidle is preparing a proposal for this change in zoning for the Board and a public hearing will be called for when it is ready. February is Black History month and Westchester County has a calendar of events which recognizes the accomplishments of African Americans. At the Philipse Manor Restoration on February 19, a musical celebration will be held from 2-3 PM. Trustee Treacy reported that with regard to the rebuilding of Beekman Avenue, the Surveyor has run into some difficulty in completing the survey but it will be done soon. The Design Committee will have many styles of lights and sidewalks to review, and we hope to break ground by September. Trustee Hyland reported that the new recycling and garbage schedule has been sent out. Recycling is working; we have saved $1101.26 in dumping fees since December 1987. Two extra dumpsters are at the Village garage for anyone who wishes to dump their recyclable items there. The Clinton Street lot has been cleaned up, Elm Street parking lot is now full. Route 9 between Sleepy Hollow and Philipse Manor on the east side has been cleaned up. Mayor Gandolfo read a recreation report in the absence of Trustee Coon; Trip to the Ice Capades was held on February 3 and was co-sponsored by the N.Tarrytown Police Department; read the events currently in session and those coming up such as basketball, soccer, tennis, golf, etc. Special events coming up are Circus Trip, Easter Egg Hunt, Sure Shot Basketball, Dad's Club vs. Police Basketball Game. Administrator's Report The Administrator stated that the Village Attorney has sent out a letter to all those residents whose taxes are in arrears for more than two years and that a tax foreclosure sale would take place if they did not pay their taxes. The treasurer has since collected $2500. from three owners. Sometime in March a tax lien sale will take place for those property owners who have not paid their taxes for the 1988-89 fiscal year; a tax foreclosure sale can take place two years after this. 5 H * �I 1p Regarding the legislative packet,he commented that we are working on the renewal of the $250,000. grant for 89-90 fiscal year. In the projections that have been done, we find that if GM had remained on the tax rolls, they would have been paying an additional $777,000 and we are asking the state for 1/3 of that amount. Other items included in the package are support for a proposal by the governor and state comptroller to reduce the contribution rates to the state retirement system. We are asking for the renewal of the $100,000. Economical Development grant which would be used for code enforcement officers, the beautification program of the downtown area, $10,000.grant for the North Tarrytown Municipal Center to establish a studio and offer programs to young people, the renewal of the $10,000. senior citizen grant, financial assistance for fire and ambulance services through a revolving loan fund and a $10,000. grant for the ambulance corp to assist them in purchasing equipment items. The work on the Palmer Avenue bridge is progressing ahead of schedule and should be completed before March 3 1, 1989. The contractor and state engineers have asked the village's cooperation to speed up the rest of the project which includes landscaping, regrading and raising of the section of Palmer and Riverside Drive and the reconstruction of the island at that location by prohibiting parking in front of 1 Riverside Drive for a period of two months beginning February 20. Flyers will be distributed to residents of 1 Riverside Drive. Public Comments Mr. Galella spoke with regard to asking GM for a donation towards fixing up Devries Field. The Administrator has already done this and by the next work session he will have a specific proposal for a temporary improvement on the field for this season and continue to work on the long range improvements. He also asked that perhaps the Board could consider building some sort of housing to keep our volunteer fireman and village employees. Mayor Gandolfo commented that the Board is considering the Duracell property to build some sort of housing and Trustee Treacy commented that we are asking the Halpern Associates to look into possible housing for senior citizens and our young people also. Dr. Sweet voiced disapproval of the newly built Pocantico Park. He felt that the Planning Board and Zoning Boards should not have approved this variance because of the way it is set on this lot. He also commented that the leaf grant application has been received and forwarded and we are waiting for a response. Mario DeFelice addressed the Board stating that the Pocantico Hook and Ladder speaker was broken and is now missing. The Administrator will check into this. 6 �I Mr. Belanich addressed the Board stating that he met with Mike Rovello who had sent a letter to the Village asking for the use of Village Hall for anyone to ask questions and wanted to know when this would be. Mayor Gandolfo stated that the letter did not state which date he wanted. Mr. Galella also asked that something be done with the sidewalk in front of the new Rodrigues building on Valley Street so that pedestrians can walk. There being no further comments, Mayor Gandolfo closed the Public Comment section. Resolutions #2/19/89: RESOLVED; That, the Mayor and Board of Trustees of North Tarrytown do hereby express their opposition to any proposals by the Federal Government which will result in the imposition of a fee upon depositors of Savings and Loan Associations or other banking institutions. BE IT FURTHER RESOLVED; That, a certified copy of this resolution be forwarded to U.S.Representative Nita Lowey, Senators Daniel P. Moynihan and Alfonse D'Amato and President George Bush. Trustee Hyland so moved, seconded by Trustee Fudali and motion carried. Trustee Fudali also suggested that a certified copy be sent to National League of Cities. Resolutions #2/20/89 and #2/21/89 are attached. With regard to the resolution of immobilization of vehicles, Trustee Treacy stated that a list of phone numbers of those owing $100. or more is being compiled so that they can be notified of this new ordinance and he urged anyone who has any outstanding violations to come in and pay their fines. Mayor Gandolfo stated that before any action can be taken on this ordinance, the schedule of fees should be set. Old Business Trustee Fine commented that at the next work session she like to discuss the earlier closing time for bars. would Trustee Fudali recommended that the Board meet with our auditors at the next work session to discuss their proposal and negotiate the fee that they requested. Two weeks ago Trustee Fudali met with Bill Moulton, our insurance representative to discuss certain issues; whether or not we have liability coverage for members of the Parking Authority and TV Center. Mr. Moulton felt that both items would be covered under our volunteer clause that we have with regard to liability insurance. He would like Sunny McClean and the Chairman of the Parking Authority to be informed of this. 7 �Mayor Gandolfo stated that the figures she quoted at the last meeting were incorrect for Ross Hardware expenditures and the correct figures were $2276 from 9/1-12/31/88 and a total of $5600. from 3/1-12/31/88 and at Berger True Value from 9/1-12/31/88, $1995 was spent and from 3/1-12/31/88 a total of $12500. was spent. The Administrator will look into the reason we spent less at the local merchant. The Mayor was in receipt of a memo from Robert Peirce, Village Prosecutor stating that the prosecution of the building code violations involving our code enforcement officers has been very successful. The owners on Beekman Avenue were fined $2000 and there are approximately 12 to 15 more cases pending in court. This should serve as a warning to other homeowners who have building code violations. She also wanted to remind the people that the Village is considering selling 79 College Avenue and will accept proposals until February 15 at 4:30 PM. The Mayor was in receipt of a check from Continental Cablevision in the amount of $2685.43 which is their franchise fee taxes for the quarter ending December 31, 1988. New Business Mayor Gandolfo stated that the next work sessions will be held on February 14 and February 28; the next board meeting is February 21, 1989. Artic2e XV, Section 57-69, "Towing and Storage of Vehicles, is hereby amended by adding the words "and Immobilization" to the title so it no reads "Towing, Storage and Immobilization of Vehicles." 2. Article XV, Section 57-69, Towing, Storage and Immobilization of Vehicles, is hereby amended by adding a new subparagraph "B: as follows: (B) "When any vehicle which has $100. or more in outstanding or unpaid parking violations issued against it and which is found, operating or parked on any highway within this Village or any way publicly maintained when any part thereof is open tot he use of the public for purposes of parking or vehicular travel, or on any property leased by or in the possession and control of the Village of North Tarry town, said vehicle may be removed or cause to be removed* by or under the direction of a member of the Police Department by towing or otherwise, consistent with subparagraph A of this Section 1. In addition to, or in lieu of towing, any such vehicle may be immobilized in such manner as to prevent its operation, except that no such vehicle shall be immobilized by any means other than by the use of a device or other mechanism which will cause no damage to such vehicle unless it is moved while such device or mechanism is in place. In any case involving immobilization or a vehicle pursuant to this subsection, such member of the Police Department shall cause to be placed on such vehicle, in a conspicuous manner, notice sufficient to warn any individual of the effect that any attempt to move such vehicle might result in damage to such vehicle." 3. Article XV, 57. "Towing, Storage and Immobilization" is hereby amended by adding a new subparagraph "C" as follows: C. After removal of any vehicle as provided in this Article, the Chief of Police may cause such vehicle to be stored in a suitable place at the expense of the owner. Before the owner or person in charge of any vehicle taken into custody or immobilized as provided in this section shall be allowed to repossess or to secure the release of said vehicle, the owner or his agent shall pay the following: (a) An administrative fee to the Village of North Tarrytown in the sum of Fifty Dollars ($50.00). (b) All sums legally due the Village of North Tarrytown for parking violations issued and outstanding against such vehicle. No vehicle shall be released by an officer or employee of the Village until such sums are paid in full. �7^P (c) To the V i l l a g e of North Tarrytown, the towing s e r v i c e and/or t o the person with whom t h e v e h i c l e i s s t o r e d , a l l expenses a c t u a l l y and n e c e s s a r i l y incurred i n e f f e c t i n g such removal and s t o r a g e . Maximum removal and s t o r a g e charges s h a l l be e s t a b l i s h e d from time t o time by r e s o l u t i o n of the Board of T r u s t e e s .
