Present: Trustee Trustee Trustee Trustee Absent: Cicchetti Kyland Treacy Alter Mayor Gandolfo Trustee Apollonio Trustee Coon Also Present: William T. Regan, Village Administrator John J. Hughes, Jr. Village Attorney Newly appointed Morris Alter was sworn in as Village Trustee by Deputy Mayor Treacy. Deputy Mayor Treacy called the meeting to order with a pledge to the flag. Public Hearing Deputy Mayor Treacy reopened the public hearing on parking on Rice Avenue. Chief Richard Gross addressed the public citing the reasons no parking is needed on certain sections of Rice Avenue. He stated that it is for the benefit of all those living on that street in case of a fire. The fire trucks cannot make the turn to get into Rice Avenue and that the fire wardens have been asking that something be done for many years now. He tried to impress upon the people how important this request is and that there are many residents of that street who are very much in favor of this ordinance. Dr. Richard Sweet asked if the Village were liable for damage done to any vehicles parked there when a fire truck is trying to get through? The Village Attorney commented that in the case of an emergency where lives are at stake, the Village would not be responsible. There being no further public comments, Trustee Cicchetti moved to close the public hearing, seconded by Trustee Hyland and motion carried. Deputy Mayor Treacy reopened the public hearing on the proposed addition to the R-l district. 1 �Dr. Sweet asked that the Board look into this very carefully before granting this use to the museum, since we have many tax exempt properties already and should look into something in lieu of taxes if possible. Steve Salman asked about spot zoning and Deputy Mayor Treacy responded that spot zoning was illegal. There being no further comments, Trustee Hyland moved to close the public hearing, seconded by Trustee Cicchetti and motion carried. Approval of Minutes Trustee Hyland made a motion to approve the minutes of May 16, 1989 as submitted, seconded by Trustee Cicchetti and motion carried. Communications, Petitions & Requests Deputy Mayor Treacy read a letter from Cindy Curran regarding a potentially serious problem involving cars coming off of Route 9 onto Millard Avenue and suggested the installation of speed bumps on those avenues that directly connect Route 9 in our area. Referred to Public Works department. Deputy Mayor was in receipt of a letter from Amanda Shaw of 126 Valley Street protesting the rate increase in the parking lot. Deputy Mayor read a letter from the Immaculate Conception Church requesting permission to hold their annual bazaar on the nights of August 10,11,12,17,18,19, & 20 starting at 6 PM. Trustee Cicchetti made a motion to approve this request, seconded by Trustee Alter and motion carried. Deputy Mayor read a letter from County Executive, Andrew P. O'Rourke officially declaring an end to the drought. A letter was received from David Beale of 17 Merlin Avenue advising the Board that two street lights are out on Devries Avenue. A letter was received from Metro-North soliciting comments and suggestions regarding future changes to train schedules. The Mock Trial Team at Sleepy Hollow High School wrote a letter to the Mayor thanking her for the police escort they received when they returned from the Westchester County Court House on April 6, 1989. General Motors Corporation sent the Board a copy of their news release which states that GM achieved first quarter earnings of $1,6 billion, highest quarterly profit in almost five years. 2 �6" The Sleepy Hollow Family Festival will be held on June 11 from 11AM-5PM in Patriots Park. In the absence of Trustee Coon, Trustee Treacy reported that there are still 39 residents that need to be visited before the mailers can be sent out. residential valuation will occur after responses to the mailers are received. There are still 90 residents who need interior inspections and they are asked to call Village Hall to set up an appointment. Deputy Mayor Treacy commented that there are grants up to $5000. available from the County to elderly home owners for emergency repairs when they meet certain eligibility requirements as far as income. The Latin Restaurant has a new facade as does the Off Broadway Deli and Pulsoni's new awning will be going up shortly. Trustee Hyland submitted the Police Report into the record. The Highway Department has trimmed the hedges along Riverside Drive. Minor repairs have been done to Elm Street lot, pot holes will be filled shortly along Hunter, Harwood and Kelburne Avenue. Littering tickets have been issued to those residents who have put garbage and bulk out on the wrong days and once everyone complies with the rules, our Village will be much cleaner. Trustee Cicchetti reported that the 1988-89 fiscal year will be closed out shortly. The auditors will be reviewing the accounts and we should have an audit report on the state of Village finances sometime by the end of this summer. Administrator's Report The Administrator reported that the BOOT program will begin around June 15. We are awaiting a list of scoff laws who have outstanding tickets of $100. or more. Attempts have been made to notify these people about the BOOT if they do not pay their tickets. The Administrator commented that in an article in the newspaper a few weeks ago, it was noted that the County roads received 52 million dollars and that N. Tarrytown's local street improvements for access to General Motors plant, $410,000. This money will be for the realignment of Continental Street. Proposals to restore Beekman Avenue from Route 9 to River Street which would include the installation of a 24" storm sewer on Route 9 to Cortlandt Street, the rehabilitation of River Street,restoration of Howard Street to Kendall Avenue and traffic signal improvements at the intersection of Beekman and Washington are on the drawing board. The Administrator reported that flyers will be placed on cars parked on Clinton Street listing alternate side parking regulations going into effect on June 12 with regard to the GM access improvements and the light on Wildey street. 5 �Resolutions- All resolutions are attached. New Business The next work session will be held on June 13 and the July Board meeting will be held on July 18. Deputy Mayor Treacy called for a for a public hearing on July 18 for the possible zoning change to limit or eliminate future use of food establishments and bars in a C-2 zone. Trustee Cicchetti so moved, seconded by Trustee Hyland and motion carried. Approval of Warrants Trustee Hyland made a motion to approve the warrants and authorize the Treasurer to pay the bills, seconded by Trustee Cicchetti and motion carried. Executive Session Trustee Hyland moved to adjourn to Executive Session to discuss legal matters and personnel matters, seconded by Trustee Cicchetti and motion carried.. Trustee Hyland made a motion to approve the purchase of a new jacket for a police officer whose jacket was torn in the line of duty, seconded by Trustee Cicchetti and motion carried.-—' After much discussion on the litigation of Biros vs the Village, Trustee Treacy moved that this lawsuit be settled before it goes to trial by paying a sum of $35,000. to Biros. This figure is the deductible on our insurance coverage. Motion seconded by Trustee Alter and carried with Trustees Cicchetti, Treacy and Alter voting YES and Trustee Hyland voting NO. On the matter of the grievance of Iris Emerson to pay her 50% of health insurance premiums due to the fact that she is on her spouse's plan, Trustee Treacy moved to pay premiums at six month intervals, seconded by Trustee Cicchetti and motion carried and also to pay her the contractual holiday pay due to her even though they are still awaiting the completion of her disability form while she was out on maternity leave. The Board adjourned back to the regular meeting and there being no further business, the Deputy Mayor adjourned the meeting. Respectfully submitted, Angela L. Everett Deputy Village Clerk 6 �i <& A letter was received from Annamaria Bertacchi of Andrews Lane requesting that a sign be posted in the Andrews Lane parking lot stating that vehicles without permits are not allowed to park in the lot. Deputy Mayor Treacy stated that tow away signs will be erected. Trustee Hyland moved to accept the communications, seconded by Trustee Cicchetti and motion carried. Deputy Mayor Treacy stated that Trustee Fine has resigned from the Board to accept a position in Washington D.C. Deputy Clerk was in receipt of letters from Mrs. George Hongach of 25 Pine Close and Frank Key of 37 Holland Avenue requesting curb repairs; also a letter from Mr. Lewis Connolly of 43 Howard Street requesting sidewalk repairs.(Referred to General Foreman.) Mr. Steve Salman presented the Board with a petition requesting that the recent increase for parking at the Philipse Manor station be rescinded. Jane Harris of Hudson Terrace presented a petition from residents of Hudson Terrace asking for the continuation of being allowed to park facing west (downwards to Broadway). This privilege has been granted for the past 25 years for safety purposes and is now being taken away. Deputy Mayor Treacy stated that they will be trying with the help of the Police committee, to get around this State ordinance. Public Comments Mr. Salman commented on the permit parking fee increase at Philipse Manor stating that he felt 750% was excessive,and felt that it did not cost the Village that much to maintain this area and felt that the extra money would go into the General Fund. He asked if the Village has the authority to impose a parking fee on the street. In answer to this, Ugo Checchi stated that it has been reaffirmed by the State Senate and Assembly as stated in the newspaper last week; that a law was passed giving Villages the right to charge fees for parking on the street. Deputy Mayor Treacy stated that the fee increase has been rescinded and will not take effect until February 1990. Ugo Checchi, Chairman of the Parking Authority spoke in favor of the increase at the station. He commented that there is no town or village where anyone pays this ridiculous fee of $1. a month; also the monies collected is used to maintain all the lots in the Village and not just that particular one and that the Parking Authority is looking into improving that area. The Authority is also looking into creating another parking lot in the Village with approximately 4 0 spaces. 3 �i Mario Belanich asked about the status of the traffic going through the school parking lot by Hudson Terrace. Deputy Mayor stated that a chain will be installed with a sign "No Parking After Dusk". Mr. Belanich also asked about a tree in his yard that he wished to donate to the Village. Deputy Mayor suggested that he contact the General Foreman when he returns from vacation. Dr. Sweet commented that on July 24 & 25 a replica of Henry Hudson's ship the Half Moon will be coming down the Hudson River to the Tarrytowns. This will be part of the New Netherlands Festival which will be kicked off on July 10 and they are hoping that this will help the Old Dutch Church in their fund raising efforts for the restoration of the church. They are looking for donations for this restoration and anyone interested, please contact the church. There being no further comments, Trustee Hyland moved to closed the public comments section, seconded by Trustee Alter and motion carried. Trustee's Reports Deputy Mayor Treacy reported that the tax bills went out late due to a problem at the computer company who produces the bills. There will be a Zoning Board meeting on June 21 at 8PM. On the agenda is an appeal by Mrs. Shibetti for a variance on 20 Dell Street and an appeal by Mr. Jeffers for a building permit to relocate two gas pumps and to build a one story addition and install a restaurant in the existing building at the location of the Old Sleepy Hollow garage. Summer jobs are still available in the Public Works Department. The Duracell cleanup should be completed by April 1990. Deputy Mayor Treacy appointed George O'Hanlon of Lakeshore Close to fill the vacancy on the Environmental Council. Deputy Mayor Treacy read a proclamation proclaiming the week of June 4, 1989 through June 10, 1989 as National Safe Boating Week. Deputy Mayor Treacy read memo from Village Prosecutor, Robert Peirce regarding successful prosecutions concerning various heat and hot water complaints. On June 17 the Philipse Manor Train station will be undergoing a cleanup. New lines will be painted and three more parking spaces will be created. There are two members on the Architectual Review Board now; Frank Arvan and Robert Barstow who are both architects.
