Present: Mayor Gandolfo Trustee Apollonio Trustee Alter Trustee Cicchetti Trustee Treacy Trustee Hyland Absent: Trustee Coon Also Present: William T. Regan, Village Administrator John J. Hughes, Jr. Village Attorney Mayor Gandolfo called the meeting to order with a pledge to the flag. Before the regular.order of business, the Mayor stated that a representative from Finnegan Associates would answer any questions that the audience might have with regard to the reassessment. Ms. Tasadfoy explained the data mailers that residents have received and also reminded them that this reassessment is for Village taxes only. All commercial properties and four families or more should have received an income and expense statement. Anyone who has not received their data mailers, please contact Village Hall. Several residents, Mr. Belanich, Mr. John Morabito, Mr. Galella, and Dr. Sweet asked a few questions with regard to the reassessment. They wanted to know what would happen with regard to illegal apartments that were found. The Mayor stated that Finnegan Associates would have nothing to do with this part; the Board is studying this matter now and will have to come up with a decision at a later date. Trustee Treacy asked Linda to explain what happens to someone who has a four family house and is renting to family members at below the market rental as far as the assessment. Linda explained that they will take all the income of four family apartments or more and do an analysis on them and come up with a standard rent for one, two or three bedroom apartments and then they will adjust them according to location and condition of the property. Linda stated that evaluation will be done between July and August, field review is scheduled for August and September, full disclosure notices will be mailed out late October or early November and following that informal hearings will be held, physical review as a result of the hearings will then take place and tentative assessment roll is filed on February 1, 1990 and the final role on April 1, 1990. 1 �Public Hearings Mayor Gandolfo read the public hearing notice which is a proposed amendment to the zoning code with regard types of changes on properties that need to go before the Planning Board for site plan approval. (Copy attached) John Hughes, Jr. Village Attorney, gave a brief explanation of the purpose of the hearing. He commented that this proposed legislation extends the reach of the Planning Board; that is commercial sites of 10,000 square feet or more to basically any change of use. The Mayor read the other two public hearing notices because these same types of issues are involved. (Copies attached) A few residents, Mr. Belanich, Mr. William Hennessey, Mr. Serina and Frank Rizzi made comments, such as the reason for this amendment, what happens if one owner sells his business to another person and if a Liquor store would fall into this category. Mayor Gandolfo stated that the Village is saturated with bars, delis and restaurants at this time and would like to see other types of businesses open here. There is a problem with garbage disposal with the existing businesses, and that existing businesses are not affected if the same kind of business is opened by the new owner; also anyone can go before the Zoning Board for a variance if they were to be denied. A Liquor store is selling packaged goods and does not fall into this category. There being no further comments, Trustee Hyland moved to close the Public Hearings, seconded by Trustee Alter and motion carried. Mayor Gandolfo read the Public notice regarding the noise ordinance. (Copy attached) Trustee Hyland stated that contracted construction should be prohibited on Sundays altogether. Several residents spoke in favor of amending the noise ordinance and felt that the fine should be increased. Mrs. Belanich asked about the noise of motorcycles. Trustee Treacy stated that there is a V&T ordinance on mufflers on motorcycles that they would check into. The Mayor stated that the $150. is just the minimum fine and can be increased. One of the owners of Greene County stated that the 8:00 AM restriction for deliveries would be a hardship for them. 2 �» Angelo Verdi asked if a loud radio being played in the middle of the afternoon would be considered a violation. The Mayor commented that all radios are prohibited on the street after 9:00 PM but a loud radio during the day would be considered a disturbance and can be reported. There being no further comments, Trustee Hyland moved to close the hearing, seconded by Trustee Alter and motion carried. Mayor Gandolfo read the public notices with regard to the amendments to the electrical and plumbing codes. (Copy attached) Ugo Checchi, Plumbing Inspector, stated that he felt that the increase in the insurance to $500,000. was too high in light of the fact that plumbers have to put up a $10,000 bond. The Mayor stated that the performance bond is not the same as the insurance and the Village Attorney will check into it. He also did not feel that the workman's compensation insurance was fair. The Mayor stated that this was needed only if an electrician or plumber had men working for him. The Village Administrator stated that the Building Inspector is concerned that the Village should have added protection as well as the homeowner. If you are self-employed, you must present an affidavit to the Building Inspector and that requirement will be waived. There being no further comments, Trustee Hyland moved to close the public hearing, seconded by Trustee Apollonio and motion carried. Approval of Minutes Trustee Hyland moved to approve the minutes of June 20, 1989 as written, seconded by Trustee Treacy and motion carried. Public Comments Mr. Galella asked what the delay was in the sale of 79 College Avenue. The Mayor stated that the Village is in contract right now and is waiting for approval from HUD. Mr. Kavicky thanked Trustee Hyland on behalf of several young people for having the Restoration gate open for them to go fishing. Mr. John Morabito asked when the residents will be notified that their house is non-conforming? The Mayor stated that he could apply for a variance now to go before the Zoning Board, show them that the property has been a three or four family house for many years which predates the code and show that there was a building permit at that time. 3 �i Mr. Frank Rizzi addressed the Board asking if the Code Enforcement Officers were aware of certain places in the Village where there are an illegal number of people living and that the conditions of many of these buildings are a disgrace. Mayor Gandolfo stated that the Code Enforcement Officers have been at these places and some of these owners are now in court; to date they have closed up several places and the Board feels that they are doing a great job. There being no further comments, the Mayor closed the public comment section. Communications, Petitions, & Requests Mayor Gandolfo gave report of Code Enforcement Officer; inspected 22 Barnhart Avenue, 74 Clinton Street, 270 N. Washington St. and will be inspecting 11 Barnhart next week. Mayor Gandolfo stated the Village received donations to the Street Festival from the following: $250. Local 664 UAW, $500. from Duracell, Weekend for Two 'from the Hilton Inn, $100. from Peoples Westchester Savings Bank. Metro-North was unable to make a contribution because it is a tax-supported public agency operating at a deficit. A letter was received from James Paolantonio of 4 3 Amos Street requesting repairs to the storm drain in front of his house (referred to Public Works Department). The Mayor was in receipt of a letter from a group called Habitat for Humanity of Westchester who is looking for land or vacated buildings to build affordable housing in North Tarrytown. The Mayor received Cablevision. quarterly newsletter from Continental A letter was received from Metro-North stating that additional commuter parking is possible at Philipse Manor. Mayor Gandolfo asked that the Board approve her appointment of Louis Falasca to the Architectural Review Board; Trustee Hyland so moved, seconded by Trustee Alter and motion carried. The new Board will meet on July 26 at Village Hall. There are five new parking spaces available for commuters on Riverside Drive. 4 �i Administrator's Report The Administrator met with representatives of the DOT regarding the new foot bridge at the Phil ipse Manor Station. Parking will be eliminated from July 26 through August 2 and the state is requesting that commuters be allowed to park on Kelburne and Palmer from Riverside to Munroe for that week. Actual construction will occur Saturday and Sunday, July 29 and 30 from 2:00 AM-5:00AM. Permit holders will be notified of this change. The sidewalk repair bid opening will be held on August 3; the street repaving program should begin in September, fire alarm box bid will be opened on July 28, 1989 at 10:00 AM. Trustee's Reports Trustee Apollonio read fire department report: Carmen Zarrilli has completed 50 years of service in Columbia Hose, Louis Rizzi will receive his five year exempt certificate. Trustee Apollonio made motion to approve these, seconded by Trustee Hyland and motion carried. Trustee Apollonio then read resolution #7/076A/89 appointing Carmen Guarnieri as part time Code Enforcement Officer; read resolution #7/085/89 awarding the contract for the purchase of fire pumper to Hahn Motors. (See Attached) Trustee Alter read Recreation Report listing activities for the summer, scheduled Mets trip on August 17, Army Football game trip on September 23 and concerts being held at Morse Park on July 11, 25 and August 8. Trustee Cicchetti reported that as far as finances, the Village has saved $16,000. in the remainder of the 1988-89 fiscal year and will save approximately $100,000. in the upcoming year by switching to MEBC0 Health plan. In a letter from Phil Speziale, MEBCO Administrator, he stated that they have been notified by Teamsters, CSEA,and Tri-County Federation of Police that they are recommending to all local units that they bargain for, that MEBCO become their health program and all grievances filed on this subject be dropped. The preliminary work on the 1990 census will begin in the Fall. It is important to get a full census count due to the fact that there are federal programs that do give grants for categories of population. Anyone interested in working on the census, may contact the Census Office at 4 Gannett Drive in White Plains. Trustee Treacy reported that since the BOOT program has been enacted, we have immobilized seven cars and collected a total of $5000. The Sign & Awning Program is continuing. Off Broadway Deli, Lemac Drug Store and Chams Bar all have new awnings. 5 �lit In a meeting with the County a few weeks ago, sidewalk program on Beekman Avenue was discussed. They reviewed different designs and materials to be used and a new light called the Bishops Crook was chosen. Volunteers are needed to help build a studio on the third floor for cable television. There is no longer any money left from the County Grant program for the seniors, but grants for the handicapped are still available as are low interest loans. Trustee Treacy stated that the contract with the Teamsters has been approved and read Resolution #7/086/89. (Attached) Trustee Hyland entered Police report into the record. Bernard Foley, a former police officer has transferred to Briarcliff. He was in receipt of a letter to Acting Chief Brophy from Bernadette Kingharo of the Juvenile Law Education Project thanking Sergeant Ferguson for the time he spent with the students at Morse School. (Letter in Sergeant Ferguson's file) The State has repaired the ripple in the road at the bottom of 448, lines have been painted throughout the Village. Trustee Hyland read Resolution #7/088/89 appointing Joseph DeFeo to the position of Assistant Road Foreman effective August 3, 1989. (Attached) Fesolutions-All resolutions are attached. Old Business Trustee Hyland moved to replace the jacket that was damaged by the police officer when he was acting in the line of duty on a particular call, seconded by Trustee Apollonio. After a brief discussion, Trustees Hyland and Apollonio voted YES and Trustees Treacy, Cicchetti and Alter voting NO. Motion failed. The next work session will be held on August 8, 1989 and the next regular board meeting will be held on August 15, 1989. Approval of Warrants Trustee Apollonio moved to approve the warrants with the addition of three more items and authorize the treasurer to pay the bills, seconded by Trustee Alter and motion carried. It is hereby determined that the purpose described in Subdivision 27 of Paragraph a of Section 11.00 of the Local Finance Law, and that the period of probable usefulness of such purpose is twenty years.
