Present: Mayor Gandolfo Trustee Coon Trustee Hyland Trustee Treacy Trustee Cicchetti Trustee Apollonio Also Present: Absent: William T. Regan, Village Administrator John J. Hughes, Jr. Village Attorney Trustee Alter Public Hearings Mayor Gandolfo called the meeting to order with a pledge to the flag. Mayor Gandolfo stated that a continuation of the Sign Ordinance public hearing would be held at tonight's meeting and anyone wishing to speak could do so. Gerry Bregman of Ross Hardware asked if the ordinance would allow his temporary "Sale" signs in the window of his store? He was told that as long as these signs did not stay up after the sale was over, there would be no problem and as long as they conformed to size. Dr. Sweet asked about the removal of holiday decorations including lighting to be removed 10 days after the holiday. This would be changed to thirty days after. The Mayor stated that there was some concern by those merchants who had recently purchased new signs or awnings and had received a building permit for them. Permanent variances may be granted as well as exemptions for up to seven years if they go before the Architectural Review Board. Any other violations of the ordinance must be corrected within eighteen months There being no further comments, Trustee Coon moved to close the public hearing, seconded by Trustee Treacy and motion carried. Approval of Minutes Trustee Hyland moved that the minutes of July 18, 1989 be approved, with one correction that Shams Bar should be Chams Bar; seconded by Trustee Apollonio and motion carried. Trustee Coon abstained because he was not present at that meeting. 1 �M Communications, Petitions 6 Requests The Mayor was in receipt of a letter from Mrs. Chulla of Spruce Street requesting that a tree in front of her property be trimmed, letter referred to General Foreman and Tree Commissioner. The Mayor was in receipt of a notice of small claim against the Village by one of our police officers. Mayor Gandolfo received a letter from Michael Gressel stating that he would like to donate wood sculptor worth $6000. to the Village upon his death. The Mayor stated that they would discuss this at a work session. Public Comments Jim Timmings of Rice Avenue spoke at great length about the reasons he felt the Board should not have passed the "No Parking" ordinance on Rice Avenue. He also asked why Ossining fire company is used as mutual aid instead of Tarrytown. The Mayor stated that this was done after much research because of the request of the Board of Fire wardens. Richard Gross, Fire Chief, who was present at the meeting explained to Mr. Timmings that this parking ban was needed due to the fact that fire trucks have a difficult time getting into this street and for the safety of the people living there. In fact, many residents of that street were in favor of this ban. There are also many other streets in the village that have the same problem and that issue will have to be addressed also. The Fire Chief explained that Tarrytown's fire engine does not fit into our fire house and Ossining's does, therefore, when we need a truck to stand by, we must use Ossining, otherwise Tarrytown is our first engine company and then Ossining. The Chief told Mr. Timmings that he would be very happy to schedule a demonstration with the aerial ladder for him. Richard Gross commented that a Sprinkler Committee has been formed which includes the following members including himself. They are Richard Nagle, Carmen Capossela, Anthony Apollonio, John DiCairano, Michael Whalen, William Herlihy, James Margotta, Fred Gross, Bob Stiloski and Carmen Guarneri. The Fire Chief also stated that they would like to adopt a sprinkler code which many villages have already adopted. Under this code, any new building construction,places of public assembly, rooming houses, night clubs, day care centers, etc. would need to install a sprinkler system. 2 �They would have 60 months to have it installed and within this tine, 36 months to submit the plans to the building department to install the sprinkler system. A sprinkler would be required if a one family house addition is greater than 50%. Trustee Apollonio moved to call for a public hearing to adopt a sprinkler code on September 19, 1989/ seconded by Trustee Kyland and motion carried. In conjunction with the sprinkler code, Chief Richard Gross commented that there will be a demonstration of the sprinkler van on September 2, 1989 between 10:00 AM and 2:00 PM, and requested that Beekman Avenue be closed from Washington Street to Pocantico Street for approximately half hour intervals between these hours. The Mayor and Board approved this request. There being no further public comments, the Mayor closed the public comment section. Mayor's Report Mayor Gandolfo presented Carmen Zarrilli with a certificate of merit for fifty years of service in Columbia Hose. The Mayor reported that the Zoning Board will meet on August 16 and the Planning Board on August 17. The Mayor thanked the following people for their generous donations to the Street Festival: Bill Herlihy, Lorainne Annicharico and from the Marriott, a free weekend. The Mayor announced the terms of those appointed recently to the Architectural Review Board; Robert Barstow and Frank Arvan, 3 years, Anagret Rice and Elena Malunis, two years and Louis Falasca, a one year term. Trustee Hyland moved to accept the Mayor's appointments, seconded by Trustee Coon and carried. The Mayor will meet with John Halpern on Friday to discuss his proposal for development in the village. The Mayor congratulated Amelia Babcock who was elected State Vice-President of the Ladies Auxiliary of the Ancient Order of Hibernians, and congratulated Mr. & Mrs. James Malzone who celebrated their 40th anniversary. Administrator's Report The Administrator reported that two bids were received for the street and sidewalk repairs and the contract will be awarded at tonight's meeting. The Water Department building roof is in need of repairs and the village will be seeking bids soon. An engineering firm will draw up specs for the heating system and the roof repairs as a combined job. 3 �The Elm street lot is being repaired because of damage due to soil erosion and the Duracell lot is being used in the meantime. The Phil ipse Manor station has nine new parking spaces and we are waiting for a response from Metro North on possible diagonal parking. Specs are being prepared for road repaying and will cost approximately $200,000. This figure is double of what was budgeted. We will be looking for assistance from Town Supervisor Mike Rovello for repaving Sleepy Hollow Road from Webber Avenue to the Mt. Pleasant line. General Motors has a storm drain line that comes in parallel to Metro North tracks and empties into a canal that runs along the south end of Devries field. This creates a stagnant pool of water. In conjunction with their new rail facility, GM is creating a different pipe line to this storm drain. The Administrator wrote a letter to Ray Windas requesting that GM continue that pipe line down the canal so that all of the water goes into the Pocantico River and to cover over the pipe line creating additional land for recreation. Trustee's Report Trustee Coon reported that the Recreation Department has tickets on sale for Army football game on September 23, 1989 at $20. per ticket, day camp and tot camp are over, a new kiddy gym has been installed at Margotta park, GM has donated T-shirts for the first 75 registrants in the 5-K run at the street festival. The reassessment is in its last stages; they have collected the last batch of inventory content sheets and have collected approximately 140 records of sales which will be used for their evaluation of the properties using comparable sales, and commercial properties have received income and expense sheets. Trustee Hyland submitted the police report into the record. The AAA club congratulated North Tarrytown on having no pedestrian fatalities for the last three years, the crime rate in North Tarrytown has dropped 12.3%. The drains on route 9 and Amos Street have been repaired and various trees throughout the village have been trimmed. Trustee Hyland thanked the Van Tassell management for cleaning up half of Teresa street and removing parked cars that have been there for about three years. There will be a recycling breakfast for elected officials on October 5, 1989. Trustee Treacy reported that four new signs or awnings have been erected at Hair Quest, Jiminez One Stop Grocery, Beekman Rooming House and White Front Meats; Sleepy Hollow Bicycle Shop has removed the aluminum siding to show the original brick facade. 4 �The funding for the facade improvement program is all spent and no more applications can be accepted. The Committee to Rebuild Beekman Avenue met on August 2 and they will present their suggestions to the Board sometime in September. Trustee Treacy reported that owners of bars and stores met with members of the police department showing them how to detect altered ID cards by the use of a special new flashlight and he thanked Gordon Ferguson and Jim Brophy for their quick response to his request to get the flashlights. With regard to the sign ordinance, Trustee Treacy read Resolution #8/094/89 which is attached. The Village Attorney stated that this would be made part of the zoning code and those applying for sign ordinance variance, would go before the Architectural Review Board and the word Board in the ordinance refers to them. Trustee Cicchetti reported under finance and administration that they have received the June and July budget analysis and now that we are on computers we will get these reports on a monthly basis. These reports are quite detailed and valuable. Trustee Apollonio reported that the Code Enforcement program is progressing very well. The owner of 138 Cortlandt Street is now in court for violations, and the inspectors have made 10 inspections and four reinspections since his last report. Mayor Gandolfo was in receipt of a letter from the Town of Mt. Pleasant requesting the use of our premises for primary election on September 12, 1989. Trustee Coon moved to grant this request, seconded by Trustee Apollonio and motion carried. Trustee Hyland asked to go on record opposing the Town's suggestion of moving the second polling place to the ninth district. Resolutions- All Resolutions are attached. Old Business- None New Business- The next work session will be held on August 29, 1989 and the next regular meetings will be held on September 5 an September 19. Approval of Warrants Trustee Coon moved to approve the warrants and authorize the treasurer to pay the bills, seconded by Trustee Apollonio and motion carried. 5 �Executive Session Trustee Apollonio moved to adjourn to executive session, seconded by Trustee Coon and motion carried. During executive session a brief discussion ensued on the small claim brought against the Village by a police officer who^ did not join our health insurance plan and therefore, was entitled to receive payment of one half of the total premium. The officer was given only one half of the total payment now and would receive the balance at the end of the year. She feels that she should have received payment in one lump sum. The Board felt it was not in their best interest to do it this way, in case an employee left the Village before the year was over. Brief discussion ensued on the status of the parking left side to curb on Hudson Terrace. The Board would check with the state on this especially for the winter months. Brief discussion ensued on the abused sick leave of a few officers. They will be required to see Dr. Panitz if they called in sick. The Board commented on the recent car accidents of Officer Otero. He was asked to be extra careful while driving. Brief discussion ensued on the Vallejo and Biros suit. Brief discussion ensued on personnel matters concerning a police officer and a department head.
