Present: Mayor Gandolfo Trustee Coon Trustee Treacy Trustee Hyland Trustee Cicchetti Trustee Alter Trustee Apollonio Also Present: William T. Regan, Village Administrator John J. Hughes, Jr. Village Attorney Mayor Gandolfo called the meeting to order with a pledge to the flag. Before starting the regular order of business, the Mayor stated that there were a few awards to be presented. Mr. Warren Lesser, Vice-President of Halpern Associates presented Fire Chief, Richard Gross, with complimentary pagers for the fire department. Chief Gross accepted the pagers and thanked Mr. Lesser. Mr. Caola, high school teacher, and two of his students, Mark Ruddy and Blake Smith, who represented the United States recently as exchange students in West Germany presented Mayor Gandolfo with a plate with a picture of their city hall and a framed picture. Mayor Gandolfo thanked the students and commented that she was proud to have had these students represent us in West Germany. Mayor Gandolfo presented certificates of appreciation to the members of the Festival Committee who worked so hard to make the festival a huge success. Public Hearings Lucille Sachi and her associates from the County Department of Planning gave a presentation on the proposed revitalization of Beekman Avenue. She stated that this is part of a grant from Westchester County Department of Planning; $300,000. from them and a matching grant of $300,000. from the Village, totalling $600,000. They worked with the Design Committee from the village and they came up with a good proposal. She showed drawings and a small scale model of what is proposed for the Avenue. One resident asked if Cortlandt Street is going to be included? Ms. Sachi stated that it is not in this grant, but in three years they will ask for another one. 1 �Another resident asked if the wooden benches that will be placed along the Avenue are better than the ones that are there now. She commented that the wooden ones will last much longer than the original slats on the benches now which have to be replaced periodically. here being no further comments from the public, the Mayor closed le public hearing. ie Mayor then opened the Sprinkler Code public hearing which was continuation from last meeting. r. Sweet and Mr. Caetano both spoke in favor of the proposed ordinance because it will save lives but still felt the cost factor is the biggest drawback. They felt that the companies who would be installing these sprinkler systems would take advantage of the homeowners as far as the cost. Robert Stiloski, Greenburgh Fire Marshal, and Richard Gross, Fire Chief, both emphasized the importance of the installation of sprinkler systems; smoke alarms do not save lives, sprinklers only go on when there is a real fire, therefore, there are no false alarms and if you have a bonafide sprinkler company to give you an estimate, your local plumber can do the installation and the cost will not be as great as originally anticipated. The Mayor stated at this time, only the ordinance for new construction will be voted on. Trustee Apollonio moved to close the public hearing and to reopen it at a later date to discuss retrofittings, seconded by Trustee Coon and motion carried. Approval of Minutes Trustee Hyland moved to approve the minutes of September 19,1989 as written, seconded by Trustee Coon and motion carried. Communications, Petitions and Requests Mayor Gandolfo was in receipt of a letter from Linda Vilches of 95 Bee km an Avenue commending the North Tarry town Ambulance Corps for their quick response to emergency transportation to the hospital when it was gravely needed. Thanks to their outstanding ability, she is alive today. The Mayor was in receipt of a letter from Tarrytowner's & Proud of It thanking us for our contribution to the July 4th fireworks display. A letter to Janine Nicol from Sylvia Freyler and Dolores Foley thanking her for an outstanding job in making the street festival a huge success was read by the Mayor. 2 �I#> A copy of a letter from Thomas Finn, written to the Daily News, was read stating the objections of many residents to the state's proposal to the Route 9 widening. A copy of a letter from Frank Arvan, President of PMIA, written to the NYS DOT, was read expressing their objections to the proposed widening of Route 9. The Mayor was in receipt of a letter from the Public Schools of the Tarrytowns thanking the Board for obtaining a carnival booth at the street festival. The Deputy Clerk was in receipt of a letter from Kitty Fries, Town Clerk, requesting the use of our premises on October 7 and October 12, 1989 for registration days. Trustee Hyland moved to grant this request, seconded by Trustee Coon and motion carried. The Deputy Clerk was in receipt of a letter from Mr. Galante, requesting permission to hold annual Veteran's Day services in Patriot's Park on November 11, 1989. Trustee Coon moved to approve this request, seconded by Trustee Treacy and motion carried. Mayor's Report Mayor Gandolfo gave a brief background on the management of 100 College Avenue. The Village is the supervising agency for this federally subsidized building, and they have been receiving complaints regarding the management of the building. The Village has made numerous attempts to correct these problems of mismanagement, but have been unsuccessful. We do have options under state law with regard to our authority as supervising agency. Therefore, the Board will be adopting a resolution tonight and a letter from the treasurer to the North Tarrytown Realty Associates will be sent advising of this. The Village Attorney gave a brief report on the background of the origination of College Arms: It was built in 1970 under the plan of urban renewal and the purpose at that time was to eliminate some of the deteriorating housing in that area and replace it with good housing. At that time there were agreements between the North Tarrytown Realty Associates and the Village; one of which was to insure proper tenant admissions. HUD became the supervisory control over this building, who would on a periodic basis oversee and audit the management and operation of the building as well as the capital repairs and ongoing improvements. The Village Treasurer has statutory powers and the Village would like to exercise these powers to investigate the allegations and correct them. A few residents from College Arms and others addressed the Board and thanked them for taking this action and Dr. Sweet stated that it had been brought to the attention of prior boards and nothing had been done. 3 �BE IT RESOLVED: That, the Treasurer of the Village of North Tarrytown, as Chief Finance Officer, be authorized to take the necessary steps to exercise the authority vested in his office as Supervising Agency, pursuant to Article V of the Private Housing Finance Law. Trustee Treacy so moved, seconded by Trustee Alter and motion carried unanimously. Dr. Richard Sweet believed that there were certain inequities for revenues applied against the tax levy for the Village of North Tarrytown within the school district of the Tarrytowns and in further support of his argument, the board would like to pass the following resolution: Be It Resolved: The Board of Trustees supports the effort to include the General Motor's P.I.L.O.T. as revenue to be applied against the tax levy within its defined area of North Tarrytown, and Be it Further Resolved, the Village Attorney is authorized to seek an opinion from the NYS Comptroller on this matter. Trustee Cicchetti so moved, seconded by Trustee Alter. After a brief discussion, the resolution was tabled for a couple of months. There will be a Zoning Board meeting on October 18 and a Planning Board meeting on October 19, 1989. Public Comments Mr. Galella asked why road repaving had stopped on Depeyster Street. The Mayor stated that they are waiting until Rodrigues finishes his project on that street. He also asked what the status of 79 College Avenue. We are waiting for HUD. A few residents asked about the painting of yellow lines. The Mayor stated that there seems to be a difference of opinion as to whether or not these lines are needed. The General Foreman feels that the signs are the important designation, not the lines. The Mayor stated that they would look into this matter further. A few residents addressed the Board with respect to the fact that we need more policemen patrolling the streets because there are public nuisances that are happening and shouldn't be. Administrator's Report The Administrator reported that at a recent AAA luncheon, the Village received an award for no pedestrian fatalities in three years. The Administrator has received a letter from NYS DOT soliciting comments about their plans to improve Interstate 287 and he will present this to Administrator in Tarrytown ask them what their concerns are with regard to the states plans. 4 �I \Y?Bids were opened on September 29, 1989 for a new garbage truck. The lowest of two bids received was Gabrelli Mack Sales & Service, Inc. for $112,186.00. The sidewalk program has begun and residents have been notified. With regard to complaints about an odor in the Village, the Administrator stated that the DEC will be investigating it further tomorrow but he commented that they were told that when female trees drop their flowers, it causes this odor. Trustee'a Reports Trustee Apollonio reported that the Code Enforcement Officers have done twenty inspections and five re-inspections and eight cases are pending in court. Fire Prevention Week starts October 9, 1989. Trustee Apollonio read memo from Fire Council regarding action taken at their regular monthly meeting held on September 18, 1989- Trustee Hyland moved to approve this action, seconded by Trustee Apollonio and motion carried. Trustee Apollonio read resolution # 10/11/89 regarding sprinkler systems required, (copy attached) Trustee Alter reported that flu shots will be given to senior citizens at the Neighborhood House on October 13 and November 3 from 10 AM to 12 Noon. There will be a $5. charge for local residents and $7. for non-residents. Trustee Cicchetti reported that he attended a meeting of the Conservation Advisory Council on September 29, 1989 with regard to the Local Waterfront Revitalization Program. The Department of State is charged with assisting a municipality to prepare LWRP program to assure that it is not contrary to existing State and federal policy. In addition, financial assistance is being provided under a federal grant to the State's Coastal Management Program for small-scale construction and land acquisition projects and for the research, design and other preconstrution activities. The LWRP has a long range policy action plan to increase the authority of the municipalities. Dr. Sweet commented that he attended a workshop in Fishkill and we need to get the public more involved. Trustee Treacy reported that the Police Labor Management Committee met twice and many issues were cleared up. They will meet again on October 26, 1989 at 4 PM. Trustee Treacy commented that the rebuilding of the sidewalk, curbs and street lights on Beekman Avenue is major step towards the enhancement of our Village. Trustee Treacy read resolution #10/119/89 regarding cable negotiating committee which is attached. 5 �i Trustee Hyland submitted the Police Report into the record. He reported that Gordon Ferguson has successfully completed the 14th Annual Police Juvenile Officers Training Conference course and was presented with a certificate. Elm Street lot is now open, work has started on sidewalk repairs, and there will be an EXPO on recycling at the County Center on October 4 from Noon to 7 PM and October 5 from 9AM-4PM. Trustee Coon reported that Finnegan Associ< ns has now established what they have determined to be a reasoi Die reliafc]^ model using comparable sales for residential purposes. They have also completed commercial evaluations. Field evaluations should be completed by next week. He then read resolution #10/114/89 which is attached. Resolutions- All resolutions are attached. Old Business- None New Business The next work session will be held on October 10 and the next board meeting will be held on October 17, 1989. No building permit shall be issued for the construction of any building, structure or portion thereof unless compliance is met, as defined in Subsection A above. C. No certificate of occupancy shall be issued for occupancy or usd of any building, structure or portion thereof required to have a sprinkler system, as defindd by Subsection A above, unless such system is installed, inspected, tested and approved. D. Exeption. Sprinklers shall not be required to be installed in spaces where the discharge of water would be hazardous. In such places, other approved fire-extinguishing equipment shall be provided, as approved by the Bureau of Fire Prevention. E. Alterations, additions, or repairs of any building as defined herein equal to or exceeding fifty (50) percent of the usable floor area of that building, shall be required to comply with Subsection A above. F. In order to be in compliance with Subsection A above, a Bureau of Fire Prevention shall be established consisting of the three chiefs, the building inspector, the plumbing inspector, and the code enforcement officer. G. Two copies of all plans shall be submitted with calculations where needed and said plans shall be stamped by a licensed New York State Professional Engineer or a licensed Fire Protection Engineer.
