Regan, Village Administrator John J. Hughes, Jr. Village Attorney Mayor Gandolfo called the meeting to order with a pledge to the flag. Mayor Gandolfo commented that this would be a short business meeting and then a small Christmas party would follow to celebrate the anniversary of the Village. Public Bearings The Mayor read the first public hearing with regard to no parking in a certain area on Tappan Avenue at the request of Mr. Simcoe who has a handicapped child who needs an area for bus pick up. (Notice attached) One resident inquired as to whether this would be an all day ordinance? The Mayor stated that this would only be for a half hour in the morning and an hour in the afternoon, Monday through Friday. Mr. Simcoe asked that this ordinance take place all year round due to the fact that his child attends school even in the summer. There being no further comments, Trustee Alter moved to close the public hearing, seconded by Trustee Coon and motion carried. John Hughes, Village Attorney read the following resolution: Resolved: The Board of Trustees does hereby amend Chapter 57-6 of the General Code of the Village of North Tarrytown entitled "Parking Prohibited" to add: 17.On the Northerly side of Tappan Avenue, running a distance of twenty-five (25) feet easterly from the intersection of Tappan Avenue and Anderson Avenue between the hours of 8s30 AM and 9:00 AM and 2:30 PM and 3:30 PM Monday through Friday. Moved:Trustee Cicchetti Seconded:Trustee Alter Vote:6-0 Mayor Gandolfo read the next public hearing notice regarding tax exemption for veterans (copy attached) . 1 �I The Mayor commented that the Board wants to repeal the ordinance that was adopted in 1984 so that veterans of the Korean and Viet Nam war can receive this exemption. The Administrator stated that veterans should apply for both and they will receive the higher one. Mr. Richard Green thanked the Board for bringing this exemption back. There being no further comments,Trustee Hyland moved to close the public hearing, seconded by Trustee Coon and motion carried. The Village Attorney read the following resolution: Be it resolved, the Board of Trustees of the Village of North Tarry town repeals Chapter 50-A of the General Code entitled "Tax Exemption for Veterans" (effective 10-1-89) . Moved:Trustee Hvland Seconded:Trustee Apollonio Votesfcfi Mayor Gandolfo read the next public hearing notice with regard to the Homestead Law (copy attached). The Village Attorney stated that this local law has to do with the apportionment of the tax burden between commercial and residential properties. It insures that the residential property owners will not incur an increase in their tax levy by virtue of the reassessment. Dr. Sweet addressed the Board asking them not to accept the reassessment for the upcoming tax year. He felt it was done too fast. The Mayor stated that the reassessment has been done over the past two years and out of almost 2000 parcels, approximately 150 parcels came to grieve which is a very small percentage. There being no further comments, Trustee Coon moved to close the public hearing, seconded by Trustee Apollonio and motion carried. Village Attorney read the following resolution: Resolved: That the Board of Trustees adopts The Homestead Base Proportions pursuant to Real Property Tax Law, Section 1903. Moved:Trustee Coon Seconded:Trustee Cicchetti Vote: 6-0 Approval of Minutes Trustee Hyland moved to approve the minutes of December 5, 1989 as written, seconded by Trustee Apollonio and motion carried with Trustee Coon abstaining because he was absent. Mayor's Report The Mayor urged everyone to take advantage of any tax exemption that they might be entitled to, such as fireman's, veteran's and senior citizen's. The Planning and Zoning Board meetings will resume in January. 2 �<&(£ Trustee Cicchetti reported that we are in the process of trying to substantiate our figures as coapared to the census bureau figures by looking at tax naps, assessment roll, building inspector's verification and the post office sailings .The County announced that there is a difference of 19,000 units between what the census bureau shows and the County figures. It is very important to verify the figures so that we can obtain state aid. The Village Administrator reported that the garbage schedule for the next two weeks will be as follows: Monday's garbage will be picked up on Tuesday, Tuesday's garbage on Wednesday and the recycling day will be eliminated both weeks. Resolutions- all resolutions are attached. Mew Business- The next board meetings will be held on January 2 and January 16, 1990; the work sessions will be held on January 9 and January 23, 1990. Trustee Treacy moved to call for a public hearing on January 16, 1990 to erect a stop sign at the intersection of County House Road and Bedford Road westbound, seconded by Trustee Coon and notion carried. The Village Attorney stated that he would check to see if we could call for this hearing since this was a state road. Trustee Coon moved to call for a public hearing on January 16, 1990 to prohibit gas station canopies, seconded by Trustee Alter and motion carried. Approval of Warrants Trustee Coon moved to approve the warrants and authorize the Treasurer to pay the bills, seconded by Trustee Apollonio and motion carried. The total of the General fund is $60,042.25 and the Water Department fund is $6,908.65. There being no further business, the Mayor adjourned the meeting. After the party, the Board would adjourn to executive session. Executive Session Discussion ensued on personnel and litigation matters. SERIAL BONDS OR CAPITAL NOTES OF THE VILLAGE OF NORTH TARRYTOWN PURSUANT TO THE LOCAL FINANCE LAW, TO FINANCE THE ACQUISITION OF EQUIPMENT FOR USE BY THE VILLAGE AND APPROPRIATING THE PROCEEDS TO SUCH PURPOSES. * * * * * * * * * * * * BE IT RESOLVED by the Board of Trustees of the Village of North Tarrytown, in the County of Westchester, New York, (the "Village") as follows? Section 1. The Village shall issue its Serial Bonds or Capital Notes of the aggregate principal amount of $15,000. pursuant to the Local Finance Law of New York, to finance the objects or purposes hereinafter described. Section 2. The objects or purposes (hereinafter referred to as "purposes") to be financed by the issuance of such Serial Bonds are (a) the acquisition of various pieces of equipment, machinery, apparatus and furnishings for municipal improvements at an estimated maximum cost of $15,000. Costs incidental to such purposes shall also be included as costs to be financed. The proceeds of such obligations are hereby appropriated to such purposes. Section 3. It is hereby determined and stated that the aggregate maximum estimated cost of such purposes as determined by the Village is $15,000. and that no money has heretofore been authorized to be applied to the payment of the cost of such purposes. The Village plans to finance such costs entirely from funds raised by the issuance of the obligations authorized by this bond resolution. Section 4. It is hereby determined that the purposes are described in Subdivisions 77 and 32 of Paragraph (a) of Section 11.00 of the Local Finance Laws and that the period of the probable usefulness of such purpose is 5 years. �Section 5. Subject to the tint and conditions of resolution and of ths Local Finance law, end pursuant to the provisions of Sections 30.00, 50.00 end 56.00 to 60.00, inclusive, of the Local Finance Lav, the power to authorise Bond Anticipation Notes in anticipation of the issuance of the Serial Bonds authorised by this resolution and the renewal of such notes, and the power to prescribe the terns, form and contents of said Serial Bonds (or Capital Kotes) and Bond Anticipation Notes, and the power to sell and deliver said Serial Bonds (or Capital Notes) and any Bond Anticipation Notes Issued in anticipation of the issuance of such bonds is hereby delegated to the Village Treasurer, the Chief Fiscal Officer of the Village. The Village Treasurer is hereby authorised to sign any Serial Bonds (or Capital Notes) issued pursuant to this resolution and any Bond Anticipation Notes Issued in anticipation of the issuance of such Serial Bonds, and the Village Clerk is hereby authorised to impress the corporate seal of the Village to any of said Serial Bonds, Capital Notes or on any Bond Anticipation Notes and to attest seal. In the alternative, the Serial Bonds may be signed with the facsimile signatures of the appropriate Village officials and the Serial Bonds may be authenticated by a fiscal agent. The Chief Fiscal Officer of the Village is also hereby authorised to issue a 'statutory installment bond* in lieu of Serial Bonds subject to the terms of this resolution applicable to Serial Bonds. Section 6. When this resolution shall have taken effect in the manner provided by law, this resolution shall be published in full by the Village Clerk of the Village together with a notice in substantially the form prescribed by Section 81.00 of said Local Finance Law and 6uch publication shall be in 'The Daily News*. The validity of said Serial Bonds or of any Bond Anticipation Notes issued in anticipation of the sale of said Serial Bonds may be contested only if such obligations are authorized for objects or purposes for which the Village is not authorized to expend money, or the provisions of law which should be complied with at the date of the publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity, is commenced within twenty days after the date of such publication; of if said obligations are authorized in violation of the provisions of the Constitution of New York. Section 7. This resolution shall take effect at the time and in the manner provided by the Village Law of New York.
