Present: Mayor Gandolfo Trustee Hyland Trustee Treacy Trustee Cicchetti Trustee Apollonio Also Present: William T. Regan, Village Administrator James Brophy, Acting Police Chief John J. Hughes, Village Attorney Dominick Bueti The following resolution was read: Resolution #: 12/143/89 Be it Resolved: The Board of Trustees approves the probationary appointment of Dominick Bueti, 188 Webber Avenue, North Tarrytown, New York 10591 as Police Officer from Eligible List No. 69-687 at an annual salary of $20,000. Said appointment to be effective December 30, 1989 and be probationary for a period of fifty-two weeks subject to approval of the Westchester County Civil Service Commission. Moved:Trustee Hyland SecondedsTrustee Cicchetti Vote:4-0 Trustee Hyland indicated that the Police Commission interviewed Mr. Bueti for the position of Police Officer and the commission unanimously approved and recommended his appointment. Mayor Gandolfo noted that the Acting Police Chief, James Brophy, indicated verbally that Mr. Bueti has passed the physcological and physical examination. Present: Mayor Gandolfo Trustee Treacy Trustee Hyland Trustee Coon Trustee Cicchetti Trustee Alter Trustee Apollonio Absent: John J. Hughes, Village Attorney Also Present: William T. Regan, Village Administrator Mayor Gandolfo called the meeting to order with a pledge to the flag. Approval of Minutes Trustee Coon moved to approve the minutes of December 19, 1989 as written, seconded by Trustee Cicchetti and motion carried. Communications,Petitions and Requests The Deputy Clerk was in receipt of a letter from the attorney for the Embassy Bar, Inc. notifying the village of their intent to renew their liquor license. Mayor Gandolfo was in receipt of a letter from Emilie Spaulding thanking the Village for the walkway along Riverside Drive. The Mayor read a letter from Hitachi asking the Village to participate in a clothing drive for the needy in our community, which they are sponsoring together with The Open Door and the Tarrytown Schools. The Mayor stated that we would place a box in the lobby of the Municipal building for such clothing. The Mayor was in receipt of a letter from Metro North asking us if we would like to make any changes in the train schedule. She would refer to our previous letters on the same subject. The Mayor was in receipt of a letter from the American Red Cross asking the Village to fly the Red Cross flag during the month of March, which is traditionally Red Cross month. The tentative date for the flag raising will be on March 12, 1990. The City of Peekskill has requested that all Villages, in an effort to combat drugs, pass a resolution amending Section 220.44 of the New York State Penal Law to expand the stiffer penalty conditions of the current law to any person who is convicted of mere possession or sale of drugs in these areas. This would be referred to the Police Committee. 1 �j\r The Mayor received a synopsis of the lavs which were passed in 1989 from Assemblyman Peter Sullivan which she asked the Board to review in case the Board may want to act upon some of these laws. Mayor's Report There will be a Zoning Board meeting on January 17 and a Planning Board meeting on January 18th. Mayor Gandoifo commented that we have contacted the State Department of Transportation with a request for improvements along Bedford Road. The Mayor stated that they are working on the legislative package from Senator Spano and Assemblyman Sullivan office for grant requests. Lawrence Ecker, Acting Village Justice has submitted his resignation effective December 31, 1989. Trustee Hyland moved to accept his resignation with regrets, seconded by Trustee Treacy and motion carried. Administrator's Report The Administrator reported that the vehicle mats have been delivered to the fire departments, the radio pagers should be in within the next two weeks. With regard to the Beekman Avenue Revitalization Program, the Administrator stated that Lucille Sachi is ready to meet with us and that Trustee Treacy will be meeting with her this week. The Administrator stated that we have received many aged and veteran's exemption applications. Trustee's Reports Trustee Apollonio read the Fire Council report which is attached. He reported that many repairs have been made to the Ambulance building and firehouses, but there are still many repairs left to be done. The Code Enforcement program still has eight cases pending in court. Trustee Alter reported that second interviews with the two finalists for the Superintendent of Recreation position will be held on Wednesday night. �Trustee Cicchetti reported that the final steps in the pre-census review have been completed and sent to the Regional office. With the help of Jim Margotta and Janine Nicol, we have identified 218 units more than the census bureau had. The census mailings will be made around April 1. Sometime after the census is taken, the Village will have an opportunity to have a post census review. Trustee Treacy reported that the North Tarrytown Fire Department is eligible for a new grant from the State Public Employee Occupational Safety & Health Hazard Abatement Board. These funds are made available through a special fund to insure the safety and protection of our municipal employees and volunteers. The State will pay for 75% of the anticipated cost and the Village pays the other 25%. Trustee Treacy reported that the latest state mandated costs which puts a burden on the municipalities is the increase in the unemployment and disability benefits. Over the next three years, the unemployment benefit will increase to $300. per week. Trustee Treacy will be meeting with Lucille Sachi on Friday to set up a timetable to go out to bid on the sidewalk, hopefully by February and start the project by the Spring. Trustee Hyland reported that at a special meeting held on December 29, 1989, the Board of Trustees appointed a new police officer, Dominick Bueti of 188 Webber Avenue, North Tarrytown, New York, effective December 30, 1989. The newspaper was notified in advance of this meeting. Trustee Hyland reported that the Police Committee has reviewed the complaint of Judge Crosby against Police Officer Hrotko and would recommend that no action be taken against the police officer in light of the fact that the Appellate Supreme Court has overruled Judge Crosby's decision against the officer. Before taking a vote on this, the Board will discuss it further in executive session. Trustee Hyland stated the Christmas trees will be picked up on a daily basis when left at the curb, and on January 12 the chips from the trees will be available to residents at the Devries field on a first come basis. All the abandoned cars have been removed from the College Arms parking lot. Trustee Coon had no report. 3 �?tl Resolutions- Attached New Business The date of the next meeting is January 16th, the next work sessions will be held on January 9,23, and 30. Approval of Warrants Trustee Treacy moved to approve the warrant and authorize the treasurer to pay the bills, seconded by Trustee Alter and motion carried. Total of general fund is $66,595.58. Public Comments Dr. Sweet addressed the Board about his concern regarding all the large tractor trailers from General Motors that are going up and down the avenue and damaging the road. Perhaps they should be charged for the damage which is done and charged everytime that the trucks use the road.The Mayor commented that this was an excellent idea and that the Board will be hiring an engineer to look at these roads to see if they can handle these large trucks. The Board will ask General Motors to pick up the cost of the engineer. The Board will be meeting with the new plant manager on Thursday to discuss our proposal. There being no further comments, the Mayor asked that a motion be made to adjourn to executive session to discuss personnel matters. Trustee Hyland moved to adjourn to executive session, seconded by Trustee Apollonio and motion carried. Executive Session Discusssion ensued on personnel matters. The matter of William Crosbie against Officer Hrotko was forwarded to John Hughes, Jr., Village Attorney for a response.
