                  <text>A regular meeting of the Board of Trustees was held on June 5,
1990 at 8:00 PM.

Mayor Gandolfo called the meeting to order with a pledge to the
flag.
Public Hearing
Mayor Gandolfo read the public notice with regard to amendment to
Chapter 62 "Zoning" which was a continuation from the previous
meeting. The Administrator spoke on the recreation fees; he is
reviewing a list of recreation fees submitted to us from other
towns.
There were no comments from the public, therefore,
Trustee Marren moved to close the public hearing, second by
Trustee Alter and motion carried.
Mayor Gandolfo read the public notice regarding the amendments to
Zoning Code, Chapter 62-3OF which was a continuation from the
previous meeting.
There was no discussion, therefore, Trustee
Marren moved to close the hearing, second by Trustee Treacy and
motion carried. Both proposed amendments will be discussed
further at the work session.
Approval of Minutes
Trustee Hyland moved to approve the minutes of May 15, 1990,
second by Trustee Cicchetti and motion carried with two minor
corrections; on page 6, DAD'S conference should be DARE and the
word proposed should be added to concept plan. Trustee Rey asked
that a memo be placed in Richie Chulla's file with regard to his
quick response to the emergency gas problem on Depeyster Street.
Trustee Cicchetti moved to approve the minutes of May 25, 1990 as
written, second by Trustee Alter and motion carried 5-0 with
Trustee Marren abstaining.
Communications, Petitions &amp; Requests
Deputy Clerk was in receipt of two letters of intent to renew
liquor licenses; one from Kail Development Inc. and one from
Melisa Superette. These will be referred to Police Committee and
Fire Committee.

�Mayor Gandolfo received a letter from Carmelo Camillieri stating
that he is unable to serve on the Operation Clean-Up Task Force
at this time.
The Mayor was in receipt of a letter from David Gross regarding a
problem with his water bill and she will check with the Water
Department about this.
A letter was received from Mrs. Kantowitz with some helpful hints
regarding litter, noise, etc. These will be referred to the Task
Force, of which she is a member.
A letter from Edna Belanich regarding a misunderstanding
concerning a decibel meter was received and the Mayor will check
into it.
A letter from the Sleepy Hollow Family Festival inviting us to
join them on June 10, 1990 from 11:00AM-5:00PM.
A letter from NYCOM was received stating that the state is
proposing a sales tax on parking permits issued in the Village.
Mayor Gandolfo presented a proclamation to Patrick Haggerty who
became an Eagle Scout on May 26, 1990 designating May 26, 1990
Patrick Haggerty Day.
Mayor Gandolfo stated that disability retirement has been
approved for Police Chief Richard Spota effective June 15, 1990
and she wished to present him with plaque extending the Board's
sincere appreciation for his twenty-nine years of dedicated
service to the Village. Chief Spota was watching from home.
Public Comments
Kay Lingardo of Pine Close asked who the owner of record is at
Tappan Motors with regard to the violation of the oil discharge
into the Fhilipsburg Manor pond. The Mayor stated that Tappan
Motors II ( the new corporation) owns the property and the
violation went to Tappan Motors Corp. who still owns the
business. Mrs. Lingardo stated that no new permits should be
issued to anyone until this is resolved and past violations are
corrected and hoped the Board would have some power in making
sure that this case does not keep being adjourned.
The Mayor stated that the Building Inspector has recommended to
the Board that the Water Department conduct a thorough dye test
of all the gas stations, garages and automobile agencies to
determine where their interior drains discharge.
Mrs. Lingardo also asked when would the old house on route 9
would be torn down because it is causing a hazard; and the Mayor
responded that the new owners of Tappan Motors are looking into
this matter and it should be resolved shortly.
Alex Fudali thanked the Board for budgeting money for the Fall

�Festival on September 8th and recommended that we ask Tarrytown
to use their part of Patriots Park also.
Mr. Fudali stated that the coach of the Babe Ruth baseball league
had asked him to check why he was asked by the recreation
commission to submit in writing the process by which he chooses
the players for the teams.
Jim Warren, a member of the commission, stated that there were
players from other towns even though the league is being
supported by North Tarrytown and Tarrytown. After a brief
discussion by the trustees and Mrs. Lingardo regarding the
process involved, Trustee Alter stated he would speak to the
recreation commission and get the complete picture and they will
speak to the party involved telling him that he is appreciated
and no offense was meant.
Miguel Jiminez expressed his concern over the construction which
has been under way for over six months at the corner of Clinton
and Cortlandt Street and also the status of the Sleepy Hollow
Restaurant. The owners of the Clinton Street construction are in
court now and the building inspector and the village are getting
an engineer to determine the extent of the damage of the
restaurant because if it is more than 50%, they must start from
scratch. Mr. Jiminez thanked the Board for giving the Rock of
Salvation Church a permit to hold their services and said they
will work with the Board.
Howard Phillips, President of the Sleepy Hollow Taxpayers
Association thanked Trustee Cicchetti for checking into several
items regarding route 9. He asked what streets in the Manors are
scheduled to be repaired. The Administrator stated that the
culvert by Fremont and Hemlock Drive is on the schedule for June
or early July.
Edna Belanich asked about the problem of the shopping carts from
the Grand Union which is getting worse. Trustees Hyland and
Marren stated that fines should be issued. This situation will be
referred to the Public Works and Police committees.
Chick Galella asked where the $105,000. from the State would be
applied? The Mayor stated that we have not received this money
yet. Trustee cicchetti commented that if we do receive it, we
will deposit it in an interest bearing account and use it towards
next year's tax rate. Mr. Galella also asked what the payment to
Bridging the Gap was.
The Administrator stated that this is a
firm that was hired to review our telephone bills over the past
four years regarding lines, police call boxes, etc. and they
found that we have been overcharged, therefore they have recouped
$34,000., half of it to be paid to them. Mr. Galella asked
several questions regarding the replacement of the Police Chief
and he was told that personnel matters cannot legally be
discussed at a public meeting.
There being no further comments from the public, the Mayor closed
the public comment section.

�Mayor'» Report
The Mayor reported that the Operation Clean-Up Task Force has
been a great success. Everyone is invited to join them every two
weeks on Thursdays.
Some of the comments and concerns of the
committee are litter on the streets especially on weekends.
Suggestions included hiring a part time sweeper and ask the judge
to consider imposing community service as part of a sentence.
Other concerns were the noise level, garbage being dropped by
sanitation men, incinerator smoke at College Arms, bar doors
being left open at night,"Quiet Zone" signs being put up in front
of churches and hospitals, possible citizens patrol at 126
Valley Street, and the possibility of picture signs throughout
the Village to replace some signs.
The Planning Board will meet June 14 and the Zoning Board on June
20th. Flag Day ceremonies will be held on June 14th at 7 PM at
Patriots Park with Tarrytown and the VFW.
All are invited to
attend.
Counting of truck traffic on Beekman Avenue has been completed.
The Mayor and the Administrator attended an annual meeting of the
fire department earlier this evening at Morse School.
Administrator's Report
The Administrator reported that we have been reimbursed for
damage which was done -to the base of the fence at Douglas Park;
prior to that we received a check for the damage to the fence.
We opened bids for street lighting and maintenance of traffic
signals and there are a few clarifications that need to be made
on the apparent low bids which will be discussed at the next work
session.
Trustees' Reports
Trustee Treacy reported that we have been awarded a $1000. grant
from the Heritage Task Force. The Governor has put much emphasis
on the Hudson River Valley Greenway and the Council would like to
create a greenway which would stretch 154.8 miles on the Hudson
River and the greenway North Tarrytown is proposing would make us
strong contenders for the large grant. The $1000. will help to
improve upon our application with the State for a one million
dollar grant from the new Environmental Quality Bond Act.
On May 21 a meeting with the merchants was held concerning the
upcoming improvements on the avenue. A representative from the
Department of Planning gave them reassurance on many of their
questions such as parking. Additional parking will be available
at Morse school lot.
Labor negotiations are continuing with the PBA and the new
municipal employee unit.

�Trustee Alter reported that regarding Devries Field, GM has
planted over forty trees between the field and their property
line, Metro North has also planted trees along the fence of their
power station and is giving the Village an additional 300 feet of
railroad ties.
He stated that at the next work session the Board will discuss
the monies to be appropriated to implement the plans for the
completion of the field.
Day Camp registration is being held, tot camp registration is
full; there are still openings for camp counselors and there will
be a trip to the Mets game on August 16, tickets are $14.
Trustee Cicchetti stated that the Village was asked to prepare
written policy statements on purchasing procedures that require
bidding.
Trustee Marren will review the financial management
guide with the administrative officials to see if this guide is
being followed. He will be reviewing the guide for competitive
bidding purchasing.
He has checked with other villages regarding suggestions for
merit awards to employees. They will discuss this at the next
work session.
We have received a proposal from Law Enforcement Systems
Incorporated for the the collection of fines. He asked the Board
to discuss whether they want to change the policy, since our
contract with Complus will be expiring.
Trustee Rey applauded the fire department for their response to
the oil spill at the Restoration. He commented that Mr. Kahn has
not transferred ownership as yet. He asked the Fire Chief to
follow up on the old storm drain to have it filled and blocked
off so that it doesn't happen again. Trustee Rey moved to have
the Water Department follow up on the dye tracing in the drains,
second by Trustee Alter and motion carried.
He commended the Ambulance Corp. for their quick response to a
life saving situation at General Motors.
Trustee Hyland spoke on code enforcement. The houses on New
Broadway and Lawrence Avenue were reinspected and both are still
being occupied. The Mayor stated that the police should be
notified and a warrant issued.
He entered the police report into the record.
He asked the chair for a moment of silence at the next meeting
for a former policeman Hugh Fiorella, who just passed away.
Under Public Works, he commended the Assistant Foreman for a job
well done in the absence of the General Foreman for the past few
weeks; the highway department crews are still working on the
roads; the dip in front of 220 Palmer Avenue has been repaired,
and Wednesday is a recycling day.

�Trustee Narren reported that the Retail Expansion Committee met
last week. Trustee Treacy provided some background information
especially on the sidewalks. They will be sitting down with the
merchants to listen to their complaints and ideas. Trustee
Marren stated that they also discussed that the Revitalization
and Retail Commission should be one committee or at least meet
together on a regular basis.
The Mayor commented that once the downtown area is upgraded, new
businesses would be encouraged to open. If we can convince
merchants to deliver food to GM at lunch time, traffic will be cut
down considerably.
Trustee Narren stated that these two committees must be in cinque
with one another.

Old Business
Trustee Hyland stated that the Police Committee has decided that
there are enough taxi cabs in the village right now and more
companies are not warranted at this time. After a brief
discussion, Trustee Marren asked that it be discussed further at
the next work session.
Trustee Cicchetti commented that on the matter of Code
Enforcement, the revitalization committee needs to know what is
being done and Trustee Marren commented that we need a follow-up
system. The Mayor stated we do have a log which just needs to be
updated. Trustee Marren asked if the Water Department would be
marking out the water mains before the sidewalk project begins.
Trustee Treacy stated that the drawings show where they are
located.
Trustee Marren also asked if the possibility of
breakaway hydrants could be considered before reinstalling the
original ones. She also commented on the back up chlorinator for
the aqueduct and the Administrator stated the engineer is working
on it now.
Trustee Marren asked about the age of the police vests and if
police officer vests were mandatory. Officer Warren stated that
the officer must sign a waiver if he chooses not to wear it.
Trustee Treacy commented that there are grants available for
police vests.
Mayor Gandolfo asked the Police Committee to check into the
possibility of assisting persons who are locked out of their
cars. She stated perhaps they could sign a waiver if there is any
damage done to the car.
Trustee Marren asked about the change in the first and second
election districts. The Mayor stated that the Town has changed
the second district to Holy Cross, but we have not.
Trustee Rey wanted to reaffirm that there is proper insurance for
the sidewalk program. The County is taking care of this.

Fund i s $76,146.16 and the Water Department fund, $4,297,65.

�Executive Session
Discussion ensued on a request made by Chief Spota that the
Board consider giving him $4,000.00 severance pay upon
retirement. The Board determined he was not entitled to this
and denied his request.
After much discussion on the position of Acting Police Chief,
Trustee Treacy moved to rescind the assignment of Lt. James
Erophy as Acting Chief. This motion was seconded by Trustee
Cicchetti and was carried by a 4-2 vote with Trustees Rey and
Hyland voting NO.
Trustee Treacy moved to assign Gabriel Hayes as Acting Police
Chief due to the continuing absence of Chief Spota until June
15, 1990; upon the retirement of Richard Spota, he will be
appointed provisional Chief. His present salary will remain
the same. This motion \f£*s seconded by Trustee Cicchetti.
After much discussion, the motion was carried by a 4-2 vote
with Trustees Rey and Hyland voting NO.
Trustee Cicchetti moved to approve the retirement of Richard
Spota, effective June 15, 1990, seconded by Trustee Treacy
and motion carried by a 6-0 vote.
Trustee Cicchetti moved to call for a new civil service test
for Chief of Police. This motion was seconded by Trustee
Alter and carried by a 6-0 vote.
Back to regular session, Mayor Gandolfo adjourned the
meeting.

Be It Resolved, the Board of Trustees sets a Public Hearing for
June 19, 1990 to revise Chapter 45, Sanitary Code Article II,
Section 45-17 Fees as follows to add:
(NEW) C. A plumbing contractor who is a bona fide holder of
a certificate of registration or license duly issued to him by
some other municipality in the state of New York shall be
entitled to a license for plumbing work upon filing with the
Plumbing Inspector a certified copy of said certificate of
registration or license issued by the Plumbing Inspector to
plumbers, and upon payment of fee of fifty dollars ($50.), and
shall be renewed by January 1 of each succeeding year on the
payment of fifty dollars ($50.).
All applications for reciprocal licenses must be reviewed, and
all reciprocal licenses must be approved by the North Tarrytown
Examining Board of Plumbers.
