                  <text>A Regular meeting of the Board of Trustees of the Village of
North Tarrytown was held on Tuesday, September 18, 1990 at 8:00
PM.

Mayor Gandolfo called the meeting to order with a pledge to the
flag.
Public Hearings- None
Approval of Minutes
Trustee Alter moved to approve the minutes of September 4, 1990
as written, seconded by Trustee Treacy and motion carried 6-0.
Approval of Warrants
Trustee Hyland moved to approve the warrants and authorize the
Treasurer to pay the bills, seconded by Trustee Cicchetti and
motion carried 6-0. The total of the General fund account is
$94,917.92 and the Water Department fund is $2,030.44.
Communications, Petitions &amp; Requests
The Deputy Clerk was in receipt of a letter from Pat Damin of 14
Dell Street requesting tree trimming. Referred to Public Works.
Mayor Gandolfo was in receipt of an invitation from Pocantico
Hook &amp; Ladder inviting the Board to a dedication ceremony in
memory of Ex-Chief Bernard Rosenblatt on September 22 at 7:30 PM.
The Mayor was in receipt of a letter from N. Tarrytown
Patrol regarding the annual inspection and
conditions of
houses they would like the Board to look into. They would
like to have ID cards issued to the firemen. Referred to the
Department committee.

The Mayor was in receipt of a copy of a letter to the Building
Inspector from Bruce Von Glahn regarding the rental of a store at
18 0 Valley street to open a miniature supermarket and he is
requesting a variance. Will be discussed at the work session.

�Letters were received from two residents of Philipse Manor,
Elizabeth Connors and Tom Hales, expressing their concern over
the No Parking restriction in the Manor. The Board will look into
their particular problem.
A letter from Dr. Donald Grunwald was received stating that the
site for the proposed group home is unacceptable and unsuitable.
Letter will be referred to the committee.
Ferry Sloops' Seventh Annual Hudson River Celebration will be
held on Sunday, September 2 3 at Pierson Park, Tarrytown from
11:30 AM to 6:00 PM.
Trustee Rey presented many letters from residents
their concern over the Halpern proposal.

Administrator's Report
The Administrator reported that he attended a meeting in
Briarcliff regarding the 911 system which the County and NY
Telephone will be installing. There is alot of work that still
must be done by the County, Telephone Co. and each municipality
before it is completed. Each customer will be charged up to
thirty five cents per line per month for this system and each
municipality will pay a minor cost also.
There is a opening in the Recreation Department for a part time
clerical position and there will an opening in October for a part
time parking enforcement officer.
Specs will be available to prospective bidders for the Devries
Field project this week and bids will be opened on October 1 st.
Trustees' Reports
Trustee Treacy reported that the Beekman Avenue Beautification
Project is proceeding on schedule. Some modifications have been
added to the project such as two dropped curbs but the additional
cost will be minor.
No agreement has been reached in the contract negotiations with
the PBA.
The state mediator could not bring both parties to an
agreement, therefore the PBA will be filing for arbitration.
Trustee Treacy thanked Tarrytown for allowing us use Patriots
Park for our successful Fall Festival this year.
Trustee Alter reported on recreation: men's softball is being
held on Monday, Wednesday and Friday, there are several programs
being offered for both high school and adult outing clubs, slow
break men's basketball will start in December, open gym for
tennis will begin October 10, golf clinic on October 12,
registration for aerobics is now in progress. Several favorable
comments have been received on our Fall brochure.

Trustee Cicchetti reported that our 1989-1990 accounts are now in
the process of being audited and our own auditor is very pleased
with the way the Village has implemented various recommendations
that had been made.
Trustee Cicchetti stated that the post census review is still
continuing.
Trustee Rey reported there was some problem with the painting at
Union Hose which will be taken care of, and minor items
that
were discovered at the inspection will be corrected shortly.
Trustee Hyland entered the Police Report into the record.
He stated that leaf season is

On code enforcement: several reinspections have been done and
there are some cases still in court.
Trustee Marren gave an update on the proposed group home. The
Citizens Committee has met several times to discuss this issue
and bring to the board their recommendations. There are three
alternatives that the Village can take; accept the group home,
offer an alternative or reject the group home on the basis of
concentration. The committee is still searching for an attorney
who is skilled in the area of the mental hygiene law. They have
spoken with Senator Spano's and Peter Sullivan's office to
discuss the way in which an agency comes into a community. There
are guidelines which the agency must look at.
There will be a public hearing on Tuesday, September 25 at 7:30PM
in Village Hall. A court stenographer will be present to take
minutes, the group home agency will give a presentation and the
citizens committee will be present.
The Committee will meet on
September 2 6 to present the Board with their findings and for the
Board to take action on the group home.
There are copies of brochures available at Village Hall which
will explain the agency and is quite informative which should be
read before the public hearing.
Public Comments
Mr. Albert Pirro of Pirro &amp; Monsell, attorney representing
Halpern addressed the Board asking them to approve the concept
plan and extend the original August 1988 agreement between
Halpern and the Village until December 31, 1990. Halpern is very
anxious to start the environmental review.

�Mayor Gandolfo stated that the Board was not prepared to vote
because there are still some concerns and very vocal opposition
from the residents; the buildings should be only 3-3 1/2 stories
high, the density of the project should be lower and more parking
must be provided.
Mayor Gandolfo asked for a motion to extend the Halpern agreement
for two weeks until October 2, 1990; Trustee Treacy so moved,
seconded by Trustee Cicchetti and motion carried 6-0.
Susan McCarthy of Andrews Lane presented the Board with a
petition containing 710 signatures opposing the construction of
the six story housing unit on the Duracell/Andrews Lane area.

Stan Pulaski expressed concern over the Cortlandt Street area
where the buildings there are too high and adding more would make
it worse.
Todd Ruppel, a resident of Philipse Manor, expressed concern over
the enforcement of the No Parking ordinance on the streets of
Philipse Manor which was initiated by the PMIA.
He felt that
this would be an inconvenience to many of the residents and he
will be circulating a petition against this enforcement.
The Mayor stated that the Board will be discussing this further
at the work session.
After a brief discussion by the Trustees,
Trustee Marren moved to extend the waiving of the ordinance from
October 1 to October 15, seconded by Trustee Rey and motion
carried 6-0.
Mrs. PiersonP President of the PMIA, phoned stating that every
home in the Manors was contacted and 2 32 were in favor of
enforcing this ordinance.
Miguel Jimenez requested permission for the Rock of Salvation
Church to hold a service next Saturday inside Friendship Park
from 7-9 PM. Trustee Treacy moved to grant permission, seconded
by Trustee Cicchetti and motion carried.
The Mayor told Mr.
Jimenez to contact Tarrytown also.
Mr. Jimenez also asked that the Board consider removing the bus
shelter at the corner of Beekman Avenue and Cortlandt Street
because it is creating a nuisance whereby young people are using
it as a hangout.
Trustee Treacy commented that we have a
contractual agreement with Department of Traffic of Westchester
County and the bus stop must stay, but he will speak to them
about the possibility of removing the shelter in the middle of an
agreement.
Ellen McDonough of Kendall Avenue questioned the height of the
proposed buildings in the Halpern project. The Mayor stated that
the Board will not agree to any building higher than 3-3 1/2
stories.

Ms. McDonough also asked if the Elm Street parking lot would be
part of the project; the Mayor stated those parking spaces would
be included at another site in the project.
Martin Kavicky asked why the cut out for the bus stop at the
corner of Beekman and Washington Street was eliminated.
Trustee
Treacy responded that the cut out is still there, just smaller.
Chick Galella asked when the financial report would be made
available to the public. The Mayor stated that as soon as the
Board has received it and reviewed it.
Mr. Galella suggested that work sessions be televised.
He also
asked what the additional cost would be for the dropped curbs for
the Beekman Avenue project. Trustee Treacy stated that the cost
would be minimal, probably $500. or less.
Mr. Jadus invited the board
members to attend a meeting of
Operation Task Force on September 27, 1990 at 7:30 PM.
Mr. Kadlec would like the Halpern project to put on a referendum.
There being no further comments, the Mayor closed the section.
Mayor's Report
The Mayor and John Hughes met for a second time with the members
of the school board and the town board to discuss the
negotiations that are going to be commencing regarding the GM
railroad facility. John Hughes and William Plunkett are now in
the process of looking for appraisers and will be reporting back
to the board on how to proceed.
Mayor Gandolfo congratulated Alex and Laura Fudali and the Fall
Festival committee for a job well done.
Old Business
Trustee Marren asked about the status of the water department.
The Administrator stated that the repairs and the possible move
are still on hold.
Trustee Rey asked about having a representative from the phone
company review our bills.
The Administrator stated that a
consultant had reviewed our bills and the telephone company sat
down with us and as a result, we recouped $17,000.
The Mayor stated that it is not necessarily the phone company's
fault, it may be the way the system was installed many years ago.

�New Business
Trustee Marren stated that there will be a public hearing on the
proposed group home on September 25th at 7:30 PM. Trustee Marren
moved to call for a special board meeting on September 26th at 8
PM for the committee to present their findings to the Board and
ask them to vote on the direction that they should take, motion
seconded by Trustee Cicchetti and carried.
Mayor Gandolfo reported that there will also be a work session on
Tuesday, September 25, 1990.
Public Comments
George Fitzpatrick commented that he felt that erecting a stop
sign on Howard Street would present a speeding problem and a
problem getting up Pocantico Street in the winter with ice and
snow. He also felt that if the sign is erected, there will be
more traffic on Lawrence Avenue because it is an easier hill.
He asked what "Dogs and Other Animals" meant with regard to the
proposed pooper scooper law. The Administrator stated that this
is just the title of the chapter.
Trustee Cicchetti moved to adjourn to executive session to
discuss personnel matters and possible litigation, seconded by
Trustee Marren and motion carried.
The Mayor stated that they will not be returning after executive
session so regular meeting was adjourned.

service exam in a few months.

A G R E E M E N T

AGREEMENT made this
day of
, 1990, by
and between the Village of North Tarrytown, a municipal
corporation duly organized under the Laws of the State of
New York, with offices at 28 Beekman Avenue, North
Tarrytown, New York, and James J. Hahn, P.E., Route 22 and
Milltown Road, Brewster, New York.

WITNESSETH:
WHEREAS, the Village of North Tarrytown wishes to hire
James J. Hahn, P.E. as its Consultant Village Engineer; and
WHEREAS, James J. Hahn, P.E* is desirous of accepting
the position as Consulting Engineer; and
WHEREAS, the parties hereto are desirous of setting
forth in writing the terms and conditions of the aforesaid
employment;
NOW, THEREFORE, in consideration of the foregoing and
for other good and valuable consideration, receipt of which
is hereby acknowledged, the parties agree as follows:

ARTICLE I - EMPLOYMENT
1.01 James J. Hahn, P.E. is hereby hired and agrees to
accept employment as Village Consulting Engineer, effective
, 199_ for a period of one (1) year from the
aforementioned date. This contract may also be terminated
by either party on six (6) months written notice to the
other party.
1.02 For purposes of clarification, it is agreed and
understood that the nature of this employment is that of a
Consultant Engineer, and accordingly, James J, Hahn, P.E.
and employees of James J. Hahn, P.E. shall not be entitled
to any retirement benefits, life insurance, medical, dental,
optical or other health related coverage, or any and all
other fringe benefits offered Village of North Tarrytown
employees. All payments to James J. Hahn, P,E, shall be
considered contract payments, and accordingly, no taxes, or
any other required item shall be withheld by the Village of
North Tarrytown.

�ARTICLE II - COMPENSATION
2.01 James J. Hahn, P*E. shall receive compensation
for services rendered for the Village of North Tarrytown in
the normal course of its day to day business at an hourly
salary as shown on attached Schedule "A". James J. Hahn,
P.E. shall keep accurate time records which shall be
submitted to the Village of North Tarrytown on a voucher
basis and shall receive payments accordingly for work
performed by James J. Hahn, F,E, and any employees
performing work for the Village of North Tarrytown.
2.02 The maximum annual payment to James J. Hahn, P.E.
pursuant to this contract shall be $
, unless
otherwise authorized by the Village Board.
2.03 In the event the Village of North Tarrytown shall
elect to undertake additional projects which require
services of a special nature, other than weekly services
presently required, James J. Hahn, P.E» shall, upon prior
approval of the Village Board, receive compensation in
accordance with Schedule "A" annexed hereto and made a part
hereof.
ARTICLE III - REIMBURSABLE EXPENSES
3.01 In addition to the payments provided for in
Article II above, the Village shall pay James J. Hahn, P.E.
the actual cost of all Reimbursable Expenses incurred in
connection with services rendered under this Agreement.
Reimbursable Expenses are defined as the actual expenses
incurred in connection with performance of services under
this Agreement, including, but not limited to:
(i)
(ii)
(iii)
(iv)
(v)

Transportation.
Obtaining Bids, proposals or quotations from
contractors,
Toll telephone calls,
Postal expenses,
Expenses for drawing reproductions, maps, or
other items similar in nature.
ARTICLE IV ~ DUTIES

4.01 James J. Hahn, P.E. shall visit the Village on a
regular basis to meet with department heads and assist in
resolving Highway, Building, Planning and Zoning Board

�problems.
He shall also continue to work on road and
utility improvements, develop intermediate and long range
maintenance and capital improvement programs in conjunction
with obtaining Federal, State, and Local grants, and attend
Village of North Tarrytown Planning Board Meetings and other
meetings when requested*
James J. Hahn, P.E. shall, in
addition, inspect construction projects to insure proper
completion and perform such other weekly engineering duties
as may be required by the Village. Full-time inspection of
construction projects shall be considered services of a
special nature and payment for these services shall be as
shown in Schedule "A", and deemed not included in Section
2 .02.

4.02 It is anticipated that the village of North
Tarrytown shall require an average of

Nothing in this paragraph shall be construed to
prevent this estimated time need to fluctuate as required on
any give week*
ARTICLE V - RESPONSIBILITIES OF VILLAGE OF NORTH TARRYTOWN
5.01 The Village shall have responsibility for the
following:
(a)
provide
all criteria and
full
information
pertinent to responsibilities of James J. Hahn, P.E.
hereunder as to all services and additional projects,
including, where applicable, design objectives and
constraints,
space,
capacity
and
performance
requirements, flexibility and expandability, and any
budgetary limitations.
(b)
confer with James J, Hahn, P.E. before issuing
interpretations
or
clarifications
of
documents
furnished by Consultant, and obtain written consent of
James J. Hahn, P.E. before acting upon shop drawings,
samples or preliminary drafts,
(c)
prior to acceptance of any contractor who propose
to do work in the Village, consult with James J, Hahn,
P.E. to determine if, after due investigation, he has
reasonable objection to any such contractor.
(d)
give prompt written notice to James J, Hahn, P.E.
whenever the Village Mayor observes or otherwise
becomes aware of any development that affects the scope
or timing of services of James J, Hahn, P.E. , or any
defect in the work of contractors performing work in
the Village.

�ARTICLE VI - PROFESSIONAL RESPONSIBILITY
6.01 Nothing in this agreement shall be construed to
interfere with or otherwise affect the rendering of services
by James J. Hahn, P.E* in accordance with his independent
and professional judgment.
James J. Hahn, P.E. shall
perform all engineering services in accordance with the
generally accepted engineering practices and principals.

ARTICLE VII - MUTUAL RELEASES
7.01 Any and all agreements entered into between the
parties hereto are terminated, and each of the parties
hereby releases and discharges the other from any and all
obligations and liabilities heretofore or now existing under
or by reason of any such agreements, it being the intention
of the Village of North Tarry town and James J. Hahn, P.E.
that this agreement effective as stated above, shall
supersede and be in lieu of any and all prior agreements or
understanding between them.

North Tarrytown will hold a Public Hearing on October 2, 1990 at
8:00 PM in Village Hall to exempt from Village taxes within the

cent (50%) of its assessed value, properties owned by one or more
persons sixty-five (65) years of age or over who comply with the
