                  <text>A Special meeting of the Board of Trustees of the Village of
North Tarrytown was held on September 26, 1990 at 8:00 PM.
Present:

Mayor Gandolfo
Trustee Treacy
Trustee Cicchetti
Trustee Marren
Trustee Alter
Trustee Rey
Trustee Hyland

Also Present:

William T. Regan, Village Administrator
John J. Hughes, Jr. Village Attorney

Mayor Gandolfo called the meeting to order with a pledge to the
flag.
The Mayor stated that the purpose of this special meeting was for
the Board of Trustees to vote on the proposed group home for 1
Evergreen Way.
Trustee Marren, Chairman of the Citizens' Committee which was
formed to review this proposal, stated that according to state
law, the Village has three options; approve the proposed
location, object to the proposed location or select at least one
other suitable location.
The ad-hoc Committee formed to study the proposal opposed the
proposed site because of poor access to public transportation,
lack of parking and sidewalks, and because the Village already
has the largest percentage of tax exempt property in the County.
The Committee had suggested another possible site at 194 Beekman
Avenue. The Mayor and the Board objected to this or any other
alternative site without having first notified the residents in
that area. Since time was of the essence, there would be no time
for a public hearing to be held for these residents to voice
their opinions.
After much discussion, Trustee Marren moved to object to the
proposed community facility at 1 Evergreen Way on the basis of
concentration and several other reasons. A resolution is
attached. This resolution was seconded by Trustee Cicchetti and
motion carried 6-0.
Trustee Marren moved to engage Sive, Paget &amp; Riesel to assist
the Board through the next p r o c e s s , whereby the State
Commissioner of Mental Health schedules a public hearing to rule
whether there is concentration. The motion was seconded by
Trustee Cicchetti and was carried 6-0.

Our Village Attorney, John Hughes, Jr. recommended this law firm
because of its experience in helping municipalities fight
community facility proposals.
There being no further business, Mayor Gandolfo adjourned the
special meeting.

WHEREAS, the Board of Trustees of the Village of North
Tarrytown has received a letter dated August 22, 1990 from
Planned Community Living Inc. expressing its intent and interest
in establishing a c o m m u n i t y facility for the mentally
retarded/mentally impaired at 1 Evergreen Way, North Tarrytown,
New York; and
WHEREAS, the Board of Trustees of the Village of North
Tarrytown opposes the establishment of this community facility
for reasons which include, but are not limited to, the following:
(1) the existence of this community facility in the neighborhood
in addition to the Phelps Mental Health Center; and Farrington
House would result in such a concentration of community
residential facilities for the mentally disabled in the area of 1
Evergreen Way, North Tarrytown, New York that the nature and
character of the area would be detrimentally altered; (2) an
additional community residential facility would further
financially burden the Village of North Tarrytown, a village with
the largest percentage of tax-exempt property in Westchester
County; and (3) the residence at 1 Evergreen Way,
North
Tarrytown,New York is particularly unsuitable for a community
residence facility due to lack of parking, sidewalks and public
transportation.
NOW, THEREFORE, IT IS RESOLVED that the Board of Trustees
disapproves and rejects to the establishment of a community
facility for the mentally retarded/mentally impaired at 1
Evergreen Way, North Tarrytown, New York and directs the Village
Attorney and /or his designees to prepare and transmit a letter
objecting to the establishment of this community facility.
