Present: Mayor Gandolfo Trustee Treacy Trustee Hyland Trustee Marren Trustee Cicchetti Trustee Alter Also Present: William T. Regan, Village Administrator John J. Hughes, Jr. Village Attorney Absent: Trustee Rey Mayor Gandolfo called the meeting to order with a pledge to the flag. Public Hearings Mayor Gandolfo read the attached public notice with regard to amending Section 46 7 of the Real Property Tax Law. There were no public comments, therefore Trustee Hyland moved to close the public hearing, second by Trustee Cicchetti and motion carried. Approval of Minutes Trustee Hyland moved to approve the minutes of October 16, 1990 with minor correction, seconded by Trustee Treacy and motion carried 4-0 with Trustee Marren abstaining. Mayor Gandolfo stated that under new business, it should read that the PILOT is just for Village taxes and not for School, Town or County. Approval of Warrants Trustee Hyland moved to approve the warrants and authorize the Treasurer to pay the bills, seconded by Trustee Treacy and motion carried. Brief discussion ensued on the snow watch payments. The amount of the General fund was $151,343.79 and the Water Department fund was $14,72 0.27. Communications/ Petitions & Requests The Deputy Clerk was in receipt of a letter from Goldies Restaurant informing the Village that they have applied for an application for an on-premises liquor license. (Copy given to Fire Chief) 1 �The Mayor was in receipt of a letter from the NY State Division of Housing and Renewal with regard to our petition for more restrictive standards on sprinklers stating that since a majority vote was not achieved by the Code Council, our local sprinkler code ordinance is in effect at this time. Referred to Village Attorney. The Mayor was in receipt of a letter from John Ryan, Secretary of Union Hose requesting a 50 year certificate for Dominick Manno. Mayor Gandolfo received a progress report from Mayor Pilla and a copy of a letter from Tarrytown Village Attorney stating that there are no regulations on dealing with attempts to establish a "Tappan Zee East" scenic district. Five of eleven municipalities; Tarrytown, North Tarrytown, Irvington and the Towns of Mt. Pleasant and Greenburgh have agreed to form such a district. A letter was received from the Sleepy Hollow Chamber of Commerce requesting that the Village buy an ad in their 1991 booklet. Trustee Treacy moved, seconded by Trustee Hyland that the Village buy a half page ad. Motion carried 5-0. A letter was received from Edna Belanich requesting that consideration be given to the erection of a sign designating "No Parking Here to Corner" placed at the corner of College Avenue and Cortlandt Street. (Referred to Police Committee) Notice of appeal has been received from William Patten, Sr. with regard to his lawsuit against the Village , Zoning Board and Pat & Esther Damin. The appeal is going before the Appellate Division of the Supreme Court. Referred to Counsel. The Mayor received a letter from someone wishing to remain anonymous with regard to problems in the Ambulance Corp. such as problems with getting new equipment. (Refer to Fire Chief) A request for a new sidewalk at 322 N. Broadway has been received from Fraternal Order of Eagles. Has been referred to Public Works and Administrator. The Mayor received a letter signed by four residents of Sleepy Hollow Manor objecting to the application before the Zoning Board for a building permit at the corner of Lakeview and Evergreen Way. She was in receipt of a letter from Mr. Ceccarelli of 240 Hunter Avenue asking that the Board review the No Parking ordinance on the streets in Philipse Manor and arrive at a solution. A letter was received from Mr. & Mrs. David Chillemi of No. Washington Street asking that the fire whistle not be blown for all the ambulance calls in the evening hours. n �The Mayor received correspondence from MEBCO regarding new rates for 1991. Public Comments- None Mayor•s Report There will be a Planning Board meeting on November 15, ARB will meet on November 28 and Zoning Board will meet on November 29. The Mayor received a copy of a letter from John Hughes to General Motors regarding the assessed valuation of the new rail facility. Administrator's Report Bids for the Fire Pumper were opened on November 2, 1990. Columbia Hose committee is reviewing them and will give us their recommendation prior to the next meeting. The Administrator reviewed the garbage schedule for the week of Thanksgiving; no recycling on Wednesday, Thursday and Friday are holidays. The Administrator reported that the 1972 payloader is no longer working and that there are various options that the Board can take. One option is to rent a payloader at a cost of approximately $3500. a month with the option to buy or to purchase one outright and use the available capital interest money. The Public Works Committee has recommended that the Board declare an emergency to purchase a new payloader. Discussion ensued on how valuable this piece of equipment was. The Administrator stated that it is used in our snow loading operation, for breaking ground, digging to find water leaks, pushing salt and sand and lifting the spreaders onto the trucks. After the discussion, Trustee Hyland moved to declare an emergency for the purchase of a new payloader, seconded by Trustee Cicchetti and motion carried 4-1 with Trustee Treacy voting NO. Trustee Treacy did not believe that there was an emergency and that they should go out to bid. The Administrator also stated that normal operations of the Public Works Department is not possible without payloader and hence the need for declaring an emergency. Trustee Hyland moved, seconded by Trustee Cicchetti to purchase Case Payloader Model #721 for the purchase price of $80,000. less trade in. After further discussion, motion was carried 5-0. Trustee Treacy moved, seconded by Trustee Marren that the method of financing be done through the purchase of serial bonds over a ten year period. Motion carried 5-0. 3 �Trustees» Reports Trustee Treacy reported that the Beekman Avenue Beautification program is progressing well except for a few delays such as the arrival of the street lights and the installation of the pole in front of Village Hall which has a camera attached to it. There was also a slight delay in the installation of a new manhole in that vicinity. Even with the delays, completion is expected around the end of November if good weather holds out. He reported that regarding the increase in basic cable costs, local governments cannot do anything about this due to the fact that President Regan had passed a deregulation bill which took municipalities' rights away. They claim that the reason for the increase is that a new channel was added, increased operating expenses, cost associated with pending improvements and increased phone lines. The Municipal Employees Union is going to arbitration. Trustee Treacy stated that there are variances pending before the Zoning Board for two new restaurants/food establishments and the Board of Trustees has been asked for their opinion. He has asked that the Zoning Board not approve these based on the new ordinance which was passed recently. He and Trustee Alter attended a dinner presentation on the new 911 system. There will be a monthly surcharge of thirty five cents added to each telephone bill. He hopes that there will not be any additional charges. Over the projected costs, the County taxpayers will have to pay for personnel costs to run the system and that has not been projected. Trustee Alter gave a report on Recreation. There will be a canoe,bike and hiking trip coming up. Slo break basketball will start in December.There is open gym on Monday and Tuesday. New sessions of golf and tennis lessons will start in January. On November 24, the North Tarrytown High School Alumni will hold their reunion. Trustee Alter moved that the Village proclaim the week of November 18-25 North Tarrytown High School Alumni Week, seconded by Trustee Treacy and motion carried. Trustee Cicchetti reported on finance. The Finance Committee has held meetings to discuss ways to increase revenue for the Village due to the fact that a filtration system must be implemented in the water department to reduce acidity. Some recommendations are to send water bills monthly to improve cash flow, increase the penalty for late payments, reduce the grace period from three months to one month or impose a surcharge. The committee will continue to review the courts but felt that since there was a recent increase in parking fines, they shouldn't be increased. 4 �I Trustee Hyland entered the police report for October into the record. He gave a report on code enforcement; some court cases are still pending and some building permits have been issued. The new sweeper is in service. Trustee Marren gave an update on the group home status. The Village can look for an alternate site. The Site Committee is trying to find other possible sites. Right now there is no home that meets the specifications. They have looked at 8 Katrina Avenue and the owner of 176-178 Washington Street has offered to sell his home for this group home but the committee has not looked at it as yet. The Mayor stated that the residents in that area must be made aware that this home or any other home is a possible selection. Resolutions- Attached Old Business Mayor Gandolfo stated that at a previous meeting, the Board approved donating $1000. to Public Cable Television from the surplus of the street festival. She asked that we hold off giving them the check until all the bills for the festival are paid to make sure that we do have this surplus. She also stated that the $10,000. grant from the State is not forthcoming and we have already purchased equipment for Cable TV for this amount. A discussion ensued on ways to recoup this money, if possible. The Mayor stated that although the equipment is insured, the Village must be protected in case of theft to make sure who owns the equipment so that we would receive the insurance money. After more discussion, Trustee Marren moved to hold off on previous resolution to donate $1000. to Cable TV, seconded by Trustee Cicchetti and motion carried. New Business The work session will be on November 20, 1990; the next board meeting on November 27th. The Administrator stated that a study of the staffing of Police Department is being considered and at the next work session the Board will discuss hiring a consultant, Robert Bartsch, former Deputy Commissioner of Westchester County Personnel. He would determine the needs of the Department as far as the number of Sergeants and Lieutenants. Fees will be discussed with him. 5 �Executive Session Trustee Marren moved to adjourn to Executive Session to discuss personnel matters, seconded by Trustee Cicchetti and motion carried. Discussion ensued on the upcoming Police Chief's exam and who should be eligible to take it. It was decided that it would be open to Sergeants who qualify to take the exam and Lieutenants. Discussion ensued on disciplinary matters regarding the Public Works department and discussion took place regarding a problem concerning a part timer in the Police department. There being no further business, the meeting was adjourned.
