Present: Mayor Rey Trustee Timmings Trustee Treacy Trustee Alter Trustee Hayes Trustee Hyland Trustee Nazemetz Also present: William T. Regan, Village Administrator Robert J. Ponzini, Village Attorney Mayor Rey called the meeting to order with a pledge to the flag. Mayor Rey asked everyone to remain standing for a moment of silence for Mr. Don Caetano's father, who passed away last week. PUBLIC HEARING This is a continuation of a Public Hearing to consider amending the New York State Emergency Tenant Protection Act of 1974 to apply only to those residential rental properties that contain ten or more rental units. Mr. Demetrios Kringas of 14 9 Webber Avenue stated that he owned a five family apartment house and spends more on repairs and maintenance then he receives in rents. He presented the Board with a list of municipalities that have 12 or more units covered under ETPA. Ms. Anne Pauletti co-owner of 190 Valley Street described her experiences dealing with the Rent Guideline Board and her problems trying to register the apartment house with ETPA and submitting leases and rent increase applications. She stated she has owned the building for three years and has invested over $200,000. in improving the building, and has not been able to increase the rents. Mr. Peter Kringas, of 14 9 Webber Avenue, said he presented materials to the Board at the Work Session of April 9 and hoped the Board would act on passing the resolution to offer relief to the small apartment house landlord. Mrs. Patricia Kringas presented ecomomic information to the Board and asked that they pass the resolution to amend the ETPA ruling for North Tarrytown. Mr. Brand Reese, President of the Apartment Owners Association explained the difficult economic situtation for the small building landlords, as did Mr. Albert Annunziata, President of the Small Apartment Owners Advisory Board. 1 �Mr. James Tierney of 2 55 North Broadway stated if the ETPA did not exist, there would be more homeless people. He commented that in his case, he has continued to pay increases for improvements in his rent for years. The increase stays on his rent long after these items should have been paid. He inquired as to when the Board plans to adopt a resolution for senior citizens over the age of 62, and who live on fixed incomes, can be exempt from rent increases due to repairs. Trustee Treacy explained the Board has held off making a decision until they can research what the Village's exposure would be if the Board passed a resolution granting the senior citizen rent exemption. Mr. Sol Shapiro commented that he owns a six family unit in the Village, and loses money every year on the property due to higher tax and increases in the water bills. Mr. Peter Kringas stated that only 2 9 buildings and 175 tenants would be affected by passing this resolution. Mr. Donald Caetano spoke in favor of eliminating the ETPA law for the small apartment house owners. Trustee Timmings moved to close the Public Hearing. seconded by Trustee Hyland. Motion carried. Motion was Trustee Treacy commented that the small landlords are being penalized for obeying the ETPA law. He spoke in favor of passing the resolution and the Board should approve the amending of the ETPA law for North Tarrytown. He feels it would encourage the small landlords to stay and improve their buildings. Mayor Rey stated that he would like to see a tenant advisory council formed and he would ask them for their input on the proposed amendment to insure that people will not be dispossessed from their apartments if rents reach beyond the tenants ability to pay. The Mayor would like certain items placed in the Village's legislation whereby 75 to 80% of the increases would revert back into the properties. Trustee Hyland moved to remove ETPA from 10 units or less. Trustee Treacy seconded the motion. Trustee Timmings commented that he did not feel qualified to vote on the resolution at this time and felt that not enough tenants have been given the opportunity to address the board. He then asked for a motion to table the matter until the next Board Meeting. After some discussion, Trustee Hyland moved to withdraw his motion and to table the resolution until the May 7th Meeting. Trustee Nazemetz seconded the motion. Vote was six in favor of tabling the resolution and 2 H I �i one nay. Trustee Treacy opposed. Trustee Treacy also asked if Mr. Diament could be invited to attend the next meeting and offer his comments regarding the ETPA resolution. Approval of Minutes Trustee Hyland moved to approve the minutes of the Organization Meeting of April 1, 1991, seconded by Trustee Timmings. Motion carried. Trustee Hyland moved to approve the minutes of the April 2, 1991 meeting, seconded by Trustee Hayes. Motion carried. Approval of Warrants Trustee Hyland moved to approve the warrants and authorize the Treasurer to pay the bills, seconded by Trustee Timmings. Trustee Nazemetz raised some questions regarding the Gilleece & Altman bill. Trustee Treacy asked for time to review the Post Automotive bills from the Highway Department. The amount in the General Fund is $112,619.28 and the Water Department Fund is $10,837.63. Communications, Petitions and Requests Mayor Rey read aloud a letter from the New York State Office of Parks, Recreation and Historic Preservation dated April 12, 1991 informing the Village that the Philipse Manor Railroad Station at Riverside Drive in North Tarrytown has been listed on the State and National Registers of Historic Places. He also read aloud a letter from Mr. Parra of 49 New Broadway regarding sidewalk replacement at that address. Trustee Treacy read aloud a letter addressed to Village Administrator William Regan regarding full time employment for the Building Inspector and Highway Department Foreman. The letter stated that full time employment for these positions (which would include wages and benefits) would be too expensive at this time. Pie also read letters from Annegret Rice, and Daniel Nuzzi of Smith William Memorials in favor of keeping James Margotta,the present building inspector, as a part time employee. PUBLIC COMMENTS Mr. Albert Pirro, of Pirro and Monsell, addressed the Board on behalf of the Halpern Revitalization Project. He briefly went over the history of the project for the past three years. He stated that the original proposal called for 1500 units and it has been scaled down to 350 or less units. Since 1987 Halpern has submitted at least 3 different plans for a revitalization proj ect. They have paid for attorneys and a consultant to review the concept on behalf of the Village. 3 �He asked the Board to honor the concept plan that was adopted in October, 1990, so that the plan may move on to the next step. He feels that the Finance Committee would be more effective when the Village deals with the Environmental Impact Statement, question #8. Trustee Treacy suggested that the Board honor its commitment and get in touch with the attorney hired by the Village to move along on this project. After a long discussion it was suggested by Village Counsel to hold a Work Session to study the draft submitted by our attorney, Brown and Wood. Mr. Regan commented that one of the reasons for the delay was the last three pages of a draft faxed to the Village by Mr.Pirro's office could not be read. The Village has made two requests to Mr. Pirro's office asking that the originals be sent, so they can be forwarded to Brown and Wood for their comments. Mr. Mario Belanich addressed the Board and asked about condemnation proceedings in the Halpern revitalization plan and questioned the work done on Riverside Drive in the Manor. Mr. John Tucci addressed the Board and spoke of the recent parking problems on Pine Close. Trustee Hyland made some suggestions to help alleviate the problems. Mr. Mario DiFelice approached the Board and invited everyone to attend the tree ceremony to be held in front of Village Hall in memory of Thomas J. Cavalieri on Saturday, April 20. He then asked Mayor Rey if the rumors that have been circulating were true that three Italian Americans, who are Village employees, would be losing their jobs. Mayor Rey responded that certain personnel changes were recommended to reduce the budget and that it was true that these jobs were part of that discussion. Mr. DiFelice asked if their removal would decrease his taxes, or were these employees to be replaced. He also asked if the Board considered the ages of these employees, as all of them were over 60, and what the effects of either dismissal or demotions would be on their social security benefits and pensions. Mr. Rey commented that some positions would be filled by existing staff with an adjustment to salaries. Trustee Treacy asked who was making the study on the effects of the dismissals on the budget. Mayor Rey responded that discussions took place during Executive Session. Mr. DiFelice asked if minutes were taken during the Executive Session. Mayor Rey stated no as a final decision was not reached. 4 �Mayor Rey responded with regard to the Building Inspector that he wanted the Board to review the position and consider hiring a full time Building Inspector. Ms. Joan Shibetti addressed the Board and spoke against the present building inspector she felt that the Building Inspector should be a full time position. Mr. JDon Caetano spoke in favor of the present Building Inspector, and stated that politics should not influence personnel decisions . At this point, a heated discusssion took place between Trustees Treacy and Nazemetz with regard to personnel changes. Trustee Timmings stated that these matters were only under discussion and decisions have not been finalized. Mrs. Katherine Cappello addressed Trustee Timmings and commented that her husband, Mr. Manny Cappello, Foreman of the Water Department, was informed by Mr. Regan, Village Administrator that the Foreman's position was being eliminated due to budget cuts. Mr. James Margotta, Building Inspector, rebutted some of the rumors that have been circulating about his qualifications. Trustee Timmings moved to close the Public Comments section of the Meeting, seconded by Trustee Hayes. Motion carried. Mayor's Report Mayor Rey stated that the New York State Department of Health will meet with residents who live in the area of the Duracell site to discuss the results of the recent mercury tests. A second meeting is scheduled for May 1, to discuss expanding the testing area. He also announced that on Saturday April 20, at 12 noon there will be a tree ceremony held in honor of the memory of Mr. Thomas J. Cavalieri, in front of Village Hall. He announced the Department of Recreation will plan Earth Day activities for Sunday April 21, 1991, and it may involve cleaning up Douglas or Barnhardt parks. Administrator's Report The Administrator stated that there was a resolution on the agenda to sell at auction 6 pieces of highway equipment. The matter of the plow listed as an sale item will be at the discretion of the Administrator. He announced that the sidewalk program was moving rapidly along and that work in front of the Van Tassel Apartments would be starting the following day. 5 �I He stated that the Water Departments Bids were due on Monday, April 22, 1991 at 10:00 AM. Mr. Regan stated that Devries Field has been finished and the field has been seeded. He mentioned recent discussions regarding Recreation Fund monies. He stated that $77,000 was collected in recreation fees since the beginning of the program and all the money has been spent on village parks, primarily Devries Field. In 1988, the Capital Fund borrowed $30,000 from the Recreation Fee fund rather than go to the market and pay interest on the borrowed money. Surpluses have been identified in other capital projects and the monies will be replenished shortly to the Recreation Fee Fund and the remaining funds will be used to finish the Devries Project. Trustee Timmings asked the Village Administrator if there was a minimum bid on the items being sold at auction. He responded no as the equipment is quite old. Resolutions (see attached) Old Business Trustee Treacy commented that he was happy with the new seating arrangement. Trustee Treacy also reported that he spoke with Chuck Lesnick of the UDC and they are being affected by the State's budgetary problems and will hold off on making any decisions regarding the facade grant for the Village until May, when their Board of Directors meet. Trustee Treacy was also informed by UDC that the Village was in very good shape for receiving this grant. He cited General Motors' problems with shut-downs of their assembly lines, and how it has affected business in the Village, and with more shut-downs, more business will leave the Village. Mayor Rey reported that the Village's Insurance Broker attended an earlier meeting with the Trustees and left a packet of insurance information for their review. Mayor Rey also reported that he received a letter from the Sleepy Hollow Taxpayer's Association regarding road work throughout the Manor. After the budget is passed, he will ask them to appear before a Work Session or a Board Meeting to discuss the repair project. Public Comments A resident asked what happened to the Plans for Domino's Pizza to open on Valley Street. Mayor responded that the application was withdrawn. 6 �23 New Business Mayor announced a Work Session is scheduled for April 23rd and another Budget Meeting is scheduled for 7:00PM on Wednesday April 17. Trustee Treacy moved for a Special Meeting for April 30, 1991 at 8:00 PM to adopt the 1991-92 budget. Trustee Hayes seconded. Motion carried. Mayor Rey asked the Village Administrator to send a notice to the newspaper to announce the meeting. Executive Session Trustee Treacy moved to adjourn to Executive Session to discuss personnel matters, seconded by Trustee Alter. Motion carried. Discussion ensued on personnel matters. The Board of Trustees voted unanimously to settle the grievance with Sgt. M. Caixeiro with Trustee Hyland making motion and Trustee Nazemetz making a second.
