Present: Frank J. Rey Mayor Morris Alter Michael Hyland John T. Hayes, Jr. James J. Nazemetz Trustees Also Present: Absent: William T. Regan, Village Administrator Robert J. Ponzini, Village Attorney James J. Timmings, III Sean Treacy Trustees Mayor Rey called the meeting to order with a pledge to the flag. Before starting the regular order of business, the Mayor presented a Certificate of Appreciation to a resident Ann Thorton, who assisted the police in a recent burglary. There are a few others who also helped and they will receive certificates at the next meeting. Public Hearings William Regan read the attached public hearing notice regarding increasing fines for violation of Chapter 24-3 entitled Garbage. Don Caetano, resident, of Lawrence Avenue, commented that there was no need to increase the penalties but that our Sanitation men should be more careful when picking up garbage and not drop it on our streets. After a brief discussion among the T r u s t e e s , Trustee Hyland moved to close the public hearing, second by Trustee A l t e r and c a r r i e d . The Administrator read t h e a t t a c h e d p u b l i c h e a r i n g n o t i c e r e g a r d i n g amendments t o V i l l a g e Code e n t i t l e d " P r o p e r t y Maintenance". There were no comments from t h e p u b l i c , T r u s t e e Hyland moved to adopt t h i s amendment, second by Trustee Nazemetz and motion c a r r i e d 4-0. The Administrator read t h e a t t a c h e d p u b l i c h e a r i n g regarding addition to the Zoning code, Chapter 62. notice George Hritz of t h e Sleepy Hollow Taxpayers A s s o c i a t i o n s t a t e d t h a t there i s no purpose in reducing the setback requirements and wanted to know why i t i s being proposed a t t h i s time. Trustee Alter agreed with Mr. Hritz and was a g a i n s t t h i s proposal by Frederick P. Clark Associates and wanted t h e Board t o d i s c u s s t h i s further with them. 1 �Timothy Coon of Bellwood Avenue also wanted to know why the Board would be considering this proposed amendment, since Frederick P. Clark Associates recommendations do not address the problems that will be created by this proposal. The consensus in Westchester County is to give more open spaces and not less. Mayor Rey commented that this hearing came about recommendation of the Chairman of the Zoning Board. on the Village Attorney stated the purpose of this hearing is to get comments from the public. Haig Bohigan, President of the PMIA, suggested the Board table this consideration until the PMIA has discussed the reasons for the proposed setbacks and not for just the one case involved. Trustee Alter moved to table this public hearing; there was no second. Based on the advice of Village Counsel, Trustee Alter moved to adjourn the public hearing, second by Trustee Hyland and motion carried 4-0. William Regan read the attached public hearing notice regarding the proposed amendments to the Wetlands/Watercourse Ordinance. Nicholas Cicchetti, former trustee, commented that numbers 1-5 have already been addressed at two previous public hearings and did not know why we were holding another public hearing tonight. The only amendment that needs to be addressed is number 6 which will be with regard to Sleepy Hollow Cemetery's request to expand their gravesite. George Hritz of Fremont Road stated that with regard to the Cemetery's request, he felt that the removal of a major water way would have a terrible effect on Fremont pond. Donald Stever, member of the CAC, stated that at two previous hearings all of the proposed amendments were already addressed. He urged the Board to make a decision. The purpose of this ordinance is to give the Village authority to control what happens to smaller wetlands. The first five amendments are only technical amendments and there is no objection to these changes. The Planning Board should decide if a project meets certain conditions. Gerard Weiss, representing Sleepy Hollow Cemetery, reiterated what he stated in previous hearings that Sleepy Hollow Cemetery has not asked for exemptions, all they ask is for the Planning Board to exercise their discretion and for this Board to make a decision. The Cemetery would not do anything to jeopardize the look of the cemetery. Dr. Richard Sweet, Chairman of the CAC commented that during all the previous discussions the CAC never stated that size didn't matter. The Citizen's Campaign for Environmental Wetlands stated that there should be no minimum size. Amendments 1-5 are technical amendments but not number 6. 2 �Mr. Kennell, President of the Sleepy Hollow Cemetery Association commented that it is not true that stopping the flow of the watercourse will affect Fremont Pond. All the Cemetery wants to do is replace the pipe from the old Fremont fountain. There being no further comments, Trustee Hyland moved to close the public hearing, second by Trustee Nazemetz and motion carried. Brief discussion ensued among the Trustees. Trustee Alter made a motion to remove number 6 from the list of amendments. There was no second. Resolution #:8/101/91 Trustee Nazemetz moved to adopt all the amendments to the Wetlands/Watercourse ordinance, second by Trustee Hyland and motion carried 4-1 on roll call vote. Trustees Hyland, Nazemetz, Hayes and Mayor Rey voting YES and Trustee Alter voting NO. Approval of Minutes Trustee Hyland moved to approve the minutes of July 16, 1991 as written, second by Trustee Alter and motion carried 4-0. Trustee Hyland moved to approve the minutes of August 6, 1991 and August 13, 1991 as written, second by Trustee Nazemetz and motion carried with Trustee Alter abstaining. Approval of Warrants Trustee Hyland moved to approve the warrants and authorize the Treasurer to pay the bills, second by Trustee Nazemetz and motion carried unanimously. The General Fund total was $157,987.28 and the Water Fund total was $23,866.38. Communications, Petitions and Requests Mayor Rey was in receipt of a letter from Mr. Meneses regarding a tree in Barnhart Park which fell on his car and the maintenance of the trees in the park. (Claim has been sent to insurance company and foreman is checking trees in the park.) Deputy Clerk was in receipt of two letters regarding tree removal. One was from Mrs. See for removal of tree at 23 Barnhart Avenue and Ms. Zastenchik at 22 Chestnut Street. Letters referred to Tree Commissioner and General Foreman for review. A letter requesting sidewalk repairs in front of 65 New Broadway from Richard Green has been received and referred to General Foreman. The attached letter from Fire Chief Whalen regarding the assignment of the assistant fire chief's vehicles was read by the Deputy Clerk. Mayor's Report The Mayor received an application for a USA growth award that we have qualified for from the National Arbor Day Foundation and he will be submitting it. 3 �The Open Door has asked the Village to look over their application for funding from the federal government for the health care services they provide. Public Comments Don Caetano asked that the Board consider a heavier police foot patrol throughout the Village. He also suggested removing a parking space on Teresa Street to help in the-garbage collection. He questioned an unregistered trailer attached to a village truck; the Mayor stated he will check into the matter. Mario Belanich stated that since General Motors will be working on the Saturday of the Street Festival, he suggested that the Village advise GM of the route the trailers should take when travelling in and out of the village. Mr. Belanich stated that he was against the amnesty program. Administrators Report William Regan reported that the Street Festival is moving along nicely; the bicycle race will be held on October 6th; the brush chipper is working very well, sidewalk repairs have started, the storm drains in Sleepy Hollow Manor have been repaired and the silt in the eastern end of Fremont Pond can now be dredged, Columbia Hose's new fire pumper is being delivered tomorrow and after being thoroughly checked,it should be put into service by early September. Discussion ensued on the newly adopted Constable ordinance, on litigation matters and on our towing contract. There being no further business, the meeting was adjourned.
