Present: John T. Hayes, Deputy Mayor James J. Timmings, III Sean Treacy Morris Alter Michael Hyland James J. Nazemetz Trustees Also present: Absent: William T. Regan, Village Administrator Robert J. Ponzini, Village Attorney Mayor Frank J. Rey Deputy Mayor Hayes called the meeting to order with a pledge to the flag. Before the regular order of business,Deputy Mayor Hayes commented that the President of the TNT club wanted to make a presentation. Ted Kawalerski commented through the efforts of two players, Joe Gaspare, Jr. and David Thompson, money was raised to purchase a pitching machine and batting cages. They presented the check to Henry Atterbury, the Recreation Superintendent. He thanked them for the money and the effort put forth in raising this money. Public Hearings The Deputy Mayor asked if there was anyone present who would like to comment on the public hearing regarding Senior Citizen Tax Exemptions (copy of public notice is attached). There were no comments from the public; Trustee Hyland moved to close the public hearing, second by Trustee Treacy and motion carried 5-0. Approval of Minutes Trustee Hyland moved to approve the minutes of October 1, 1991 as written, seconded by Trustee Timmings and motion carried 4-0 with Trustee Treacy abstaining. Approval of Warrants Trustee Hyland moved to approve the warrants and authorize the Treasurer to pay the bills, second by Trustee Timmings and motion carried 4-1 with Trustee Treacy voting No, Total of the General Fund is $151,559.05 and the Water Department Fund is $39,186.35. Communications,Petitions & Requests Deputy Clerk was in receipt of a letter from Kitty Fries requesting the use of our premises on Election Day, November 5th from 6:00AM to 9:00PM. Trustee Hyland moved to approve this request, second by Trustee Treacy and motion carried. Deputy Clerk read attached correspondence from the Fire Council regarding action which took place at their meeting and their recommendation that Mr.Stiloski's title be changed from Code Enforcement Officer to Fire Inspector. Trustee Hyland moved to 1 �approve the action which took place, seconded by Trustee Timmings and motion carried. Discussion ensued regarding the title change and the Board will take up the matter at their next work session. Public Comments Don Caetano of Lawrence Avenue wanted to know if there was a suit against the Village regarding ETPA. Village Attorney stated that there is a lawsuit pending and we are awaiting a decision,but could not discuss it further. He also addressed the attorney asking if any village official has the right to give confidential information to anyone in our community. The Attorney stated it depends on the circumstances but he cannot give individual legal advice at a meeting. James Tierney wanted to know if anything is being done on his previous request for exemptions for tenants who are senior citizens. The Village Attorney asked the Board to put this on the agenda for the next work session. There being no further comments, Trustee Hyland moved to adjourn the public comment section, second by Trustee Nazemetz and carried. Administrator's Report William Regan reported that he sent out notices to all the Fire Departments in the County and advertised in several publications for the sale of the old Columbia Hose fire pumper. The minimum bid will start at $22,500* and bids will be opened on November 14 at 11:00 AM. He has received a memo from Henry Atterbury regarding the Little League Field at Devries Park stating that the Recreation Commission has voted to name the new field the "Joe Quattro Memorial Field" in honor of the past Recreation Director of the Village. The vote was 4-0 with one abstention by his sister. A date will be set for the dedication of the field. The Administrator and Trustee Treacy met with a representative of the Urban Development Corporation regarding our request for money for facade improvements on the Van Tassel building, storefronts, etc. We are waiting to hear from UDC in the near future. A memo was received from the Building Inspector regarding Mrs. Batchelder's request for a variance regarding the Sprinkler Code which was discussed at the last work session. The Administrator stated that perhaps a public hearing could be set to amend the Sprinkler Code. Trustee Nazemetz moved to call for a public hearing on November 6th to amend the Sprinkler Code , seconded by Trustee Treacy and carried. Since the next regular meeting is scheduled for November 5, 1991 which is Election Day, Trustee Nazemetz moved to change the regularly scheduled Board meeting to Wednesday, November 6th at 8:00 PM, second by Trustee Timmings and carried. Trustee Hyland reminded everyone that plastic recycling starts next Wednesday, October 23. 2 �Resolutions-Attached Old Business Trustee Nazemetz commented that he and Trustee Hyland attended a dedication of a statue on Sunday in Valhalla for fallen firemen. Andrew O'Rourke was the principal speaker. Trustee Treacy commented that as a Trustee he had requested a copy of an evaluation of an employee who had been terminated but has not received it as yet. He will file a freedom of information form to obtain this information. Trustee Treacy moved that the Board direct the Administrator to conduct evaluations of all employees, seconded by Trustee Alter and motion carried 5-0. New Business-Nona Public Comments Don Caetano wanted to know if any action has been taken by the Board regarding the employee who was brought up on charges filed by him and was fined in Court for disorderly conduct. The Administrator commented that he was aware of the problem but was not aware of any resolution of those charges. The Village Attorney stated it is a personnel matter and cannot be discussed at a public meeting. There being no further comments, Trustee Hyland moved to adjourn to Executive Session to discuss personnel and litigation, second by Trustee Timmings and motion carried. Executive Session Discussion ensued on the water department building purchase. Discussion ensued on a civil service personnel matter regarding a Code Enforcement Officer. Trustee Timmings moved to terminate the provisional appointment of Carmen Guarnieri as Code Enforcement Officer effective October 29, 1991 in accordance with Civil Service rules and regulations, seconded by Trustee Nazemetz and motion carried 5-1 with Trustee Hyland voting No. Discussion ensued on the changes that were made in the Detective Division of the Police Department. Discussion ensued on the salary for the position of General Foreman. A resolution was proposed by Trustee Hyland that the Board approve an annual salary of $48,000. for the position of General Foreman, seconded by Trustee Nazemetz; there was a tie vote and therefore motion did not pass. Trustees Treacy, Alter and Timmings voted No and Trustee Hyland, Nazemetz and Hayes voted Yes. After further discussion on the salary increase, Trustee Nazemetz moved that the Board of Trustees approves an annual salary of $46,500. for the position of General Foreman effective November 1, 1991. Said position currently being filled on an acting basis by Assistant Road Foreman Joseph DeFeo. Motion was seconded by 3 �Trustee Hyland and motion carried 5-1 with Trustees Nazemetz, Hyland, Timmings, Hayes, and Alter voting YES and ..Trustee Treacy voting NO. There being no further business, Trustee Nazemetz moved to adjourn the meeting, second by Trustee Timmings and carried 5-0. MOVED: Trustee Hvland SECONDED: Trustee Treacy VOTE: 5-0 �I Meeting Date: Resolution #s I 10/15/91 10/109/91 Trustee Treacy_moved to adopt the following resolution: RESOLUTION AUTHORIZING THE VILLAGE OF NORTH TARRYTOWN TO ENTER INTO AN AGREEMENT WITH THE COUNTY OF WESTCHESTER FOR THE PURPOSE OF UNDERTAKING A COMMUNITY DEVELOPMENT PROGRAM WHEREAS, the Secretary of Housing and Urban Development of the United States is authorized, under Title I of the Housing and Community Development Act of 1974 as amended, to make grants to states and other units of general local government to help finance Community Development Programs, and WHEREAS, Section 99-h of the General Municipal Law of the State of New York grants to any municipal corporation the power,either individually or jointly with one or more other municipal corporations, to apply for, accept and expend funds made available by the Federal government, either directly or through the state, pursuant to the provisions of any Federal law which is not inconsistent with the statutes or constitution of this state,in order to administer, conduct or participate with the Federal government in programs relating to the general welfare of the inhabitants of such municipal corporation, and WHEREAS, the Community Development Act of 1974 as amended, and any "Eligible Activities" thereunder are not inconsistent with the statutes or Constitution of the State, and WHEREAS, a number of municipalities have requested Westchester's participation, and the County of Westchester has determined that it is desirable and in the public interest that it make application for Community Development Block Grant funds as an Urban County, and WHEREAS, participation by the County of Westchester as an Urban County in the Community Development Program requires that the Village of North Tarrytown and the County of Westchester cooperate in undertaking, or assisting in undertaking, essential community development and housing activities, specifically those activities authorized by statutes enacted pursuant to Article 18 of the New York State Constitution. WHEREAS, this Board deems it to be in the public interest for the Village of North Tarrytown to enter into a Cooperation Agreement with the County of Westchester for the aforesaid purposes. NOW, THEREFORE, BE IT RESOLVED, that Frank J. Rev. Mavor be and hereby is authorized to execute a Cooperation Agreement between the Village of North Tarrytown and the County of Westchester for the purposes of undertaking a Community Development Program pursuant to the Housing and Community Development Act of 1974 as amended.
