On Tuesday, Janaury 19, 1993 at 10:00 AM a public opening of bids
took place in the Municipal Building, 28 Beekman Avenue, North
Tarrytown, New York to provide towing services to the Village.

A Regular meeting of the Board of Trustees of the Village of
North Tarrytown was held on Tuesday, January 5, 1993 at 8 PM.
Present:

Pledge
Mayor Rey called the regular session to order with a pledge to
the flag. He asked that everyone remain standing for a moment of
silence for several residents who passed away recently; Evelyn
Beckman, Edward Fahey, George Kuntz, Frank Tally, Paul Ranieri,
Joseph Frascati, who was Judge Frascati's father and Joseph
Caputo, Mayor of Ossining.
Public Hearing
Mayor Rey read the attached public hearing notice. Trustee Hyland
moved, second by Trustee Timmings to open the public hearing,
motion carried.
Mario Belanich of N. Washington Street commented that he did not
feel that there was any problem with the zoning notices being
hand delivered as well as being mailed return receipt.
Village Attorney stated that this is a recommendation from Zoning
Board of Appeals. They have been encountering some difficulty at
recent meetings where individuals have stated that they have
given personal notice but do not have proof of that notice and
were suspicious that some applicants were not actually hand
delivering these notices. With return receipt, it is more
restrictive.
Sean Treacy of Tappan Avenue asked what was done to those
applicants who did not hand deliver the notices.
Village Attorney stated that since it was only a suspicion, they
had to re-notice, make sure it was done properly and the
applicant would appear before the Zoning Board again.

�There being no further comments, Trustee Hyland moved, seconded
by Trustee Timmings to close the public hearing, motion carried.
Approval of Minutes
Trustee Hyland moved, second by Trustee Cicchetti to approve the
minutes of the December 15, 1992 as written, motion carried
unanimously.
Approval of Warrants
Trustee Hyland moved, second by Trustee Timmings to approve the
warrants and authorize the Treasurer to pay the bills, motion
carried unanimously. Total of the General Fund is $241,422.72
and the Water Department fund is $7,556.24.
Communications, Petitions and Requests
Deputy Clerk was in receipt of correspondence from Jeanne
Mettler, representing Embassy Bar informing the village of their
intent to renew their liquor license. (Referred to Police Chief)
Deputy Clerk read attached correspondence from the Fire Council
regarding action taken at their December 8th meeting. The Board
will discuss the Fire Council's requests at the work session.
Public Comments-Agenda Items Only
Trustee Treacy asked why there was nothing on the agenda for the
purchase of the foreman's vehicle; it seems to be taking a long
time to decide on the purchase of this vehicle.
The Mayor responded that it will be purchased once the Board
formally adopts a resolution; the price of the vehicle discussed
at the work session was over the line item in the budget.
Trustee Timmings commented that the vote at the work session was
only a consensus of the Board, not a formal vote.
Sean Treacy commented that he heard the Village Attorney's bills
are very high.
William Regan stated the attorney's bills are currently within
the budget. A new monthly expenditure report for December will be
available in a few days.
Mr. Treacy commented that he heard an agreement has been reached
with General Motors and hoped that it was in line with the
original projection of $60,000. per year. He wanted to know why
there was an executive session before the meeting started since a
meeting must be opened first and wanted to know what as
discussed.
Village Attorney commented that the executive session is on the
agenda and is carried over from meeting to meeting which is
adequate notice.
Mayor Rey commented that with regard to the rail facility, the
plant manager and Assessor must discuss this with the authorities
before any final decision is made. He stated that discussion on a
litigation matter took place in executive session.

Mario Belanich asked that when public comments are to be on
agenda items only, they shouldn't let people speak on other
subjects.
There being no further comments, Trustee Hyland moved, second by
Trustee Timmings to close this section, motion carried.
Mayor's Report
Mayor Rey thanked our fire department' and all the fire
departments that helped us when we had all the problems with the
water main breaks. He thanked IBM for letting the hospital U S Q
their water during the time they had no water and thanked all the
merchants for providing coffee and donuts to our men who worked
endlessly to solve the problems.
The Mayor commented that they met with GM representatives
regarding the rail facility and we are very near agreement. The
final figures should be available by the next meeting.
Mayor Rey commented that with regard to the purchase of the car,
a police package was suggested but it was not in the budget, and
this was not the direction we should pursue. Unless a motion is
put forth, we cannot go forward to purchase the vehicle.
Administrator's Report
William Regan reported that he and the General Foreman met with a
representatives of the Federal Emergency Management
Administration (FEMA) regarding the storm of December 11 and 12,
1992
when Westchester County was declared a disaster area,
making private property owners as well as governments eligible
for some assistance. The Administrator and the General Foreman
feel the breaks were related to this storm due to the undermining
of the pipes, therefore we are preparing the expense
documentations needed to obtain some monetary assistance.
Mr. Regan commented that Mr. Temple of the Department of
Transportation will meet with the Board on January 12, 1992 at
their work session to answer more questions regarding the work to
be done on Route 448.
Mr. Regan reported that there is a resolution on tonight's agenda
awarding a contract proposal to James Hahn Engineering. Requests
for proposals were sought to prepare a water supply emergency
plan as required by NY State law and mandated by the County
Department of Health.
The County has additional money available up to $100,000. to
continue the sidewalk project further down Beekman Avenue to
Kendall Avenue on one side and to the church on the other side;
this will be done at a small cost to the Village. This will be
put on the work session agenda.

Trustee Cicchetti moved, second by Trustee Hyland to add other
resolutions to the agenda. Resolution #01/09/93 is attached.
Trustee Hyland moved, second by Trustee Cicchetti that the
Administrator be directed to purchase the Caprice vehicle that
was discussed at the last work session and agreed upon by the
Board of Trustees. After a brief discussion a roll call vote was
taken and motion failed on a tie vote.

Public Comments
Sam Gittens of 100 College Avenue wanted to know why there was
such a problem with purchasing a car or a truck.
Mayor Rey commented that the blazer was $18,000. which was over
the budgeted figure.
Trustee Hyland commented that the original budget item was for
$18,000. four-wheel drive which fits into the realm of the
highway department vehicles.
Trustee Timmings commented that the purchasing of the vehicles is
getting too complicated and it is not just the purchasing of any
vehicle but a particular vehicle for one person.
Mario Belanich of North Washington Street wanted to know when he
would find out what the legal procedure would be in order to
reduce the number of Trustees from six to four members and how it
could get on the ballot for the election.
Village Attorney commented that reduction of the number of
trustees can be done either by a petition or a vote by the Board
of Trustees. He suggested that Mr. Belanich contact the Board of
Elections for this information and that unless the Board directs
the Attorney to do so, he cannot follow through on this.
After more discussion, the Mayor commented that he would contact
the Board of Elections for Mr. Belanich.
Mr. Belanich asked if all the meters will eventually be replaced.
William Regan explained that there was some money in the Capital
budget for meters and the Village went out to bid for new ones
and awarded it to the lowest bidder. We are very happy with this
company and will be replacing the old ones, when they break down
since it has been difficult to get parts for the old-meters.

Sean Treacy of Tappan Avenue asked if the results of the lead
testing that was recently done throughout the village would be
made available to the public.
William Regan commented that tests were done on a volunteer basis
and he was not sure whether this information will be available to
the public or only to those residents who volunteered in the
program since they may not want their lead content made public.
Village Attorney commented that the overall results of the test
will probably be made public but not individual results.
Mr, Treacy commented that a Ford Taurus for $10,500. which was
mentioned as a possible vehicle for the foreman was under the
budgeted figure and it should be purchased.
Mr. Treacy was very pleased that the Beekman Avenue project was
being extended further down the avenue.
Tom Wester of Beekman Avenue commented that he had copies of the
Miller report available for the public.
Sam Gittens asked about the status of the Greenway project; the
Mayor replied that it is in the hands of the State now.
James Tierney Of 2 55 N. Broadway requested that the Board
purchase a thermostat that could be used to measure the
temperature in an apartment for three consecutive days when there
are "no heat" complaints.
There being no further comments, Trustee Timmings moved, second
by Trustee Hayes to close the public comment section, carried.
Trustee Cicchetti commented that he had some new business which
he neglected to mention. He would like to discuss at the work
session the possibility of having a policy performance appraisal
of the employees of the Village, the request by the Sleepy Hollow
Manor Taxpayers Association for a stop sign and speed limit in
the Manor, and to discuss the Fire Council's requests.
Village Attorney suggested inviting the members of the SHMTA to
the work session.
Trustee Timmings commented that he has received a request from
the Recreation Commission to discuss at the work session the
Scenic Hudson Proposal for the park across from the highway
department.
Trustee Timmings moved to adjourn the meeting, second by Trustee
Alter and motion carried.

WHEREAS, the Village Board of Trustees is entering the adoption
of the proposed "North Tarrytown Environmental Protection and
Abandoned Industrial Property Reclamation Law"; and
WHEREAS, the proposed local law would affect property which is
wholly or partially within the Hudson River Shoreline Critical
Environmental Area designated by the Westchester County Planning
Board, thereby making the adoption of the proposed local law a
Type I action in accordance with the state Environmental Quality
Review Act (SEQRA).
NOW, THEREFORE, BE IT RESOLVED, that the Village Board of
Trustees hereby declares its intent to be the Lead Agency in the
environmental review of the adoption of the proposed local law
for the purposes of SEQRA; and
BE IT FURTHER RESOLVED, that the Village Board of Trustees hereby
directs the circulation of the declaration of its intent to be
