Board Members Present: Also Present: Mayor Frank Rey Trustee Hyland Trustee Timmings Trustee Hayes William T. Regan, Village Administrator Robert Balog, Village Assessor IN THE MATTER OF DEMETRIOS KRINGAS, 14 9 WEBBER AVENUE, NORTH TARRYTOWN, NEW YORK(Sections 17-04-5C, 17-04-5.C2 and 17-04-5.C3) Mrs. Pat Kringas and Mr. Demetrios Kringas came before the Board. Mrs. Kringas stated that Mr. Kringas owns three parcels of land which he has been taxed heavily in the past and feels that his taxes should be reduced more than slightly. Mr. Kringas would like a fair hearing since he has been paying taxes for 33 years, he is a senior citizen and on a fixed income. (Letter attached) Mr. Balog suggested to Mrs. Kringas to submit more detailed information which would help the process. Mayor Rey stated that when all the data is put together a review will be completed. IN THE MATTER OF DONALD AND KATHERINE CAETANO, 4 3 LAWRENCE AVENUE, NORTH TARRYTOWN, NEW YORK (Sections 15-13-28 and 15-14-09). Mrs. Caetano stated that by comparing other parcels, parcel number 15-13-19 is a four family house with garages and is assessed at $88,600, whereas the 15-13-28 parcel is a single family home without a garage and is assessed at $90,000. Mrs. Caetano feels that the assessment should be lower than $88,600. In comparing parcel number 15-14-09 with other parcels, 15-13-19 as stated above is assessed at $88,600 and parcel number 15-13-27 is a five family home which is assessed at $91,400. Mayor Rey stated that Mrs. Caetano's grievance will be reviewed and addressed. Balog Village Assessor Village of North Tarrytown North Tarrytown, N.Y. 10591 Dear Mr. Balog, I believe the new tax assessment on my property, 149 Webber Avenue is excessive. Recently, I subdivided my property, the new tax assess ment should reflect a reduction of over 10,000 square feet. For years I have paid heavily on my property. Now that I have built, The value that kept my taxes so high previously has only been reduced slightly, fl| M £ I am a senior citizen and on a fixed income. I have paid taxes for 33 years and I believe I need a fair hearing for the following reasons: 1) The assessed value has been reduced to 238,200 a net change of 26,800. This minor adjustment is so small when you consider the entire property. The assessed value must be lowered proportionately to the entire property. 2) The currant occupants of 149 Webber Avenue no longer have access to the front of the property for recreation or gardening uses. 3) The front property now has two homes on it which obstructs the view and venues for the occupants of 149 Webber. 4) Since the addition of the two homes on the front property it has caused the area to be of greater density of people and activity. Thank you for your consideration of my request and I hope and pray for a significant change in the assesed value. Rey James J. Timmings, III Steven Baderian Michael Hyland John T. Hayes, Jr. Trustees Also Present: William T. Regan, Village Administrator Robert W. Spencer,Village Attorney Absent: Nicholas W. Cicchetti Morris Alter Trustees Mayor Rey called the meeting to order at 7:00 PM. Trustee Hyland moved, second by Trustee Timmings to go into executive session to discuss litigation and personnel. Discussion ensued on the settlement of a claim. Trustee Timmings moved, second by Trustee Hayes to authorize the payment of $1003.33 to Jose Chavez in full settlement of the claim of January 6, 1993. Motion carried 4-0. Discussion ensued on tuition reimbursement for Detective James Reddy. Trustee Baderian arrived during this portion of the executive session.Attached resolution #02-36-93 was approved 5-0. Pledge Mayor Rey called the regular session to order with a pledge to the flag. He asked that everyone remain standing for a moment of silence for William Amato, Paul Singer and Ray Dool who passed away. Public Hearing Mayor Rey read attached public hearing notice regarding amending Section 62-44 of the Zoning Code. Trustee Timmings moved, second by Trustee Hyland to open the public hearing, motion carried. Trustee Baderian commented that this hearing was for the purpose of increasing the time for an applicant before the Zoning Board to give notice to all owners situated within two hundred feet of his property. There were no comments from the public. Trustee Hyland moved to close the hearing, second by Trustee Timmings and carried. Approval of Minutes Trustee Hyland moved, second by Trustee Hayes to approve the minutes of February 2, 1993 with minor additions; on page two, paragraph seven, the Mayor asked that a copy of the letter of appreciation from Phelps Memorial be given to the fire department and water department, on page three, paragraph eight, Mayor Rey commented that the vehicles are for official use only and should not be taken out of Westchester on personal business. Under discussion of the General Motors rail facility, Mayor Rey 1 �commented that he did not feel it was appropriate for Mr. Treacy to use this meeting as a political forum. With these additions, motion carried unanimously. Trustee Hayes moved, second by Trustee Baderian to approve the minutes of the Special Meeting of February 9, 1993. Since Trustees Hyland and Timmings were not present at that meeting, Trustee Hayes moved, second by Trustee Baderian, to table the approval of these minutes until the next meeting, motion carried. Approval of Warrants Trustee Hyland moved, second by Trustee Timmings to approve the warrants and authorize the Treasurer to pay the bills, motion carried unanimously. Amount of the General Fund is $89,864.30 and the Water Department Fund is $3,836.33. Communications, Petitions, & Requests Correspondence has been received from the Fraternal Order of Eagles informing the Village of their intent to renew their liquor license. (Referred to Police Chief) Attached correspondence was read from the Fire Council; Trustee Hyland moved, second by Trustee Timmings to approve the action taken by the Fire Council at their meeting of January 9, 1993, motion carried. William Regan read correspondence from the Fire Council regarding the numbering of buildings in the Village. (Will be discussed at the next work session) Mayor Rey was in receipt of a letter from Westchester County regarding the proposed reclamation law. They had no comments on the proposed local law at this time. Public Comments-Agenda Items Only Sean Treacy of 25 Tappan Avenue commented that there was nothing on the agenda regarding the cable franchise fee. The Mayor responded it will be at the next meeting. Doug Guthrie of Continental Cable asked about the cable franchise fee hearing. Trustee Timmings commented that the public hearing will be held on March 2, 1993 and Mayor Rey stated that Mr. Guthrie was welcome to attend the work session on February 23rd. Sean Treacy made a comment with regard to resolution #02-35-93, stating that we should reduce spending instead of being so dependent on the sales tax revenue. Mayor Rey stated that even though the tax base was zero last year, we did increase services. Mayor's Report Mayor Rey commented that he has written to Michigan to request the ruling by the judge in the case of Willow Run against General Motors. Then Village Counsel and the Board can review the decision to see if it will be applicable in our situation with 2 �3& General Motors. The Chief Executive Officer of General Motors has agreed to meet with the State Task Force along with Mr. Tese, William Regan and the Mayor. Administrator's Report William Regan reported on the change in the garbage pick-up schedule due to the holiday. The Administrator suggested that the Board set a public hearing for the North Tarrytown Environmental Protection and Abandoned Industrial Property Reclamation Law. Discussion ensued on when this hearing should be held. Donald Stever, an environmental attorney who is helping the Village with this proposed law, commented that he would not be available on March 23rd. Trustee Timmings moved, second by Trustee Hayes to change the regular Board meeting "from March 16th (Election Day) to March 17th; motion carried. Trustee Timmings moved, second by Trustee Baderian to set a public hearing for the North Tarrytown Environmental Protection and Abandoned Industrial Property Reclamation Law on March 17, 19 93 at 8 PM; motion carried. William Regan read the Zoning Board agenda for February 17th at 8 PM, the Planning Board agenda for February 18th at 8 PM and the Architectural Review Board agenda for February 24th at 8 PM. Resolutions-Attached Trustee Timmings moved, second by Trustee Hyland that the proposed local law that was the subject of tonight's public hearing,is a Type 2 action under the Quality Review Act and will not negatively impact the environment, motion carried. Resolution # 02-38-93 Trustee Timmings moved, second by Trustee Hyland that after a public hearing was held, the Board of Trustees does hereby adopt Local Law #3 of 1993 amending the Zoning Code to provide a minimum notice to property owners and the public of a public hearing of the Zoning Board of Appeals, carried unanimously. Old Business Mayor Rey commented that he wrote a letter to Jennifer Clarke and Mike Temple from the state confirming the Board's action taken at the previous meeting. He has written a memo to Trustees Baderian, Hyland and Cicchetti on this matter and is awaiting their answer. New Business-None Public comments John Jadus, Co-chairman of the Noise that the Board would take the time to by the committee and make comments. attend their next meeting on February 3 and Litter Committee hoped read the minutes submitted He invited the Trustees to 25"th at 7:30 PM. �Sean Treacy commented that the Mayor did not mention a serious incident that took place involving one of our trustees and wanted to know if the Board was going to indemnify him. He felt that this trustee was not operating within the scope of his duties and that the Village should not get involved. Mayor Rey commented that they could not speak on this matter under advisement of our Counsel. Trustee Timmings commented that he wondered what Mr. Treacy1s motives were by bringing this up during election time. The Mayor commented that they would not make any further comments on this matter tonight, Frank Rizzi suggested that phe twenty-four hour metered parking behind the post office be eliminated to help people find parking spaces in the evening. * Ugo Checchi, Chairman of Parking Authority recommended that the Village contact the owner of the parking lot near Mallorys to see if the Village could use it for more parking spaces. Both of the suggestions will be discussed at the next work session. There being no further comments, Trustee Hyland moved, second by Trustee Timmings to close the public comment section, carried. There was an article in the news that a person died due to the fact that the ambulance could not locate the House as there were NO numbers on the houses on the street. NOW, THEREFORE, BE IT RESOLVED, the Board of Trustees hereby expresses its strong opposition to the enactment of A.1428/S.828 because of the aforementioned reasons and urges its state representatives to oppose this legislation which would take effect January 1, 1994, and BE IT FURTHER RESOLVED, a certified copy of this resolution should be forwarded to Governor Cuomo and each state legislator representing the Village of North Tarrytown.
