Present: Absent: Mayor Frank Rey Morris Alter Nicholas Cicchetti Michael Hyland John T. Hayes, Jr. Trustee James Timmings,III Trustee Steven Baderian Also Present: Trustees William T. Regan, Village Administrator Robert J. Ponzini, Village Attorney Board of Assessment Review At 7:15 PM Trustee Cicchetti moved, second by Trustee Hyland to go into the Board of Assessment Review meeting. The Village Assessor, Robert Balog presented the Board with the attached recommendations regarding the grievances filed against the tentative assessment roll. He commented that the reason for the denials are that the grievances are lacking in proof. The burden of proof rests with the homeowner or business. A letter will be written to all those who filed grievances once the Board makes its decision. Following a denial, a homeowner has the option to file a small claims assessment review or a business can file a certiorari petition. Trustee Hayes moved, second by Trustee Cicchetti to call for a Special meeting of the Board of Assessment Review on Tuesday, March 9, 1993 at 7 PM for the Board to make their decision on these grievances. Motion carried 4-1. Trustee Hyland voted No. There being no further business, Trustee Cicchetti moved, second by Trustee Alter to adjourn this meeting; motion carried. Executive Session At 7:30 PM Trustee Cicchetti moved, second by Trustee Alter to go into executive session to discuss real property, personnel and advice of Counsel; motion carried. Discussion ensued on these matters but no formal action was taken. Pledge Mayor Rey called the regular session to order at 8PM with a pledge to the flag. He asked that everyone remain standing for a moment of silence for Joseph Blascik, Agnes Scogna, Flora Luberger, Edna Cahill, Andrew Balog and Brian Casey who passed away recently. Public Hearing Mayor Rey read the attached public hearing notice regarding the proposed increase in the cable franchise fee. 1 �Trustee Hyland moved, second by Trustee Alter to open the public hearing; motion carried. Dr. Richard Sweet of N. Washington Street commented that he heard that cable television and television in general are garnering a 40 to 50 percent profit in their operations. Representatives from Continental Cable were in the audience but did not have any comments since they were present at the Board's work session on February 23 when they made their position clear. There being no further comments, Trustee Hyland moved, second by Trustee Alter to close the public hearing, motion carried. Mayor Rey commented that we will set this aside until the next Board meeting and will advise Cable of the effective date of any changes. Approval of Minutes Trustee Hyland moved, second by Trustee Hayes to approve the minutes of the Special meeting of February 9, 1993 as written; motion carried unanimously. ' Trustee Hyland moved, second by Trustee Hayes to approve the minutes of the February 16, 1993 meeting. Since Trustees Cicchetti and Alter were not at that meeting they could not vote, leaving no quorum. Trustee Hyland moved to table this motion until the next meeting, second by Trustee Cicchetti and carried. Trustee Hyland moved, second by Trustee Cicchetti to table the approval of the minutes of the February 16, 1993 Grievance Day hearing for the same reason as above; carried. Approval of Warrants Trustee Hyland moved, second by Trustee Hayes to approve the warrants and authorize the Treasurer to pay the bills; motion carried unanimously. Total of the General fund is $127,967.28 and the Water Department fund total is $10,266.87. Mayor Rey commented that to date we have underspent our budget figure. Communications,Petitions & Requests Deputy Clerk read correspondence from Sushi Raku, Inc. informing the Village of their intent to renew their liquor license. (Referg to Police Chief) I Mayor Rey was in receipt of correspondence from the New York | Guard inviting the Board to their 75th Anniversary ceremony on Sunday, May 2, 1993 at 12 Noon at the Sleepy Hollow Cemetery. Public Comments-Agenda Items Trustee Hayes moved, second by Trustee Alter to open the public comment section; motion carried. There being no comments from the public, Trustee Cicchetti moved, second by Trustee Alter to close the public comment section; motion carried. 2 �I Administrator's Report William Regan reported that Election Day will be held on Tuesday, March 16, 1993 from 7 AM to 9PM, Registration Day will be held on Saturday, March 6, 1993 in the Justice Court from Noon to 5PM. He commented that the Board of Assessment Review met tonight to consider the grievances that were filed and have called for another meeting on Tuesday, March 9th at 7PM to decide on these grievances. Mr. Regan reported that he and the General Foreman have been in contact with Frank Chevrolet regarding his request for a loading zone in front of his property; put on work session agenda. William Regan commented that the trustees received a copy of legislation from North Castle regarding the numbering of buildings and has asked our attorney to draft appropriate wording for our village code; put on work session agenda. He commented that the Trustees have received a copy of the expenditure report through January 31st which reflects we are underspent by 2%. Mayor's Report Mayor Rey received correspondence from Westchester County making us aware that since we are a member of the Westchester Urban County Community Development Block Grant Program, we must designate a community volunteer to serve on an advisory committee. The Mayor has asked for suggestions from the Board. The Mayor and the Board have received an invitation to attend the D.A.R.E graduation on March 24th at 7 PM at the Sleepy Hollow High School auditorium. Resolutions- Attached Old Business Trustee Cicchetti commented that there will be an informal meeting of the CAC on Wednesday at 9 AM with Gus Beirne of GM to have preliminary discussions on possible ideas on the rezoning of the General Motors property. New Business-None Public Comments Trustee Hyland moved to open the meeting to public comments, second by Trustee Cicchetti and motion carried. Sean Treacy of 25 Tappan Avenue asked why the lawsuit against the Trustee was sent to the insurance carrier. He felt this Trustee was not acting within the scope of his duties as a Trustee. Mayor Rey commented that we cannot discuss this litigation matter at this time. 3 �i Robert Ponzini, Village Attorney, stated that as a Trustee Mr. Hyland has the right provided to him under the Indemnification Law of the Village and the Public Officers Law of the State of New York to have the lawsuit sent to our carrier so that we are not precluded from utilizing our insurance company by failure to notify them. If we did not notify them that Trustee Hyland is entitled to a defense we may be waiving that right and subjecting the Village to the possible loss of insurance benefits. They will be reviewing all the circumstances to make their determination, and until such time as we hear from our insurance company, the Village will not make a decision or comment on the case. More discussion ensued between Mr. Treacy and Mr. Ponzini who stated once again that he will not answer any legal questions while Trustee Hyland is involved in a lawsuit. Mr. Treacy asked about the agreement that was reached with GM regarding the rail facility. Mayor Rey commented that he met with the Board tonight. Having reviewed the recommendation from our Assessor following his work on this project with GM's Assessor, they were able to reach a designated value which will represent $25,000. to the Village for the years 1990, 1991, 1992, 1993, 1994, and 1995. The Village will receive payment retroactive for 1990 to 1993 in a lump sum. Mr. Treacy asked questions regarding the position of the Assistant Code Enforcement Officer such as when, why and how he was hired. He commented that this is a civil service appointment but no list was canvassed and he does not appear on the payroll. Mr.Treacy felt that this was a political appointment. The Mayor commented that this appointment was for special assignment when the Building Inspector and the Code Enforcement Officer requested help because of the large number of violations in the inner Village and he is certified by the State of New York. This is not political since a bi-partisan Board made this selection. Much discussion ensued between the Mayor and Mr. Treacy regarding this appointment. Trustee Cicchetti commented that this appointment was on a j temporary basis to help check the Building Inspector on all these violations and payment should not exceed $5000. The Mayor stated that he has only received about $1300. so far. I Don Caetano, 27 Lawrence Avenue commented that he heard that the Mayor wrote a letter to the Judge asking him to withdraw the charges against Mr. Rodrigues. Robert Ponzini stated again that the Board cannot discuss this case and has advised the Mayor and the Board of this. Mr. Caetano asked the Mayor if he didn't give Mr. personnel records of anyone in the Police Department. 4 Caetano �The Mayor commented that he could not answer that question. Don Caetano asked why the Mayor constantly brings up the fact that he is suing the Village. Mr. Caetano commented that the Mayor could get hurt by saying these things. Village Attorney asked what Mr. Caetano meant by the Mayor could get hurt. He asked if this was a physical threat to the Mayor. Mr. Caetano commented that he did not mean it in that sense, he meant that he could get sued. A heated discussion ensued between Mr. Caetano and the Village Attorney regarding the statement made by Mr. Caetano. Mr. Caetano commented that the Mayor has not done anything about illegal apartments in the Village or about those people who are not paying a fair market value on their assessment. There being no further comments, Trustee Hyland moved, second by Trustee Hayes to close the public comment section, motion carried. Executive Session Trustee Hyland moved, second by Trustee Hayes to adjourn to executive session. Trustee Hyland moved, second by Trustee Alter to approve the minutes of the Special meeting of January 26, 1993; motion carried. There being no further business, Trustee Cicchetti moved, second by Trustee Alter to adjourn the meeting; motion carried.
