Present: Mayor Sean Treacy Nicholas Cicchetti Greg T. Jeffers John T. Hayes, Jr. Morris Alter Steven Baderian Michael Hyland Trustees Also Present: William T. Regan, Village Administrator Donal M. Walsh, Village Attorney Pledge Mayor Treacy called the meeting to order with a pledge to the flag. Public Hearing Mayor Treacy commented the hearing tonight is a continuation of the public hearing for the proposed Environmental Protection and Abandoned Industrial Property Reclamation Law which will compel industrial owners to clean up the sites in a timely fashion after plants close. Trustee Cicchetti moved, second by Trustee Alter to open the public hearing, motion carried. Jerome Fine of Harwood Avenue asked if the clean-up would take place after the plant closes down; the Mayor responded the owners must give the village twenty-four months prior notice. There being no further comments, Trustee Hyland moved, second by Trustee Alter to close the public hearing, motion carried. Mayor Treacy read a letter from Donald Stever, author of the proposed law, commenting that the law as written now is ready for enactment. Attached resolution #05-68-93 was adopted. Approval of Minutes Trustee Hyland moved, second by Trustee Hayes to approve the minutes of April 13, 1993 as written; motion carried 4-0 with three abstentions. Trustee Hyland moved, second by Trustee Alter to approve the minutes of April 20, 1993 as written; motion carried 5-0 with one abstention. Approval of Warrants Trustee Hyland moved, second by Trustee Jeffers to approve the warrants and authorize the Treasurer to pay the bills; motion carried 6-0. Mayor Treacy stated that a check for $30,000. payable to Duracell will not be issued until we receive final paper work. The total of the General fund is $106,714.67 and the Water Fund total is $9,778.06. Communications,Petitions & Requests Attached correspondence from the Fire Council was read requesting permission to take Rescue Hose fire truck, three chiefs' cars and the color guard to a parade to be held in Montrose on August 14, 1993. Trustee Hyland moved to grant them permission, second by Trustee Jeffers and carried. Mayor Treacy read correspondence from Frank O'Brien on behalf of the Ancient Order of Hibernians requesting permission to hold an Irish Cultural Day Street Festival on July 11, 1993 from Noon to 6 PM on Beekman Avenue between Teresa Street and Kendall Avenue and to close the street in that area. This will be discussed at the next work session. Correspondence was received from Senator Suzi Oppenheimer regarding S.828, a budget bill that would terminate the assessing unit status of villages. -1- �The Mayor read correspondence from Mr. & Mrs. Charles Shibetti and Mrs. Grace Buonnano residents of Dell Street, requesting the village continue the wall which abuts their property and the Pocantico River. (Put on next work session agenda). Mayor Treacy read attached correspondence from the Fire Chiefs requesting that the Board reconsider their decision not to replace the Chiefs' cars and not to purchase a new one. Public Comments-Agenda Items Edna Belanich commented on the resolution regarding the renewal of the SPCA contract. Since we no longer have a dog warden, she wanted to know who would respond to a stray dog in our village. The Administrator stated that the Town of Mt. Pleasant animal warden will respond if you contact our police department. Sam Gittens, 100 College Avenue asked where the village would get money to purchase a new car for the Fire Chiefs. The Mayor commented that there is no money in the budget and this was discussed with the Fire Chief at a work session. Their letter shows their displeasure with the decision of the Board. Don Caetano of Lawrence Avenue commented that in some villages, the Fire Chiefs use their own car and attach a siren to the roof when on a call. Trustee Hyland moved, second by Trustee Alter to close the public comment section, motion carried. Mayor's Report Mayor Treacy reported that he and William Regan met with Barbara Fratiani of the County Executive O'Rourke's office to discuss ways which the County may be able to help the village. There is a need for Spanish recycling informational flyers, funding for the COC and Community Development Block Grant monies. They discussed the proposed Greenway Project. Ms. Fratiani felt the County would be very supportive of the project. He met with Ellen Hanig regarding the Greenway Project. There are questions that need to be addressed by the Board such as the condition of the bulkhead, access through the GM and Cooney properties, storage of sand and salt, storage of our vehicles, location of the recycling center, etc. Mayor Treacy met with Joseph Lillis of Tarrytown Schools to discuss GM and related problems. The Mayor urged everyone to vote in the May 19 school election. Mayor Treacy received a letter from Gus Beirne, GM Plant Manager, stating that Rick Zablocki has been chosen as the GM representative regarding the selection of an Assessor for the rail facility. He will provide the information requested as soon as representatives from all parties have been identified. He reported that the Local Task Force will meet on. May 10th. On May 18th a community forum will be held for officials from various levels of the state regarding future uses of the GM site. Mayor Treacy stated that he would make his committee appointments tonight, but Trustee Hyland wanted to table the appointments until the Trustees had a chance to discuss his appointments. The Mayor commented that he wanted to move forward with these appointments; a majority were reappointments and if the Trustees were not in favor of certain appointments, they could vote it down. More discussion ensued and Trustee Hyland moved, second by Trustee Jeffers to table the appointments until the next meeting, motion carried 6-1 with Mayor Treacy voting No. Since the appointment of Deputy Mayor was a Mayor's appointment, Mayor Treacy appointed Trustee Alter. Andres J. Valdespino was appointed as Acting Village Justice for a term of one year at a special meeting held on April 27th because we needed someone to fill in for Judge Frascati last week. �i 31. The Mayor appointed the following residents to the Phelps Hospital Incinerator Impact Committee: LIAISON: Trustee Greg Jeffers S.H. Ronald Grant, William Rodrigues, Urs Furrer Trustee Hayes asked that Briggsville residents be appointed to this committee and he would recommend names to the Mayor. The first meeting will be held on May 20th at 8 PM in Village Hall. Trustee Reports Trustee Cicchetti distributed to the Trustees the draft response to the LWRP questionnaire and gave a brief overview of the draft. Trustee Alter reported that the TNT is in full swing. We need a few more women to join softball; on Saturdays Tiny Tots ages 3 & 4 play ball; day camp begins July 6-August 13 for ages 5-11 and tot camp which is for ages 3 and 4 is already filled. Administrator's Report William Regan read the agenda for the Zoning Board meeting to be held on May 19, 1993 at 8 PM; Planning Board will be held on May 20th at 8 PM and the ARB will meet on May 26th at 8 PM. Mr. Regan reported that a Recycling Seminar will be held at the County Center on June 16, 1993 from 6 PM-10PM for the owners of multi-dwelling buildings. He has sent the flyer to the owners of all our large apartment buildings. The Administrator commented that there is an ongoing problem at the Recycling Center with illegal dumping especially in the evening and on weekends. We may have to consider fencing the area in and locking it after work hours. William Regan stated that everyone is urged to recycle their grass clippings by leaving them on the lawn. Resolutions-Attached Old Business-None New Business-None Public Comments Sam Long, representing the residents of the Van Tassel Apartments presented the Board with a petition urging the Police department to patrol Beekman Avenue to enforce the noise and litter ordinances. Most problems happen at night in the warm weather. Mayor Treacy commented that he will speak to the PBA president and the Police Chief about this problem, not only in the Beekman Avenue area but throughout the village. -3- �« Frank Occhipinti, Ugo Checchi, Don Caetano and Mario DIFelice made comments regarding the Hyland lawsuit. Mayor Treacy commented since this was a litigation matter, he would only say that the Board voted to defend Trustee Hyland. Emil Imhof of 95 Beekman Avenue requested that the Board erect signs throughout the village stating "that there will be a $50. fine if someone does not obey the pooper-scooper law. Mario Belanich commented on the Halpern lawsuit:. Mayor Treacy commented that since this was a litigation matter, it could not be discussed. Mr. Belanich asked if the village could put a moratorium on tax-exempt property; the Mayor responded this is not allowed by law. Sam Gittens asked if a fine of $100. could be imposed on loud noises outdoors, such as noises from boom boxes. The Mayor stated that we need to have a decibel meter to determine the frequency level of the sound. Tom Wester, Beekman Avenue commented that he thought it was a good idea that Tarrytown and North Tarrytown were exchanging services, etc. such as letting Tarrytown police use our firing range in exchange for the use of the decibel meter. Mr. Checchi wanted to know if there was a demolition permit issued to the new owners of the Con Ed building on Cortlandt Street. Mayor Treacy stated that the permit was issued by the Building Inspector. Mrs. Belanich commented about the sign on that building. The Mayor stated that it is a temporary sign which is permitted for a short time. Edmund Stocklein offered the village a sound meter to enforce the noise ordinance; the Mayor stated that he did not think this particular kind would be admissible in court. There being no further comments, Trustee Alter moved, second by Trustee Jeffers to close the public comment section. Trustee Hyland stated to Mr. DiFelice and Mr. Checchi who had commented earlier of no such title as Police Commissioner; that a recent resolution stated quote "The Board of Trustees acting in their capacity as Police Commissioners, etc." Executive Session Trustee Hayes moved, second by Trustee Cicchetti to go into executive session to discuss a litigation matter but no formal action was taken. In Regular Session Trustee Jeffers moved, second by Trustee Alter to adjourn the meeting, motion carried. I can not believe we have members on the Board of Trustees who will not approve the purchase of a new vehicle for our department and want to get rid of two of our chief cars. Our second assistant chief car is old and needs to be replaced. Most of the other department heads have received new cars this year. Are we second class around our village? We a department who give our all 24 hours a day, 365 days a year while many of you are tucked in your beds, or eating a wonderful dinner with your wife's, or playing with your children. We are out answering the calls for help. Like a cardiac arrest and having a person die in your arms, or responding to a fire and due to the dangers of our job, wonder if we will ever see our families again. We as chiefs respond to every single alarm. Last year we answered 120 fire calls, 450 medical calls and several dozen investigations including mutual aids out of town. We run numerous errands for our department. We get equipment repaired, attend many meetings and seminars to better ourselves and our department. We keep on top of training for the fire and ambulance service. Our responsibilities are to many to list, with our mens safety at the top! You only get one shot in making the right decision when someone's life is hanging in the balance. We weigh these thoughts in our minds 24 hours a day. Our worries are great and our man hours that we give are astounding, we miss many hours of sleep, many meals with our families and spending time with our kids, we ask you for no praise or pat on the back and we realized this when we took on this volunteering job. We dedicate ourselves to our village, and save you many thousands of dollars from having to pay a department to do what we do for free.
