A regular meeting of the Board of Trustees of the Village of
North Tarrytown was held on Tuesday, June 1, 1993 at 8:00 PM.
Present:

Mayor Treacy called the meeting to order with a pledge to the
flag.
Public Hearing
Mayor Treacy read the attached public hearing notice regarding
prohibiting tattooing in the Village of North Tarrytown.
Mario Belanich wanted to know if people could go outside the
village to get a tattoo. The Mayor responded that this law only
applies to getting tattoos in the Village.
There being no further comments, Trustee Hyland moved, second by
Trustee Alter to close the public hearing. Resolution #06-79-93;
Trustee Hyland moved , second by Trustee Alter to adopt a local
law prohibiting tattooing in the Village of North Tarrytown.
Motion carried 5-0 with Trustee Baderian abstaining.
Approval of Minutes
Trustee Hyland moved, second by Trustee Cicchetti to approve the
minutes of the Special meeting of April 27, 1993; motion carried
5-0 with Trustee Baderian abstaining.
Trustee Hyland moved, second by Trustee Alter to approve the
minutes of May 18,1993; motion carried 4-0 with Trustees Jeffers
and Baderian abstaining.
Approval of Warrants
Trustee Hyland moved to approve the warrants and authorize the
Treasurer to pay the bills, second by Trustee Cicchetti and
motion carried 6-0. Total of General fund is $50,719.32 and the
Water Department total is $2242.00.
Communications, Petitions &amp; Requests
Deputy Clerk read attached correspondence from the Fire Council
regarding action taken at their meeting. Trustee Hyland moved,
second by Trustee Alter to approve the action taken and to grant
permission
to take the vehicles to the conventions.
Letter
regarding the code enforcement was discussed at the last work
session and the Board will give the fire department a breakdown
on the enforcement of the overcrowding that we have had in some
of the buildings throughout the village.

Mayor Treacy read correspondence from Bedford Park Associates
regarding a meeting with the Board to discuss potential alternate
uses of the former Pickwick Post property being proposed for a
car wash. Mr. Pateman will be asked to attend the next work
session to discuss this matter.
Public Comments-Agenda Items
Mario Belanich of N. Washington Street questioned Resolution #77
regarding the numbers listed next to ayes and noes. The Mayor
responded that these numbers only pertain to the blanks that must
be filled in when the resolution is adopted.
Frank Rey of Holland Avenue asked if resolution #78 was a bid
item since it was given to an out of town contractor. The Mayor
responded that this is not, it is a professional service and is
below the level that is required for normal bids. This was the
lowest proposal received.
There being no further comments, Trustee Hyland moved, second by
Trustee Jeffers to close this section; motion carried.
Mayor's Report
Mayor Treacy appointed Rita Pulsoni to the Handicapped Committee.
Trustee Hyland moved to approve this appointment, second by
Trustee Alter and carried 6-0.
Mayor Treacy appointed Sean McCarthy to the Architectural Review
Board. Trustee Hyland moved to approve this appointment, second
by Trustee Jeffers; motion carried 6-0.
Mayor Treacy reported that he received a copy of a letter
addressed to Phelps Hospital from the Department of Environmental
Conservation regarding their application for the proposed
incinerator stating that their application was incomplete.
Requirements such as the state environmental quality review
(SEQR), designating a lead agency and conforming with the
provisions of the State historic preservation act had not been
met. Mayor Treacy designated the Board of Trustees as the lead
agency for the SEQR process when the hospital applies for site
plan approval. He commented that the Phelps Incinerator Impact
citizens' committee, chaired by Andres Valdespino met on May 19th
and will meet again on June 2 when Sam Bishop, an environmental
expert will speak. The Mayor has spoken to Keith Safian and they
will try to convince the County to accept these alternate types
of medical waste. We will be meeting with our County Legislator
Swanson on June 10th to discuss this.
Mayor Treacy reported that he met with representatives of Union
State Bank who would like to help the residents of North
Tarrytown in the creation of affordable housing.
The Mayor attended a NYCOM seminar informing village officials of
a new insurance program called NY Municipal Insurance
Reciprocal(NYMIR)which is similar to the MEBCO insurance that the
village currently has. Will be discussed at the work session.

He met with George Delaney and Jeff Thompson of the Westchester
County Business Partnership to discuss the future of the GM
plant; they will help the village lobby for grant monies and lend
their support in getting the cooperation of higher officials.
The Mayor reported that we have received notice of a small grant
that we have received from the office of the aging.
Trustee Reports
Trustee Alter reported he was informed by a resident that there
was illegal use of the recreation field at Devries park over the
holiday weekend; large groups cooking, drinking, etc. He asked
that signs be posted to avoid this with the summer ahead and to
have the Chief of Police instruct his men to patrol that area,
Recreation Superintendent, Henry Atterbury has been awarded a
$1000. grant from the Greenway Heritage Conservancy to be used in
the development of a trail from Kingsland Point to Douglas Park.
Summer camp orientation was held on May 18th, men's softball is
in progress; teen dances are being held twice a month and have
been very successful.
A light was installed at Friendship Park by our highway
department; this should help alleviate some of the problems we
are experiencing at that park. Signs will also be installed.
The Recreation Commission plans to put a playground at the grassy
area of Devries field for children from five to thirteen years
old; also a playground at Douglas Park for children under five.
Henry Atterbury plans to write a grant from Westchester County
for between $5000.-$10,000. to be used for transportation for
different activities.
Trustee Cicchetti commented that the Police Committee should meet
with the Police Chief and the Administrator to discuss the
incident at Devries field and to prevent future problems.
The Anti-Noise and Litter Committee met last week with
Sgt.Caixiero to discuss enforcing the laws with regard to noise
and litter and many other concerns. Residents should call the
police anytime they have a complaint of this sort.
Trustee Hayes commented that the Mayor and Trustees attended a
Fire Department Memorial mass on Sunday at St. Teresa's church
and breakfast at the fire house after mass.
The Library Board held their organization meeting on May 20th and
will discuss fund raising techniques at their next meeting.
Trustees Jeffers, Baderian and Hyland had no report.

�Administrator's Report
William Regan read the Zoning Board agenda to be held on June
16th and the Planning Board agenda for June 17th. The ARB will
meet on June 23, 1993.
He reported that we have received price quotes for the painting
of the ambulance building, new floor and repair to overhead door.
The lowest quote for painting was $895. Only one price quote was
received for new floor and door repair. We are hoping to have the
work done by the end of June.
The police are doing a survey of buildings in the village to see
if the number on the buildings comply with the new law that was
passed. Owners will be notified if they are not. 911 goes into
effect on July 12th and the numbering of buildings is very
important. The size of the numbers should be no less than 3
inches.
Mr. Regan commented that he will be attending a meeting of MEBCO
on June 17th and will report back to the Board with any new
information.
The expenditure report through May 21st shows we have underspent
the budget.
Resolutions-Attached
Old Business
Mayor Treacy stated public hearings had been previously held on
the proposal of a Local Law to prohibit the installation and
maintenance of pay telephones on the exterior of buildings in a
C-l and C-2 zoning district. Resolution #06-80-93- Trustee Hyland
moved to adopt this local law, second by Trustee Alter and
carried 6-0.
New Business
Mayor Treacy commented that he received a letter from Sandra
Galef and Audrey Hofberg regarding the continuation of the sales
tax; put on the work session agenda.
Street festival meeting will be held on June 9th at 8 PM and
anyone wishing to help is invited to attend.
Public Comments
Ugo Checchi, 51 College Avenue asked about the proposed purchase
of the 52 College Avenue building. Mayor Treacy commented that a
group called ARCH would like to rehabilitate the building for
affordable housing for local residents with incomes of
approximately $25,000.-$40,000. but they would have to go for a
variance.
Mr. Checchi hoped that the Board would do everything in their
power to see that all ordinances are followed before this
building is rehabilitated.
The Mayor stated that the Zoning
Board has this power and will do whatever must be done.

�Miguel Jiminez showed the Board a portion of the awning torn off
from his store and commented there is also graffiti all over his
building. He urged the Board to enforce a tougher penalty for the
kids who are destroying property. The Mayor commented any person
caught putting graffiti on a building is subject to a summons or
even arrest.
Mario Belanich commented on the Trustee committees and felt that
certain Trustees have too much responsibility and others do not
have enough. The Mayor commented that he has had no complaints
from the Trustees.
Don Caetano asked about the Hyland lawsuit. The Mayor stated
that all he could say was the Board voted to indemnify him. Our
Village Attorney stated that this is a litigation matter and can
not be discussed.
Armando Galella commented that the lighting in the village needs
to be updated and would like the Board have Con Ed do a survey of
the street lights and have the trees trimmed that are blocking
the lighting, especially Depeyster, Broadway and Valley Streets.
Mr. Galella asked if the Administrator still held a part time
job; the Mayor responded No.
Frank Rey commented that the lot on the corner of Beekman and
Clinton Street looks like a junk yard and commented that he heard
the DEC had ordered the old Con Ed building sealed so that no
more work could be done on it.
Mayor Treacy stated that he will have the Building Inspector
follow up on the junkyard and the bricks on the side of the
Cortlandt Street building are not contaminated and building has
not been ordered sealed by the DEC. The Department of Labor has
found a very small amount of asbestos in the building and the
Church has hired a licensed company to remove the asbestos.
Mr. Rey suggested that the Church not be granted a tax-exempt
status since we already have a 64% tax-exempt status and proposed
that the Board pass a resolution to provide for no further
application for tax exemption for non profit status.
Donal Walsh stated that the Village does not have power of the
New York State tax law to make a decision as to whether or not
something is an exempt entity.
Miguel Jiminez commented that there is a need for a church in
this area for the Spanish people.
Mario Belanich commented that a garbage container is needed at
Sykes Park and a line should be painted down the center of
Cortlandt street coming out of Clinton down Cortlandt.

�Ugo Checchi asked why the benches at the corner of Beekman and
Pocantico Street were removed; the Mayor stated that the youths
were creating a nuisance in that area and at the suggestion of
the Anti-Noise and Litter Committee, they were removed.
There being no further comments, Trustee Jeffers moved, second by
Trustee Alter to close the public comment section; carried.
Trustee Jeffers moved, second by Trustee Alter to move into
executive session to discuss litigation and labor negotiations;
motion carried.
Discussion ensued on the Halpern lawsuit but no formal action was
taken.
Discussion ensued on negotiations with the Municipal Employees
Union but no formal action was taken.
Trustee Alter moved to adjourn the meeting, second by Trustee
Jeffers and motion carried.

PUBLIC HEARING NOTICE
VILLAGE OF NORTH TARRYTOWN
PLEASE TAKE NOTICE the Board of Trustees of the Village of North
Tarrytown will hold a public hearing on Tuesday, June 1, 1993 at
8 o'clock p.m. in Village Hall, 28 Beekman Avenue, North
Tarrytown, New York to hear and consider a proposed Local Law to
amend the Code of the Village of North Tarrytown to prohibit
tattooing in the Village of North Tarrytown except for medical
purposes.
Section I

FINDINGS: It has been the experience of other
municipalities that tattooing has led to increased
cases of serum hepatitis. It has also been their
experience that regulatory measures have proved
ineffective in eliminating this health risk because
of the inability to supervise tattooing
establishments at all times. The Village of North
Tarrytown also lacks the resources and personnel
to supervise tattooing establishments on an ongoing
basis. Accordingly,the Board of Trustees finds that
in this Village as in other communities, a ban on
tattooing except for medical purposes is the only
feasible means of protecting the public against
disease from this source.

Section II

PROHIBITION ON TATTOOING: It shall be unlawful for
any person to tattoo a human being within the Village
of North Tarrytown except that tattooing may be
performed for medical purposes by a person licensed
or otherwise authorized pursuant to the Education
Law to practice medicine or osteopathy.

Section III EFFECTIVE DATE:
immediately.

This Local Law shall be effective

All taxpayers, residents and parties in interest are entitled to
attend and be heard at said hearing.

in our multiple dewellings be addressed. We realize the great job done
by our code enforcement team, but it is not enough as there are more
problems that need attention. The above conditions are present at most
of our alarms in these multiple dewellings and we would like to avoid
a fatal tragedy.
We hope you will look into this matter immediately as fire strikes
without warning.

' TO ENTER INTO AN AGREEMENT WITH THE COUNT* OF WESTCHESTER
FOR THE PURPOSE OF UNDERTAKING A COMMUNITY DEVELOPMENT
PROGRAM
WHEREAS, the Secretary of Housing and Urban Development
of the United States is authorized, under Title I of the Housing
arid Community Development Act of 1974 as amended, to make grants
to states and other units of general local government to help
finance Community Development Programs; and
WHEREAS, Section 99-h of the General Municipal Law of
the State of New York grants to any municipal corporation the
jjower, either individually or jointly with one or more municipal
corporations, to apply for, accept and expend funds made
available by the Federal government, either directly or through
thu State, pursuant to the provisions of any Federal law which
is not inconsistent with the statutes or constitution of this
State, in order to administer, conduct or participate with the
Federal government in programs relating to the general welfare
of the inhabitants of such municipal corporation; and
WHEREAS, the Community Development Act of 1974 as
amended, and any "Eligible Activities" thereunder are not
inconsistent with the statutes or Constitution of the State; and
WHEREAS, a number of municipalities have requested
Westchester's participation, and the County of Westchester has
determined that it is desirable and in the public interest that
it make application for Community Development Block Grant funds
as an Urban County; and
WHEREAS, participation by the County of Westchester as
an Urban County in the Community Development Program requires
that the (3) Village of North Tarry town
a n d the County of
Westchester cooperate in undertaking, or assisting in
undertaking, essential community development and housing
activities, specifically those activities authorized by statutes
enacted pursuant to Article 18 of the New York State
Constitution,

WHEREAS, this Board deems it to be in the public
interest for the (4) Village of North Tarry town t o ©nter into a
Cooperation Agreement with the County of Westchester for the
aforesaid purposes.
NOW, THEREFORE, BE IT

is authorized to execute a Cooperation Agreement between the
(G) Village of N.;. Tarry t o w d the County of Westchester for the
