Present: Also Present: Absent: Mayor Sean Treacy Greg T. Jeffers Nicholas W. Cicchetti Steven Baderian Michael Hyland John T. Hayes, Jr. Trustees William T. Regan, Village Administrator Donal M. Walsh, Jr. Village Attorney Trustee Morris Alter Mayor Treacy called the meeting to order with a pledge to the flag. Public Hearings Mayor Treacy read the attached public hearing notice regarding a proposed local law to safeguard potable water supplies from potential contamination. Trustee Hyland moved, second by Trustee Hayes to open the public hearing; motion carried. Gary McLean and Dr. Richard Sweet of North Washington Street commented adopting this law was an excellent idea. Mr. McLean stated that it will be mandatory by 1994. Dr. Sweet commented that although smaller existing homes will not be required to install these devices, he suggested that they do so for their own protection. Mayor Treacy gave a brief summary of incidents that occurred throughout the County regarding polluted waters getting into the main water system. He commented that if we adopt this law now we will be moving ahead of the state's schedule. William Herlihy, Plumbing Inspector commented that this is a safety measure and that the State of New York will be sending us a newsletter which they put out with more information. William Regan commented that we are obligated now to adopt a local law for a cross connection program and to determine what buildings are considered hazardous in accordance with the State Department of Health guidelines. Those properties declared hazardous should have these devices installed now. There being no further comments, Trustee Hyland moved, second by Trustee Jeffers to close the public hearing, motion carried. Attached resolution #06-81-93 was unanimously passed. Mayor Treacy read the attached public hearing notice regarding the installation of a stop sign at the intersection of Depeyster and Cedar Street. 1 �Trustee Hyland moved, second by Trustee Hayes to open the public hearing; motion carried. Charles Zekus of 139 Depeyster Street commented that no one obeys the speed limit and a child was hit recently; something needs to be done and perhaps a stop sign will help. Trustee Hyland commented that he remembers the child being hit by a car; the stop sign is long overdue. There being no further comments, Trustee Hyland moved, second by Trustee Jeffers to close the public hearing; motion carried. Resolution #06-90-93 Trustee Hyland moved, second by Trustee Cicchetti to erect stop signs at the intersection of Depeyster and Cedar Street for vehicles proceeding eastbound and westbound; motion carried unanimously. Approval of Minutes Trustee Hyland moved, second by Trustee Cicchetti to approve the minutes of June 1, 1993; motion carried unanimously. Approval of Warrants Trustee Jeffers moved, second by Trustee Cicchetti to approve the warrants and authorize the Treasurer to pay the bills; motion carried 5-1 with Trustee Hyland voting No. Total of the General fund is $338,186.47 and the Water Department fund is $6,829.88. Communications Petitions & Requests Deputy Clerk read correspondence from Kail Development, Inc. informing the Village that they have renewed their wholesale beer license. (Referred to Police Chief) William Regan read correspondence from the Philipse Manor Improvement Association requesting permission of hold their annual 4th of July parade and picnic on July 3rd. Mayor Treacy read correspondence from Barbara Zegarelli, a resident of Amos Street on behalf of all residents in that area, requesting the Board consider reducing the speed limit to ten miles per hour and designating Amos Street a play street. The Board will discuss this at their next work session. The Mayor and Board of Trustees received an invitation from the North Tarrytown Fire Department Parade Committee to join in their first annual parade. The Recreation Commission met on May 26th to discuss Scenic Hudson. Correspondence was received from Ellen Scheinwald of 469 Munroe Avenue requesting a tree be removed across the street from her home. (Referred to General Foreman for review.) 2 �7* Correspondence was received from the Immaculate Conception Church requesting permission to hold their annual bazaar in August. (Resolution # 06-89-93 was passed unanimously.) The Mayor commented he has been invited to be the Grand Marshall in the annual PMIA parade to be held on Saturday, July 3rd. Public Comments-Agenda Items- None Trustee Hyland moved, second by Trustee Cicchetti to close this section; motion carried. Mayor's Report Mayor Treacy reported that the Street Festival committee met last week. They are in need of volunteers. The festival will be held on Saturday, September 11, 1993. The Mayor met with Jeff Beach of the Department of State to discuss his views on the Local Waterfront Revitalization Program. Mayor Treacy met with Tarrytown officials and Joseph Lillis of the School Board to discuss items of mutual concern to both villages. We will have a non-voting liaison from the village of Tarrytown on the GM Local Task Force and the Mayor hopes that both villages will meet on a quarterly basis to discuss issues. Mayor Treacy reported that he had some good news regarding GM. Governor Cuomo met with the Executive Vice-President of GM and they have agreed to pay for a broad comprehensive study for the future uses of the site and the surrounding area. General Motors and the DEC will do a multi-media test on the site which includes soil, air and water. The Mayor has approached GM with the idea of selling sections of their property gradually so that we can build up our tax base; for example selling the executive parking lot across the street from the plant. GM will look into this possibility. Trustee's Reports Trustee Jeffers reported our bond rating is just one level above what is considered junk rating which is a cause for concern. We will be keeping a close watch on it, but we cannot afford to spend the money at this time in order to raise the rate. Trustee Cicchetti reported he, Bill Regan, Police Chief and Henry Atterbury met to discuss the recent incident at Devries park. A sign reading "No Alcohol" and "Residents Only" has been posted. They suggested a sign "Permit Required" should also be posted and a group wishing a permit would obtain one from Recreation. Trustee Cicchetti stated that it has come to his attention that people are parking on Munroe Avenue and walking to Kingsland Point. Since the "No Parking" ordinance is not enforced in the Manor, residents must deal with the Philipse Manor Improvement Association about this problem. 3 �Trustee Cicchetti reported that graffiti is a criminal offense, punishable by arrest and a summons is issued for littering. He will report to the Board after the Anti-Noise and Litter meetings are held. Trustees Baderian and Hyland had no reports. Trustee Hayes reported the Library Board will meet on June 24th to discuss fund raising. He commented that the President of Hitachi who is returning to Japan, has written a letter which states that Hitachi has donated a gift of $10,000. to the Warner Library. The Fire Committee has met with the Fire Chiefs to discuss their equipment needs. The Chiefs will be meeting with manufacturers this week and they will bring back some figures at their next meeting. Administrator's Report William Regan read the Zoning Board agenda for June 16th at 8 PM and the Planning Board agenda for June 17th at 8 PM. The bids for the Beekman Avenue project will be opened on June 21st, therefore there will be a special meeting on June 22nd to award the bid. The Administrator commented that he has received proposals for painting of the ambulance building, new floor and repair to the door. William Regan commented that there are several programs available to the public through the County and the Village's membership in the Urban County Consortium if certain requirements are met. He gave a brief synopsis of each one. Anyone interested in any of these programs can contact him at village hall. Resolutions-Attached Old Business Trustee Hyland asked Village Counsel if it were legal to consolidate Village Prosecutor and Village Counsel into one office without a resolution. Donal Walsh answered M yes". Trustees Hyland and Baderian asked about appointments to the Zoning Board. Village Counsel stated that the Mayor has the power to appoint members to the Zoning Board of Appeals and the power to fill vacancies. Planning Board is different. A new law will be going into effect on July 1st regarding changes in the Planning laws. NYCOM has prepared a series of guidelines they will be sending us and we will be able to discuss it at the next work session. 4 �Mayor Treacy commented that he has asked Assemblyman Brodsky's office to send us copies of the changes in the Zoning and Planning laws in the State. One new law would allow the Board of Trustees to require Zoning Board members to take classes in zoning and the Mayor strongly recommended it. Trustee Cicchetti commented he was a little confused about the letter received from DOT regarding the 448 project and the relocation of the water main. The Mayor commented that he met today with members of DOT and a representative from Richard Brodsky's office and he has good information and will discuss this at the work session. Trustee Cicchetti commented that he would like to discuss the district tax at the work session; the Administrator stated that the Assessor is awaiting a response from the County. Trustee Cicchetti commented on a letter received from John Henry regarding the performance evaluation proposed for village employees. New Business Mayor Treacy reported that there will be a meeting on June 17th at 4:30 PM at Mt. Pleasant Town Hall with the Department of Transportation regarding the widening of Route 448 and a fifty-five mile an hour speed limit between Pocantico Hills and Pleasantville; on June 21st there will be a Town Planning Board meeting regarding the expansion of the Pace campus. Since there may be an increase in traffic in our village, they have invited our village officials to attend. Public Comments Mr. Kavicky asked when the cable rates will be decreasing and asked that the full stop at the Kendall Avenue extension be enforced. Mayor Treacy commented that the method of regulating these rates must be done on the local level. We will apply to the federal government for the power to regulate the rates. He has requested from Congressman Fish information informing the village how to obtain regulatory power. Richard Chulla presented correspondence to the Board from the Fire Council to be read later. Dr. Richard Sweet agreed that cable fees are very high. He mentioned the equalization rate regarding the PILOT agreement and commented that he appeared before a Mt. Pleasant Grievance committee and tried to appeal to the Board of Assessors regarding our portion of the special district taxes, but was unsuccessful. Trustee Cicchetti commented that the Assessor is still waiting for figures. 5 �Mayor Treacy read attached correspondence from the Fire Council regarding action taken at their June 8th meeting; Trustee Hyland moved, second by Trustee Cicchetti to approve this action, motion carried. There being no further comments, Trustee Hyland moved, second by Trustee Jeffers to close this section; motion carried. Executive Session Trustee Hyland moved, second by Trustee Cicchetti to go into executive session to discuss litigation, motion carried. Discussion ensued on the Brown and Wood lawsuit but no formal action was taken. There being no further business, Trustee Jeffers moved, second by Trustee Hyland to adjourn the meeting, motion carried. Chapter 2 6 Cross Connection Program SECTION 26-1- Purpose The purpose of this chapter is to safeguard potable water supplies from potential contamination by preventing backflow from a water user's system into the public water user's system and to comply with the requirements of the New York State Sanitary Code, Part 5, Section 5-1.31. SECTION 26-2- Check Valves and Backflow-Prevention Devices Required. A. Check valves or backflow-prevention devices conforming to the most current requirements of the New York State Department of Health and the Westchester County Department of Health shall be installed by the owner of those systems pursuant to the rules of those Departments in force at the time of the installation. B. Certificates of Occupancy shall not be issued by the Building Inspector for new or modified /renovated/ rehabilitated structures with hazardous systems without a letter from the Plumbing Inspector or his/her designee stating that the check valves or backflow-prevention devices have been installed. C. The cost to install the check valves or backflow-prevention devices shall be borne by the owner of the property. D. The Village's Plumbing Inspector or his/her designee shall make a determination as to whether or not a property owner requires a check valve or backflow prevention device and to the type of device (i.e. double check valve, reduced pressure zone backflow preventer, etc.) in accordance with the New York State and Westchester County Department of Health. SECTION 26-3- Upgrade of Pre-existing Systems. Any pre-existing systems that do not embody cross-connection control devices shall be upgraded so as to comply with the current requirements of the New York State Department of Health and the Westchester County Department of Health within sixty (60) days following the service of notice by certified mail to install check valves or backflow-prevention devices. �SECTION 26-4- Testing; Owner Liability for Costs. The testing of cross-connection control devices shall be performed on an annual basis by the owner of any system requiring same, and the cost of such testing shall be borne by the owner of the system. The testing procedures shall conform to the requirements of the New York State Department of Health and the Westchester County Department of Health. SECTION 26-5- Manual to be Prepared. The Plumbing Inspector or his/her designee shall develop a manual which shall provide the cross-connection program requirements for the Village of North Tarrytown. The Plumbing Inspector shall incorporate the requirements of the New York State Department of Health and the Westchester County Department of Health. SECTION 26-6- Penalties In addition to the penalties provided for elsewhere, the service of water to any premises may be discontinued by the water supplier, if check valves or backflow-prevention devices required by this chapter and regulations adopted pursuant thereto, are not installed, tested and maintained; if any defect is found in an installed check valve or backflow-prevention device; if it is found that a check valve or backflow-prevention device has been removed or bypassed; or if unprotected cross-connections exist on the premises; and service will not be restored until such condition or defects are corrected.
