Present: Mayor Sean Treacy Greg Jeffers Morris Alter Nicholas Cicchetti Steven Baderian Michael Hyland John T. Hayes, Jr. Trustees Also Present: William T. Regan, Village Administrator Donal M. Walsh, Jr. Village Attorney Pledge Mayor Treacy called the meeting to order with a pledge to the flag. Public Hearing Mayor Treacy read the attached public hearing notice with regard to increasing certain fees. Trustee Hyland moved, second by Trustee Alter to open the public hearing, motion carried. Mario Belanich of N. Washington Street questioned why the old fees were not listed on the notice and suggested this be tabled until the next meeting. The Mayor stated that it is not required by law. William Regan read a list of the current fees. Trustee Jeffers asked Mr. Belanich to try not to take up so much time by speaking on matters that are not important. The Board has alot of business to attend to; if he has a legitimate problem that needs to be addressed, the Board will gladly listen. Trustee Hyland objected to the $100. Zoning Board fee. Village Attorney stated that this fee is needed to help offset attorney's fees, staff time, etc. Don Caetano of Lawrence Avenue commented that in New Castle the fees for the Zoning Board are quite high. There being no further comments, Trustee Hyland moved, second by Trustee Alter to close the public hearing, motion carried. Resolution #07/97/93 was passed. Before continuing with the regular order of business, Mayor Treacy presented Award Certificates for Special Recognition and congratulated three police officers who received medals in the Police Olympics held June 7-11. Barry Campbell won a gold medal for bench pressing, Frank Corona won a bronze medal in arm wrestling and Jose Cotarelo won a silver medal in combat handgun shooting. 1 �Approval of Minutes Trustee Hyland moved, second by Trustee Hayes to approve the minutes of June 15, 1993 with one correction; Trustee Cicchetti stated that page five, paragraph four should read "performance evaluation proposed for village employees" not Local 456; with that correction motion carried 5-0 with Trustee Alter abstaining. Trustee Hyland moved, second by Trustee Cicchetti to approve the minutes of the Special Meeting of June 22, 1993, motion carried 5-0 with Trustee Jeffers abstaining. Approval of Warrants Trustee Hyland moved, second by Trustee Cicchetti to approve the warrants and authorize the Treasurer to pay the bills; motion carried 6-0. Total of the General fund is $212,736.12 and the Water Department.fund total is $12,215.50. Communications, Petitions & Requests The Deputy Clerk read correspondence from Fire Council regarding the appointment of Robert See as driver of Union Hose Co. #2. Trustee Hyland moved, second by Trustee Alter to approve this appointment, motion carried 6-0. Deputy Clerk read correspondence from Mrs. Gathrid of 139 Hunter Avenue requesting a tree in front of 141 Hunter Avenue be trimmed and this has been referred to the General Foreman. Mayor Treacy was in receipt of petitions from North Tarrytown residents and other communities objecting to the proposed hospital incinerator and asking the Village to help prevent the incineration of hospital waste; also a card from Mr. Watts and a letter from Carol Shickerman urging the Board to hold public hearings before this incinerator can be built and that alternate ways to dispose of waste should be considered. The Hospital Incinerator Impact Committee met and the hospital is looking at alternate technologies which is a good sign. Mayor Treacy received a letter from the DEC informing us that the staff has designated the Tappan Zee East proposal as a New York State scenic district. The Mayor was in receipt of correspondence from Mr.& Mrs. Royston I of 204 N. Washington Street, opposing the proposed car detailing shop across from their home. The Mayor received correspondence from Chris Skelly with regrets that he will be unable to attend the Economic Council meeting next week. Mayor Treacy received a letter from Erica Wright, an eight year old who wanted to know why there were no fireworks this year. The Mayor received correspondence from Andrew O'Rourke stating that he was pleased that Village officials will be involved in the Westchester County Youth Council. 2 �The Mayor received correspondence from a resident, D. Haggerty commenting that she did not think the Village should spend the taxpayers money to defend Trustee Hyland in the recent lawsuit. Public Comments-Agenda Items Pat Munroe of New Broadway congratulated the Board for supporting the concept of the proposed park; it will give North Tarrytown a unique position in the County and will reap long term benefits. Wayne Jeffers, owner of a gas station on Route 9, objected to the moratorium proposed on Route 9 for gas stations and automotive use claiming economic studies are needed and an economic impact statement costs money; restrictive zoning causes hardships and the Village will lose a large amount of tax revenue. Mayor Treacy commented that in the 1950*3 gas stations were very popular; now in the 1990*s the trend has changed. Donal Walsh, Jr. stated that Frederick P. Clarke's attorney will be advising the Board with regard to this moratorium. Don Caetano wanted to know if a business is shut down for a year, does it loose its rights to operate as that kind of business. The Mayor responded yes. More discussion ensued. Mayor's Report Mayor Treacy commented that he has met twice with General Motors regarding the new assessment of the plant for 1995. We have started the process of finding an Assessor which GM will pay for, but the village, school, town and GM must agree on the Assessor. Local Task Force met and requests for proposals are almost ready to be sent out to different planners for feasibility studies which GM will pay for. GM will not sell their parking lot now as we had hoped. We are hoping GM will do the right thing for the future of North Tarrytown. The Mayor spoke to representatives of DOT regarding the widening of Route 4 48 and the Village will be moving the water main that was in question. Assemblyman Brodsky was able to set up a meeting with DOT to discuss an agreement that will enhance the beauty of the road. He received a letter from DOT stating that they will replant two trees for every one tree they remove; any trees left over can be planted within the village. Trustee Hyland asked about the drainage problem in that area. The Mayor stated a broken pipe was found and the water department will be putting in a new sewer line on New Broadway next week. There will be slopes in the road where the water will collect and run into the catch basins. More trees and plants will be planted near the new development on Bedford Road which will help the drainage problem and we will be working closely with the DOT as the project progresses. 3 �Trustee's Report Trustees Alter, Hyland and Baderian had no reports. Trustee Cicchetti reported that the LWRP has been updated and copies are available to the trustees for their review. Trustee Hayes reported that he was unable to attend the Library Board meeting on June 24th, but when the minutes are ready, he will give a report. The Fire Committee met with the Chiefs on June 22nd to discuss their equipment needs. The Chief wants a platform truck that costs $500,000. He is looking for direction from the Board on how much he can spend and would like to meet with them. Mayor Treacy asked that the Chief be invited to the work session. Trustee Jeffers commented that he met with John Vydareny of the Water Department who explained water treatment. He will have a written report for the Board by the next meeting. Administrator's Report William Regan read the Zoning Board agenda to be 21st, the Planning Board agenda for July 22nd. The Public Works department has completed paving of at Devries field. The Village has received the equipment for Devries Park and Douglas Park and we three price quotes for lumber for picnic shelters. held on July the walk area bid for play have received Paving of the roads throughout the village should begin the first week in August. We have been using Tarrytown's old bucket truck to trim and remove trees. The County will begin surveying for the Beekman Avenue project, Phase II, this week and excavation should begin next week. William Regan reported that the old New Broadway sewer line will be removed and a new line installed next week. Trustee Jeffers asked Village Attorney's advice on whether he should recuse himself on the issue of the moratorium on Route 9 since his brother will be affected by this. Donal Walsh, Jr. commented that he would review this to see if it is ethically correct. Old Business Trustee Hyland asked about the status of the proposed changes in the zoning and planning laws. He also had asked the Village Attorney about combining the Village Proscecutor and Village Attorney into one, but has not received an answer yet. Mayor Treacy commented that he has received a copy of the changes from Brodsky's office; appointments to the Planning Board are made by the Mayor which he plans to do tonight. 4 �" / Trustee Cicchetti made a motion to appoint Phil Keimig as Tree Commissioner to fill an unexpired term, second by Trustee Jeffers and motion carried 6-0. New Business Mayor Treacy received a request from Mrs. Palmer to use Friendship Park for four days to have a family gathering. She has received permission from the Village of Tarrytown to hold this outing on Friday, July 16th. Trustee Jeffers moved, second by Trustee Alter to grant her request for one day only, Friday, July 16th from 7PM-12 midnight, motion carried 6-0. Mayor Treacy made the following appointments to the Planning Board: He reappointed Ellen Tsangaris, appointed Don Caetano and appointed George Hritz as Chairman. Public Comments Don Caetano thanked the Mayor for this appointment. There being no further comments, Trustee Hyland moved, second by Trustee Jeffers to close the public comment section, carried. Executive Session Trustee Cicchetti moved, second by Trustee Alter to adjourn to executive session to discuss an arbitration matter and personnel. Discussion ensued on whether or not to accept an arbitration award. The consensus of the Board was to speak to the union and to pursue appealing the arbitration award. There being no further business, Trustee Jeffers moved, second by Trustee Hayes to go back to regular session, carried. VOTE:. 5-2 �I Meeting Date: Resolution #: 07/13/93 07/98/93 WHEREAS, the Village of North Tanytown is concerned about land use and development trends in the village, as well as preserving and retaining the historic aspect of certain areas of the community, especially the area that is known as the ''Route 9 corridor". WHEREAS, the Village intends to review the standards, objectives and development goals in that area to better effectuate both the growth of North Tanytown and the enhancement of that part of the community that is its most visible and major thoroughfare. WHEREAS, the zoning laws were enacted for that area in the mid-1950's and may no ' longer be indicative of the goals and concerns of the community. WHEREAS, there are several objectives of possible changes which might be considered, as follows: 1. To maintain a comprehensive plan for the corridor to promote the most beneficial relationship among residential, commercial, historic and public areas. 2. To preserve the natural beauty and historic landmarks. 3. To maintain adequate traffic flow and reduce/avoid traffic congestion. 4. To preserve the quality of life of the surrounding historical and residential areas. 5. To promote and enhance the historic character of the village and encourage the use of the community's historic landmarks and sites by residents and non-residents alike. 6. To recognize the aging infrastructure of the village and take steps to prevent any further overload of its resources. 7. To recognize the historic and educational value of the Route 9 corridor as a means of providing enjoyment and unique educational benefits to all visitors. 8. To promote the historic nature of the area as a way of enhancing and promoting business in the community. 9. To protect and enhance the village's attractions to tourists and visitors and the support and stimulus to business thereby provided. �10. To provide a safe thoroughfare for pedestrians and motor vehicles. WHEREAS, the village intends to review the current zoning regulations of the Route 9 corridor in an orderly, concise, efficient and deliberate manner. WHEREAS, the village does hereby find that appropriate measures must be taken to secure a reasonable interim period to protect the public interest in the various considerations above. NOW THERFORE BE IT RESOLVED, that the Board of Trustees calls for a public hearing to be held on the 17th day of August, 1993, at 8:00 p.m. at a meeting of the Board of Trustees of the Village of North Tarrytown, 28 Beekman Avenue, North Tarrytown, New York to consider the adoption of a local law regulating for an interim period of ninety (90) days the issuance of building permits and certificates of occupancy, the approval of subdivision plats and the approval of site plans in the area designated as C-l, Highway Commercial. Said local law, if adopted, shall be entitled INTERIM ZONING LAW OF THE VILLAGE OF NORTH TARRYTOWN. # BE IT FURTHER RESOLVED/ that the Board of Trustees hereby retains the firm of Frederick P.
