                  <text>A Regular meeting of the Board of Trustees of the Village of
North Tarrytown was held on Tuesday, September 7, 1993 at 8:00 PM

Mayor Treacy called the meeting to order with a pledge to the
flag.
Mayor Treacy commented that there were several plagues he wanted
to present to village employees; one to John Johnson, village
mechanic for 25 years and Elsie Moten, Court Clerk for 30 years.
Also, a life saving medal and certificate of recognition for life
saving skills to Barry Campbell, one of our police officers.
He also stated that the village has been presented with a plaque
from the NYS Department of Environmental Conservation designating
the Tappan Zee East a New York State Scenic District.
Public Hearings
Mayor Treacy read the attached public hearing notice regarding no
parking on alternate sides on Continental and Pleasant Streets.
Trustee Hyland moved, second by Trustee Hayes to open the public
hearing, motion carried.
Rocco Minella and another resident of Pleasant Street commented
that although they wanted the streets cleaned, no parking for
three hours is too long because there is no place to park on the
small street. They felt an hour was sufficient time. Fannie
Stone, whose mother lives on Pleasant Street agreed but also
complained about garbage thrown around in the empty parking lot
on the corner of Pocantico and Continental Street. The Mayor
stated that he would look into this.
Trustee Hyland stated that Mrs. Donovan and Mr. Galocky of
Continental Street sent letters in favor of alternate side of the
street parking.(Part of official minutes)
There being no further comments, Trustee Hyland moved, second by
Trustee Alter to close the hearing, motion carried.
Mayor Treacy read the attached public hearing notice regarding
the erection of a stop sign at the intersection of Clinton and
Depeyster Street.
Trustee Hyland moved, second by Trustee Alter to open this public
hearing, motion carried.

Trustee Hyland commented that this is a very congested area and
this stop sign is badly needed; three children had already been
hit by cars in the past.
There being no further comments, Trustee Hyland moved, second by
Trustee Alter to close the public hearing, motion carried.
Resolution #: 09-115-93: Trustee Hyland moved, second by Trustee
Alter to adopt a local law amending Chapter 57 "Vehicle and
Traffic" to include the following; no parking on the north side
of Continental Street on Tuesday and Thursday from 10AM-11AM, and
no parking on the west side of Pleasant Street on Tuesday and
Thursday from 10AM-11AM, motion carried 6-0.
Resolution^ 09-116-93: Trustee Hyland moved, second by Trustee
Cicchetti to adopt a local law amending Chapter 57-5 "Vehicle and
Traffic" to include the following; the intersection on Clinton at
Depeyster Street is hereby designated as a stop intersection and
a stop sign facing north and south shall be erected; motion
carried 6-0.
Approval of Minutes
Trustee Hyland moved, second by Trustee Jeffers to approve the
minutes of August 17, 1993 with additions/corrections; on page
three, 1st paragraph, Mayor Treacy wanted it clarified that any
extension on this moratorium would have to be voted on by the
Board of Trustees and there would be adequate discussion on it
before any extension was approved; in the next paragraph where
Trustee Jeffers commented this moratorium would cost $100,000. in
litigation fees, Mayor Treacy wanted to explain that the Village
is self insured for this type of litigation and would cost the
village approximately $10,000. Trustee Jeffers commented that
this is not true and they would wait for the opinion of the
Village Attorney, on page 5 under Mayor's report, should read
"two days" of very informative seminars, page 6, the Incinerator
Committee also met with "Chemical Stabilization Companies" and
there will be a meeting next week with the village and GM; motion
carried 5-0 with Trustee Alter abstaining.
Approval of Warrants
Trustee Alter moved, second by Trustee Cicchetti to approve the
warrants and authorize the Treasurer to pay the bills, motion
carried 4-1 with Trustee Hyland voting No and Trustee Jeffers
abstaining. Trustee Hyland wanted to know who authorized the
increase in payment for the rental of the employee parking lot
and commented that the fire inspection celebration went over
budget. Mayor Treacy commented that he authorized the payment
sincts the owners of the lot have been waiting for this increase
for a while and he felt that they should be given it, the extra
money for the fire department celebration was transferred from
one line item to another.Total of the General fund is $119,704.66
and the Water Department fund is $18,687.42.

�Communications, Petitions and Requests
Deputy Clerk read correspondence from the Fire Council regarding
the appointment of Miguel Jimenez as a member of the Ambulance
Corps, for a six month probationary period
Trustee Hyland moved, second by Trustee Alter to approve this
appointment; motion carried.
Mayor Treacy read correspondence from the Department of Veteran
Affairs regarding an outreach counseling program for all women
veterans who have experienced any acts of sexual violence. Anyone
seeking information can call Cathy McNee 682-6250.
There will be a Chemical Clean-Up day at Playland,
November 6, 1993.

Rye on

Mayor Treacy received an invitation to speak at the UAW's one
year anniversary vigil to save the plant on September 9th.
Wayne Jeffers presented the Board with approximately twenty
letters from owners of commercial property opposing to the
moratorium on route 9 or any change from its original zoning.
Public Comments-Agenda Items
Judge Frascati, member of the Economic Council, commented that
the Board should be suspicious of GM's deal and that they should
not back down.
Christine Mangieri owner of 4 04 N. Broadway asked about the
zoning change with regard to her property and how much lawsuits
would cost the village. Mayor Treacy commented that the
moratorium is to halt new auto related business and it would
cost $10,000. per lawsuit.
Wayne Jeffers again stated that these businesses won't be able to
grow and change and was against this moratorium.
The Mayor commented that there is an appeal provision in the law.
Trustee Baderian wondered what bothered Mr. Jeffers about the
appeal process.
Mr. Jeffers commented that he did not know why everything had to
stop while a traffic study is being done.
Trustee Baderian asked Counsel to check into this.
Wayne Jeffers commented that he had written to the Board
regarding his permits. Mayor Treacy stated that his letters were
relating to problems with the Zoning, Planning and ARB Boards.
This Board cannot take any action on this matter.
Further discussion ensued on the appeal process.
Ed Keegan and Peter Castro also spoke against the moratorium
asking what would they do with their property if they wanted to
sell. Peter Castro stated that the Village should be concerned

�more about the plant closing and all of the village not just the
route 9 corridor. They felt the proposed car wash is the reason
for this proposed moratorium.
Trustee Jeffers again stated that litagation will cost the
village $10,000. per award and he has counted at least seven
business owners who will probably sue.
Mayor Treacy stated that rezoning has been discussed for many
years and that many businesses on route 9 are non-conforming to
the the zone. If a gas station were sold within a year, it could
remain a gas station.
Vic Albanese wanted to know if the state was to widen route 9 and
does the state have a setback in that area.
Mayor Treacy commented that the State will not be widening route
9 and they have an easement of 15-20 feet.
Jessica Jeffers, manager of the BP station commented that she is
being stopped from making any changes in her place and stated
that the study should be done without the moratorium.
There being no further discussion, Trustee Hyland moved, second
by Trustee Alter to close the public comment section, carried.
Mayor's Report
Mayor Treacy reported that GM has come up with several proposals;
permission for the Greenway to go through its property, sell the
salaried parking lot ninety days after the last day of
production, fund the redevelopment study at a costnot to exceed
$200,000. The PILOT agreement will be modified. GM has offered
us $5 million over two years and have asked the village to revoke
the reclamation law. GM will give the village written assurance
that they will clean up the site according to the federal and
state laws but we need more concrete assurance from them in this
clean up. The Board will meet with GM and DEC on Thursday. A
tolling agreement has been signed which tolls the time for GM to
challenge the Reclamation law from 8/31/93-10/15/93.
The Cable franchise is up for renewal. Mayor Treacy spoke to Mr.
Price of Liberty regarding cable services. The village may look
into the possibility of becoming a reglatory agency. There will
be a meeting on Monday in Tarrytown with other communities in the
consortium to discuss the franchise fee.
Mayor Treacy met with representatives of the County Parks
Department and Westchester County Department of Tourism, County
Executive's office, Commissioner of Parks and Commissioner of
Planning to discuss the proposed greenway. We must comply with
the American Disabilities Act with regard to the bridge over to
Kingsland Point Park by installing elevators. The Mayor will
seek the help of Congressman Fish and will have the County look
into the possibility of a ramp instead of elevators.

�We have received a grant application from the NYS Office of Parks
and Recreation and Historic Preservation for funding for the
development of open parkland. We have also received the
application handbook for the ISTEA program.
Trustee Reports
Trustees Jeffers, Hyland and Baderian had no reports.
Trustee Alter reported that the Fall Festival and Five Mile Run
will be held this Saturday, September 11th, fall brochures are in
the mail, picnic shelter should be completed by October 1st.;
bocci court is in use, playground equipment has arrived for
Devries park for five and ten year olds; there have been
inquiries for use by corporations, Douglas Park play equipment
will be for ages one to five. Henry Atterbury was appointed to
the Westchester County Urban Youth Council and is in the process
of completing a local report on all youth in the Tarrytowns, not
just problem youths. He will forward this to the Council who will
use it to develop their report.
Trustee Cicchetti would like to discuss further at the
session, the hazards on route 9 that he spoke about at the
meeting. The Police Chief has gathered statistics for the

excessive speed from Phelps to Pocantico Street and the

Trustee Hayes reported that as a result of the inspection of the
firehouses held on August 27th, there is a list a improvements
that need to be done. He commented that he was a little
disappointed at the turnout of officials at the parade and dinner
on August 28th. He reported that Hitachi has donated $10,000. to
the Library fund. The Library budget ended with a $2 0,000.
surplus. Fund raising letters will be going out soon. The next
meeting of the Library Board will be held on September 9th and
the Chair of the Board has suggested a change in committee
reports whereby only one committee is highlighted each month.
Administrator's Report
William Regan reported that there will be an opening of bids for
surplus village vehicles on September 14, 1993 at 10 AM.
He read the Prosecutors report through mid August, The Beekman
Avenue project is continuing and the street lights should be
installed this week and the trees will be planted in October.
The Zoning Board will meet on September 15, the ARB on September
22, and the Planning Board on September 23rd.

Old Business
Trustee Hyland asked the Village Attorney if he had researched
whether or not the Village Attorney and Village Prosecutor could
be combined into one without a resolution by the Board; Donal
Walsh replied that it is legal without a resolution.

�Trustee Hayes asked about the possibility of having a police
officer in the area of the work being done on route 448 when
school opens tomorrow. The Mayor commented that we will have a
police officer there.
Mayor Treacy appointed Reverend Ronald Grant to the North
Tarrytown Housing Authority. Trustee Jeffers moved to approve
this appointment, second by Trustee Hayes and motion carried.
New Business-None
Public Comments
Dr. Richard Sweet commented that the Board should move with
extreme caution in their dealings with General Motors.
He asked that the Board consider an alteration in the manner by
which the PILOT payments are made to the school through the Town.
Equalization rate in not fair. He commented that Mr. Weigert, a
forester, has checked the trees in front of Morse School and
claims that they are very stressed and has suggested that the
blacktop be cut out which surrounds the trunk area and to soften
up the ground. He would like the Tree Commission to meet with the
General Foreman to discuss this. As Chairman of the CAC, he would
like to be kept up to date on the pr6gress on the GM proposals as
it might influence the LWRP.
There being no further comments, Trustee Hyland moved, second by
Trustee Alter to close the public comment section, carried.
Executive Session
Trustee Cicchetti moved, second by Trustee Alter to adjourn to
executive session to discuss a personnel item, motion carried.
Discussion ensued on the upcoming vacancy of the Recreation
Leader position.
There being no further business, meeting was adjourned at 11:00
PM.

A local law entitled INTERIM ZONING LAW OF THE VILLAGE OF NORTH
TARRYTOWN.
Be it enacted by the Board of Trustees of the Village of North Tarrytown as follows:
A local law regulating for an interim period the issuance of building permits and
certificates of occupancy, extensions of building permits, the approval of subdivision
plats and the approval of site plans in the area designated as C-l, Highway
Commercial.
Be it enacted by the Village Board of the Village of North Tarrytown, as follows:
I.

SHORT TITLE
This local law shall be known and may be cited as the Interim Zoning Law of the

Village of North Tarrytown.
H.

LEGISLATIVE INTENT AND FINDINGS OF FACT
A.

BACKGROUND:

The Village of North Tarrytown is concerned about

land use and development trends in the village, as well as preserving and retaining the
historic aspects of certain areas of the community, especially the area that is known as the
"Route 9 corridor."
The Village intends to review the standards, objectives and development goals in
that area to better effectuate both the growth of North Tarrytown and the enhancement of
that part of the community that is its most visible and major thoroughfare. The zoning
laws were enacted for that area in the mid-1950's and may no longer be indicative of the
goals and concerns of the community. There are several objectives of possible changes
currently being considered, as follows:
1.

To maintain a comprehensive plan for the corridor to promote the most
beneficial relationship among residential, commercial, historic and public
areas.

2.

To preserve the natural beauty and historic landmarks.

3.

To maintain adequate traffic flow and reduce/avoid traffic congestion.

�4.

To preserve the quality of life of the surrounding historical and residential
areas.

5.

To promote and enhance the historic character of the Village and
encourage the use of the community's historic landmarks and sites by
residents and non-residents alike.

6.

To recognize the aging infrastructure of the Village and take steps to
prevent any further overload of its resources.

7.

To recognize the historic and educational value of the Route 9 corridor as
a means of providing enjoyment and unique educational benefits to all
visitors.

8.

To promote the historic nature of the area as a way of enhancing and
promoting business in the community.

9.

To protect and enhance the Village's attractions to tourists and visitors and
the support and stimulus to business thereby provided.

10.

To provide a safe thoroughfare for pedestrians and motor vehicles.

For these purposes, the Village intends to review the current zoning regulations of
the Route 9 corridor in an orderly, concise, efficient and deliberate manner. It intends to
review current research, studies and surveys, where available, to consider commissioning
new studies, and will present findings and recommendations to the public through
informational meetings and formal public hearings. If this procedure leads the Village
Board to determine that zoning changes are necessary, this can lead to the creation and
adoption of amendments to the present zoning code and subdivision regulations of the
Village.
B.

LEGISLATIVE FINDINGS OF FACT:

The Village does hereby find, pending the completion of the necessary surveys,
studies, meetings, hearings and other actions incident to proper consideration and
decisions upon possible revisions and amendments of the Village zoning ordinance and

subdivision regulations, and to reflect such planning as has been indicated above, that
appropriate measures must be taken to secure a reasonable interim period to protect the
public interest in the various considerations cited above.
C.

LEGISLATIVE INTENT;

Pursuant to authority duly vested in it, to preserve its intended objectives and
insure future possible implementation of new regulations it may deem necessary, the
Village Board hereby adopts reasonable protective interim regulations during preparation
and consideration of the possible aforesaid prospective changes in the zoning ordinance
and subdivision regulations. Premature land development in the C-l zone could prejudice
the integrity and objectives as set forth above and can result in the establishment of land
use patterns which might be inconsistent with and in violation of the intent of said possible
zoning changes.
The Village Board farther has provided herein for a review and appeals procedure
to avoid or minimize any inequities or hardships which may derive from the strict
application of these regulations.

SCOPE OF CONTROLS

During the effective period of this law and effective as provided herein:
1.

No building permit or certificate of occupancy shall be issued by the

Building Inspector for construction in the above zone regardless of the fact that an
application therefore has been filed with the Building Inspector prior to the effective date
of this law.
2.

The Planning Board shall not grant any preliminary or final approval for

such subdivision plat in the above zone regardless of the fact that an application for such
subdivision plat has been submitted to the Planning Board prior to the effective date of
this local law.

The Planning Board shall not grant any approval to a site plan in the above

zone regardless of the fact that such site plan has been submitted to the Planning Board
prior to the effective date of this local law.
4.

The Zoning Board of Appeals and the Planning Board shall not grant a

special permit for land use in the above zone regardless of the fact that an application
therefore has been submitted prior to the effective date of his law.
The foregoing restriction on the issuance of building permits and certificates of
occupancy shall not apply to the following:
1.

Applications for additions or alterations of existing structures, provided

same do not violate existing zoning requirements.
2.

Certificates of occupancy for any and all construction made pursuant to

building permits issued prior to the effective date of this local law, provided that
construction thereon has substantially commenced prior to the effective date of his local
law and said construction is diligently pursued within the time permitted by the respective
building permit.
3.

Building permits and certificates of occupancy for structures on lots within

subdivision plats which have received final approval, as defined by the subdivisions
regulations of the Village of North Tarrytown, and filed with the County Clerk, prior to
the effective date of his local law.
No building permit shall be renewed once having expired except in accordance
with the provisions of this local law.
The Village Board reserves the right to direct the Building Inspector to revoke or
rescind any building permits or certificates of occupancy issued in violation of this local
law on or after the date of publication of the legal notice establishing the public hearing
pertaining to adoption of this local law.

IV.

APPEAL PROVISIONS

The Village Board shall have the power to vary or modify the application of any
provision of this local law upon its determination, in its absolute legislative discretion, that
such variance or modification is consistent with the spirit of its current objectives upon
which this local law is based and with the health, safety, morals and general welfare of the
Village. An application for such a variance or an application for an extension of a building
permit shall be filed upon such a form as the Village Clerk may prescribe and shall be filed
with said Village Clerk for the Board's consideration at its next regular meeting to be held
a maximum of fifteen (15) days subsequent to the filing of said application.
Upon receiving any application for such variance, modification or extension of a
building permit, the Village Board shall refer such application to the Planning Board for a
report of said Planning Board with respect to the effect of the prospective variance or
modification upon the studies under way in light of the above objectives. To expedite the
appeal, the Village Clerk shall forward, within forty-eight (48) hours after receipt of same,
all applications for relief to the Planning Board for its report.

Such report shall be

returned by the Planning Board to the Village Board prior to the scheduled hearing date.
V.

PENALTIES

Any person, firm, entity or corporation that shall construct, erect, enlarge or alter
any building or structure, in violation of the provisions of this local law or shall otherwise
violate any of the provisions of this local law shall be subject to such penalties as may
otherwise be provided by resolution of the Village of North Tarrytown for such violation.

VALIDITY

The individuality of any word, section, clause, paragraph, sentence part or
provision of this local law shall not affect the validity of any other part of this local law
which can be given effect without such invalid part or parts.

REPEAL OF OTHER LAWS

All ordinances or parts of ordinances in conflict with the provisions of this local
law are hereby repealed to the extent necessary to give this local law full force and effect
during the effective period.
VUL EFFECTIVE DATE
This local law shall take effect immediately, as provided by law, and shall remain hi
force for a consecutive period of ninety (90) daysfromits effective date. This local law is
subject to review and renewal by resolution of the Board of Trustees for additional thirty
(30) day maximum periods.

I am writing in response to your notice regarding the
cleaning of Continental &amp; Pleasant Streets.
I am not able to attend the meeting because of age, but
would like you to consider my approval for the No Parking so that the streets may be cleaned.
As a homeowner for over thirty years, I have watched as
non residents of the street, park their cars overnight
and empty their cars of papers and trash that never gets
cleaned up. It is a disgrace the papers strewn all over
the gutter and road.
I strongly approve of this recommendation in order to
clean the street.

As a resident of Continental Street for many years
I am writing to you regarding the cleaning of Continental Street. I am unable to attend the meeting
because of age and health, but would like you to consider this as approval for the No Parking so that the
street may be cleaned.
As the situation is now the road, gutter never gets

On motion of Trustee Hyland and second by Trustee Hayes the
Board unanimously voted to go into executive session to discuss
General Motors and potential litigation.

There was discussion about the plant's

operation, its site history, how D.E.C. monitors clean-up of an
industrial site, and the Village's environmental law.
No action was taken by the Board.

The representatives from

New York State Department of Environmental Conservation left at
approximately 9; 00 PM. Gus Beirne left at approximately 9:25 PM.
On motion of Trustee Hyland and seconded by Trustee Hayes the
Board adjourned at 9:45 PM.
