Present: Mayor Sean Treacy Greg T. Jeffers Morris Alter Nicholas Cicchetti Steven Baderian Michael Hyland John T. Hayes, Jr. Trustees Also Present: William T. Regan, Village Administrator Donal M. Walsh, Jr. Village Attorney Mayor Treacy called the meeting to order with a pledge to the flag. Before starting the meeting the Mayor read a proclamation whereby the Village of North Tarrytown recognizes "October as Substance Abuse Awareness Month" and does hereby proclaim October 23- 31, 1993 as Red Ribbon Week encouraging all citizens to participate in drug education and prevention activities to demonstrate support for our strong commitment to a drug- free Westchester. Public Hearing Mayor Treacy commented although this was to be a continuation of the public hearing regarding rescinding the reclamation law, he would prefer to continue it at the November 3, 1993 meeting since the attorneys are still working on the contract. He stated that those present could speak tonight during the public comment section. Our tolling agreement with GM will be extended to November 14, 1993. Trustee Hyland moved to open the public hearing, Trustee Cicchetti and motion carried. second by Trustee Hayes moved, second by Trustee Alter to continue the public hearing on November 3, 1993 and motion carried. Mayor Treacy read the attached public hearing notice regarding lowering the speed limit on route 9. Mayor Treacy entered a letter from DOT into the record. Don Caetano asked the reason for this proposed change and has it been discussed with the Police Chief. He commented that we need more police patrol in that area and perhaps drivers should pay more attention when making turns into the Manors. Trustee Cicchetti stated this was brought about by complaints from Manor residents regarding the number of accidents in that area; a survey was done showing there were many accidents in the last three years; the Police Chief agrees with the change. Vic Albanese, Dr. Richard Sweet and Mario Bel&nich supported the change. 1 �Dr. Sweet commented that he hoped this would not get the state to start talking about widening route 9 to solve this problem. Mr. Belanich felt the speed limit should remain the same along the whole stretch of route 9 instead of graduated changes. Trustee Jeffers agreed with Mr. Belanich. Discussion ensued on how to regulate the speed limit. Approval Trustee minutes written, of Minutes Hyland moved, second by Trustee Alter to approve the of the Executive Session on September 21, 1993 as motion carried 6-0. Trustee Hyland moved, second by Trustee Cicchetti to approve the minutes of the September 21, 1993 meeting as written, motion carried 6-0. Approval of Warrants Trustee Hyland moved, second by Trustee Alter to approve the warrants and authorize the Treasurer to pay the bills, motion carried 6-0. Total of the General fund is $120,712.60 and the Water Department fund total is $17,532.27. Communications, Petitions and Requests Deputy Clerk read correspondence from Ms. Fries, Town Clerk, requesting the use of our premises on Tuesday, Election Day, November 2, 1993 from 6:00 AM-9:00 PM. Trustee Hyland moved to approve this request, second by Trustee Hayes and motion carried. Deputy Clerk read correspondence from Leonard Galante, President of the Central Veterans' Committee requesting permission to hold its annual Veterans' Day services at Patriots Park on November 11, 1993 at 10:30 AM and would like the siren to blow at 11 AM in honor of all departed veterans. Trustee Hyland moved to approve this request, second by Trustee Cicchetti and motion carried. (Referred to Police Chief and Fire Chief) Correspondence was received from Mario Verini, attorney for O'Briens Tavern at 111 Beekman Avenue advising the village that they have filed for an On-Premises Liquor License with the NYS Liquor Authority. (Referred to Police Chief) Mayor Treacy commented that North Tarrytown has received the Pedestrian Safety Citation for seven years without a pedestrian fatality. The Mayor received a letter from the Westchester County Board of Realtors regarding a community service award of $1000. Anyone who knows of someone deserving of this award, please contact him. A workshop on the American Disabilities Act will be held on October 26th at 1:30 PM. The Mayor will attend an application workshop for a community development blockgrant program through funding from 1994-1996 to be held on October 20th. 2 �r?r A concert "The Legend of Sleepy Hollow" to benefit the Headless Horseman Monument Committee will be held on Sunday, October 31, 1993 at 5:00 PM at Music Hall. Public Comments-Agenda Items A resident of Highland Avenue asked if the Mayor would give a brief background on the status of the General Motors issue and asked if any developers have approached the village. Mayor Treacy gave an overview of the negotiations with GM since the adoption of the Reclamation Law back in May. He commented it is because of this tough law that we are able to negotiate with GM. There are two things that must be done; clean-up of the site and disposition of the site. He stated that there are only three developers in Westchester who could afford to develop this site so we must seek outside developers. The Mayor stated that a forum will be held on the GM issue October 26th at Morse School. Dr. Michael Masias commented that he has spoken to several people who were involved in the clean-up of the Willow Run and Messina plants. People in Messina are still fighting and it cost Willow Run $35-65 million for their clean-up. Clean-up of our plant will far exceed the $5 million GM is offering us. He commented that the Trustees should just amend the law, not revoke it. Mayor Treacy commented that our law is much stricter than the federal and state laws and the language in the contract will be in depth and contain much of our clean-up law. Jim Lear asked how much the demolition of the plant would cost. Margo Stever asked if the law could be amended if found to be deficient. The Mayor responded that we are in the process of getting costs for the demolition and we are seeking opinions from different attorneys who are reviewing the law and the contract. Trustee Jeffers commented that the board should not make public every part of the negotiations. Trustee Baderian commented that we need time to discuss the contract before making anything public. Mayor Treacy commented that although we want to keep the village informed, we must be careful not to say too much regarding our negotiations with GM. Vic Albanese wanted to know how the plant would be cleaned. Mayor Treacy stated that it will be cleaned up according to the state and local laws and the plan that would be laid out in the contract which will be much stiffer than the state's law. A resident commented about public relations with GM. Don Caetano commended the board on their negotiations with GM. 3 �I i I Being no further comments, Trustee Hyland moved, second by Trustee Alter to close the public comment section, carried. Mayor's Report Mayor Treacy stated that he was upset over the article he read in the newspaper which stated there was a 68% increase in crime in our village. He has met with the Chief to discuss ways to reduce and prevent crime such as increasing foot patrol, touring the apartment buildings and having the detectives crack down.He would like to have the auxiliary police back. There are new programs to help reduce crime; the CAT (Combat Auto Theft) which provides stickers for your car, community watch programs, tenants and homeowners associations, a scribe program to identify valuables. There is a grant available through the federal government for a supplemental program for the hiring of police which would pay for three years salary; we will look into the possibility of hiring a clerk to free officers from paper work. There will be cable meeting on October 21st at 8 PM with Tarrytown and Briarcliff to start the franchise process. Frederick P. Clark Associates has completed their study as part of the SEQR process and has declared the Sleepy Hollow Car Wash as a Type I action which may have significant effect on the environment. Regarding the UDC grant, they will be going out to bid on October 12th and the storefront projects should be completed by Christmas. Trustee Reports Trustees Jeffers, Baderian and Hyland had no reports. Trustee Alter reported that he attended a cable meeting last week where Continental Cablevision told them that in order to carry additional cable channels which will be mandated within six to twelve months, they must drop other channels such as A&E, Lifetime, Family, etc. to accommodate the others. The Mayor commented that they will discuss this when reviewing the cable franchise agreement. Trustee Cicchetti commented that as the liaison for the CAC, he would like to share with the board the ongoing work of the LWRP and passed out the information. Trustee Hayes commented that he will give a library report at the next meeting, he visited the beautiful display at the Old Dutch Church. He received a memo from the Fire Chief regarding Fire Prevention week, inspections of the firehouses will take place and anyone wishing to have their house inspected can contact the Fire Chief. The fund drive has started and pamphlets have been distributed. 4 �e?G Administrator's Report William Regan reported that next Monday is a holiday; there will be no recycling pick-up on Wednesday, he read the Zoning Board agenda for October 20th at 8 PM, the Planning Board will be held on October 21st at 8 PM and the ARB will meet on October 27th at 8 PM. The paving program is continuing; Valley Street from Washington Street to Wildey Street will be paved on October 7th & 8th, flyers have been posted. Old Business-None New Business Mayor Treacy reported that on Saturday, November 6th Westchester County will hold a Chemical Clean-Up day at Playland, Rye, NY. Public Comments Mario Belanich commented that alternate side parking regulations should be suspended on holidays, the Mayor responded that it is. Mr. Belanich asked what the status was on the return of auxiliary police. Mayor Treacy commented that originally the County Police Commissioner stated that the auxiliary police could not carry guns; there is now an Inter-Municipal agreement with the County and the Village which would require the Village, in addition to covering the auxiliary police under our insurance, the County would have to be named as a party in our insurance. This must be discussed by the Board. Being no further comments, Trustee Alter moved, second by Trustee Hyland to close the public comment section, motion carried. Executive Session Trustee Hyland moved, second by Trustee Alter to adjourn to executive session to discuss a personnel matter but no formal action was taken. There being no further business, Trustee Cicchetti moved, second by Trustee Hyland to adjourn the meeting, motion carried. Typically, consent is given before a local law or ordinance is drafted. We suggest that legislation not be written until we have had an opportunity to make a review and provide you with our decision. Offered for your consideration are our comments in regard to the proposed speed limit changes. o Speed limits should be the same for both directions of traffic. o Limits should be a minimum of 1/2 mile in length, and the number of speed limit changes minimized. o Speed limits should reflect actual operating speeds. Arbitrarily low speed limits are ineffective and are a disservice in the long run as they generally are ignored. We will schedule a review of Route 9 in regard to the speed limit. Please expect a delay in our reply because we have a backlog of previously requested studies. When our efforts have been completed, we will advise you of our findings and conclusions.
